only owned.

Less than a dozen. I'm confident I had more. I
bought more blanket cassettes than I ever bought cassettes for sure.

I'm not even that, just high speed dubbing of my
friend's cassettes. So, like, they stopped selling cassettes in two
thousand and two, but way before then they did they
start phasing them out. They started selling CDs in like
the eighties, believe it or not, but they didn't really
catch mainstream attention to like the early nineties, mid nineties.
I remember working at Chuck E. Cheese, Showbiz whatever at

the time, and CDs is what we played in the kitchen. Yeah,
and I was sixteen at the time, so I know
that even though it's twenty two and nineteen eighty, there
was already CDs in the mix and people playing those.
But I found this list of the the most valuable
cassette tapes. Okay, interesting, right, right, because that's what put

lp H. I had a lot of forty five's, right,

up to four hundred dollars sealed and on about average

In ninety set of five, AMoD man picks fight at
red light, gets run over by his own Ram fifteen hundred.
This happened in Gainesville, Florida. Joseph H. Carl, forty eight
year old Florida man who is driving his Dodge Ram
fifteen hundred in the rain on Tuesday night. According to
the Gainesville Sun, about seven pm, he ran into another

vehicle that was waiting at a stoplight. Now, this would
have been a great time to get out and apologize,
trade insurance information and deal with the mess another day,
perhaps when it's dry, but that's not what he did.
According to early reports, he jumped out and began yelling
at the other driver. He was so angry and violent

the woman in the other car panicked and drove off.
That's when Carl's ram began rolling into the intersection. He
realized he'd forgotten to put it in park. Police and
paramedics responded to the scene and found Carl wasn't taking
it easy by any measure. They say he was stumbling
around the intersection and smelled like alcohol. So this would

have been a great time to come clean and tell
police exactly what happened, but that's not what Joseph Carl did.
Carl insisted he does not drink and drive. Later, he
claimed he was returning from a neighboring town where he'd
had three beers. He failed the field sobriety test refuse

under suspicion of drunk driving, and there they found empty
beer cans and also a cold sixteen ounce Miller High
Life still in its cup holder. And when his arrest
looked imminent, Carl complained about his foot hurting. Police took
him to the hospital, where he was treated for a

down there. So he goes to Vegas, gets a room,

This happened in Virginia, where a homeowner learned the hard
way the damage that can be done by doing something stupid.
According to fire officials, someone placed the loaded gun in
the oven, turned it on. When the gun heat it up,

item in the oven, it is easy to forget it

her checking account to pay her bills as she is
legally blind and can't read her statements, write checks and
is a little forgetful. He put most of her bills
on autopay to come directly out of her checking account

and is the executor for her state. All this feels standard, right, Yeah?

About five ing to it, about five years ago he
was borrowing money from our family parentheses thousands because he
got into some serious debt, which he said was because
of the high cost of medication, high vet bills for
his aging pets, and other items such as glasses, et
cetera for our mother. We found out these were all
lies to cover up gambling problem. He admitted to it
with the family and said he get help, and we
(01:32:29):
all stopped loaning him money. Recently, he was seen by
a family member in a casino gambling. We were worried
because he has control of mom's finances. We decided to
investigate her bank and found out twenty five thousand dollars
is missing. It was slowly taken through ATMs over the
past two years. We are in the process of removing
him from the account and changing the poa, et cetera.
(01:32:50):
Since he was on the account. Did he commit a crime?
Mom's only source of income of social security, so she
really needs this money. Two questions. Let's answer their question
of is a crime and also talk about the importance
and how and if you need to change in that scenario.
Speaker 12 (01:33:07):
You know my and so you know, did he commit
a crime?
Speaker 7 (01:33:13):
He had power of attorney.
Speaker 12 (01:33:14):
But you know when power of attorney you're talking about,
they're only able to do legal stuff, you know, paying
their bills and helping them financially, those kind of things,
not draining their account in this case, and there is
a potential for elder abuse or something of that nature.
So you know, you're always welcome in that scenario. Whoever
this is to call the police and make a police
(01:33:35):
report and they'll do an investigation. If they think that
chargers are warranted, they'll refer them up to the district attorney,
who will then prosecute.
Speaker 7 (01:33:44):
So there is that possibility.
Speaker 1 (01:33:45):
Do the police have a division that specializes in in
elder financial crimes?
Speaker 7 (01:33:51):
I don't think. I mean, the detectives do.
Speaker 12 (01:33:54):
It all depends on the county, right, I mean, you've
got some counties that are much bigger than others that
have detectives for different things from homicide to you know,
theft to whatever. I mean, there's different areas. Smaller counties
obviously they've got less detectives and so therefore they just
kind of take what comes in.
Speaker 7 (01:34:10):
The door regardless.
Speaker 12 (01:34:12):
There are detectives that handle these things and can do
the investigation and get the records and find out if
that were the case. If you've got this going on,
and you know, somebody's taking the money they shouldn't, even
though they've got power attorney and all that. You know,
obviously we need to get that person office parwate attorneys.
Power attorneys can be revoked at any point. Now it
sounds like the elderly lady is still with it mentally,
(01:34:34):
she's just kind of blind and a little forgetful. She
has the right to revoke that parate attorney at any point,
so she can just say power attorney's dead, you're not
going to do this anymore, you're not going to take
any money, and you're no longer pow attorney. And she
can assign that to somebody else or you know, depending
upon how she is now mentally, physically, emotionally, that kind
(01:34:54):
of stuff. We can look at guardianship. But you know,
if she's still with it, she can revoke that parate
attorney at any point and give it to somebody else else,
if she showed chooses.

email that came in last week about a nightmare I
think a lot of men have. A friend of mine
received a message via social media from a woman claiming
he is the father of her seventeen year old daughter.

Should he respond one If he waits until she turns
eighteen to respond.
Speaker 12 (01:35:28):
I mean, you don't have to respond. I mean this
kind of gets into the.
Speaker 1 (01:35:32):
Whole moral it's a moral question.
Speaker 7 (01:35:38):
And as we've talked about before, if you want moral law,
go to Europe.
Speaker 1 (01:35:41):
Go to Europe.
Speaker 12 (01:35:42):
We don't have that here and not always our laws
taken to those things in account.
Speaker 7 (01:35:47):
But with this scenario, I mean, here's the thing.
Speaker 12 (01:35:51):
The first question any guy as to ask is is, well,
do I want to get to know this kid?
Speaker 7 (01:35:56):
If this kid truly is mine?
Speaker 12 (01:35:58):
And of course the first question anybody has popping their
head as is well, how do I know that it's
my kid? Okay, So first step obviously would be a
DNA test, and then if you are the father, then
you have to decide whether or not you want to
have a relationship with that child. Now understand that if
mom goes and files for child support under the law,
they can go back two years. So you know age
(01:36:19):
is fifteen, sixteen, seventeen. Obviously, seventeen is where they start
moving forward, but two years previously it could get you
for two years of back child support. But it really
kind of boils down to, you know, if this kid
truly is yours, do you want to have a relationship
with them or not? Does the kid want to have
a relationship with you? I mean, that's just something you
just kind of have to decide but understand, and that's
a moral and what you want to do personally kind
(01:36:40):
of thing. But from a legal standpoint, mom could go
file for child support and they could come to him
and say, Okay, she's claimed that your dad. We're going
to do a DNA test. If you are a dad,
then you're going to owe child support until the child
turns eighteen or ages out by graduating high school, and
we're gonna hit you for two years of back support
on top of that. So you had a question looked
(01:37:02):
like okay. So with that being said, there's the moral
side of it, there's the legal side of it.
Speaker 1 (01:37:10):
Is it safe to say that?
Speaker 7 (01:37:12):
And I've had this happen to clients.
Speaker 1 (01:37:13):
It feels like I've heard friends tell this story.
Speaker 12 (01:37:16):
I've had this happen with clients. In fact, I had
one one time. It's probably about ten years ago now.
But the guy, it was funny because by the time
that the bio mom got to my guy, he was
the sixth person that she had tested for DNA for
this kid, and lo and behold, he was the dad.
Speaker 1 (01:37:35):
He won. Everybody wants a lot of right ancessity.
Speaker 12 (01:37:37):
Right and so now what suck for him was is
that that was back when the law was five years
of back support instead of two and the interest rate
was ten percent instead of two percent. So he got
royally screwed when that came about. At the end of
the day, though if I remember correctly, he did end
up trying to have a relationship with this kid and
everything kind of worked.
Speaker 7 (01:37:58):
Out and you know, move forward and all that.
Speaker 12 (01:38:00):
But you know, as far as that's concerned, you know,
again it's only two years back support and two percent
is the interest, so you know, it's a lot better
now than it ever had been. But it does happen.
I've had this happen to several clients along the way.
Speaker 1 (01:38:14):
Is it safe to say? And I don't know if
this would be legal advice, but the day of discovery
will come if it is indeed your kid, And I
mean sure can skirt. It is is kind of a
you're you're playing a kind of a financially dangerous game,
aren't you.
Speaker 12 (01:38:29):
Well you can yeah, I mean, obviously it all depends
on when mom goes in files. I mean, if mom
waits till one day before the kid turns eighteen, you
could still get hit with two years of back support. Obviously,
your current support moving forward would be dead the next
day or until the child graduates high school, whichever one happens,
you know. But my point of it all is is
(01:38:51):
that there could be a day reckoning and there could not.
I mean, it just all depends on what mom does.
I mean, you're truly at her mercy as to what's
going on and what's going to happen next, unless you
take the step of saying, okay.
Speaker 7 (01:39:04):
I follow father to kid.
Speaker 12 (01:39:06):
I didn't know, but I want to try and get
to know this individual. And then of course you've got
the you know, does the kid want to have a
relationship with you? What has Mom told her or him
about everything that's been going on or about you or whatever?
You know, So it's it's definitely a quagmire to get into.
Speaker 1 (01:39:22):
And on the flip side of that, do you encourage
all mothers who aren't sure to pursue paternity.
Speaker 12 (01:39:32):
Again, that's up to them. I don't push one way
or the other. And here's why. At the end of
the day, do you want are you only going after
child support or do you want your child to have
a relationship with the father.
Speaker 7 (01:39:44):
I mean, that's really on you.
Speaker 12 (01:39:45):
I mean, that's not anything that there's no law that
says that you have to get that DNA test done. Now,
if you go for child support, there's that law that
says you have to go for that DNA test, obviously,
But at the end of the day, if you're just
wanting to know or you're just calling to do the
right thing and let the dad know that they've got
a child after seventeen years, that's up to you.

This is the text in If you have a question
for Jeff, couple ways to do it. Text it like
the one I'm about to read BMMS and whatever that
is to eight two nine four five. You can email

if child support is foregone and a divorce decree, can
the custodial parent go back and file for reviews to
continue payments.
Speaker 12 (01:40:30):
Yes, I mean even though you have a decree at
that time. Let's say it's now twenty twenty four and
you say, okay, we've agreed to no child support. We
can do this because there's no money owed to the
state for sooner care or anything like that.
Speaker 7 (01:40:44):
So we say is zero for both sides.
Speaker 12 (01:40:46):
Well, where we are now is not where we might
be financially or otherwise into three, four, five, six. However,
many years down the road, you can always modify the
decree to have child support brought back into the situation.
So just because you agree to nothing now does not
mean that that person is stuck at a zero forever.
(01:41:08):
They can modify that moving forward if they so choose.
So even you've got even though you've got a deal now,
that's great, but that doesn't mean that they can't come
for you later.
Speaker 7 (01:41:18):
Now they can't.
Speaker 12 (01:41:19):
Get you for back support because you've had an order
in place that says zero. So don't worry about that.
But if they modify, ask to modify it, because the
situations change. Financially, they've they're making less money and now
they need support or whatever it may be. Or you're
making more money and they're making less. Whatever it may be,
that person has the right to file the motion to modify. Now,
(01:41:40):
I've heard of some people trying to do this. They'll
say they'll put it in a decree that says you
can never ever ever change this zero. You can never
ask for a modification.
Speaker 7 (01:41:51):
Uh huh. It doesn't work that way. That's a violation.
Speaker 12 (01:41:53):
And anybody that writes that up should have some major
problems in their lives. And what I mean by that
is this, all right, you can't legally waive your right
to child support that way. You can't say I'm never
going to modify. Now, if you choose to, that's one thing.
If you truly choose to do that, that's fine, knock
yourself out. But I'm saying from a legal standpoint, if
the other side files down the road and you come
(01:42:16):
back and said.

Well, look in the decree it says that you weren't
allowed to do that, well it doesn't work that way.
Speaker 12 (01:42:21):
That is legally blocking them to their right to the courts,
and that's not allowed.

And here's why, all right, there has to be an
order from a judge that says that there's a child
support order in place, which means notice has to be
given to the other side about a hearing, and he
or she has a right to show up at that
hearing now. And the other thing, too is let's say
(01:43:07):
there's been an order and the person hasn't been paying
and all of a sudden it starts coming out of
their paycheck. Well, again, there can be a summary of
support order. Plus you're already unnoticed for from the original
order of which you're not paying. All right, But whoever
this is, please call me because what you're describing doesn't
make any sense in any way, just based upon my
(01:43:28):
experience and how I know how DHS handles all that stuff.
So please, whoever it is, please call me this week.
I'd love to talk to you more about it, because
it doesn't normally work that way. It can't because they
can't hit you with an order without giving you notice
of a hearing.

And notice of the hearing falls under the ways that
you have described before, which is if they can't get
a hold of you via certified mail or a process server,
or does it count if it goes in the classifieds.
Speaker 12 (01:43:53):
Well, it doesn't go in the classifieds, and that's not
how it works. Is is that you contact whatever local paper,
so of for example, also it's also world in other counties,
it's the major newspaper. Usually most small cities have only
one newspaper, and you contact them and it's published in
their newspaper, and it's it's I.
Speaker 7 (01:44:12):
Don't know if some put it under classified.
Speaker 12 (01:44:14):
Some have an entire section of just for announcements those
kind of things, but that's where it's printed, whether you
read the newspaper or not. That's just the way the
law is in Oklahoma. And so if they've done one
of those, if they've done all three of those things
and you still don't show up, then yes they could
get a default.
Speaker 7 (01:44:31):
But even then still they have to send you a
copy of the default.
Speaker 12 (01:44:35):
So obviously this person got noticed, they got an address somewhere,
which is why none of this makes sense.
Speaker 1 (01:44:42):
Because I was trying to think of the ways that
that could fall through the cracks, because you can always
say I wasn't told.
Speaker 7 (01:44:50):
You can say that.
Speaker 12 (01:44:50):
But the problem is is the other side is going
to say, well, we sent a process server out to
this address.

Is this your current address? Well, yes it is. Well
we send out a process server.

You know, they this, this, this, this, and these dates,
and you weren't there, so then we tried to send
it certified mail and you never picked it up. See,
because that's a lot of what a lot of people
do is they think, oh, you know, because when when
you're not there, you get the little orangeish, bageous.

Colored postcard time to come gets started?
Speaker 12 (01:45:15):
Right, me, come get it? And they think, oh, if
I don't get it, then I don't have service. Well
you don't have service, that's right. But then they're going
to go to the next step, which is now publication.
And publication, in my opinion, all right is a great
I hate to say it this way, but it's a
great loophole for default because how many people read the
newspaper anymore?

And I don't mean I.

Mean a lot of us read the digital newspapers look
for those announcements, right right, And that's where I was
going Next, was we all read that, you know, we
read the sports section, we read the community section, we
read the front page, what's going on in the world,
blah blah blah. But how many people skip to the
back where there's the cartoons and the classifieds and the announcements.
Speaker 7 (01:45:56):
You might have some people, you know, like my mom
that love to read the obituaries for some goofy and.
Speaker 12 (01:46:00):
But you know, the announcements are not next to those obituaries.
So my point of it all is is that even
though it goes to the newspaper, and remember these laws
were set up when people were actually reading paper newspapers
all the time, right, not digital newspapers. Now, is it
in the digital newspaper of tilsa world. Absolutely, it's there
you can look forward. But again, who goes to that section?
So again that's why I say it's in my opinion,
(01:46:22):
I think it's a great loophole for default.

But at the same time, too, courts hate defaults.
Speaker 12 (01:46:27):
So if you came someone came in later within thirty
days and said, you know, I didn't get noticed or whatever,
they'll open the case back up and things will be fine.

But but yeah, but you sid, that doesn't mean just
because they said they didn't know doesn't mean.

Right now, I don't get off the hook.
Speaker 12 (01:46:42):
And by saying well, I didn't know, especially if the
other side can prove that they've tried serving you multiple ways.
Speaker 1 (01:46:49):
If they followed the process correct, then you just chose
to ignore it correct. All right? I got another one
here though. That was the other one. If you have

Kidnapping is one of the most misunderstood things out there,
in addition to a few other things. But so you know,
kidnapping involves not returning a child is not kidnapping, especially
if you.

Know where they are and who they're with and all

Kidnapping is running across state lines and hiding in a
hole somewhere where no one knows where you are and
you've not notified the other parent and you've turned your
cell phone off and they can't find you and all.
I mean, that's when the FEDS get involved in all
sorts of other stuff. I mean, that's a whole nother
scenario as instead of intensity, Yeah, way different intensitive potency.
(01:48:01):
Just because the other side won't return after visitation. That's
not kidnapping, So please stop saying that so many people do. Please,
that's not kidnapping. That's just some jerk not wanting to
return and follow in order if there is an order
in place. So if there's not, now let's talk about
two different scenarios on this, okay. So you've got two
different requirements under the law in a You've got one
(01:48:23):
with a divorce and you got one with paternity. So
let's talk about divorce first, all right. So if you're
in a divorced situation and there are no orders as
to visitation yet because you've not been to a temporider
hearing yet, or you've not made any agreements as to
visitation that had been signed by a judge, all right,
Remember it has to be signed by a judge if
you don't. If one of those two scenarios, all right,
(01:48:45):
and the other side has visitation or refuse to return them,
there's nothing we can do in any way, shape or
form until we get into a temporarity hearing with the judge,
plain and simple. The only exception to the rules on
that obviously, if the child is in some sort of
idiot irreparable harm. Okay, we have an avenue to take
care of that particular issue. But let's say that's not happening,
(01:49:06):
all right, there's nothing we can do until we can
get in front of a judge.
Speaker 7 (01:49:09):
That's a divorce. Now let's talk about paternity, all right.
And paternity.
Speaker 12 (01:49:14):
Remember, under the law, all right, it says that mom's
got sole custody until there's an order that says otherwise,
which means mom can control visitation and all those kind
of things. If mom releases the child to dad and
Dad refuses to turn the child to mom, then because
of Oklahoma law, we can go and get what's called

kid back to parents.

psychopaths are generally unbothered by how they are perceived by others.

wore lots of makeup were also found to be more
agreeable in most social.
