law, which has not yet been crafted, and common law, which
has to be respected by the judge.
A judge can ignore common law and decide that it's not in his
best interest to rule in that direction.

That's why you're getting these repeated constitutional
challenges until they craft new law, new statutory law, to
prevent it from happening. Remember that once federal law
is crafted, Article 6, Clause 2 applies.
