I couldn't get into Dexter. Itried to watch the first season, got

busted for smuggling cocaine and weed intofacility. Our forty six year old Regina
Davis putting my home city of MichiganCity, Indiana, on the map this

morning. She arrived for work earlierthis month at the Indiana State Prison,
where the property of employees, includingtheir lunch or dinner, passes through an
X ray machine before they enter.The maximum security lockup houses more than two
thousand adult male prisoners, and it'slocated forty five miles east of Chicago.

So Regina's lasagna moved through the Xray machine, and a guard thought that
it looked odd, so he soughtthe opinion of a colleague, who concurred
that something did not appear natural.When investigators looked through the lasagna, they
found several packages wrapped in electrical tapethat contained three ounces of cocaine and just

under two ounces of marijuana. Duringquestioning, Regina claimed she had been at
a female friend's house the prior eveninggetting a tattoo, when the woman gave
her two containers of lasagna to eat. She claimed not to know that the
lasagna was stuffed with contraband It's unclearif they also contained tiny meatballs. After

she reportedly agreed to allow her phoneto be searched. Investigators found photos of
the wrap drug packages that were takena day earlier, and that's when her
story changed. She claims she'd beengetting calls from unknown numbers from unknown individuals
who threatened her safety and that ofher brother, who she said had just
been released from a prison work releaseprogram. She said she had been instructed

to go with a guide to pickup the drugs, some of which she
admitted wrapping herself. That narcotic,she added, would be picked up in
the prison by an individual who stoppedby the drug room where she works.
They said that the carrier would saythey were there to pick up some cream

for their feet. Yeah, andthat's how she would get the drugs to
that person. And despite her compellingexplanation of the lasagna, she was arrested
on two felling and narcotics trafficking charges. It charges free on a fifteen hundred
dollars bond. Who she's pleaded notguilty. She's been ordered by a judge

to appear in court for an Augustsecond status hearing so she could get first
offense not less than five at nomore than forty Okay, still doing sometime
though. Yeah, and based onwhat she had, which three ounces she
had? Three grams is not reallyI don't know. She's not gonna get

federal trafficking now. I was gonnaquestion it. I thought you said it
was like two three ounces of cocaine, not very much. One point seven

like mama's on vacation and she's shegoes and she checks the security cameras to
see if old ken dog has donehis chores like she had asked him to
do. And when she check tothe cameras, that's when she had found

comes back home, confronts her sonabout it. Right, he tells her
that he was washing the horse andaccidentally touched its genitalia, even though there
were no soap, no water,no gloves, no cleaning utensils around it

and he goes off to his friend'shouse. She then calls the sheriffs to

his buddy's house, which I don'tknow if his friend had any idea,

I mean it's a it's a thing. They just do it. There's not

know, you see some guys inthe wheelchairs sometimes going up to uh to
females doors and they're like knocking,and you know, they'll go away and
they'll come back, uh you know, ten minutes later knock on the ladies
doors. Again. I haven't seenthat happen, but I'm sure it happens.

You haven't hurt a name evidence ofit? No, no, not
yet, not a giantly, butindeed different. You were also a former
corrections officer at a facility, ata max facility. How did you get
that job? Uh? Kind ofout a desperation. I mean I needed

a job at the time, andI knew that that prison was always hiring.
Got ten years ago. It wasMedia Max and it was a little
nerve wracking, but yeah, Ijust kind of went in to interview,
and I had I had a friendfrom high school that worked there and she
was a correctional counselor, so shekind of helped me, helped me in

the door. And and how longdid you work there? Between three and
four years? Okay, so notvery long. And do they have a
how do they what's the interview processlike to be a prison guard somewhere?
At the time, it was kindof just like like I said, desperation.

(01:04:54):
They're they're looking for people, youknow, warm bodies to fill pods,
and uh, you know, itwas kind of like a they're always
shorthanded, So it wasn't much ofan interview pross this and obviously I had
no experience in that. Yeah,And it says here that it says to

(01:05:15):
ask about the Aryan Brotherhood nut biters. Yeah, we're on. UH.
We were on and I worked nights, so it was right about a time
we would do counts and they calleda response to a MAX unit and UH,
I was on the response team,so we ran to UH the max

(01:05:36):
unit went upstairs and there was twoguys in every brotherhood. They're Selly's and
they were just going at it.And they were sitting there in the little
white boxers. They were just justbeating the crap out of each other.
And they were and as soon asthe MAX side, if you can't just
open the door, they have tocuff up through the through the little food

hoole, and they were just notdoing it. We popped some gas and
we sprayed them with OC, youknow, trying to trying to get them
just to submit. And I guessthe problem had been one of them found
out that the other one that sleptwith the sister. So they were rolling
around on the ground fighting covered inOC, and you know, they got
to the point where they were justwalked up kind of like in a giggity

position, and they rolled around wherewe're filming it. They just started biting
each other's jump and not like Imean like biting and walking down. It
was pretty insane, and you guysare filming it because you have to or
yeah, yeah, anytime there's there'sa disturbance or an incident, it's got

(01:06:43):
to be on camera, just becausesome stuff happens, like for example,
and holding built that prison the headof the area area sorry, the head
of the Irish mob was had startedhad you know, or riot, and
they were they were trying to todo him in his cell and get him

(01:07:05):
cuffed up. And we had thosesix cylinder kind of like a rocket launcher,
you know, and there's different munitionsthat would go in there, like
dragon's breass that would just shoot out, you know, a cloud of tear
gas. But there was also onesthat would go one hundred feet before they
exploded. And you got a personbeside you that's supposed to keep track of

what what munition is and what cylinder, and they kind of messed up and
instead of shooting him with a dragon'sbreath, they popped him in the face
with a hundred yard gaspernade. Andthat wasn't on film, you know,
none of that, which is stilltheir fault. But yeah, the guy
ended up getting rich but drinking througha straw the rest of his time in

(01:07:47):
prison, which is life. Well, everything's got to be on camera.
What is the craziest thing you eversaw? I mean there was some,
there was some. It was thestuff uh we had no, not really.
The strangest thing I saw was wehad been in uh visitation and the

(01:08:13):
guy had swallowed, well we sawhim on camera swallow the package. So
when that happens, they go intouh medical bay into a room with a
window. When someone sits there andwatching them, they turn the water off
to the plumbing so they can't blushthe toilet. And every time they would
go to the bathroom, we'd haveto get you know, like those they
use those little tone suppressors, likethey look at you, remember they look

(01:08:36):
at your throat and he kind ofgot to dig through their waist and try
to find this package. Got it? And uh yeah and this guy,
yeah, that's that happened. Thathappened like times. Yeah, draw Straws.

(01:08:57):
Whoever has to watch that person inthe medical bay trying to pass whatever.
The captain would a sign like whoeveryou know was extra Like there were
two yard officers one other than thathave to go and just didn't stare at
the person. Did the captain everdo it? Yeah? Yeah, I
feel should people people people weren't onthat one. Yeah, lead man,

(01:09:18):
come on lead Yeah. Uh,I'm How many people did you see die
in prison? Uh? I wantto say it wast for for when you
took that job, were you awareyou were going to see people die?

(01:09:39):
I mean I've watched movies. Iknew that. I knew it was the
death of possibility. And and howdid how were some of the ways you
saw people die? Uh? There'sriots and I'm sorry, incidents. They
don't really like to call them riots, but it Yeah, I just uh,

(01:10:01):
every pod would have basically two differentgames in it, and statistically those
people would get along, but onetime they didn't and it was just an
all out riot in the pod.And you know, four people ended up
losing their life. Wow, likethey all took each other out. Yeah.

(01:10:26):
Yeah, it was an insane incident. Do you have nightmares about that?
No? No, No, Iprobably did then, but I it's
a distant memory now. And yousaw someone get tossed off a second floor.

(01:10:46):
Yeah, we did. We weredoing intake. So when you do
intake, people come in and youhave to ask their affiliation. Obviously,
you strip them, you dress themout, you get the stuff. And
then when you're doing an interview process, they one of the questions is,
you know, are you affiliated withany gangs? Well, this guy was
probably the most winneck person you've everseen, red ou tattoos on his arms,

(01:11:09):
you know, mullet and he saidhe was associated with the neighborhoods.
And uh, you know, wekind of look at him and are you
sure you want to do that?You know, like, this is prison,
this isn't you know, East Tulsa. He's like, yeah, yeah,
yeah, I got I got alot of neighboring friends, you know,
uh in here, like all right, man. So he wanted to

(01:11:30):
be affiliated with him, So weput him in the pod and like a
week later they threw him off thesecond tier and he bounced by the basketball
off the concrete. Wow. Becausehe tried to associate with him and they
were like no, yeah, yeah, he was the only white guy in
the pod. Yeah, so andhe was nowhere near you know what he

(01:11:57):
said, he was right, Andif someone were to say like, hey,
we're this and you know they're not, you would just you would be
like okay, well, good luckI mean, yeah, pretty much.
I mean we try to explain thesituation, you know, like this is
this is different, and this isyou know, this is prison. We

(01:12:18):
got lifers in here, and wegot you know, obviously violent offenders,
and you know, prisoners have away of finding out. I mean even
then, back then, they hadyou know, smartphones, you get on
Facebook, and and whenever somebody wentto sleep, you know, they'd go
through their papers, they get theirnames, they're you know, all all
the information that we need to looksomebody up and look up their court case.

(01:12:42):
So I mean they were good atdoing research. And yeah, this
guy just he didn't cut. Hedidn't make the cut. What was the
moment for you? You were like, I can't work here anymore. This
isn't for me. Well, really, it wasn't that. It wasn't anything
violent or whatever. It's just Ihad worked nights for those years and I
got to me and my wife justhad a little girl, and we were

(01:13:03):
basically she works eight to five andI would work five to seven. So
basically when I was getting home,she was leaving, and uh, you
know, I just had enough ofit, and I tried to go to
days. And at the time,the chief of security told me, I
was too useful on the night shift, so I was th kind of stuff

(01:13:26):
there and I ended up leaving andgoing and managing in that woods. It
says, So we read this storythis morning that this woman got in trouble
for smuggling. She was a nursein the in the prison and she smuggled
drugs in her lunch and she gotin trouble. Right, did you ever
see anybody smuggle drugs in and catchit? How did you find out?

(01:13:47):
Oh? Yeah, Well, wheneveryou go whenever you go to the facility
to you know, go to briefing, you get shut down, you get
you know, you get searched justlike an inmate. Would you gotta take
all your stuff of put it inthe next room machine, all metals,
all everything out of your pockets,and then the person working the front door
would actually you know, patch youdown and search you before you got to

(01:14:11):
go through the metal tector getting yourstuff back. And uh, sometimes they
would they would catch them there,but most of the time it would be
if they if the if whoever wasbringing stuff in, they got caught in
that circle, the inmates pretty muchowned them, you know, so they
would have to keep keep bringing.I think the most we saw was an
ounce of mess come out of thefemales and other regions. And she was

(01:14:35):
a she was an officer. Ohwow. And so that is really not
a good thing because I mean,one one officer, one co worker does
that. I mean, they pushyou in a lot of danger because for
one, that's that's feeding the drugproblem, and that in itself is violent
in prison. And you know ifcell phones, bringing in cell phones a

(01:15:00):
big deal at the time, youknow, a little flip phones that you
could store places, and that wasbad because obviously prisoners could make calls out
to uh, there are people,and it's just could be a dangerous situation.
And it says here you found afootball in the yard one time,
that finding a sporting piece of sportingequipment doesn't seem that crazy. No,

(01:15:25):
no, it's not. But atthe same time, the yards are supposed
to be clean after wreck or afteryard time. And each pod had,
you know, a little room offto the side which had carried we could
hold the sports stuff. And Iwas the yard officer that night, and
I'm just like, oh, well, there's a football they missed, you
know, So I just went tograb it and put it up, and

(01:15:46):
it had weight to it, notair. So I'm like, well,
this is funny. So we tookit in an administration office where the captain
usually sits, and we cut itopen and a twenty two caliber pistol fell
out. Wow, and multiple multipleSmith and Wesson knives. So that was

(01:16:08):
one of those old Pratt moments,you know. I mean, working as
a prison it's not really scary unlessyou let it be. So whenever you
find something like a firearm that kindof takes it up a notch, right,
you were immediately reminded this is areally dangerous place. Sure, sure,
for sure. Uh wow, dude, I don't think I'm built to

(01:16:30):
work in a prison. I didn'tthink that was either the first time you
have to go through I think aneight week training period and I think like
the third week they actually take youthrough all the pause, they take you
through MAX, they kind of introduceyou to all those those areas, And
that first time we walked through there, I mean it was pretty scary because

(01:16:51):
I mean, all the inmates obviouslyknow you're you're a new officer, so
it's a very big go. They'restarting to starting to think you know what
can this person for me? Andthe ones that are sitting you know,
have windows, I mean, theydon't have nothing else to do every day
to stare out those windows. Sothey know, you know what you drive,
They know when you get there,they and they just start, you

(01:17:12):
know, trying to come up withways to get you on their side or
to get you to start bringing stuffin. So, I mean there's a
lot of holler in there, especiallywith the female officers. I mean,
as you can imagine. Yeah,that sounds terrifying. Yeah, that was
probably the most nerve wracking time ofmy of my time there. Wow.

So I had a dig and itcame up on an Oklahoma City station about
something that happened here. And thestory is is that a man was thrown
from a bridge. Oh okay,right, and the police found the man
bound in duct tape in the DeepFork River. Yeah, it doesn't sound

like he was Uh, he didthat voluntarily. Yeah, And since then,
three people have been arrested and accusedof throwing this man off a bridge.
Because he survived and so d forksdown by Henrietta for those who don't
know. And according to reports,they responded to a call of someone jumping

(01:19:23):
out into traffic at the State Highwaytwo sixty six bridge over the Deep Fork
River near Grayson. Deputies described theman as badly injured and determined he had
been adducted and forced off the bridgeafter being bound with duct tape. His
condition hasn't been released. After hewent to the hospital after speaking with the

(01:19:44):
witnesses. Deputies located and arrested aman on complaints of assault and battery with
a deadly weapon, attempted first degreemurder, conspiracy to commit a felony,
and kidnapping. Further investigation, anotherman and woman were arresting connection with the
incident. Was jailed on complaints ofassault with a tempt to kill and kidnapping.
The man was jailed on complaints ofaggravated assault and battery, kidnapping,

and pointing a firearm. I amnot a crime expert. This feels somewhat
organized crime related. Little bit.Well, maybe a drug deal. I'm
gone wrong. You know, hedidn't have what they was looking for or
wanted, so they tie him upand throw him over the bridge. Could

be could be gambling. I thinkif you're going to do something like that,
you should he must well just killthe person, right. I think
they thought they were going to,right, But I mean, like before
you toss him off the bridge,you know again, I think you're trying
to push a point. Eh.I just think, you know, because

this guy survived and now he's ableto tell his story and who exactly done
it, and now these people arein trouble. If it was organized crime,
he ain't he ain't safe. Ohno, even they got these three
people. And if you've seen thenews over the weekend you're here, there's

been a lot of activity in thatarea. And I'm not up on my
Oklahoma gangs, but I know thereare some, especially in the rural areas.
Remember that that bus they had out. I was in Kowita and it
was all the people that were stealingstuff off cars and they got like nineteen

people, and it was all connectedto a gang or a group of organized
crime. I don't know what theright term is. I don't know if
calling one gang but it's a mafia. I don't know. Though I don't
want to. You don't want tobe a target, No, I don't
want to. I'm not trying todisrespect anybody. I'm just I'm just saying

that, like that was organized crime. Yeah, yeah, maybe not so
much, and like you think inthe Mafia movies, but still there's some
kind of organization on there. There'sa ring of sorts, right, crime
ring organized crime. They just happenedto be still in catalytic converters and not
you know, dealing drugs or prostitutionor maybe so that's just what they got

popped on. Ah, the basisare all the same, right, you
need to collect money to pay payit up. Yeah, pay it up
the line, so they can payit up the line. Right, So
they can pay it up the line. Eventually somebody is at the top getting
rich and fat. Right. Meanwhile, next right, that's a that's a
job. No, you know,you think you're expendable at your job.

Now that one's just you know,even more so they can get any schmo
in there to do their bidden.Yeah. But if you don't have a
choice in life because maybe you haven'tbeen given the same opportunities or you you
know, when you were little,you did something younger, you did something
stupid and went to jail. Andthen you go out and you can't get
a job, and you get ayou got how to feed it, Like,

I get it. You got tofigure it out. I get it.
And not everybody's like I'll shovel sright, right, So you do
what you can. So you fallinto the wrong group and the next thing
you know, you're you're in andyou're doing worse things. But the fact
of it is, you mess upone time. You know, you can
mess up at your job now asa you know, manager of a grocery
store bag whatever the case is,may get written up, may get a

couple of warnings. I feel likewith that particular, you know group of
people, you don't get many writeups or warnings when you mess up on
your job. Or maybe it wasn'teven a mess up. Maybe it was
a I don't want to do thisanymore. I want out of this,
and that was what happened. Youknow, you don't get to just leave

or my buddy says I shouldn't doit anymore, And they went and got
the buddy that too, to maketo use logic right right, normal everyday
buses this practices. Boy, Iguess that would teach me a lesson though,
if like they went and got oneof my friends, tied him up
with duct tape and then tossed himoff of a bridge to prove a point

to me. Right, Oh okay, I guess I want to do whatever
you guys want. Right. Youfeel like you have no choice because they

There may be some challenges to it. I've never seen them, but
that's the law as it is rightnow. And so his concern was,
as well, the child was bornbefore we got married, and then we

got married, do we have tofile a paternity Do I have to file
a paternity action to a certain paternityAnd the answer would be no, I
mean because the child was they gotmarried with, you know, the next
August they were it was born withinthree hundred days of the marriage. He's
the biological father. There's no disputesupon that, so he's good to go
at that point. And that canalso go the other way, right if

you are in the process of gettingdivorced and somebody gets pregnant, right,
so if you get if the wifegets pregnant during the divorce process, and
I don't mean pregnant by you husband, if she's anyone, anybody, well,
and it could be anybody, couldbe husband, it could be anybody,
and it does happen, then youknow, the divorce basically is kind
of put on hold in the senseof we can't finish that divorce, even

if you've got an agreement, evenif we've had it all signed by everybody
but the judge. Everybody's happy,everybody's happy. We can't sign. We
can't have the judge sign that thinguntil the baby's born because we now have
to deal with the issue of thebaby and the divorce. And they wait
like that because God forbid, somethinghappens to the child during the pregnancy.

Okay, I mean, we neverwant that to happen, but those things
do happen, and so the lawsays, well, we need to make
sure that this child is actually bornso that we can deal with the custody,

of the judge to get them takencare of. This is a custody question

or any parental rights by seeing seeby seeing and taking care of him every
other week? Okay, So ifhe's not on it, it doesn't all

right. So if he's not onthe birth certificate and it's a paternity action,
yeah, we can always follow apaternity case to get him, you
know, official visitation and custody.You know, as far as the visitation,
what they're doing now just goes tohelp put a precedent before the court
of Look, this dad's been havingvisitation. So when mom comes in and
says, no, I don't wanthim to see him, you can say,

well, well, that's funny becausehe's been having visitation whatever they said,
it is every week for the lasthowever many months, you know,
so that we just need to filea paternity action to get that in writing.
Because you know, it's great whenpeople are able to work out things
as far as visitations and all that, that's great. You know, I
applaud people for getting along, especiallyit's a day's world, right, But

at the same time too, ifsomething happens and the woman gets upset and
says, I don't want you tosee your kidneymore or you're not going to
see your kidneymore. There is anavenue for those fathers so that we can
file for paternity and get the visitationand custody and all that kind of stuff.
Over the on Friday, we dida question of your biggest surprise,
and we got more than one thatsaid that they took care of their child

(01:37:39):
only to find out it wasn't theirchild. Right. Is that common?
It can be? Yeah? Absolutely, I mean it's unfortunate that happens,
but it does happen, and that'swhy you want to give us a call
so we can get that taken careof that. You know, we can
have DNA test run to find outif you actually are the dad. You
know. The sad part of aboutthat is is that then you have to

(01:38:00):
step in and figure out, well, you know, is biodad going to
step in and if not, canyou become the presumed father? I mean,
there's there's all avenues to deal withthat, and there's a lot of
different legal strategies to handle that.So if you're having that issue, please
call me and let's talk about yoursituation. This one says, my ex
husband has given me a choice tomake sign custody over for my two boys

without without any visitation, or gettaken back to court while he proves that
I'm an unfit mother. What doesit take to prove unfit an unfoot parent.
It's one that has an issue withtaking care of the children in some
way, or they put them inyou know, they've they've harmed them,
they physically have damaged them. Theyyou know's there's all sorts of different ways.

You know, if you're a druggie, and of course you're not,
you know, you live in aditch and you're not seeing your kids and
you're not taking care of them,or you know, you are leaving kids
at home by themselves while you goout and go to the casino for five
or six hours, or like thelady that was in the news that left
her, you know, infant inher little kid in the car while she

(01:39:04):
went into the casino for five hours. You know, those would definitely be
ideas or or thoughts or proof ofunfitness. I mean, and the person
who's claiming that the other side isunfit has the burden of proof to show
the court that the other side isunfit in some way. So it's you
know, if you're saying, well, she's unfit, then it's your responsibility

(01:39:25):
to show that she is. Sheis unfit to the court. Well,
and what about the idea of justthat's making that threat. Is there anything
that the court would interpret that ifI mean that was presented, What do
you mean making the threat? Well, him saying the person is saying that
they said that if he didn't signover custody. You know she didn't sign
over custy. Whoever that is isusing that as a leverage tactic. Okay,

(01:39:45):
I mean, consider your sources,everybody. I mean, that's what
I remember, I remind everybody isis that when the other side pops off,
unless they're a lawyer that practices thisall the time, and even lawyers
that don't remember they don't practice,if they don't practice this kind of law,
they may or may not know whatthe law is. Okay. So
whoever is popping off and saying thata lot of times, they're just using
it as a scare tactic. They'reusing it as a tactic to try and

control the situation or to control theother person by making these threats. Until
you call and talk to somebody whoactually does this at like at our office,
me or you know, somebody atmy office or our post office are
being told may not be true atall in any way, shape or form.

in high school? Are they gettingready to did they just graduate in May?
Or do they have another year left? Or are they going to turn
eighteen some time this next year whilethey're working the way towards their graduation.
So it's it's and or it's notnot both. We got to figure that

out. That's step number one.So the second part of that is is,
let's for argument's sake. Assume thatthey turned eighteen and graduated in May
a couple months ago. All right, Great, you can't just stop paying
child support, all right. Theproblem is is that when you do that,
the order is technically still in placeuntil you terminate it. Now,
there are situations and I'm sure peoplewill call in or call me at the

(01:41:33):
office and say, well, youknow, I you know, DHS automatically
terminated it for me. Great.That is the exception to the rule.
That's not the norm, all right, especially in the larger counties in Oklahoma,
simply because they've got too many casesand it's not like they have a
master list that prints out every youknow, every day at eight am that

(01:41:53):
says, okay, these are thecases we need to terminate today. It
doesn't work that way. I mean, your typical office in Tulsa, for
example, you've got any of themdealing with anywhere between twenty and thirty five
thousand cases. So there's no waythat that's always going to happen. If
it has happened to you, perfect, great, count your blessings, say
thanks to God, and move forward. But for those who haven't had that

(01:42:15):
problem, please call me, becauseI have had clients call me a year
after the fact just to find outthat they've been paying. They've still been
having a drown out of their checkfor a year, not terminated, and
now they've overpaid for an entire year. So what I typically tell people is,
if your child is eighteen, oris going to turn eighteen, or
is about to graduate high school,call me about March, because by the

(01:42:39):
time we get done, it'll beMay, they'll have graduated and you'll be
done. So plan ahead. Thisone says what is the process for a
step parent adoption? So the processwould be is number one, you got
to know where they're at. Numbertwo, and even if you don't,
you know there's ways too. I'msorry to bile the biological parent that you're

(01:43:00):
wanting to determinate the rights of.And of course if you don't, then
obviously there's avenues to handle that aswell legally. But you know, if
they don't consent to the adoption,then there's something called an adoption without consent
hearing, and in that hearing youhave to prove that in twelve of the
fourteen months prior to filing for theadoption. So that's the only timeframe we're

(01:43:20):
talking about all right. For thathearing, did they maintain a substantial relationship
with the child, did they paychild support based upon what they could pay,
or if there was an order inplace. If you can prove that
they failed at one of those,it's A or B. You're not required
to have both, although a lotof times they go together. Then you

(01:43:42):
win the adoption without consent hearing,and then you can move on to the
next step, which to the bestinterest hearing. If the court finds that
it isn't the best interest for thechild to be adopted, then the child
be adopted and that'll be the endof things. Now, as always when
we're dealing with adoptions, even stepperent adoptions where we have to look at
equo okay, Indian Child Welfare Act. And of course that's a big deal
and it has been a big dealfor a very long time, and so

(01:44:06):
and just to understand if people don'tunderstand what it was all about, I
encourage you to look it up onthe internet. But the basic gist of
it is is that you know,there were these horrible stories of during the
nineteen forties, fifties, and sixties. You know, people American agents or
people of the state would walk intoa Native Americans home and just take their
child and walk out, and they'dnever see him again, and they'd be

(01:44:28):
adopted off into another family somewhere.So if you're interested in that, it's
an interesting hearing to read, aninteresting story to read. But at the
same time too, it's a bigdeal for the Native American community because they
want to keep Native American children withNative American parents if possible. So the
idea behind EQUA is is that ifyou're going to have a set parent adoption,
you've got to and the other sideis Native and the child is Native

(01:44:50):
and on the rolls all right,then you've got to prove that there were
substantial things done to try and reunitethe child with that parent. And if
you can't prove that, then theadoption is stopped. If you can prove
that and it shows that no matterwhat you did, it still didn't happen,
they still didn't reconcile, they stilldidn't get back together, and the

(01:45:12):
biological parent ignored the child or whateverit may be, then the adoption can
move forward. So being Native Americanis a big deal, especially when it
comes down to adoptions. And thisis true for most states, not just
Oklahoma. And you can definitely tryto navigate the process of step parent adoption
on your own, but you don'twant to do it that way. You
want to make sure everything's right.It's too important to try and navigate it

(01:45:32):
on your own. That's why youneed the folks at Hensley and Associates.
Here's another one. My daughter wantsto have her name changed. What do
I need to do? Sure,so give us a call. We can
do the name change. I mean, first of all, how old your
daughter is? She eighteen or anolder she not? If she's not,
then you know, changing name isfine. The question that becomes is is
that does the other parent agree withthe name change? And we have to

(01:45:55):
give them notice. They have aright to object, and if they object,
then we'll deal with it. Andif they don't object, then we
get the name changed and life moveson. So you know, if you
need a name change, give usa call. We can get that taken
care of, no problem. Oneof the first ones we read, they
sent a follow up they said,can you answer the first part of the
question. I guess I'm wondering whenthe step dad's will will is executed,

(01:46:16):
it is is it now that he'sdead or is it after mom dies?
Oh? It'd mean I mean oncesomebody dies, their will is executed,
regardless if there's a spouse. Regardlessif there's a spouse. I mean that
their will is their will. It'snot you don't have to wait until mom
dies. I mean there are wifedies. I mean that's not the case.

(01:46:38):
It doesn't just transfer automatically. No, right, right, right exactly.
I mean every will has to behas to be dealt with and probated.
So you should be able to contactthe attorney that drafted the will,
who will then help execute it andget things set up for probate. So
give them a call, whoever itis. You know, when we draft
a will, we're required to keepa copy of it. So please whoever

(01:46:58):
that is, call the aturney thatdrafted it and asked them about the probate
process. That's an important point too, because it's not an automatic. Well,
you know, you have to youhave to engage the process. I
think so, yeah, I mean, first of all, how else is
the attorney gonna know Number one?Number two? You know, we again,
I think movies have screwed us up, and TV screwed us up because
you know we always see these someonedies and we immediately see the attorney walking

(01:47:19):
in and we're going to read thewill. Well, somebody had to I
mean what you don't see off scenesobviously, and someone didn't write in the
screenplay is is somebody had to callthe attorney to tell them they're dead.
So yeah, I mean you needwhoever drafted the will, you need to
call them so they can help youwith the next steps. Uh. The
last thing we have here for you, Jeff from Innsland Associates is something I've

heard people say a lot the basisof this question A lot says I have
an a rarige case in later thismonth. The CSS attorney wants me to
get the order file stamped, butI only have copies of the order.
The original attorney isn't contacting me back, the court clerk won't file a copy.
What can I do to get anoriginal order? I mean, first

of all, this is kind ofwacky. It doesn't quite make sense to
me the way it's explained. Typically, when there is a child support case,
all right, DHS handles all that, They handle all the filing and
send you a copy. So DHSif they're the ones that had the hearing,
especially if it was an administrative courthearing, DHS has the file stamp
version. Now if you need acopy of that, you just need to

(01:48:25):
contact DHS and they will give youa copy of that. They can certify
it because and also too, ifthere was a copy, if there was
an order that was made in administrativecourt, then it is also filed in
district court and you should be ableto go up to the district court clerk
and just ask for a certified copy, pay your two or three bucks or
whatever it is for photo copying toget a copy and walk out. Whoever

this is please call me. Iwant to walk you through and see what's
going on here because the way you'vedescribed it's a little odd to me,
especially if DHS was the one incharge of the hearing. So please call

It applies to both offensive defense.This causes players to learn to be ambidextrious.

water a water sport process of treading, swimming, throwing, the players work
