Up first, like I mentioned, we're going to talk about
the huge US Supreme Court case that was just handed
down where a six to three majority comprised of the
Conservative majority and the Supreme Court ruled in favor of
red states that have restricted or banned gender transition treatments
for minors aka child sex changes, like puberty blockers and

hormone therapy, and ruled against the ACLU and a number
of plaintiffs who argued that those were unconstitutional violations of
the Equal Protection Clause. And guys, well, I certainly agree
with this ruling. Some people in the LGBT movement, particularly transactivists,
are absolutely losing it over this. First, here's some reporting

from CNN that's surprisingly fairly neutral to get you caught
up on the facts of what went down.

The US Supreme Court has just upheld a Tennessee law
that bans gender affirming care for minors even if it's
prescribed by a doctor. Our chief Legal Affairs, Course bout
A Paula read is following all these developments. Firus Paula,
What can you tell us about the Supreme Court's decision?

Well, if this is one of the big cases we've
been watching this term because roughly half of states have
a ban that is similar to the one in Tennessee,
and this focuses on access to certain medications that can
facilitate a gender transition. After Tennessee band miners from Axis
sing these medications for this purpose families of transgender youth,
they brought a lawsuit saying, hey, this violates the equal

protection clause because other miners who are using the same
medication for different purposes can still have access to it.
But today, in this six' to three, decision it fell
along party. Lines The Supreme court affirmed this law In
tennessee and in the, Majority Chief Justice John roberts, wrote
this case carries with it the weight of fierce scientific

and policy debates about the, safety, efficacy and propriety of
medical treatments in an evolving.

Field now we'll turn to the extremely bizarre and unhinged
reaction to this decision across The, internet but particularly on
websites like blue sky and. TikTok in my personal favorite,
example The harvard law instructor and former congressional Witness Alejandro
carabaio tweeted in response to, this OR i guess blue

skied in response to, THIS i honestly don't care anymore
if this country destroys itself and burns down to the.
Ground the current form of The United states is incompatible
with democracy or human. Rights it no longer has any
chance at legitimacy to, govern And i'll dance on its.
Grave let something better rise from the. Ashes, Uh alejandro seems.

Stable seriously imagine wanting to burn the entire country down
and start over because roughly half the states aren't going
to be allowing child sex changes and The Supreme court
ruled that it's legal for them to do. So slightly
disproportionate response there even if you disagree with the ruling,
deeply WHICH i absolutely do. Not to be, clear now

we're going to get to the response On TikTok and
across the. Internet for, example here is transgender Activist Aaron
reid responding to the ruling On.

TikTok The Supreme court just ruled that transgender people have
no constitutional protections whenever it comes to the medically necessary
care that we. Need this is the same logic that
was used In loving Versus, virginia where The state Of
virginia tried to argue that it wasn't banning black people
from marrying white, people but rather it was banning interracial
marriage for all races. Equally it's a horrific ruling, Historically

so the only silver lining is that they didn't rule
on broader trans rights. Issues so for, now rulings and
passports and bathrooms and more are still. Safe but it's
clear that this court is intent to dismantle any rights
that we, have not just transgender, people but all.

Minorities so, wow quite the statement, there. Guys this is
WHY i say That Aaron, reid WHILE i have nothing
Against aaron, personally is not a reliable source for Information
sometimes people will send Me Aaron reid's, journalism which IS i,
think deeply suspect and basically, activism and try to cite

points from, it And i'll engage with. Them but, Frankly
aaron is not a good source of. Information i've Found
aaron mischaracterizing laws and bills and studies on many occasions her,
work and in this, CASE i, mean what she just
said is is a clear misunderstanding of the ruling that
also makes wildly untrue and hyperbolic. Claims the idea that

The Supreme court wants to abolish all minority rights totally
for all minorities is just like obviously not. True in,
fact two of the judges in the six', Three Ruling
john roberts And Justin Justice neil gorsich, my favorite they
actually ruled in another case to expand gay and transgender

rights and. Employment law so they, are not, you know
committed to abolishing. All rights they just upheld this particular
case involving state laws banning children from receiving medical sex
changes as legal. And proper the claim that they want
to abolish all minority rights at all just shows that
you are maybe you're letting your emotion get. TO you i,

don't know but you're not analyzing things objectively or. Factually
whatsoever But The supreme court actually ruled was not that
trans people are entitled to no constitutional protections at all
or anything, like that but that these laws which restrict
or ban puberty blockers and hormones from being prescribed to
minors for the purposes of treating gender dysphoria a. Mental,

condition well what they said was that these laws discriminate along.
Two lines age which. Is allowed you are allowed to
discriminate on age in. The law that's not a prohibited
characteristic Under. The constitution and the second one is discriminating between.
A diagnosis so these treatments are allowed in some cases for,

some purposes but not in other cases for. Other, purposes so,
for example it is legal under these laws to prescribe
somebody puberty blockers if they have, precocious puberty a medical
condition where puberty starts for them a few years. Too
early they want to pause it and then let them
go through their birth sex puberty a few, years later

when you know the rest of their peer group does and.
Not prematurely that's, Still allowed but prescribing puberty blockers for
the purposes of treating gender dysphoria a mental condition is.
Not allowed so it's a very basic aspect of regulating
medicine that a treatment can be legal to treat one
thing and not legal to treat. Another thing and in,

this case it's not discriminating against people on the basis,
of sex which is WHAT the acl, you argued because
a person regardless of their sex can't get these treatments for,
gender dysphoria so they can't get them to treat this particular,
mental condition but they can get them if they have
precocious puberty or another one of these. Physical conditions the

sex of the person is not a butt four cause
of whether they can or cannot receive a. Certain treatment
that makes it fundamentally different from something like, interracial marriage
where people are denied the ability to access fundamentally the
same thing because of, their race which is just marrying
the person of. Your choosing in, this case we're talking
about two. Different things it is not honest or accurate

to suggest that giving someone puberty blockers to block their
birth sex puberty and then cross sex hormones so they
go through a puberty resembling that of the opposite sex
in order to treat a mental condition known as. Gender
dysphoria is the same thing as delaying puberty for a
year or two with puberty blockers because of precocious puberty a,
physical condition and then allowing them to go through their

birth sex puberty to treat a. Physical condition these aren't the.
Same thing so that's why the. Lawsuit fail and it's
not because they use the same logic as people who denied.
Interracial marriage and a Lot of aaron's argument just kind
of begs the question assumes things that are actually the
core of, the dispute which is whether these treatments are
safe for kids are. Medically necessary the weight of the

evidence and the conclusion that legislators in many of these
states have reached suggests that they. Are Not but aaron,
just frames, you know they're denying medically, necessary care kind
of assuming what is actually at the core of the
debate as fact when it. Is, not guys now we're

pulled about the kind of unhinged discourse after. This ruling

level bands on child, sex changes we have blood on.

but only for lives that they. Approve of i'm living
proof that it is vital that trans kids have access to.

Of us they're fueling real, world violence especially against trans women.

are somehow to blame for alleged acts of violence against
trans women of color if we oppose child. Sex, changes
no that's. Not true you can't, invoke random statistically dubious
claims about violence as a way of shutting down debate

on a totally. Unrelated issue we of course condemn VIOLENCE
and i almost any advocate of these bands or restrictions
would condemn violence against trans women. Of color so that's
just like a random guilt by association attempt to distract
or emotionally, manipulate us which is unfortunately the broader rhetorical.
Strategy here and you saw this rhetoric echoed by the

way in statements of this will cost, trans lives in statements, from,
many Many many democratic senators and Members of congress after.
This ruling there's just. One problem it's. Not true it's
based on, a lie a, false premise and it's a
bit of emotional demagoguery that's being used to basically smear

and scare people into shutting up and going along with
EXPERIMENTAL and i think unethical medical treatments being given. To
Minors so i'm going to get into the weeds a
little bit, on this but to, be clear this is
a very common argument and talking point that if you
don't allow transgender identifying youth or gender confused youth to

access puberty blockers and, hormone therapy that they will. Kill
themselves and so if you, oppose that you have blood
on your hands because you're taking away medications that, reduce
suicide and you are trapping people in this state where
more of them will. Kill themselves that has explicitly been
the argument many a doctor, has told and this is

even captured in A Recent New york times Podcast Called.
The protocol many a transactivist doctor has, told parents would
you rather have a dead son or a living daughter or?
Vice versa and it's a Very compelling THAT'S why i
have sympathy for parents in. This situation it's a very emotionally.
Compelling argument, of. COURSE nobody i don't care if you're
trans or. NOT trans i don't want anyone to take

that tragic and horrible decision to end your. OWN life
i want you to. GET help i want to personally.
Help you i've struggled seriously with mental health in in,
the past so my heart breaks for, these people and
of course we want what's best. For THEM so i
bristle at this notion, that, like oh if we disagree,
with this we have blood on, our hands we're going to.
Cause suicides because it, is literally factually. Not True and

i'm gonna. Explain that as the Science Reporter benjamin ryan
explained on x only one study has ever directly assessed
whether prescribing cross sex hormones to use with gender dysphoria
is associated with a statistically significant independent difference in the
suicide death rate. Among them this study found no. Such,
association therefore claims such as those that denying such treatment

of minors will lead to suicide are not. Evidence based
in the same WAY the uk is extraordinarily comprehensive cast
review By doctor hillary cass reviewing the evidence and research into,
this subject concluded that it has been suggested that hormone
treatment reduces the elevated risk of death by suicide in,
this population but the evidence found did not support. This conclusion,

in fact this claim that this medication, reduces suicide so
if you restrict access, to it you are causing more
suicides is. So untrue it is so factually baseless that
even the ACLU's, Lead Attorney, chase strangio who is a,
radical transactivist admitted during the oral arguments that there's not

ABOUT that i do think it is clearly established in
the science and in. THE record, i think as with
all underlying questions, of it looking, at evidence there can.

EXAMPLE The cast review only looked at studies up until twenty.

cast report it says there is no evidence that gender

suicide and the reason for that is, completed, suicide thankfully
and admittedly it, is rare and we're talking about a
very small population of individuals with studies that don't necessarily

long term longitudinal studies that do show that there is
a reduction, in SUICIDALITY which i think is a positive
outcome to.

strangio basically just admit it that The main democratic talking
point that these treatments literally stop and prevent suicides is. Not,
true now some will retreat to the idea that some
studies activists point to say that these treatments reduce suicidality

aka thinking and thoughts. About suicide but suicidality is not
directly linked. With suicide, far, far far far far more
people experience some form of suicidality at, some point and
of course we want, that alleviated but it doesn't mean
they will actually end. Their lives only a tiny percentage.

support the claim either that access to these treatment for
minors reduces suicidality or suicidal. Thoughts either, in fact the
major twenty twenty two study that people constantly cite to
support this claim has been debunked By Journalist. Jesse single

data they found showed that when you gave kids puberty blockers,
and hormones their mental health did. Not improve. That's right
it showed the opposite of what the activist authors claimed
and then was parroted in the media in its actual,
underlying data and just through extreme dishonesty and misleading sleights,
of hand they portrayed a totally different narrative than the

way the one that their study. Actually SHOWED so i
just really really reject and resent this emotionally manipulative narrative
where you're trying to blame people, for suicides even though
if they dare disagree with you about the ethics of
a experimental form of medicine. On children but the propaganda

been internalized and they just keep repeating this over and
over and, over again even though there's no factual basis.
TO it i will not fall for that emotional manipulation. And,

used to also uphold a state level ban on gender
affirming care being legal. FOR adults i actually think. THAT'S

be constitutional for states to choose to ban gender transition.
Of adults maybe there is nothing in the constitution that

happen and so my take on, it, is well maybe
they legally could ban this, for ADULTS but i actually

huge distinction between miners. AND adults i do believe adults
should be free to do basically whatever they want with their.

it and advocate against it if states do try to

decision would provide a precedent to uphold a future ban

to me the solution is just to democratically advocate against

compassion for the complexity of a lot of these issues

i know there are some kids who genuinely truly have
extreme gender dysphoria from a very, young age but we
cannot allow the current system to continue where people are
with very little gatekeeping, in safeguards given these experimental treatments
