check and he was there cleaning upa vomit all over the floor. How
did he know she had really lowblood sugar? And that short amount of
time said this happens every once ina while. In other words, she

hungry, dizzy, anxious or irar, sweating, shaking, tingling lips.

that you're going to want to filein, and that's typically the state where
the spouse, the spouse that stateside is living. So if she's here
in Oklahoma and he's serving in Germanyor Afghanistan or wherever, she can file

here in Oklahoma even though he isout now. The one thing about being
in the military is is that eventhough you go ahead and file on him
now, they can actually ask fora stay of the divorce until they return.
So just beware that when you dofile, there is a particular that

southwest Oklahoma area. I know becausethat's where I'm from, and I
know exactly where Cattle County is.So you know, our judges here in

the idea is to not keep draggingit out and dragging it out and dragging

it out. But sometimes when youget into smaller counties, all right,
you deal with judges that are alittle bit old fashioned, I guess in
a sense, and they'll pass it. So you know, there's no straight
line or law or legal requirement asto how many times the judge can pass
it, although how many times hasit been passed? Now? This will

be number three. July is alreadyfirst. We go back again, and
it said if she doesn't have alawyer a week in advance, she needs
to gut up there and let himmatter. So they'll puts the court date
back further so I don't have todrive. Yeah, see that that's ridiculous

most I've ever seen is a twotime path. At the most, I've
never seen path that. You know, if a judge is passing it over
and over and over trying to allowsomebody to get counsel. Obviously, if
the person doesn't have a counsel withinthe first thirty days, they're not going

That's what I've seen in my practicein fifteen years of doing this, and

you know over a thousand cases,is that you've got somebody who keeps telling
the judge that just to drag thisout. So at some point, do
you have a lawyer yourself or no, yeah, I have one. Your
lawyer, in my professional opinion,needs to file something with the court to

say, look, this is it. They shouldn't be giving more passes.
This is just dragging it out.This needs to stop so we can get
these two divorced to move on.So you know, your lawyer has the
ability to file something. Now Here'syou may not be doing it for some
particular reason that I'm not aware of. Maybe they're afraid of the judge,
or you know, I don't knowwhat the deal is, but you know

(01:33:32):
you need to have a conversation withyour attorney and says, look, this
has been drug out for two years. It's now been passed three times being
and I'm being told that it couldpotentially be passed for another fourth time and
that's just not acceptable. So youknow, while your attorney have have a
call. You know, there's somethings we can't control on passes. Okay.

We can't control when people die,we can't control when people are born,
we can't control when people get COVID. We can't control when people,
you know, break their ankles likeI did. Okay, so you know
you can't there's certain things you can'tcontrol. But somebody who's just saying that

like the judge is running everything together. So the I have a custody of
the kids, emergency custody and sheuh and the promise whenever I got custody,
she attempted to punch my lawyer inthe courtroom. So there's a kim

charge right there. And assault chargethat they're running they're running everything to he's
running everything together, and he doesn'twant to do anything, especially with the
g A L until she has alawyer, which is insane because I mean,
I'm well, okay, so that'sthe whole in January third, Okay.
So if that's the case and she'sconsidered indigent, meaning she doesn't have

money at all, I mean,the judge has the ability and the jurisdiction
too. And maybe they don't doit because it's such a small county,
but here in Tulsa, what theywould do is is they would appoint a
public defender. They would point anda point an attorney to represent her on
the contempt in the assault charge.I mean, she's entitled to that by

law. So the judge has theability to stop dragging this out. Something's
going on and you need to talkto your attorney about it and find out
what's going on, because you know, I've never practiced in Cato. I
mean, I'm I'm from that area. I've practiced in Comanche, if I
practiced in a bunch of other countiesArounther, but I've never actually practiced in
Cado. So you know, youneed to talk to your attorney and say,

look, I get this is whatthe judge wants to do, but
doesn't that you know, the judgehas the legal right to appoint her an

keep her from driving around. Imean, if she needs to go into
a mental institution like Lorette or somethinglike that, you have the ability to
do that with her, and thatobviously keeps her away from those kind of

just like having kids. You know, there's only so much you can do

if they may if they're not doingwhat they need to do and they want
to make a bad decision. Imean that's just true for anything. You
can do as much as you cando. You can, you can try
and you know, prepare yourself,compare your family and your home and everything
else to accept this individual so thatthose things are minimalized, but minimized.
But at the same time too,you know, there's only so much you
can do. But you know,as far as being liable, I mean,

if she goes out and shoots somebody, you're not liable for that.
She's that she's on her on thehook for that herself. But you know,
the car is pretty easy. Justtake the keys, you know,
disable the car. I mean,there's ways to do that to keep her
from driving, whether she likes itor not. Fold is this individual,

she obviously needs help and and gettinga guardianship will allow you to get her
into a place that can get herhelp, hopefully get her on meds and
get her, you know, gether evened out where she needs to be
and and be able to be productiveand happy. Okay, all right,

individual? Jeff Well, I meanyou are, yeah, you are financially

responsible in other words, or you'rethe one that is appointed to handle all
of their finances, so you knowthat way, there's you know, that's
why there's an accounting every year ofall the finances of the individual. Where
did the money go, what wasthe money spent on? You know,
you have to show receipts and allthese other things to show exactly where the
individual's money goes, because typically thesepeople are on some sort of you know,
social security disability or something of thatnature, and you have to make

(01:39:33):
an accounting for every pentny of wordsbeing spent, you know. And that's
the other easy thing to lock upis that if she's got an ATM car,
take the ATM card away, shecan't. And if you're the guardian,
you can block her from going inand trying to get money out of
the account without your approval. Sothere's ways to block money for her so
that she's not out buying drugs ordoing things that she shouldn't be doing.

(01:39:58):

custody, guardianship, name, change, any of those things. Jeff

has filed. Is he responsible forpaying for everything in the divorce? I

mean the answer is no. Imean he if he wants to file,
he'll obviously pay the filing fee.But as far as paying for everything,
I'm not sure exactly what that means, other than to say, you know,
in Oklahoma, Oklahoma is an equitabledivision state, meaning there is an
you split everything down the middle.I mean, it's typically fifty to fifteen,

and that's the term we use,is equitable for fifty to fifteen Oklahoma.
There are exceptions to the rule.Obviously, there are different scenarios that
would be very rarely different, butthose typically don't apply. It to ninety
nine percent of the population, allright, But you know, paying for
everything doesn't mean he's not going topay for all the debts. I mean
that's going to be split down themiddle. He's not gonna pay for the

entire house and her get you knowa was scott free, or get all
of her equity one hundred percent ofthe equity or whatever. I mean.
She's gonna have to be involved init in some way, whether it be
physically being involved or understanding that she'sgoing to be responsible for half the debt
and she'll get half the assets andall that. So, but you know,
if he wants to start the processand pay the filing fee, absolutely

process one that once they're an adult, so unlike with children, you've got
to give notice and all these otherthings, whereas an adult that's not the
case. So please give us acall, be happy to get that change,
because that's you know, that's thebeauty of name changes. Once you're
an adult, I guess, isthat you can change your name to anything
and everything you want to. Obviously, there are restrictions. There's not judges

that are going to allow you to, you know, change your last name
to a swear word or something that'sgoing to offend somebody per se, but
for the most or for it's copywritedfor some reason. But otherwise, you
can change your name to whatever,and we can help you make that happen.

attorney. Why is it important tohave an attorney on something in terms of
other family los scenarios that is sosimple, Well, because it's it's something

if it's not done correctly, youcould end up with the legal name
that you thought you were getting,it'd be something completely different. And now

it's a mess to get it corrected. So you know, we know how

guardianship and a power of attorney?Sure? So, a power of attorney

is something that is granted by anindividual to somebody else. In other words,
for example, you can give apower of attorney over let's say finances,
all right, over money to somebody, all right, but you have
to be the person who's giving thatpower away. Has to be looseid and
with it, and has to beable to legally be able to make that

(01:43:43):
decision on their own. And youknow, powers of attorney can be very
limited. You can limit them toone thing only, or you could limit
them to everything from medical to financesto whatever it may be. Or you
could just lock them into one thinglike finances or just medical or whatever it
may be. All right, Andthere's no judge's signature. There's no court
order. There is obviously a powerof attorney paperwork, but there's no court

(01:44:08):
order signed by a judge. Now, a guardianship is something completely different in
the sense that it gives you fullcontrol and care of an individual, whether
it be a child or an adult. Right you're the decision maker for that
individual. Now you're the one that'sgoing to be handling all their finances,
all of their stuff. You're goingto be making decisions for them medically,

(01:44:29):
You're going to be making decisions forthem financially, whatever it may be.
You've got full control over everything thatis said or done for that individual because
they have been found by a courtbe able not to be where they can't
do it themselves. For example,if you're a kid, obviously you're under
age, so you can't make thosedecisions on your own. But if you're
an adult, you know you're you'reincapacitated in some way, whether it be

(01:44:53):
medically or mentally, or physically orwhatever it may be. There's something that
requires you to have help from somebodyelse else to make those decisions for you.
That does have a court order,that does have a judge's signature,
that does have something called letters ofguardianship that allow you to do those things.
So power attorney, if you wantto put it on a scale of

(01:45:14):
things, let's on a scale ofone to ten. You know, that's
a power of one through four,But a guardianship is a power of five
to ten, meaning you know,it's a higher it's a higher document.
It's something that allows you to domore and gives you more control than just
a power of attorney. And aguardianship can be granted whether somebody is loosen
or not. You know, typically, and we're talking about adults here,

(01:45:38):
I get kids. If you're underthe age of eighteen, it's that's not
the case. But you know,if you're incapacitated, a judge can find
you incapacitated so that things can bedecided for you, so you can be

guardianship? What is it? Guardianship? Guardianship? Okay? And who has

sure at the guardianship and not apaternity action. That might be a paternity
action now because I had him forthe first seven years. Yeah, and
then he just cames out of nowhereand takes him without me knowing and filed

for custody. Okay, So thatwould be a paternity action, not a
guardianship. And so what did hewhat did he claim that that you were
unfit? About? I mean,he couldn't. He can't just come in
and take the kid away. Hehas to say something. He has to
prove something to the core that wouldmake you considered unfit and would give him

emergency custody or whatever it may be. What happened there, he came in
and then he filed for paternity.But what did he claim that made you
unfit? What did he say?He said that I wasn't fit because I
was in a domestic voluntary I gotaway from and I haven't been you know,
I haven't been back to that relationshipin over a year. And but

he tried to, but he convincedto judge that, oh my ex is
coming back when I'm actually in abrand new relationship. I've been in this
relationship for over a year now,and okay, he's been having my son
for three years. Okay, sowe can definitely help with that. There's
all sorts of emotions we can file. Most is to enforce contempt citations,
all sorts of stuff. You'll giveyour name a number to gimpe. I

that. I mean the problem.But here's the thing under the UCCJE that
sends for a Uniform Child Custody JurisdictionEnforcement Act. That's the act that defines

is in Georgia and has only everbeen in Georgia. That's the home state,
which means any action you're gonna haveto take for visitation or anything like
that is gonna have to be donein Georgia. There's not a single thing
we can file for in Oklahoma.Okay, Oklahoma doesn't have Oklahoma doesn't have
any controller jurisdiction over that child.It does you because you're a resident,

but the judge can't make any decisionson the kid, at least none of
our Oklahoma judges can make a decisionon the kid because there's no jurisdiction here
in Oklahoma. Okay, even thoughshe's not let me talk to him,
or I don't even know where he'sthat again, that's what I'm saying,
Jays. If it's in Georgia,anything and everything it deals with, phone

calls, visitation, whatever it maybe, pick up drop of any of
that stuff is gonna have to bedealt with in Georgia. Oklahoma simply has
no jurisdiction to enforce a Georgia order. Okay, you're gonna you call it
Georgia. I mean, most ofthis can be done remote. I mean
you can call it Jojia attorney andsay, look, I'm not getting visitation.
