so she leaves behind a grieving familyand four children and very sad. Isn't
it funny how it's if someone breaksinto your home stabs you to death,
that's murder, but he hit,buy a car and die. They don't

one of those I spent many,many weekends with their family. And so

with the older kids. So shewas around us a lot. She hung

Got up early, we all metat the pop, we had breakfast,

oh man, there was like overone hundred bikes there for sure, and

all that raised money for the family. Whatever. Had a great auction afterwards,

and if I've got the cash todo so. I think last time we
had a poker run, I thinkI bid on a few things, but
I didn't take anything home with me. There's a couple of bottles of tequila.

it continued to happen. There wasone night I had to drive Telequad Miskogi.
I picked him up from the barbecause he was wasted, couldn't drive.
I brought my daughter because I couldn'tleave her at home. You know,
she's only five at the time.And he kept acting up, so
I stopped and I said, what'syour problem? And he kept playing on

him to focus for a minute.She woke up just as he was throwing
a punch across the car and theland to do so. Not only were
you sexually assaulted, you were assaulted, Yeah, on different occasions. Yeah,
and you dealt with that by numbingthe pain with alcohol. Yep,
because nobody would believe me. Nobodybelieved so you would tell people and they

It's it's something that she probably wanted, but she was too intoxicated to

moments and how it was handled.Honestly, I regretted it, like it's
something I promised I would never allowmy daughter to see because it's something I

know husbands. I've been divorced wife. Both husbands were extremely abusive and one
was more physical, one was moreemotional. And then I was like,

my human, my daughter, myworld was never going to see that.
And then when it happened, itit just took everything out of because I
thought to bring this child into thisworld and then I had to sit here
and watch it all crumble. Soyeah, I regret just not taking better

was molested as a child uncle andthen a grandfather on a different occasion,

don't think, honestly, I don'tthink my parents knew how to because they
were so young when they got married. They were they're only they're in the
fifties right now, so I'm thirtyeight. They're only in like fifteen years
ahead of me. Really, wow, So they're growing up and in there.
My mother was a victim, blessher heart. She was a victim
from her father, my grandfather,you know. And I don't think she

knew how to handle it. AndDaddy was a truck driver at the time,
so they just went with it,stuck with the positive duty. My
brother did fantastic and he handled hisdifferently, and I just I didn't.
I couldn't for some reason. Hewas abused too. He's no longer alive
to say yes or no, butyeah, I'm pretty sure he was.

He was the one that stayed withthem a lot more, and there was
a lot more damn and that hejust wasn't as vocal about it. And
how did he pass? He endedup passing away, I want to say
about three years ago, and alot of his was he ate his problems
away. I also ate my problemsaway. But I had my gas to
bypass ten years ago, which iswhy the alcohol became so easy to become

addicted to. So you going fastforwarding back to you need a liver transplant?
Do you go to rehab or doyou just go to detox? No?
I went to medical vdoxes. Andwhat happened was in twenty nineteen,
I went to a six month athree months stay in rehab. I maintained

nine months sobriety, and then whenI came out, I was hunted down
by a guy. It wasn't itwasn't a personal thing. He didn't personally
hunt me, but he found anattraction to women in a weakened state,
and he's seen that as an advantageand I was friends with his so he
friended me. And then I waslonely coming out of rehab. Don't date

coming out of rehab, And yeah, I fell into a relationship. He
discouraged me from progressing and getting mylicense and trying to get back into real
life and kept Mander's thumb and hiswatch. So going through your hab alone
is just traumatic. Yes, Andthen you get out of rehab and you've

this guy phraise on you and tellsyou to disconnect from all that what you
just learn to try and better yourself. Yeah, because he was trying to
better himself too, and then hewas flabbed with his words. He's not
now. He tried, but yeah, he helped me get back into it.
He's a narcissist. He's an alcoholicin his own right and he knows

that. And yeah, he justaided and kept me from from doing anything.
He would travel on the road.I was working with him when I
worked in the plant, so huldtravel on the road while he was out.
He had neighbors watching me to makesure I wasn't having people over or
doing a ething crazy and stuff likethat. This is all a lot,

age to go through. Yeah,it's crazy, and it's crazy because I
was playing dodgeball with you in twentyeighteen. Do you don't remember that,

transplant in on January. I didn'tleave a hospital until April the eighteenth,
and I was very able to even'tstand on my own after I was transplanted,
but they released me back to thewild. Oh my gosh. I
didn't actually learn to care for myselfuntil January twenty twenty three. Whenever I
nearly ran him over trying to likeleave him. So you were trying to

get away from him, and hewouldn't let you leave, and you almost
you threatened to hit him with yourcar. Oh no, that wasn't even
a threat, like he was drunkone morning and it got to the point
where he was breaking my phone,like snapping on my phone and half in
front of my face to prove apoint. And I had the car key
in my pocket, so I seenhim as the wobbly, one of those

wabbly thingies, except that he wasn'tpopping back up. He was gonna stay
on the ground for a minute.So jumped in the car, pushed the
start. He managed to get upquicker than I thought and followed me out.
He opened the car doors I wasstarting, it started to grab me
and I managed to away in time. My neighbor across the sheet called me.
She goes, why are you tryingto kill him? And I said,
what are you talking about? Shegoes, you drug him down the

driveway a little bit, and Iwas like, I was just trying to
get away and protect myself. Soit wasn't intentional I'm going to kill him
because in all honesty, like Iwas, I wasn't trying to save him,
but I wasn't going to just likeleave when he was about to kill
himself. But the only way Icould protect myself was to leave at that
time. I'm sure listening. Thereare people, maybe even women, that

are in a scenario about similar towhat you were describing. What would you
say to them if you have thechance, don't don't, I guess it.
If you feel like you're at thatpoint, you know, get some
help, reach out, reach outto your to your friend. You know,
it doesn't have to be a friend, reach out to somebody complete stranger,
you know, find me on tastic. I'll help you. Just reach
out. Don't be afraid. Theless we speak, the less it gets

heard and the less it gets known. Spousal rape is a thing. I
was spousily raped after the transplant.He was or seeing me into sex.
Even though I didn't paint, Icouldn't handle it. The same thing with
the man who raped me. Youknow, we're in a relationship and he
took advantage of me and away.Don't. Don't keep your mouth shut,
you know, speak up. Ifnot, have someone do it for you.

Like I said, you find meand I'll do what I can to
help you. If not, I'llfind someone who can. You have had
years and years of people chipping awayat trust. How do you trust people
now? It's difficult, Like Ihave to proceed with caution. I've had
to put I refer to it asputting assholes in the box. In the
boxes like you know what you're being. You're being an ass today. So

I'm going to put you in thishole and you're not allowed to talk to
me until I feel like you're comfortableand I have that day you deserve.

so you know military divorces depending uponhow long you were married, and let's
just put it this way. There'ssomething called DFAs DFAs, right, So
it's the Department of Finance for theUS government that people that handle all the
money and stuff for the military individuals. And they're real pain in the butt.

They change their rules all the time. I actually have somebody that I
refer a friend of mine that isformer military who does military divorces simply because
the rules from DFAs and the survivorbenefits, and I mean, it can
be a real true nightmare. Now, if you've only been married a year
or two and you're in the military, no big deal. We can handle

those problem. But if you've beenmarried over ten years and you've got retirement
involved and survivor benefits and all thisother stuff, I can talk to you
about that and we can see ifwe want to refer you or not,
simply because it's just a headache.There are so many rules for defacts.
They change faster than the tax code, and it can be a real pain
in the butt. And is therea big difference between the divorces besides just

benefits. Well, so the actualI mean, the actual divorce itself is
the same. But when we're talkingabout dividing up benefits and you know,
things of that nature, making surethat you get your portion of the retirement
benefits and all these other things,defas can be very specific. Their forms
are very specific. They're like Isaid, their forms change all the time,

their rules change all the time.So you know, that's why it's
so much more difficult to deal withsimply because you want to make sure it's
done correctly with somebody who is actuallyin the military, so it's you know,
I've got a friend of mine thatI can refer you to. But
if it's a simple one, wecan do that. Not a problem.
But I have found over the yearsthough that when DEFAST is involved, it

and Oklahoma is goofy in that it'svery different than other states. It's
based on need and ability to pay. So the person asking for it has
the burden to show that a they'vegot a need of some sort and b
the other person has the actual abilityto pay. So and it's looks for
like that from a global, globalperspective. So let's say you're a stay
(01:31:34):
at home mom, but you're gettingfive million dollars in the settlement of the
divorce or the division of the divorce. Okay, alimony. Argument's a little
hard there, simply because you're receivingfive million dollars you've got access to and
I know this is not your typicalthing. I'm just kind of giving you
a scenario. Okay, But soit's from a global perspective. But you
know, need and ability to paynever do this thing alone. I know
(01:31:56):
you want to trust the other side, and I you know, I applaud
those that can actually trust each otherand get along. But as we've talked
about many times throughout the years,you know it's fine until it's not.
And the last thing you want tobe is screwed out of something that you
should have received. Simply because youtrusted the other side or their lawyer.
It seems appropriate for a guy whohas a law from to say, don't
go out this by yourself. Solet's go through a couple of the pitfalls,
(01:32:19):
especially when the other party has alawyer that you could find yourself into.
But remember the other lawyers not.Their job is not to represent you
or represent your best interest, numberone, even if they say they'll help
you out right, even which theywill right help you out of certain things.
Yes, that's and you know notall of us are like that.
(01:32:39):
I mean, I like to believethat when I'm dealing with somebody, I'm
trying to be honest and follow thelaw and those kind of things. But
you know, not all of usare that way. And you know,
as long as they follow the law, that's what's required. So with that
being said, you know, youwant to make sure that you're getting the
split on everything you're soppo speaking.Remember, Oklahoma is an equitable division state.
(01:33:00):
Okay, that typically means fifty tofifty. There are acceptance to the
rule on that, but it usuallymeans fifty to fifty. But if you're
getting thirty percent and they're getting seventy. Why you know, I mean,
you've got to make sure that allthe i's are dotted, and all the
t's are crossed, and all thelowercase jays are dotted as well. You've
got to make sure that those thingsare covered so you're not losing out on
something, because if it's not coveredin the decree, it may not be
(01:33:23):
able to come back later unless youcan show fraud or deceit or something of
that nature to get it put backin. So you want to make sure
it's done right the first time inyour interest, and you've got somebody in
your corner making sure your best interestsare taken care of. And that's why
you want to give us a call. I remember when I got divorced and
we decided we would share an attorney. We thought we were going to share
an attorney, and we met withthe attorney, did all the paper and
(01:33:45):
he's like, I can represent bothof you, and told her she has
to sign this piece of paper sayingultimately I am his attorney. He explained
it to her, and then whenI had a separate medium with him,
he was like, I'm not herattorney. I can only be your attorney.
But she signed a document saying thathe was her attorney. No,
no, no, saying that sheunderstood that he cannot represent b all right,
(01:34:06):
right, right, And and Ididn't know that going in. It
was not a tactic of mine totry. And I think, I think,
and I honestly believed he could representboth of us. Well, And
that's the first thing I say.When I meet with a couple like that,
I'm like, look, I canonly represent one of you. I
can't represent both of you. Soat the end of the day, if
this you know, little settlement conferencewhere having falls apart and we have to
(01:34:28):
file something, I can only representone of you. It can't represent both
of you, right, So understandthat no attorney can represent two parties.
Right. There is one exception tothe rule, but I'm not going to
confuse people by talking about it.The base rule of it is, we
can't represent two people in a divorce. So if negotiations fall apart, I
can only present one of you.And you know, it sounds nice to
(01:34:50):
say, oh, we'll share thesame attorney and it'll be all hunky dory,
and you know it'll be lollipops andraindrops and unicorn farts. I mean,
that's great, but at the endof the day, it's great until
it's not right. And so ifsomething falls apart again, that attorney can
only represent one of you, soyou always want to have your own.

For example, I had I've gota I met with somebody this last week
on a potential case where they dealtwith a pronumptial agreement, okay, and
he had an attorney and she didn't. And in looking at this prenup that
she ended up signing because she didnot have an attorney review it with her.
She got royally screwed in this prenup, but she signed it and the
(01:35:31):
judge found it to be a validprenup. All right. So my point
of it is is that if youdon't want to get screwed like that,
you want to make sure that thedocuments you're signing are you know, in
your best interest too. You needsomebody to represent you, and that's why
you want to give us a call. I have a question, Yeah,
what's the difference between spousal support andalimony? And can someone get both?
They're the same, I mean,they're just different terminologies. So they're they're
(01:35:57):
kind of inner in Uh, what'sthe word interchangeable, just like attorney and
lawyer, you know, kind ofthe same thing. So we typically were
respirsed to spousal support more during thedivorce and then call out alimony after the
decrees entered. But it's the samething. You're still getting money to be
supported and live on in those kindof things. So it's just it's a
(01:36:17):
term of art that's interchangeable. Buttypically the term spousal support will apply more
so during a divorce and alimony appliesfor after the decree is entered. If
you're a stay at home mom andthen someone says a stay at home dad,
I would imagine you'd the need formoney would be quite urgent. It
could be, I mean absolutely.I mean remember though, that whatever sitting
(01:36:40):
in the bank accounts as of theday that you file, you're both entitled
to half of that. So ifyou've got ten thousand dollars sitting in a
joint banking account, you're allowed totake half of it out. Okay,
so excuse me. Same things withmoney markets and savings accounts and all those
kind of things. Okay, youcan access those, go put them in
your own account. Still have somemoney to start living off of while we
(01:37:02):
work on all the other things,so you still have access to that.
The kicker of it is is,you know, accessing it before the other
party does and draining the accounts.I've had people do that where they drain
him down to zero. Then wehave to file with the court to get
the money back and those kind ofthings. So you know, it's all
about timing and strategy and those kindof things for sure, right because then
it's a whole scenario of they're justtrying to draw out the process and make
(01:37:25):
it cost more money for you.I've got one case right now where the
parties had a joint business together andthe husband decided to file first, and
he drained all the accounts, personalaccounts, business accounts, drained them all
down to zero, and went andput them in some completely other bank where
she could my client couldn't access anyof it. So it happens, folks,
(01:37:45):
And they're within that. Everybody's niceand a divorce, are they Is
that individual within their rights technically?Yeah, I mean before something is filed.
I mean, it's not the nicething to do. It's not the
thing that will garner you any respector favor with the judge by doing something
like that. I mean, judgesdon't like people being left out in the
(01:38:08):
cold because the other side has decidedto drain the account. But you know,
before something is filed, technically youcan do whatever you want with the
accounts. But once it's filed,that's when rules go into effect and laws
going to effect to prevent certain thingsand gives us the ability to file contempts
if we need to and whatnot.But before it's filed, you know it
(01:38:29):

hot topic. And this one says, my mother has become sick and I
need to get guardianship of her.How long does it take? And can
I do it if she's incapacitated?What are the steps? Do rights just

go to her boyfriend or default tome? Oh, not to the boyfriend
at all. I mean, sowhen you're talking about guardianships, especially in
this kind of case where it seemslike there's something urgent that needs to be
addressed. We can file an emergencyguardianship, whether it be an adult or
a child, either one. Okay, that way, it's granted immediately and
you can start making some emergency temporarydecisions on all those things that you need
(01:39:15):
to make the decisions on, especiallyif they're incapacitated, those kind of things.
So we can always go for anemergency for sure, absolutely, And
then once an emergency is granted,there's something called a show cause hearing that
has to be heard within a certainnumber of days after being granted, where
you have to show costs to thecourt while the emergency why the emergency should
stay in place. And of courseI would imagine at that point the boyfriend
(01:39:36):
would try and potentially you know,contest it and that kind of thing.
But with that being said, guardianshipsare a big deal. Whether you need
an emergency one or not, wecan help you with those, so please
give us a call. I've alwayswondered when you're in the hospital in an
emergency scenario like that occurs, andmaybe your loved ones partner is that they're

not married, and you show up, how do you get the hospital to
stop listening to that person. Well, the hospital can't listen to either person
legally. You can't legally listen tothe boyfriend. You can't legally listen to
the child. You can't listen becauseunless you've got an advanced directive or you've
got however attorney or a guardianship orsomething, you don't have any legal rights
(01:40:18):
over that person. So what happensis is the hospital has to make those
legal decisions until there's a document inplace that says otherwise. Kind of thing.
So the boyfriend doesn't have any legaldecision making whatsoever because they're not married.
I mean, if you're married,it might be a different scenario,
obviously, But at the same timetoo, even then the court, you
(01:40:39):
know, the hospitals are kind ofbreaking are not breaking down, but cracking
down on those kind of things simplyfrom legal aspects. They don't want to
get bit in the butt where they'velistened to somebody that they shouldn't have and
all of a sudden, now you'vegot a legal lawsuit or a lawsuit going
on because you've made a decision thatyou shouldn't have. So it's all very
sticky, it's all very crazy.That's why you want an attorney give us
(01:41:00):
a call, well in a medicaldirective. On top of that, you
want to make sure that those thingslined out. But so if I show
up, what stops me from justsaying I am the husband? Well,
sometimes, I mean they have toprove it. I mean I've seen hospitals
do that where you've got to proveyou know, it's a call and they
just went blank your marriage license,those kind of things. But otherwise you're
(01:41:21):
I mean, you could just walkin and say, well, I'm the
husband or I'm the wife or whatever, you know, but it the burden
at that point is on the hospitalto make those proofs and make sure that
they're dotting their eyes and crossing theirteeth so they don't get in trouble.
And hospitals are really kind of crackingdown on that because they're tired of all
the lawsuits that go on that arefrivolous or otherwise. Jeff Finsley's joining us

Wrong, clarify that for us,because I think people do believe that I
brought this into the marriage, sotherefore it is mine. Right. So
part of the problem is is thatwhen you're dealing with a prenuptial agreement,
you're dealing with people who have largeassets of some sort, okay, And
sometimes those ask assets get commingled,whether they realize it or not, or

whether they do it on purpose ornot. And so it very goes through
and very clearly defines what is tobe considered marital or not. For example,
okay, and the prenup that Iread that I dealt with, all
right, there were some properties involved, okay, and marital funds had been
used throughout the years to maintain thoseproperties. Okay, So by co mingling,

all right, that could potentially makeit marital, putting it into prenup
saying it ain't makes it completely different, all right. So you know a
lot of people don't think about comingling things, and especially when you've been
married long amounts of time, right, I mean I've been married, you
know, twenty get it right,I know, well I'm better out to

that my wife is as as faras dates and stuff, you know,
we've been married twenty three years.And so my point of it all is
is that you can I sit thereand go, I know I brought this
into the marriage before or not,or if I haven't co mingled it or
not in some way maybe on afew little things, but not everything.

I mean, that's why, youknow, especially it's it's used to protect
businesses, it's used to protect properties, it used to protect large amounts of
investments things like that, because rememberyou know, as soon as even if
you had investments before marriage, yes, that portion is your, but any
portion from the dative marriage forward,all right, they're entitled to half of

the increase on those investments unless youput it in a prenup that says otherwise.
So this is why the prenup isthere to include all those kind of
things, all right. So it'sit sounds simple, but you know again,

I understand why they do it obviously, because they don't want kids going across
you know Interconnell or you know UnitedStates lines into international areas without the other

parent knowing. But it's difficult whenyou've got a parent who has disappeared into
the ether or refuses to respond andas being a jerk for whatever reason.

It can be quite the hairy situationwhether you're trying to get a passport
for your child and the other partydoesn't want to cooperate, or you're trying
to get a guardianship done for anadult or a child who is disabled.

he's going to get fifteen? Youwent from life to fifteen pretty fast.
I'm hoping it's that he gets life, but I feel like he's not getting

years wow in federal prison. TheAttorney's office said that Tyler Smith admitted to
conspiracy to violation of the Hate CrimesPrevention Act by committing crimes against the most

vulnerable and doing nothing to report.A coworker recordings of numerous attacks at this
facility in twenty sixteen and twenty seventeen. The victims, many of whom needed
wheelchairs, were attacked in a varietyof ways, including by punching and kicking
residents, rubbing purele hand sanitizer intheir eyes, spraying mouthwash in their eyes,

and, in one instance, removinga residence compression stocking in a manner
intended to inflict pain. So theseguys are just being assholes because these people
were nonverbal. Who are they goingto tell they don't talk, right,
Let's just torture them man. Accordingto the government's sentencing memo, the man's
(01:50:47):
job was providing critically daily assistance toresidents, as well as identifying and reporting
signs and symptoms of injury and illness. Instead, he did the opposite.
Several of the assaults were recorded onone of the man's phones. In one
instance, he admitted jumping on topof a thirteen year old miner while the
(01:51:08):
child was laying prone on his bedwith the lights off, and while one
man filmed the incident on his cellphone. He further acknowledged that immediately after
the recording the video, he textedthe video to him his other buddy,
and prosecutor said in a press release, also noting that co defendants were aware
the victims were nonverbal. The attacksof which were as many as eighteen,
(01:51:35):
involved anything from kicking, punching,choking, rubbing pure in the victim's eyes,
and in many instances, they recordedthe abuse and they texted about the
abuse with each other. So notonly is he an asshole for doing it
to nonverbal humans, these are kidsthat he's messing away. In one instance,

one of them was even quoted assaying, kill him, dude,
he's better off. Oh god,So they should be tortured the same way.
Yeah, eye for an eye,Yeah, Yeah, I wonder because
we talked about jail house justice andstuff like that. When it comes you
know, things that you do tosmall children, you know, whether you
molest them or you know, justabuse them in any way whatsoever. There's

thing pertains to this sort of scenario. Yeah, the government says that they
benefited from the evidence of the cellphone photos and videos, but they pointed

out that they were saved to memorializethe assaults that they committed upon the residence,
and their text exchanges made it abundantlyclear that the Holy Joint desire to
kill and beat residents, to quotesmash the residence faces in, and to
sanitize the residence eyes. How dothey get a job there? Well,

I'm sure that's not how they ledtheir interview with you know, right,
But it's like, that's sad,man, that's sad because you never you
hiring these people to help take care, you know, get the job done,
and then you get assholes like thisthat come in here and do that
to people. What was on theirresume, Like what kind of work did
they do before? You would thinkthat they were in some sort of healthcare

right, healthcare background. Those jobsare really hard to hire for, so
you hope they have some sort ofmedical background. And again, I'm not
clear on what Pennsylvania's threshold is forhiring those individuals, because a lot of
those homes have really loose thresholds becausethey've been lobbied so hard to make it

so right in the defensive memo.The public defender emphasized that the client was
actively addicted to drugs and now callabuse substances daily and struggled with deep seated
feelings of despair at the time ofthe crimes. The defense argued that his
conduct was far more limited than hisco defendants. I don't care. You're

is how I eventually I found out, But why was it anybody else?
Like when they came in and sawSally, you know, her eyes were

right? That's a good question,if there is any I imagine that these
atrocities probably happened in their rooms,right, not in a public setting.
So are their cameras allowed in therooms? I don't know. Maybe you'd
think to monitor patients, you know, especially since they're nonverbal patients. I

think somebody would have to keep aneye on besides just walk them by every

it's hard to hire for those positions, right right. Very few people go
into that field going I just wantto be the best nonverbal caretaker I can
