(04:24):
week we introduced you To, Bobby, joe And, annette two
women who vanished the same night while hitchhiking From, Breckenridge.
COLORADO a brutal winter storm buried the, region and searchers
brave sub zero temperatures Across Oosier pass and surrounding. Wilderness
all they found were scattered belongings and a haunting clues
(04:44):
left in the. Snow, tonight we pick up where that
search left, off as the mountain begins to reveal what
really happened on that frozen. Night, Mike i'm only good
(05:11):
for like errorless intros one time a. NIGHT i know
you nailed it at. First oh, NO i gave a,
fist pump and. Everything at that, Time i'm, LIKE i
already did this. One, okay, yeah last, week last, week
we took you back to the winter of nineteen eighty.
Speaker 2 (05:26):
Two that was not ten minutes.
Speaker 1 (05:28):
Ago it was last, Week, yes a winter that Brought
colorado's high country to its. Knees the tiny ski town
Of breckenridge was buried under snow and ice as a Brutal.
Speaker 2 (05:37):
Arctic front swept across The.
Speaker 1 (05:39):
Rockies temperatures plunged to nearly forty degrees below zero on
the ridge lines Of Pike National. Forest it was under
these conditions that two, women twenty nine year Old Bobby
Joe overholtzer and twenty one year Old Annette, schnee vanished
on the same, night just hours. Apart both were last
seen hitchhiking south From, breckenridge heading home along the same mountain.
(05:59):
Corridor hitchhiking wasn't unusual back. Then it was how locals got,
around a ride into, town a lift back over the.
Pass it was part of mountain. Life When Bobby joe
didn't return home that, night her Husband, jeff went, searching
driving the dark snow blown roads Towards Hoosier. Pass the next,
morning a rancher miles away found her driver's license and
wallets scattered on his, driveway and Just jeff discovered more
(06:22):
of her, belongings a blue, backpack a bloodstained, glove and
tissues in the snow near the. Highway search teams mobilized
quickly skiing Across Hoosier pass in whiteout, conditions battling the
same sub zero winds that likely swallowed both women the night. Before,
meanwhile co workers in Nearby frisco Reported Annette schnee missing
after she failed to show up to work after two
(06:45):
days in a. Row she'd last been seen At breckinridge
drug store filling a prescription and speaking with a woman
no one could later. Identify if you want the detailed
description of the, location we also went over Some halloween.
Facts we probably should have saved those for this, one
but you can go back and listen to. It give
us some more give him some more. Stats, yeah go
back to the last. Episode we talk about who they,
(07:06):
were kind of their, experience the character, profile character. Profile
but for the people who hate that part of the, Show,
yeah this is Your halloween trick or treating.
Speaker 2 (07:15):
Gift, yes we're going right into the, Timeline, baby right
into the, timeline like take it. Away all.
Speaker 3 (07:20):
Right this is probably the craziest part of part, two
And i'm going to introduce a new character to this.
Story It's january sixth of nineteen eighty.
Speaker 2 (07:31):
Two it's.
Speaker 3 (07:32):
Late it's around ELEVEN. Pm so during a severe blizzard
with the temperatures dropping to minus twenty and wins gusting
to fifty miles per, Hour Allen lee phillips truck got
stuck in a deep snowdrift on the ten thousand Foot Guinela.
Pass it's a, remote unplowed mountain road near both crime,
(07:54):
scenes Straddling Clear creek And Park. Counties, phillips who was
then thirty years, old was a local miner From, Dumont.
Colorado he so this is. Contested some reports say he
activated an EMERGENCY cb radio, signal and then this part
is reported he was flashing his headlights In morrise code
to spell sos so three short three long three short
(08:17):
flashing do.
Speaker 2 (08:19):
Do do do?
Speaker 3 (08:20):
That?
Speaker 2 (08:21):
God, YEAH i, KNOW i, KNOW i know My morse,
code don't you? Know this is the crazy.
Speaker 3 (08:25):
PART a sheriff's deputy on a commercial flight overhead at
thirty thousand, feet spotted the flashing lights through the storm
and alerted authorities on the ground.
Speaker 2 (08:36):
That that is. Wild that is.
Speaker 3 (08:38):
Wild, Yeah so from thirty thousand, Feet Sheriff Harold bray
reads three, short three, long three short sos flashing up
from a closed mountain road flying an airliner at thirty thousand.
Speaker 2 (08:51):
Feet.
Speaker 3 (08:52):
Geez so this triggered a, again we have this kind
of telephone game with this a little.
Speaker 2 (08:58):
Bit so some.
Speaker 3 (09:00):
Things some reports state it was a massive rescue operation
that involved THE Us Forest service and The Colorado National
guard and, helicopters but for more official, reports it was
just a kind of a local, operation so it involved multiple.
Speaker 2 (09:16):
Agencies so this.
Speaker 1 (09:17):
Was maybe for local that's. Massive, Yeah, well involved two
small mountain.
Speaker 3 (09:21):
Towns, yeah to Involve Clear Creek County sheriff's office and
local fire. Departments, rescuers including Fire Chief Dave, montoya who
Knew phillips from their shared work at The Henderson, mine
braved sub zero, conditions heavy, snow and zero visibility to reach.
Him they used, snowmobiles four by four, vehicles and ground
(09:41):
teams on. Skis the operation lasted for several hours into
the early morning On january, seventh with the rescuers risking
hypothermia and. Avalanches phillips was found cold but, alive with
a prominent bruise on his, face which he had claimed
was from falling in the snow while trying to free his.
Truck it was wrapped in, blankets given hot, drinks and
(10:02):
transported down the pass for medical. Checkup the rescue actually
did make national headlines as a heroic tale of survival
and community, effort with no connection to any crimes noted
at the.
Speaker 2 (10:14):
Time, okay it's.
Speaker 3 (10:16):
Now january seventh of nineteen eighty, two three, pm searchers
Discovered Bobby joe's, frozen fully clothed body in a snowbank
at the summit Of Hoosier, pass approximately ten miles outside
Of breckinridge and about four hundred feet south of the
summit along the. Road she was found with zip ties
on one, risk suggesting an attempt to restrain, her and
(10:39):
had been shot twice at close range in the. Chest
Holy Cow, jeff who was part of the search, effort
pleaded with authorities to see her body and identified her
at the. Scene an autopsy concluded shortly after that and
confirmed no sexual, assault and the presence of the zip
ties and gunshot wound indicated a violent. Struggle like we
said in part, One, jeff, okay there's a scene an
(11:02):
image of where her body was. Found oh, wow so
just off the. Road, Yeah, jeff like we, said had
become an initial suspect due to his proximity, involvement though
no charges were filed at the. Time In february nineteen eighty,
two a similar attack herd In Summit, county a woman
was beaten with a hammer and raped according after accepting a.
(11:24):
Ride Tom, luther another new, subject was. Arrested he had
a violent, history especially against women as and was a potential.
Link law enforcement thought they had their, guy but no
evidence connected him to The annette And Bobby joe, cases
and he was only convicted for the, assault which he received.
Speaker 2 (11:44):
A ten year.
Speaker 3 (11:44):
Sentence luthor would later be linked to an actual murder
in that, area but it was not related to these.
Speaker 2 (11:51):
Cases.
Speaker 3 (11:52):
Yeah kind of some, crazy crazy stories coming out of
there at this. Time we are now fast forwarding To
july third of nineteen eighty. TWO a thirteen year old
boy was fishing when he discovered the body of a
net face down In Sacramento, creek about twenty three miles
south of The breckinridge drug store where she was last.
(12:14):
Seen this would roughly be about seven to thirteen miles
From Bobby Joe joe's discovery site and about seven miles
From jeff's home In. Alma she was fully clothed but in,
disarray Broken jean's, zipper Broken jean, zipper shoes on the wrong.
Feet forensic show she had been shot once in the,
back with a downward angle exit wound on the, front
(12:37):
suggesting she may have been on her knees or running
downhill towards the, stream and no bullet was ever. Recovered
they also suspected a sexual, assault but could not be
confirmed to the decomposition from the time in the. Water
no physical evidence was found at the scene except for
an orange booty sock on her left. Foot so there
is that, Actually so, yeah, okay so matched the one
(13:00):
found Near Bobby joe's, body which formally linked the. Cases
jeff's business card was also discovered inner jacket pocket during the.
Investigation and THEN i just want to make a note
on that's from when he gave her a ride, Originally.
Speaker 2 (13:14):
So, yeah it's. Interesting how everything's linking.
Speaker 3 (13:16):
UP i just wanted to make a note to some
of the DISTANCES i, mentioned like seven to thirteen miles
From bobby's site and seven miles From jeff's home are
approximate from secondary. Sources official pages stick with the twenty
miles From breckenridge, Figure so just put that in your.
Head so it's now nineteen eighty, eight and this is
per secondary. Sources so crime labs tested the bloody glove
(13:40):
AND dna was a mix of hers and an unknown,
male's not the, husband's and the husband was cleared at
this time of any possible connection to the. Murder, okay
nineteen eighty, Nine, again this is per Some And joe's
got a picture of the creek area where A net's
body was, found so that's roughly the area where she was. Found,
(14:00):
Yeah so nineteen eighty, nine a task force was. Formed
detectives pursued leads like an armed, carjacker but it was dead.
Ended there's an nuts genes that were recovered from the crime.
Scene i'm not showing the, Screen oh, NO i.
Speaker 2 (14:14):
Am were you not showing the whole? Time, NO i
was showing it for part of.
Speaker 1 (14:18):
It, okay that's WHY i always tell you not to
always say. It sometimes we're not chilling the. Screen oh
so there there's the sweater.
Speaker 2 (14:24):
At the bullet.
Speaker 3 (14:24):
Hole that's the bullet hole That Bobby joe was wearing the. Sweater,
Okay so nineteen ninety five, Again oh and there's the.
Speaker 1 (14:33):
That's still wild that that an airliner saw AN sos
signed from the.
Speaker 3 (14:36):
Truck, Yeah joe's we're looking at a news clipping from the.
Speaker 1 (14:40):
Time we did have the map pulled up the second,
one so that's what the truck.
Speaker 2 (14:45):
Was, yeah and this is where the body. Was.
Speaker 3 (14:48):
Yep, Okay so nineteen ninety, five detectives Revisited Tom luther
as a suspect but turned out to be another dead.
End now we are getting in the era OF dna.
Analysis it is two thousand and. Two this is again
per secondary. Sources SO i keep saying that because there
(15:09):
are some like official sources that were using for, information
and then there were secondary sources where people went and
were reporting they talked to different people involved in the. Case,
okay long after it. Happened SO i mean we're in
two thousand and, two, now this happened in nineteen eighty. Two,
yeah so a lot of time has. Passed so at this,
time an unknown MALE dna from the glove was entered
(15:30):
into THE codis data, bank but there was no. Matches
now this is gonna start getting very interesting how they
ended up tracking down the actual. Killer so early twenty.
Twenty we're in the twenty twenty, now so you can
see how this. Happens in nineteen eighty, two a, decade
two decades go, by, nothing.
Speaker 2 (15:48):
Then there's like a little fragment of.
Speaker 3 (15:50):
Information then in two thousand and, two and then another
twenty years and then and then.
Speaker 2 (15:54):
Five years ago or picking right back.
Speaker 3 (15:56):
Up, Yeah so early twenty, Twenty Park County Detective Sergeant
Wendy kip and Investigator charles McCormick partnered with The Colorado
bureau Of, investigation which is CALLED CBI, fbi and private
forensic genealogy Firm United Data. Connect they uploaded the crime
SCENE dna to public databases and started building family trees
(16:16):
that narrowed suspects To phillips and his.
Speaker 2 (16:18):
Brother.
Speaker 3 (16:19):
Bruce the brother Of Alan, phillips was ruled out since
he did not have Any colorado. Ties It's, january Late
january twenty twenty. One investigators covertly COLLECTED dna From Alan
phillips from a discarded discarded trash at a sonic drive in.
Speaker 2 (16:37):
Got pulled up right.
Speaker 3 (16:37):
Here, yeah so there's a picture of the actual. Evidence
they had a bag and a napkin and they were
able to GET dna off of, That and On february
twenty third of twenty twenty, one official lab results matched
the unknown male profile from nineteen eighty two To Alan.
Speaker 2 (16:54):
Phillips that's.
Speaker 3 (16:55):
Wild so In february twenty, fourth one day, Later, phillips
who's NOW u, seventy was arrested In. Dumont though there's
a picture of him from from back in the. Two
he was arrested In, Dumont colorado for the murders Of,
Bobby joe And, annette who disappeared On january sixth of
nineteen eighty. Two he was charged with two counts of
first degree, murder, kidnapping and. Assault phillips denied involvement was
(17:20):
but was extradited To Park, county and this marked the
beginning of the resolution of the what people started calling
The Orange Sock murders cold. Case the arrest revealed That
phillips had committed the murders hours before his. Rescue so
the crazy thing was he had just murdered the women
hours before that crazy rescue.
Speaker 2 (17:41):
Happened that's. Wild.
Speaker 3 (17:43):
Yeah he had picked up a net around four forty
five pm while she hitchhike out Of, breckenridge assaulted and
shot her in the back as she fled downhill towards the. Stream,
Jeez and this was the one where they there was
possible sexual assault indicated by the condition of the, clothing broken,
jeans a broken jean, zipper shoes on the wrong, feet
(18:04):
and she lost one orange. Sock it was A christmas
gift from her. Mother in his. Truck, later around seven
point fifty, pm he picked Up bobby hitchhiking Towards almah
via the pass and attempted. Assault she fought, back hitting
him with a brass key, ring causing the bruise that
they found on him when they rescued, him which he
(18:24):
claimed was from just falling in the. Snow she jumped,
out dislodging the sock and was shot twice in the
chestick close. Range phillips dumped the bodies in a remote.
Area he lived freely for, decades marrying and having children
while the victim's families. Grieved the case was considered ironclad VIA,
(18:45):
dna though no murder weapon was found and his defense
was trying to challenge evidence. Collection On march third of
twenty twenty, one the arrest was publicly announced by The
Colorado bureau Of. Investigation On august twenty ninth of twenty twenty,
two the trial. Began evidence INCLUDED dna, matches the orange
socks linking the, cases the bruise from the, keyring and
(19:08):
the ironic. Rescue the trial lasted for about two and
a half. Weeks the jury deliberated for four to five
hours and Convicted phillips on eight counts two first three, murders, kidnappings,
assaults and, robberies and this received a lot of attention
at the. Time it was covered in CBS's forty Eight
hours Episode lasting In breckinridge and dubbed The Spree murder
(19:31):
or Rampage. Killing On november seventh of twenty twenty, two
at his, sentencing emotional victim impact statements From jeff the
husband called him a despicable and evil, being and thats
sister Noted phillips live freely while her family Suffered, phillips
at age seventy, one was sentenced to two consecutive life
terms without, parole and this forty year journey to justice
(19:57):
was highlighted by emphasizing the genetic genealogies, role which is
similar to another case called The Golden State killer. Case and,
then On february twenty, seventh twenty twenty, three to wrap
all of this, Up, phillips at age seventy, two died
by suicide At Arkansas Valley Correctional facility and no foul
play was.
Speaker 2 (20:16):
Suspected, wow so that is as? Wild isn't that a
wild ending to?
Speaker 1 (20:23):
THIS i feel really bad THAT i like went after
the husband like well and you you got?
Speaker 2 (20:26):
Me you made me THINK i was, RIGHT i got? You. Yeah,
NO i mean the craziest part of this was the.
Rescue that, yeah that's that's pretty.
Speaker 3 (20:36):
Wild and not even just the, rescue but it was
hours after he had just murdered both of.
Speaker 1 (20:41):
Them, well it's, like you wonder if he didn't get,
rescued if he would have perished out, there and then
they would have been able to solve the.
Speaker 2 (20:46):
Case, yeah because they would have had HIS, dna but
they would have had the weight to. Test. It, yeah
a good.
Speaker 3 (20:52):
Point but the crazy thing is too before what DID i,
say so if we would have covered this case four years,
ago official results weren't matched To phillips Until february of
twenty twenty. One for forty, years this case went, unsolved
and your theory might have been, Plausible, yeah until just very.
(21:14):
Recently that's wild and it's crazy how they gathered the.
Evidence so they took HIS, dna put it in a
genealogy to database like an ancestry dot, com and built
a family tree.
Speaker 1 (21:27):
And realized, It oh, crap there's someone related to somebody
who was rescued very close. By, yeah that was passing
through on the exact same.
Speaker 3 (21:34):
Night and then they covertly got HIS dna from garbage At, asonic.
Speaker 1 (21:38):
WHICH i mean that would be easy to do once
because like he's been going around for forty, years is completely,
Like I'm i'm in the.
Speaker 2 (21:45):
CLEAR i got away with. This after forty, years he's.
Speaker 3 (21:47):
Seventy he's thinking like he probably never in a million
years thought they would get him FROM dna from.
Speaker 2 (21:54):
Garbage, yeah OR i think he just thought he got
away with.
Speaker 3 (21:58):
It, yeah that's wild and it's it's crazy to think
that cases are still being closed that.
Speaker 1 (22:04):
FAR I i love that BECAUSE i don't know in
like in a, sense it would make anyone just keep
like the rest if you do something that, Heinous, yeah
like the rest of your, life.
Speaker 2 (22:16):
You have to look over your. Shoulder.
Speaker 1 (22:17):
Yeah, no you can't just get away with. It well
in something wild can come up or, occur and it can.
Speaker 3 (22:23):
Just can you google quickly When i'm curious WHEN dna
testing started becoming or started getting used in murder, cases
because this case is kind of like in the perfect
time line of oh wow.
Speaker 1 (22:41):
That SO dna testing was first used in murder case
In england in nineteen eighty six to solve the Narrow
borough murders Of Linda mann And Don. Ashworth in THE,
us it was first used in a courtroom in nineteen eighty,
Seven so it's been used for a.
Speaker 2 (22:55):
While, Yeah oh the.
Speaker 1 (22:58):
Code in nineteen, NINETIES i established the codis The COMBINED
Dna Index system, database which began as a pilot program
in nineteen ninety and was later formalized by THE Dna
Identification act of nineteen ninety. Four so they only started
centralizing it in the nineteen.
Speaker 3 (23:14):
Nineties and LIKE i, said they put THAT dna into
THE codis database.
Speaker 2 (23:18):
And didn't have a.
Speaker 3 (23:19):
Hit, yeah and when did commercial genealogy go?
Speaker 2 (23:25):
Live i'm, CURIOUS i can't spell, Genealogy that's.
Speaker 1 (23:29):
Okay commercial genealogy began in two thousand with the launch
of both Family TREE dna And Oxford, ancestors which offered
direct to CONSUMER dna testing for. Genealogy this marked a
shift from academic studies to public access to genetic genealogy.
Tools that's like the libertarian in me is, like, OOH
i don't want to give MY dna. Away but then
(23:49):
there's also justice being served as a, result because that guy's,
answer like one of his family, members was LIKE i
want to learn about my, heritage and that got him.
Speaker 2 (23:58):
Arrested, yeah that's.
Speaker 3 (24:00):
Wild so that's the crazy thing, Too like even though
THE fbi database was around from nineteen ninety HIS, da
he had never committed another crime where it would have been,
collected so it wasn't in the. Database it wasn't until
the two thousands where they were able to because when
DID i say they put that in? There that was
back in early twenty. Twenties, yeah, yeah twenty twenty One,
(24:24):
February so they didn't enter HIS dna INTO cotis until
two thousand and.
Speaker 1 (24:28):
Two, yeah and oh, no it was official lab results
match the unknown mail from nineteen eighty. Two that was
twenty twenty.
Speaker 2 (24:34):
One, Sorry so.
Speaker 3 (24:35):
They actually in nineteen eighty eight actually analyzed THE dna
and realized it was a mix of her blood and
an unknown. Person so that far back they were analyzing,
it but there was no database to plug it.
Speaker 2 (24:47):
Into, yeah they put it into THE.
Speaker 3 (24:49):
Fbi database and there was no match because he had
never committed a crime where it would have been. Collected
it took until the twenty twenties for the genealogy site to.
Match you, know it's probably like cousins and uncles and
aunts and whoever. Else and they whittled it down to
his brother may have must have put HIS dna in,
(25:11):
there like his BROTHER'S, Dna and when they were able
to match it get it down To BRUCE'S, dna they're, like,
OH i wonder If bruce has a.
Speaker 2 (25:19):
Brother, yeah it's just.
Speaker 3 (25:21):
Crazy i'm still that that set rescue was wild that
someone in thirty thousand feet in an airline jets saw
THE sos.
Speaker 1 (25:28):
Signal's and to think about if that, rescue if he
didn't get a. Rescue maybe he would have, survived, yeah
and got out of, there and then there'd be no. Record,
yeah could they wouldn't be able to place him in that.
Speaker 3 (25:41):
Spot that was probably THE dna evidence is pretty. Ironclad
but also having the fact, that.
Speaker 1 (25:46):
But think about it forty years, later if you can't
prove that he was in the area at, All, yeah
and it's OLD dna. EVIDENCE i bet like a shady
lawyer could just be, like, okay like you've used RANDOM
dna from an ancestry, thing like, know but like the fact, that,
no this IS dna of somebody who also was rescued
