together the night before. I'm someone who will like try
to get that done way ahead of time and then

have to worry about it. And it's not always possible.

Maybe this is taking into consideration getting the home ready
for company or having company there, and you don't have
time to get a toy built or something. So they
have no choice but to stay up, you know what

my kid's sick, that's it. Yeah, right, if my kids

traumatic brain injury, right exactly, just trying to please your kid,
just trying to make them happy for the holidays. We
did milk and cookies. That was it. Yeah, that was it.
And most of the time the milk and the whole
cookie was still there. Santa never took a bite. Oh oh.

For some reason, my kids always put out stuff Santa
likes to eat. Of course, I've tried to convince him
to put a ipa, but they are not thinking sand

his milk and cookies and his gin and tonic. From
what Santa has told me, it gives him the poops.
The milk does that. Late at night, He's like, he

like I said, they talk to two thousand parents, and
sixty six percent have said they stayed up the entire night.
They found that the results showed that the holidays this

year might be better as three quarters of parents seventy
seven percent feel some pressure to make the merrier. When
it comes to inspiration, Facebook is the biggest source for
parents looking to create holiday magic, followed by TV and
then other family members. Okay, you got to get inspiration somewhere,

And eighty six percent consider festivities festive activities to be
the best quality time. I agree. I mean, I think
it's important around the holidays to plan stuff that's festive,
like if a gingerbread thing, making special Christmas cookies, maybe
a craft of some I don't know. Yeah, but you

shouldn't stress yourself to the max. It should be easy, yes,
there shouldn't. It shouldn't be like, oh, we got to
force this square through the circle, right right, try to
do all the things. Just pick one or two. We
like going to look at holiday lights, like a lot
of families, I'm trying to weord I gotta make sure
I wear this right. And some things you go to

do are really expensive. I'm not paying thirty dollars a
car to look at Christmas lights. I'm just not. I
get it. It's cool, But when you're charging thirty dollars
for lights, I feel like that. When I can go
to Rayman it's free. Who charges to look at their lights?

like Rayma's free. We went to the Christmas shoot in
Sepulpa on Saturday, Saturday. Yeah, and that's free and fun.

not feel pressure at all to I would hope I'm
already an individual that can make Christmas memories and I don't,
so I don't. It feels natural to do it. We
want to put up Christmas decorations, we want to go
look at lights, we want to do a gingerbread house.

I'm a big believer in trying to find things that
I like doing for my family because it makes it
not stressful for me. And if my kids like doing X,
Y Z, then that's different. I still don't feel pressure.

I don't want that. That was my childhood, right, I
remember going to cut down a Christmas tree and it

the positive, and so to me it's to feel pressure

good gift and that I get that. I get like
a lot of parents, moms put a lot of power
into that. Yeah, and they want it to be good,
and I get it. Spoiler, your kids won't love you
more if you get them the perfect gift. They won't
love you more. No, it'll be broke, they won't care.

You'll be selling into grid saling here and you're still stressed. Yeah,
I'm just being honest. The number of things we put
in a garage sale or we give away, I'm like that.
Do you know how hard we stressed and debated over

chili because then it's not stressful to make it right,

Pantless man breaks into home, grabs carpet cleaner while high
on meth. This happened in winter Haven, Florida, where Austin
Alexander Smith, twenty three years old, was charged with burglary
of an occupied dwelling and was booked into the Pope
County Jail. According to the winter Haven Police, residents inside
the home were suddenly awakened on Thursday about one thirty

six am to a loud bang at their front door.
The residents then discovered Smith in the living room wearing
only a shirt and aunt liss no shoes. He's holding
in his hand a carpet cleaner belonging to the residence
of the home. One of them yelled at Smith, who
then dropped the carpet cleaner and ran out the door.

Minutes later, police located a person matching Smith's description walking
into the area of the neighborhood. The officers detained him
and he was later identified by the resident as the
suspect who broke into their home. Smith had broken into
the home by kicking in the door. He told officers
he didn't recall what he was doing because he was

A woman fled traffic stop with officer still in her car.
This is another doozy out of Florida, where a gal,
she's thirty three. Her name's Victoria Mooseve. Now, Victoria had
gotten pulled over for failure to yield the right of
way to another vehicle. Okay, So the cop comes up.

She's like, he's like, hey, can I get your driver's license?
And she's like, no, I don't have one. It's suspended
and they took it away. Okay, So they called back
to dispatch to get her identity, find out she's got
a warrant out there for duy. All right, so they
she's in the cop car at this point in time,
and there's another officer that's in her car. Her ford

escape with her six year old daughter. Okay. So as
all this is coming through, old Vicky here decides to
hop out of the cop car and jump back into
her car and then take off with the cops still
in the back with her daughter. Well, they eventually did
stop her and they arrested her took her in for
fleeing and eluding so with her warrant. Florida Man, Yeah,

trying to squeeze it in at the end of the
ear huh. IHOB worker claims she was fired for giving
needy man pancakes. It's not a movie that Lindsay will
talk about tonight with all the hustle bustle of Thanksgiving
holiday and the holiday season. This happened in Florida Lakeland.
Victoria Hughes she'd been a thirteen year employee with the

local ihop, but was fired after committing the sin of
giving someone pancakes and water to a homeless person outside
the restaurant. She says she was told she was fired
because it could cause a loitering issue or a safety
issue for customers. She says she stands by her decision
would do it again. After the media got ahold of
the story, she said she's received a phone call from

corporate office, which included a job offer and compensation for
the days of work she missed. She's reportedly now deciding
on whether or not to go back to that job.
Would you go back? This is a tough one because
she was trying to help someone in need. Admirable. Right. Also,

I hops in the money making business, right, they don't
just be giving out free pancakes everyone. I'm sure this
person needed it. I'm sure the employee was in heart,
was in the right decision. It's against policy.

and stuff, and they have stuff on Veterans Day and
certain specials.

people happy, and it's good publicity. And again if it
is good publicity, but if you spread that up, now

want to do that too, and now it's you know,

then got up helped me clean house, and then I
made a really good homemade chicken and noodle's dinner that

can go backwards with it, but he can't straighten it up.

So but the good news, I guess on he's being

Well, everybok does a lot of things for bikers and
their rights to ride their motorcycle and do what they
want to do to their motorcycle, so that we're really
a big education group as well. So we do a
lot for education, changing laws, for making about Oklahoma the

best place you can to ride.

Speaker 1 (57:31):
Yeah, and I don't think people knew that that's what
you guys do. It's about motorcycles. I don't love this term,
but like motorcycle rights, it's you know, you said it
the best place to ride a motorcycle in the country.
You wanted to beat the state of Oklahoma. I'm curious
about this because I think this is really fascinating. Handlebar
laws and hands free laws. Talk to me about that.

Speaker 7 (57:54):
Yeah, So this year we're actually going after two laws.
We're going to change our law gets sandlebarre high and
hands free for people driving their farers up to down
the road right now in the stay with the home.
Now if you're legal for your handle bars to be
any taller than your eye level. And part of the
problem with that is is like if you're out riding
in the group and wanting your butt and when you

get hurt and you got to call somebody, Hey, can
you come ride a bike home for you your handle
bars or eye level that your friend may be a
little bit shorter than you. So whenever he gets on
your bike to ride the bike home for you, as
you're not able to for whatever issue, now he gets
pulled over and to get the ticket because your handlebars
are on your bike are taller than his eye level. So,

you know, we don't think that's fair. You know, we
want to be able to choose what we want to
put on our bikes, and so we think we're going
to go after changing that law for that reason. But
also hands free. You know, one of the biggest killers
of motorcycles is other people driving their cars and uh,

you know, first thing they say when when they hit
a motorcycle is is I never saw it. A lot
of times they don't see us because they're on their
cell phones. You know, it makes us really dangerous for us.
We don't have a cage around us, whatever, we'll get
in an accident, as you know as a biker yourself.
So we want to make it to where we have
stricter laws for being hands free in your thought. We're

not saying you can't take a call, we just don't
want you to do it with your with your phone
in your hand, hands free.

Of Sometimes I thought there was already a law about that, So.

There there is a but it's not really it's it's
kind of a difficult gray area there. But we want
stricter enforcement and stricter punishment for it because what they're
doing right now isn't working. So you know, we don't
want to get rid of the law or and make

a new one or anything like that. We're going after
the change to the law. We want to make it
lit a strict and a little more forced because it's
what they're doing isn't working. We're still getting killed, We're
still getting killed by people on our cell phones.

Now this isn't new, Like you guys have worked on
laws before. What are some laws that you guys have
already changed.

Speaker 7 (01:00:15):
Well, one of the very first laws a bait changed
here in the state of Oklahoma was the law forcing
motorcycles to wear a helmet when they're riding the bike.
And so now because of what a bait had done
in the past, now you can choose whether or not
you want to put a helmet on your head. We're
not against helmets a matter of fact, a lot of

us wear helmets on our Bible. But it's the freedom
of choice. So, you know, one of the laws we
changed there was if you're eighteen year older the state
of Oklahoma, you now have the choice to whether or
not you want to put a helmet on your head
when you get on your motorcycle.

Does abait have other chapters around the country or is
it just an Oklahoma thing?

Speaker 7 (01:00:57):
There is an abait in every state.

Okay, we need to get that changed all the way around.
I hate having a good and we're put my helmet

take it back off.

It's like, come on, and as a matter of fact,
I believe it was Nebraska just actually had their law
changed earlier this year.

Are there any laws that you are for that should
exist for motorcycles?

Speaker 7 (01:01:28):
Well, I mean there's a lot of laws out there
and we don't We're not really against any law. The
only laws were really is one that force you to
do something they really they have no reason to be
forced to do. So laws are good in stride, So,

I mean, it's feed lim It's obviously we got to
have those because speed kills people that don't know how
to ride with their riding. Does that make sense? But
we want the freedom of choice to be able to
a lot of fire motorcycles the way we want. We
want the freedom of choice to purchase our motorcycles the
way we want because right now they're trying to make
laws forcing the cell of electric motorcycles and we are

against that. That pusher. We're not against electric bias. You
want to buy an electric motorcycles, that's fine. We're against
the force of an electric motor tracle.

Wouldn't you say forced? What do you mean by that? Like,
what are they doing to force?

Speaker 7 (01:02:27):
Well, okay, so here's an example. Have you guys heard
of carb California air Board. I have not, so they recently, Okay,
so that was a group obviously in California. You know,
California recently pushed the deal saying that all their vehicle
cells fifty percent of their vehicle sales by the year

I think it was twenty twenty five or twenty thirty five,
something like that, I don't remember. The exact terminology had
to be electric, and they were working on pushing the
same bill in the in a motorcycle version, which the
m r F, who is basically the same thing as
a BAIT only their national scale works in coordination with

their SMROS or state more circle rights of organizations like ABAIT,
and here recently cars shut that build down, so they're
no longer pushing a force fifty percent production only electric motorcycle,
and not just production but sell as well, so they're
trying to force out they're trying to product the engine

and bushes all straight to an electric.

Besides motorcycles, what are some of your hobbies.

Speaker 7 (01:03:45):
I do a lot of things, and I'm a mechanic
and I love working on cars. I love peeping with
my bike, modifying my bike, my cars, my trucks. I
bought a jeep. I just put thirty ones on it,
bought new front rear bumpers.

I love playing with my kids. You know, my kids
enjoy going with me to do things like yesterday with
a serif he spoke up earlier this morning, my kids
were there. They loved it. But I spent a lot
of time with my family when I'm not at work

Then I grew up on a drag trip. My dad

boss owned a truck to be built it for a

just strange. You know, I've got the only the size
of coconuts when they're built properly. Now, I've never really
cared for somebody taking a classic and you know, just
trying to turn it into this this modern thing. I

fuel injected engine and the Okay, fine, I get that,

Man? I paid one hundred bucks of that car, put

So here's a question when it comes to like, are
do you wait, do you do resident? Do you do
a commercial or like personal car mechanic stuff?

I work for a little owner operator shop okay in Tulsa,
and we don't we're not a We're kind of do both.
So we have a few commercial clients, but most of
what we do is just people's cars.

Speaker 1 (01:09:34):
Yeah, I get. I just didn't want to ask a
qu if you worked on rigs. I didn't want to
ask a question that would So what's a myth about
car maintenance that you wish everyone would stop believing?

Speaker 7 (01:09:47):
So they're I mean, maintenance is pretty pretty well maintenance.
There's not really a bunch of myths about it. I mean,
you do need to change your oil cula stuff like that. Honestly,
if you follow what's in the owner's manual, which is
one thing people don't do anymore. They buy a car
that don't read their owner's manual. Don't just listen and
what people tell you break that owner's manual. Out read

(01:10:07):
your maintenance. They'll tell you when you need to change
your oill, how often you change your coolant, your transmission flush.
Anytime you hear squeaking a break, drive that far into
the shop. If you're not going to restate yourself, it's
all your break PABs are getting low. I don't know
how many times we get a car in here? Is
that all it's just noisy breaks? No, it's not. Your
breaks are metal to metal. Man, you have no no

pad left. But honestly, I mean I don't really hear myths.

Speaker 1 (01:10:37):
Okay, So I mean, what's what's one of your favorite
customer stories where they bring a car in and they
say car is doing X, and then you come to
find out it's something really ridiculous.

Speaker 7 (01:10:50):
I actually had one last week. We had the sweet
little lady brought a car in and she was like,
I need knew were breaks they're squeaking And it turned
out I pulled the real wheel rough that car and
she swore up down and needed brakes. And she's just
the sweetest lady. There was a rock stuck behind the rotor,

not the size of the marble. It got hung up
behind the desk feaver, and every time you put the
car in reverse, it would just sound like five fitch screw,
almost like a little little girl screaming. And it only
happened in reverse though, But it ended up not needing break.

I pulled that roader off that car and that rock
fell out and I picked it up and it was
the size of the marble, and I was like, good grief,
how does she even get this thing in there?

Speaker 1 (01:11:43):
I have one final question for you, man, about being
a mechanic. Of the people I know that are mechanics,
some of them create their own, like invent their own
tools or modify a tool. Have you ever created or
invented a tool to help make a job easier for you?

Speaker 7 (01:12:00):
We've we've done a few here and there, you know,
We've we've cut some wrenches down, we've been them and
heating them up, and we've also shaved them to make
them more in a thinner because sometimes you just can't
get in that space with a regular wrench that you
buy off the shelf because it's just too thick, so
do things like that, and sometimes you just got to

(01:12:22):
get creative. Man, the way they build they build these
cars these days, they make it harder, harder to work on,
so there are just no spakes. So yeah, I'm want
to say we we've built a few tools here and there,
you know.

Speaker 1 (01:12:35):
Yeah, yeah, I don't understand any of that. So I'm
just not I'm just not a mechanic basically. Sometimes it's
just too thick. Yeah, And I have one more I
just thought a homer question I want to ask you
and that and that is what is the repair You
couldn't figure out that it keeps you up at night
that you had to ask somebody else to help you

figure out.

I mean, there's not really one that keeps you up
at night, because when you're work in a shop like
I do you just yet it's like a family, maybe
all work together. It's so there's not really one that
you don't that keeps you up at night because we
always do whatever we can to figure it out. And
there's not a lot of times the vehicle leaves our

shop that we couldn't figure it out. We either figured
it out and it's not something we work on like
shop I work out.

We don't.

We don't fix transmissions. We'll we'll do like flush and
filters and stuff like that, but we don't break your
transmission apart and rebuild or nothing like that. So there's
cars that leave here that need to go to the
transmission shop. But anything else, you know, if it's something
that we work on, we figure it out one way
or the other, and we all just lean on each

other so that things like that just don't happen.

so thats more than four times a week even uh,
and that requires there to be a lot of chicken farms,
and for some reason, nearly six hundred million chickens go
miss seen each year. What six million chickens just vanish

They escape, just free roaming chickens, which sounds crazy, I know,
but down in Key West they have chickens just roaming
the streets wherever. All They just that's that's like their
their town animal. It's just so many, so bizarre.

Yes. In twenty twenty one, five hundred and fifty six
million chickens in the US died at hatcheries and on
farms before reaching the slaughterhouse, and then their cocauses go

forty one million never entered the food supply chain, either
because they died during transport to the slaughterhouse, were slaughtered
but deemed unsafe to eat do to whatever reason like

chickens that are never consumed six percent of the nine
point eight billion raised to eat every year. It's a

to ten years, did it land on me how many

that if you have something like that and you want
to protect your assets. A prenuptial agreement is the way
to do it. And you know there's certain things you

can and can't put in a prenup. You know you
can't put people like children in a prenup, but as
far as everything else, it's pretty much fair game. So
you know, if you've got questions about that, you want
to protect your assets because you've worked hard, and while
you love the other side, you know, we never know
it's going to happen in the future, right, and so

Here's a question we've never talked about when it comes
to prenup. If you are the one being offered a
prenup to sign, is it a negotiation?

you want to understand that if you're presented with a prenup,
First of all, it needs to be way in advance
of the wedding, Okay, and at least several weeks show.

Well, you joke and you laugh. The number of people
that sign these things on the church house steps is unreal.
And the problem with that is is that you've got
this issue of is it coercion, is it force? You know,
are you forced to sign it? Because the person is saying,
if you don't sign this right now, all this is

(01:32:39):
called off, we ain't getting married. Well that's coercion, all right,
that doesn't work. You can't force somebody into signing these things.
But the number of people that are it's it's staggering.
I actually did a national continuing education thing for lawyers
across the US about pre nups and the number of
people I talked to in another states that have dealt
with these issues, use of people signing on the court

(01:33:02):
on the on the church house steps is unreal. And
so you run into problems there because down the road,
when you do decide to get married or excuse me,
divorced and something falls through, you fall back on the prenup. Well,
was the prenup entered into mutually? Was it entered into legally?
Was it entered into without any force of coercion or force?
I mean, it's really hard when not to want to

(01:33:23):
sign something right away when you're on the court on
this I keep saying Qutter on the church steps being
told you're not going to get married, which is something
you've been planning for for I don't know how many
months and paying how many tens of thousands of dollars
for these super expensive weddings now just to be told,
if you don't sign this right now, we're not getting married.
I mean it's that's coersion and that's a problem. So
first of all, you want to sign look at it

(01:33:44):
way in advance, number one, if you're number two, if
you're number two, if you're presented with a prenup, all right,
you want to have an attorney look at it right.
Don't just trust your own skills to make sure that
things are correct and the way you want it to be.
You want to hire an attorney to look at it
with you and through it and make sure it covers
everything you wanted to cover. Or saying look, you know,
I don't agree with this, or I don't agree with that,

(01:34:06):
or I want to add this, whatever that may be.
You want to have an attorney help you through that
so you know exactly what your rights are and what
they can and can't do, so that no wolves pulled
over your eyes. The number of people that don't hire
an attorneys and sign these things again staggering again. I
think a lot of this is coercion. You know, you
don't no one ever wants to think about. Like for example,
when my wife and I got married, we were poor

(01:34:27):
college kids. Okay, we didn't have anything, so we didn't
need a prenup, right, we didn't literally didn't have anything.
But people who are getting married, especially when they're older,
they've worked hard in their careers. They've bought property, they've
owned businesses, they all these other things. You want to
protect those assets, and a prenups a way to do that,
but you want to do it the right way and
not force the other person to sign it. You know,
at the last minute, you want to do everything properly

(01:34:50):
because when you get to that divorce, if you get
to divorce and those issues come up and says, well,
I was forced to sign this because I was told
if I didn't, we weren't getting married. You got a
problem now with the prenup, and now your stuff is
potentially open for grabs.

Speaker 1 (01:35:02):
So we do it the right way. The person offering
the prenup has should also have a responsibility of making
sure there wouldn't be a catch later by doing it
on the steps of the church, right, And what would
be just quickly. I don't want to go too much
into it because people can call you if they want
to get into the weeds. But what is something most
people who are offered a prenup overlook that they should

(01:35:24):
re counter back with, like a duration of type if
we've been together ten years, this dissolves. I mean, what
would be something you would recommend.

Speaker 9 (01:35:32):
As far as what like to negotiate back? Well, I
mean you never know if. I mean, first of all,
everyone ers enters into marriage with the idea of well,
we're not going to get divorced, or we don't want
to get divorced, or we hope it don't get divorced. Right,
I mean, no one, no one enters into marriag quoting yeah,
I'm gonna be divorced in five years, that's my goal.
I mean, no one does that, right, So it's hard
to plan ahead and think, well, what if we get married?

(01:35:54):
You start playing the what if game? All right, It's
like playing the what if game with my eleven year old.

Speaker 7 (01:35:58):
All right.

Speaker 9 (01:35:58):
You can get into these if what if, would, what if?
What if? And the problem with that is is it's
hard to plan for every single scenario. The idea behind
it is to look and see, if you get divorced,
no matter when it is all right, what stuff do
you want to protect? All right? And so that's what
you've got to get in and figure out. You've got
to make a list of all your assets, all the
things going on that you want to include properties, you know, businesses, stuff,

(01:36:24):
whatever it may be you want to you have to
list all those things out. That says, if you get divorced,
you walk away with this, and the other side walks
away with this, whatever those items may be.

Speaker 1 (01:36:33):
But to the person's tax that came in, if they
want to safeguard all the things they're bringing into the marriage,
can they one hundred percent safeguard them?

Speaker 9 (01:36:40):
You can try absolutely, I mean we can definitely try
and do that. But we've got to look and see
what those assets are. I don't know. I don't know
everything that he has or if she has, or whoever
it is, I don't know. And so we've got to
look at it and see, well, is it something we
can include or is it something we can't include? Right,
We've got to go through step by step, and that's
why you want an attorney to do these things. You
don't want to go online and do rocket lawyer and

(01:37:00):
also their craft that's out there to draft up your
own prenup. All right, most of the times those things
are wrong. Even though they say they're state specific, they're
not all right. So with that being said, you want
an attorney to draft it up. So please, if you're
thinking of doing this, give us a call. We've been
drafting up a lot lately. We'd love to help you out.

What if you don't have anything, but you know the
other party has substantial debt. Would a prenup safeguard you
from taking her?

Speaker 9 (01:37:23):
Yeah? Absolutely. I mean you can put in there that
any debt you walk into, any debt you walk into
at the marriage, at the time marriage, anything it's before
the marriage, is all on the previous person.

Speaker 1 (01:37:32):
Yeah, so it's it's mostly seen as a thing to
protect your assets, but it can also be a thing
to not have to take on the other person's pay.

Speaker 9 (01:37:37):
I mean, there's all sorts of protections that the prenup involves, absolutely,
and most people don't think about it. Not everybody needs
a prenup. Okay, let's let's just throw that out there
the example I gave. If you don't have anything, you
don't need a prenup, all right. I would only suggest
prenups for people with very large assets and lots of
or businesses or whatever it may be. Now, that's not

(01:37:58):
true for everybody, everybody. You know, some people may want that,
and prenups are a good tool, but they're not necessarily
for everybody, not every I'm not saying that every person
out there that gets mary needs a prenup.

That's not it, right, You should consult legal advice to
make sure if it makes sense for you.

Speaker 9 (01:38:12):

lot of holes here. I mean holds serve with.

A DNA part of it. Because you've addressed this before
when people find out they are the father.

Speaker 9 (01:38:35):
Right, so you know, if you do a DNA test,
all right, you want to make sure that it's done
at a facility, all right, You don't want to use
the ones at CVS and Walgreens. I'm not saying those
tests are bad. I'm not saying those tests are not accurate.
I'm merely saying that those tests cannot be used in court. Okay,
So with that being said, you want to make sure
you do it at a facility that is licensed to

(01:38:56):
do these things. There's three or four here in Tulsa
that do it. I know other bigs have all multiple
different places to go. But you want to make sure
you get an actual lab test done rather than something
that you buy at Walgreens recivs all right. Main reasoning
is that the nations, no matter what nation it is,
if you're trying to get on their roles, is going
to require that directly from a facility, not from a

(01:39:18):
home test Number one, number two. As far as you know,
you got to get into these weeds, and it gets
very confusing, and every tribe has a little bit of
different requirements and all this other stuff. You know, some
some tribes have blood amount requirements. You have to be
X number percentage and all these other things to prove.
So you have to first and look and see is

(01:39:39):
this we're doing. I don't know this person's heritage. Maybe
his dad is full blood. I don't know. We'll have
to figure that out, you know. But whoever this is,
give us a call. We can work on getting that done.
But it is a process and it's not something that's quick.
It's not something that necessarily easy. It can be done.
We've done it all. We've done several of them, but
it does take some time. So understand that we can
make that happen. Again, I don't know ho this person is.

(01:40:00):
I mean are we talking, are they teenager? Are they
in their twenties or and then the fifty I mean,
we've got to find out all these things. So whoever
this is, please give me a call. I'd love to
help you walk you through it a little further and
find out what's going on.

What would be the benefit of, let's say they are
an adult, what would be the benefit of getting your
father on your birth certificate? Just ceremonial at that point.

Well, I mean, in this case, when you're talking about
getting on a native role, okay, you've got to prove lineage,
all right, And so that means proper names have to
be on birth certificates. You can't just say well so
and so is my birth certificate, but he's not really
my dad, and my real dad is the one that's
the native, and so you know, you've got to get
those things cleared up so you can very clearly show
the lineage that goes on. Other thing too, is about

(01:40:42):
being on a birth certificate is let's talk about non
native things, right, So if that if dad were to die,
all right, now you're part legally, you're legally part of
his estate and so not a state, but his familiar
line that deals with the issue of his estate when
he passes away. So you know, there's all sorts of
advantages and things you would want to have on there,

(01:41:03):
but it can get deep in the weeds, and so
you want to give us a call so we can
help you through that.

So what's the question in there? Let's say one more time,
do I.

Speaker 1 (01:41:44):
Need to continue the therapy? We've been going to reunification
therapy for eight months and she has not shown up
and refuses to respond to my lawyer or the therapist.
Let's talk about me therapy part of that. And because
most people might not know what reunification requirements.

Speaker 9 (01:41:57):
So reunificate. We kind of use two terms synonymously. Okay,
So you've got reunification and you've got reconciliation. They're basically
the same thing. Okay, we use them interchangeably, just like
you know, lawyer and attorney. It's an interchangeable word. And
what we mean by that is when you've got a
child that has not been around a parent in a
long time, or has never met the parent, and the

(01:42:20):
parent is now coming out to try and get some
sort of legal rights or to get some visitation or whatever.
It may be you don't just take the kid and
throw them in the deep endo the pool and hope
they survive emotionally or mentally. All right, So we have
this thing called reunification slash, you know, reconciliation therapy, all right,
where the idea behind it is is to very slowly
bring the child and the parent together so it's not

(01:42:42):
a mental shock and emotional shock and all these other things,
and you very care for lean very slowly reunify them
or bring them back together so that they're able to
have a normal relationship. Now, does every reunification reconciliation therapy work,
Absolutely not. I mean you can try and try and
try and try with this is I'm talking about with

(01:43:03):
someone who actually shows up, all right, And not every
kid is going to want to reunify with that parent.
I've had several who say I want nothing to do
with the other side, And that's kind of how it
has to sit until the kid turns eighteen, and then
that parent can try and do whatever they want to do.
But then you've got people like this who just don't
show up. Now, if you're not showing up, there's no
there to be the therapy to be had.

Speaker 1 (01:43:26):
Not really.

Speaker 9 (01:43:26):
I mean, if the other parent is not showing up,
there's no reunification, there's no reconciliation, there's nothing simply because
you've got the other side failing to show up. So
you know, if but is it an order of the court.
That's where you kind of give in this gray area
because you want to follow orders of the court no
matter what they say. Right, that's the idea is you
don't want to defy a court order. Court order is
there for a reason. A judge has authority and the

(01:43:50):
power to say, look, you have to do this. But
then you've got these issues where you've got the other
side not showing up, and if they're not talking to
the attorneys, this person who's failing to show up, someone
needs to file something with the court to end the
reunification therapy. That would be the cleanest way to do it. Now,
could you just stop? Yes, absolutely, until mom shows up
out of the blue, whenever that may happen, you could

(01:44:13):
do that. But if you want to make it one
hundred percent clean, you would follow a motion to end
it simply because mom's not there, Mom's not doing what
she wanted to do. She's not or she claims she
was wanting to do to reunify with his kid.

seen a will and I don't believe my wife has either.
Can the aunt legally withhold the account?

Well, the question comes is is is everything tied up
in probate at this point? What has happened? Because when
people die with wills or without wills, all right, trust
her a different thing, all right? When we're talking about
those situations, then the estate has to go through probate,
all right. So the question is is is this in
probate right now?

Speaker 1 (01:45:17):
And probate is and you section of the courts, right
It's like family laws exactly.

Speaker 9 (01:45:21):
It's a section of the court. It's just the section
of court that handles when people pass away. And we
have to deal with their estate. What are we going
to do with it? Or their bills or their debts?
You know who oat gets what? That kind of stuff, right,
and there's loss to handle that, But I'm guessing it's
probably not because it sounds like these people haven't had
any notice about a probate hearing. So that's the first
thing is is give us a call so we can
figure out if it's in probate, and if not, we

(01:45:42):
need to get it in probate so we can start
dealing with this issue of this money that was left behind.
Because the question also becomes is does this was it husband?
What does it hurt?

Speaker 1 (01:45:51):
Is why wife's grandpa passed away?

Speaker 9 (01:45:54):
Right at the end, right her aunt? Does her ant
have a power of attorney over the estate? Did her
did her aunt have a power of attorney over the grandpa?
I mean, there's a lot of holes here. We need
to figure out all those things because if she's got
a power of attorney and it hasn't gone to probate,
there's problems and we need to deal with those. We
need to get in into probate so that she can't say, well,

(01:46:15):
I've got power of attorney I'm just gonna do what
I want with the money, and I'm going to go
blow it on a boat or a you know, trip
to Rome or whatever it may be. You don't want
all that stuff to happen, so please give us a
call so that we can have this dealt with and
help you figure out where things are at to get
you the money that you were promised.

Speaker 1 (01:46:31):
But the aunt can can't legally do it, but she
could absolutely do it because it would have to go
to probate for any of that stuff to be executed. Right.
You do not know about it until it's brought forward, right.

Speaker 9 (01:46:41):
At which point she's going to be in trouble and
have a lot to answer for her. She's not done
what she needed to do.

Speaker 1 (01:46:46):
So is that criminal?

Speaker 9 (01:46:49):
I don't know. I'd have to look that up. I
mean it's it's it's obviously not elder abuse because the
person has passed away. Is in a misuse of funds potentially,
But you know we before I spout off, it's criminal
and I need more facts.

And how many times does someone come forward and say,
my grandpa told me before he died X y Z,
and then there'll be no doctor.

Speaker 9 (01:47:09):
It's very common I mean it's very common where you know,
you've got that where Grandpa said this or Grandma said that,
and I'm supposed to get this, and I was supposed
to get you know, grandma's silver bowl that was you know,
left to her by Napoleon bowling apart, whatever it may be.
All right, there's a lot of that. It's very common, okay.
But the problem you run into is is that when
you get people that start fighting over stuff and especially

(01:47:32):
money obviously when someone passes away, that's when you've got problems.
That's why we have probate courts so that we don't
have these arguments, so that a court can help them
through these issues and make sure everything is done a
legally and b fairly.

Speaker 1 (01:47:44):
I know when my I was taken out of my
grandmother's will, I was served with papers and to inform
me that my name was going to be removed unless
I had took issue with it and I had an
option to fight it and go to court or just
say that's fine, correct, But they have to inform you.

Speaker 9 (01:48:01):
They have to inform you that's right. And then of
course when you if you find out later that you
were taken out of the will without notice you have
a right to contest it, so there's all sorts of
options for you. We just and you know, maybe grandpa
had a will and it's just that this lady hasn't
seen it.

You know.

That's what we got to find out too. So please,
whoever this is, give us a call. We'd love to
help you get all straightened out.

Last one here it says I'm getting divorced. We split
two years ago, but just filed for divorce. My husband
sold the house almost immediately when we separated and bought
a new home. Can he do this well?

I mean, the problem is you've got stuff that happened
prior to the divorce that was filed. All right, number one.
But the other issue is is you know where was
there equity in the house? Was there not equity in
the house. If there was equity in the house, did
he pay her her equity share? Did he keep the cash?
I mean, again, lots of holes in it. And that's okay.
