some and they were amazing.

Knicks had a huge run late in the game. The

in house legal expert working the Karen Reid case. Here's
the problem with having Katherine in. Catherine comes in and
we're all so worked up about the Karen Reid trial

It's really simple, okay, Catherine. In my eyes, the trial
reminds me now that it's not TV, it's not a movie.
It's so damn boring. But it was boring until they
played the voicemail from Karen read the night of the killing.

Speaker 17 (27:23):
So you know, this is the interesting thing about the
way that Attorney Brennan is presenting the case and sort
of the back and forth is that after really you know,
tedious witness or you know, cross examination things that they're
voluing back back and forth, then we get these clips.
So he's he's sort of you know, sprinkling them in
throughout the case in a really interesting way. I think

(27:45):
it's very strategic the manner in which he plays them.
But as you said, this is not quote TV, this
is not you know, CSI trials are boring and sometimes
some of the most important evidence, you know, like the
Jessica Hyde who was testifying yesterday, It's very heavy, it's
very monotonous, it's very technical, and even though it's boring,

(28:06):
it has to be gone through.

Speaker 2 (28:08):
How crucial is that testimony about the time stamp of
Jen McCabe's.

Speaker 17 (28:12):
Search, Well, it's more crucial to the defense theory, right
because ultimately, from the Komas perspective, this never would have
been an issue unless it was raised by the defense.
So the first we ever heard about any Google search
at all, never mind what time it was, was from
the defense expert Richard Green, who opined that based on
his review of the data, it happened at two twenty seven.

(28:32):
Then the Comwealth hires two independent experts, they review the data,
they say, no, it doesn't happen at two twenty seven.
That's what time basically the tab was created, and that
the search happened at six twenty three and six twenty four, So.

Speaker 2 (28:44):
It's pretty crucial.

Speaker 17 (28:45):
There was a lot of things in the past couple
of days between the timeline with Lieutenant O'Hara as well
as Jessica Hyde that really go to the crux of
the defense theory, because you know, the timing of things
does matter. If this Google search didn't happen at two
twenty seven, if that's what the jury believes, then you know,
I think it sort of leans away the strength from
the strength of the defense theory.

Speaker 4 (29:05):
But the maniacal voicemail I was frightened.

Speaker 2 (29:08):
Yeah, right, which the fifty phone the fifty phone call,
Oh my god, you know.

Speaker 17 (29:14):
And the interesting thing about that, there's a lot of
kind of questioning about how does that help the commonwealth?
And I think it's important to remember that there's multiple
charges here. So there's a second green murder manslaughter leaving
the scene. If you're looking at the murder charge, you know,
it does it leaves the viewer question and if she
knew she hit him, why would she be leaving these
sort of frantic, you know, voicemails. However, if you take

(29:37):
the murder off the table and you look at a
manslaughter when the allegations really are just that she's drunk
and hit him and that's all they have to prove,
it goes to the level of you know, level of intoxication,
level of anger, frustration, frustration, and what they're trying to
do is paint a picture of like, look at how
she was acting at twelve thirty six, twelve thirty seven,
twelve thirty eight, twelve forty you know.

Speaker 9 (29:57):
On and on and on.

Speaker 4 (29:59):
I'm still having a it's a very small area outside
the house. It looks larger than it is on TV
right and on video. I'm still having a problem with
a house full of people dead asleep with the lights
flashing and chaos right in front of the house and
nobody wakes up.

Speaker 5 (30:14):
Yeah.

Speaker 17 (30:14):
Well, I will say the size of lawn two I
find really interesting because everybody always says it's small.

Speaker 2 (30:19):
And yeh a sealthie kid of like looks pretty big.

Speaker 6 (30:23):
Ten times the size of the concrete.

Speaker 2 (30:26):
Hey, that's a big ad.

Speaker 17 (30:27):
But you know, I think that again, that goes to
what the jury believes about what's happening.

Speaker 2 (30:32):
From the defense perspective, I think it's a reasonable question.

Speaker 17 (30:35):
It's one of the things that I thought about right
on the front end when I started covering the case,
is like, that's kind of weird, Like the people in
the house they don't come out, you know, does that
automatically mean that they are murderers and they didn't come
out because they're covering up I don't know. The com
Wealth basically says, hey, it's five o'clock in the morning,
it's a blizzard.

Speaker 1 (30:52):
It's a nor'east.

Speaker 17 (30:53):
The winds whip and you see there's actually a video
that I we start in the last couple of days
of Karen Leavin Meadows John John O'Keefe's house at five
o'clock or so, and you see on the ring camera
that the wind is it's like sheets of snow and
I so you get.

Speaker 2 (31:08):
Kind of this understanding of what it's actually like outside.
But there was a new witness that was called a meteorologist,
and I thought his testimony was fascinating.

Speaker 17 (31:19):
He was great, and you know why, he just presented
like he's just given his opinion, right, He's not one
way of the other.

Speaker 2 (31:26):
He's interpreting what the weather was.

Speaker 17 (31:29):
You know, what the snow totals were, what when they
were when there was a lot of snow, when there wasn't.

Speaker 2 (31:33):
A lot, But there wasn't a lot of snow overnight,
and that's his testimony. I thought that was fascinating. They
were only in like two or three inches and then
it started snowing hard like you said between five and six.

Speaker 1 (31:43):
That's right.

Speaker 17 (31:44):
So it started to snow. It really right at the
time when John's body is being found, and you know,
the sort of chaos of the scenes starts unfold and
is when the weather really starts to pick up. And then,
as he said, it was the biggest snowfall in January history,
I think twenty four inches. So by the time you
know that goes to also by the time that the
ceart team is searching, there's a lot of snow on

(32:05):
the ground, you know. And and the purpose I think,
aside from the snow for what the Comwalth was trying
to use with mister Gilmot, was the how hard the
ground was, because they're going to call a doctor who
says that his brain injury could only be caused by
you know, hitting the ground or something else like that
couldn't be caused by you know, a fist or a
blunt force object.

Speaker 2 (32:25):
I thought that was interesting.

Speaker 17 (32:26):
So's you know, the these little pieces that are being
tied in together. It's not obvious necessarily on its face
when the testimony comes in, but I think, you know,
Hank Brennan's pretty meticulous, and.

Speaker 4 (32:37):
All the jury needs is reasonable doubt right, that's right.

Speaker 17 (32:40):
And so that so the defense is doing a really
good job. I think of you know, poking host, poking host,
poking holes in each witness. And the way I try
to explain it when I sort of think about reasonable
doubts people, is we think about each piece of evidence
as a brick, right, and so the com wealth is
using all these bricks to build a wall, right while
so high that they've proven the case. And the job
of the defense is to, you know, like Jenga, poke

(33:03):
the hole. So the question is are you able to
poke the poke enough holes that you you know, prove
that they can't show up beyond a reasonable doubt? And
I mean I think they're both doing These are very
you know, highly skilled, trained attorneys, So they're all doing
a really good job.

Speaker 3 (33:17):
Now it's topic time with Billy and Lisa.

Speaker 2 (33:20):
In the morning.

Speaker 4 (33:21):
Yeah, we've got Catherine Loftus in studio. We're talking about
we're breaking down the Karen retail. Quick question. Okay, Catherine,
So when you watch the trial, the same people are
sitting in the same seats every single day all day.
How can they do that?

Speaker 17 (33:39):
You mean the in the audience. Yes, Yeah, So there's
a little bit of a rotation in the Okee feel.
It's sort of the same groups of people, but they
rotate in and out. Sometimes if you pay attention, there's
you know, people there in the morning, then they do
the afternoon.

Speaker 6 (33:52):
But how do they work?

Speaker 4 (33:55):
Yeah, well, nobody works well.

Speaker 17 (33:56):
I think if you look at both sides right that
this is from the Oki side. These are people who
you know, are were John O'Keefe's friends, so they make
sure that there's enough people that you know, they're taking
time off. And then on the red side, I mean
their daughter friend is on trial for murder. So people,
you know, people make it work when you have somebody
close to you who's going through something like this.

Speaker 4 (34:16):

So my question is how important was it when the
name When Ryan Nabel was on the stand and he
talked about John o'keith not being seen in the.

Speaker 24 (34:39):
Car when they drove by, doesn't that mean he was
in the house.

Speaker 12 (34:43):
If he wasn't in the car. Doesn't that help the defense?

Speaker 17 (34:46):
So I thought Ryan Aga was actually a really interesting
witness because I think you could put him as a
plus for both both the prosecution and the defense because
two things. He testified that he saw nobody walk across
the driveway. He didn't see a man, you know, come
from the car into the house, so that would help
the commwealth. On the converse, like you said, Jamie, he
also testified that he didn't see anybody in the passenger seat.

(35:09):
He just saw the dome light on and a female
in the driver's seat, so either way, he doesn't see him.
But he also gives the opinion that you know, no,
he wasn't in the car, but no, he didn't go
in the house either, So you could really take that
piece of information and argue it both ways.

Speaker 4 (35:24):
Great question, Jamie, Great, great boy. Our talkbackers in college

Speaker 5 (35:34):
Yes, Hi, Catherine, I'm curious actually taking from what was
just asked, if Julianna, Nagel and Levinson's testimony seemed, you know,
really credible both in the first and in the second trial,
and what kind of holes can the defense folk in
those testimonies, because it really seemed like nobody was in

(35:58):
the house. There was no fight arguing what are your
thoughts on that?

Speaker 17 (36:03):
So Julie Nago hasn't yet testified in the second trial,
but Sarah Levinson din as a reminder, those two individuals
were friends with Brian Jr. And we're in the house
from you know, sort of the evening hours on throughout
the night, and then they left with Jen McKay, you know,
approximately one one point thirty. You know, I think it's
that's a fair sort of evaluation of their testimony, is

(36:23):
these are it you know, these are independent witnesses. They're
not part of the McCay family. I understand that they're
friends with the Alberts, but you know, what you need
in order to believe that they're you know, not telling
the truth is that they're up there on the stand.
You know, everything they're saying is false. That somebody actually
did come in the house. They've been through quite a
few proceedings, not only trial last time, but multiple grand juries,

(36:46):
you know, and so the problem from the defense perspective
is that there is never going to be somebody who
actually puts John in the house in testimony unless they
have somebody who you know, in their own case in chief.
So I think it's pretty powerful evidence from the calmwalth
and difficult in some ways to robot from the defense.

Speaker 4 (37:04):
Boy, you're good. You should have a TV show. Let's
go to Lisa implement Lisa question for Catherine.

Speaker 24 (37:18):
Hi, Good morning, Catherine. So I am calling because how
is it with Jen McCabe and Carrie Roberts explaining that
Karen's running around acting like a lunatic and crazy and
carry Roberts, you know, swears at her to shut up?
How come nobody's pointing out the fact that that's kind

(37:39):
of a normal reaction if she just found her boyfriend
laying on the ground all bloody, possibly did that would
be anybody's reaction to be running around like kind of
frantic like that and screaming at somebody, you know, to
call for help, and you know, asking questions like what's happening?
Doesn't that seem like strange that they're not pointing that
end out?

Speaker 17 (37:59):
So I think you're totally right, because you know, whatever
way you look at it, right, if you're if you
believe that you know the Komo's case and that she's
guilty or you believe she's innocent. Either way, the reaction
of finding somebody that you love and care about basically
deceased in the snow in this sort of chaotic circumstance
is going to evoke this type of emotion, Right, So,

(38:22):
I'm not surprised that she's hysterical, that she's screaming, that
she's yelling, you know. The question I think becomes about
that specific reaction is more so before they find John O'Keeffe, Right, So,
before they find him, Carrie and Jen testify that they're
basically like, she's drunk, she doesn't know what she's talking about.
We're gonna find him in the house. Why is she
so hysterical? So what the Camwald wants you to believe that,

(38:44):
you know? Okay, it's one thing if she's acting like
that after John o'keith's body is found, why is she
acting like that beforehand?

Speaker 1 (38:50):
Different?

Does she know?

If she just dropped him in the house a couple

So I was wondering, I'm following the case. And Ryan
Nagel said that he saw he didn't see John O'Keefe
in the passenger side when they pulled up, but the girlfriend,
his girlfriend said that she did see him in the
passenger See, how does that correlate, like it's conflicting.

Speaker 17 (39:24):
Well, I think it's it's a good example, right in
a reminder to everybody that most of these witnesses who
testify about the events that happened that night had some
form of alcohol. That memory is really an interesting thing, right,
eyewitness testimony. Most of our memories actually don't line up
exactly with the other. So I actually think it's more

(39:46):
reliable that if you have two people to counter one person,
you know that they vaguely remember the same scene, the
vehicle there, you know, the dome light on pulling up,
speaking to Julie. But then they have small memories that differentiate,
and I I think that actually goes to that it's more.

Speaker 2 (40:02):
Consistent, right.

Speaker 17 (40:03):
You don't want to have witnesses who exactly line up
everything's exactly the same, you know, And it goes to
I don't know the timeline of if she saw him when.

Speaker 2 (40:12):
Was That was obviously before the vehicle was still there.

Speaker 17 (40:16):
So I think theoretically in the Comwall's case, they could
have seen him near the car and then the incident
happened after if you took you know, if you take
that cases the facts all.

Speaker 4 (40:24):
Right, Carolyn's been on hold for a while in Wakefield.

Morning, thank you for taking my call.

I've got a question.

About former trooper Michael Proctor. Why aren't they referring to
him as former trooper Michael Proctor to get into the
jury That kind of questioned like, oh, why doesn't Why
isn't he working for the state police anymore? Also, is
there a chance that he'll get on the stand again,
and if he does, any chance because he kind of
got nothing to lose now, that he might open up

(40:55):
a whole new can of worms.

Speaker 17 (40:57):
Well, you know, they have excuse me, has a few
times thrown in the words former. And that's what they're
trying to get the jury to pay attention to, is
that this isn't a state trooper. Now, obviously something happened,
they haven't learned of that quite yet. You know, we
were just talking about whether he's going to be called
and when, you know, I think I think he will
be called, because it just looks like to the jury

(41:18):
who you're trying to convince that if you don't call him, you're,
you know, trying to hide the ball, or you're Sometimes
what happens is if you know the train's coming, you
do everything you can to stop it. So I think
Attorney Brann has to call him and put everything out there.
The interesting question about whether it opens up more of
a can of worms, you know, there is an argument
to that that you know, I don't know. Could he

(41:40):
say something else? He's not under he's not a state
police officer anymore. He's essentially testifying, you know, and he's
now a civilian. So could we hear more about what
he saw or what he knows? I mean, he could
let that slip on the sand.

Speaker 4 (41:53):
Justin, let's get a couple of talkbacks in quick, Dave,
hold on for a minute on the phones. Okay, talk

Okay, So I work in news, and obviously working in news,
I've noticed that every single day, after you know, test
somebody concludes Karen will walk out and she will say
something to the media. Now, in your opinion, why do
you think her lawyers keep letting her say something or

(42:18):
you know, let her give her input. Isn't it probably
like a bad idea that she keeps talking.

Speaker 6 (42:25):
That's a good question.

Speaker 4 (42:26):
They say, what you say can be used against and
they have been playing them right and talk.

Speaker 17 (42:32):
So from a technical perspective, normally it would be the
lawyer's talking, but they're all under a gagg on to
both the colmwealth and the defense, so they can't say
anything about the case. Right, So last year when they
came out, it would always be David Natty or Alan
Jackson answering questions. So Karen has really become like the surrogate,
you know, representative. It's like with everything else in this case,

it's so unusual. It's I find it odd that they
still allow her to talk. After know, in theory she
could say something outside the courthouse that could be used
in trial, which seems, you know, really wild, but you know,
nonetheless they persist.

she drops him off, he goes. The defense is saying,
he went into the house. I thought there was a
potty going on in the house. So did he go

in the house. And my concern is the dog bite
or the bits on his arm? Right, So if he
was in the house and he took off his jacket
and he got bet up and killed and the dog
was grabbing at his arm and stuff, where's the guys
when he was found outside, did he have his jacket?

Nobody's even brought up the jacket.

Speaker 2 (44:06):
So we have I think we'll hear.

Speaker 17 (44:08):
A little bit more about the specific specifics of his injuries.
But when he was found he had like a light
you know, like a zip up hoodie sweater on. He
didn't have a winter jacket on him relative to the timeline.
So what the defense theory is is that he did
go in the house, that he was assaulted, there there
were dog bites, and then somebody you know, brought him
out and put him on the front lawn. And they

(44:31):
are using essentially interpret their own interpretations from their experts
of data that they say puts John in the house. Again,
there won't be any there's not going to ever be
anybody who testifies that says John in the house. On
the contrary, there's going to be a number of people
and have already that say John did not go into
the house. So the uphill battle for the defense is

not only to put him in the house, but to explain,
you know, his injuries the other right, which they say
was caused by a dog.

Let's face it, an assault any kind is going to
trigger most.

Speaker 17 (45:01):
Dogs, you would think, so, I mean, especially a German shepherd,
you know, you know, And I think we'll get more
into what his you know this allegedly last time we
heard about this microscopic pieces of taillite in his sweater
that he's found with. There's no dog DNA on his arm,
so that's we haven't heard any of that really yet.
