We have a lot to discuss. There's been a lot of documents
released in the case of the Idaho 4, the four students that
were murdered in their off campus home.

And it's hitting the news. It's everywhere.
I've seen it on TikTok and we need to talk about it.
So I might scan some of these news articles.
But first we have the actual PDFhere of what was filed by the
state. And these have come out because
of court filings by the prosecution.

(02:37):
So we now have as an exhibit a transcript of the 911 call that
everyone has been interested in since the beginning.
It has been 2 1/2 years and I would say this is the biggest
update we have had since this happened.
We do not have the audio. Maybe it would be safe to assume

it's coming, but As for now, we do have the call transcript as
well as transcripts of text messages between the two
surviving roommates on the nightof the murders.
So let's get into this. Jumping right into the
transcript at the top, we have kind of just a key that breaks

down which line is whom, whetherit be the dispatcher.
And it seems as though when the call was placed from the King
Rd. property, there are four different people who got on the
phone with the 911 dispatcher. So it starts out with dispatcher

911 location of your emergency party one.
Hi, something is happening. Something happened in our house.
We don't know what we have. Dispatcher What is the address
of the emergency 1122 No, don't.Dispatcher What is the rest of

the address? 0 Kings Rd.
Dispatcher OK and is that a house or an apartment?
It's a house, can you repeat theaddress to make sure I have it
right? Says the dispatcher.
I'll talk to you guys. We're we're live at the right so

(04:35):
we're next to them dispatcher. I need someone to repeat the
address for verification. The the address 1122 King Rd.
dispatcher. And what's the phone number that
you're calling from? The person on the other line

(04:58):
says what's your phone number? It's also been shared that this
call originated from the surviving roommate BF.
We're going to use initials B FSphone.
So this male who is on the phonesays what's your phone number so
he can give it to dispatch. The next few lines are redacted

(05:20):
as it seems BF is giving her phone number.
In the midst of that this male says what's the rest redacted
Redacted dispatcher. OK and tell me exactly what's
going on. Umm, one of our one of the

(05:40):
roommates who's passed out and she was drunk last night and
she's not waking up. Someone else chimes in.
No, we saw dispatcher. OK, going back to the males on
scene. Oh, and they saw some man in
their house last night. Yeah, another male.

(06:01):
Hi. So we're switching people,
different people are getting on the phone with the dispatcher.
So the dispatcher then says, andare you with the patient?
OK, I need someone to keep the phone.
Stop passing it around now. We are on to a different male on
scene. Can I just tell what happened?

(06:23):
Pretty much Dispatcher, what is going on currently?
Is someone passed out right now?I don't really know, but pretty
much at 4:00 AM. Dispatcher.
OK, I need to know what's going on right now.
If someone is passed out, can you find that out?
He says yeah, I'll come, come on, let's we got to go check but

(06:50):
we have to is she passed out? She's passed out.
What's wrong? Dispatcher dispatching Moscow
Lawn Law ambulance for the male says she's not waking up.
Dispatcher unconsciousness 1122 King Rd.
And then we have some police response saying 70 is in route.

(07:16):
Dispatcher OK, one moment I'm getting help started that way.
Mail on the scene responds OK, maybe some of it's not able to
be made out. It says unintelligible
dispatcher. 1122 King Rd. All ambulance respond for
unconsciousness. 1122 King Rd. Law enforcement ambulance

(07:40):
response. I copy 58 multiple RPS on the
phone advised saying the roommate on scene is passed out
and not waking up. Believe she got drunk last night
unintelligible. It's noted about a male being in
the room with them so RP just incase if you're familiar is

reporting person more law enforcement feedback
unintelligible being around someone else says that I copy
about 20 year old female unconscious trying to get
further copy male on the scene which is one of the guys I

(08:27):
believe that the surviving roommates called over.
He says yeah yeah, it's Evan OK Dispatcher says OK and how old
is she? She's 20.
Dispatcher. 20. You said yes, 20 here.
Do you want to talk to them? Dispatcher.

OK, The phone has now been passed again.
Hello. Hello, Dispatcher.
OK, I need someone to stop passing the phone around because
I've talked to four different people.
This person responds. OK, Sorry.
They just gave me the phone. Dispatcher.
Is she breathing? Hello and this is from the

(09:10):
parties at the home. Dispatcher asks again.
Is she breathing? Response No Dispatcher.
OK updates police response and route.
Then we are back to the parties at the home.
Bethany or Dylan, I need you to to talking to them.

(09:33):
OK? I can't talk to them.
I need you to talk to them, which is one of the other people
on scene telling Bethany or Dylan they need to speak to the
dispatcher and then we have another person on the phone.
OK, hello, question mark dispatcher.
OK, I have already sent the ambulance and law enforcement
stay on the line response. OK, dispatcher, if there is a

defibrillator available, send someone to get it now and tell
me when you have it. Units responding, there's a
response, it's unintelligible. Dispatcher updates the patient
is not conscious, not breathing.Dispatcher says again, OK, if
there is a defibrillator available, send someone to get

(10:20):
it now and tell me when you haveit.
Response. We don't have one.
Then we have law enforcement feedback.
Unconscious, not breathing. Do you have a defibrillator?
And then this is law enforcementor ambulance response that says
Yep, yes, we have one. Then we have the dispatcher say,

but are you talking to the officer?
Response? Yes.
Dispatcher. OK, I'm going to let you go
since he's there with you and can help you.
Response OK, thank you. Bye, Dispatcher.
OK, law enforcement then responds Moscow 46 out
dispatcher says copy we have more law enforcement 13 I think

(11:13):
we have a homicide then we have more law enforcement response.
Moscow Engine 20 is in route Lawenforcement 1370 Law enforcement
70 unintelligible one O 7. I relayed it.
And then at the bottom we have noted this transcript has been

(11:34):
revised with the audio recordingsubmitted and it is an accurate
transcript and this was submitted as an exhibit that is
attached to a motion by the prosecution.
And then we're going to get intothis motion some.
We have, as we know, Ann Taylor,Brian Koburger's defense

(11:57):
attorney. They are fighting everything.
They're fighting the DNA. They have certain words they do
not want mentioned during trial.They don't want the bushy
eyebrows referenced. They don't want words like
psychopath mentioned during trial.
They are filing to try and have these words prohibited from the

(12:20):
trial. We also have an update as of
late that due to one of the filings, it suggests the defense
team may try a sort of defense referencing that Brian Koburger
may be on the autism spectrum. So in relation to this

(12:41):
transcript, the motion that is attached says the statements on
the 911 call are hearsay but fall within firmly rooted
hearsay exceptions and should beallowed.
In general, testimony that is hearsay is excludable at trial.
However, there are many exceptions to this rule. 2

firmly rooted exceptions are Idaho Rule of Evidence eight O 3
( 1. Present sense impression A
statement describing or explaining an event or condition
made while or immediately after the declarant perceived it.
Idaho Rule of Evidence Eight O 3( 2.

(13:27):
Excited utterance A statement relating to a startling event or
condition made while the declarant was under the stress
of excitement that caused it. The requirements of the federal
version of each of these rules are best stated in US versus
Mitchell. So it then breaks down the

(13:49):
required principles to meet these two items which would make
what is considered hearsay admissible into the trial.
And then there's a lot of explanation of all of the
different things that are noted in that Idaho versus Mitchell.

(14:13):
So then coming down to page 4, we have in the case at bar, most
of the of the declarations made were present sense impressions.
HJ, which is one of the male friends that the surviving
roommates called over, located the unresponsive body of
Xanacarnodel and informed BF andDM to call 911.

(14:38):
EA, which is another male friendthat was called over, was
present at the time all declarants personally perceived
the event, IE Kernodle unresponsive.
The majority of the declarationswere describing to dispatcher
Carolina Calvin what they were perceiving, IE present sense

(14:59):
impression. Those statements relate to
Kernodle being passed out and not waking up.
The declarations were made immediately after HJ discovered
Kernodle's body. Some declarations made would
also be considered excited utterances.
Those statements include quote. Oh, and they saw some man in

(15:21):
their house last night. Yeah, End Quote.
As well as the heaving, breathing and crying that can be
heard throughout the call, the declarants were responding to a
startling occasion. Discovery of unresponsive
roommate. The statement regarding a person
being in the home is in direct response to why kernel might be

(15:43):
passed out. All statements are made while
the declarants are processing what is happening and were made
before an opportunity to reflectand fabricate why kernel is
unconscious. Clearly, the statements of BFDM,
EA and HJ and the dispatcher Carolina Calvin fall within the

(16:08):
hearsay rule. Exceptions.
Judge John Judge has already ruled that the 911 call is not
hearsay, IE not offered for the truth of the matter asserted.
And even if deemed hearsay, the exceptions for present sense
impression and excited utteranceapply.

(16:29):
On August 23rd, 2023, defendant move to dismiss the grand jury
indictment. One basis for this motion was
that the 911 call was, quote, improperly admitted hearsay,
cumulative, irrelevant and improper attempt to bolster
witness testimony and quote, in response, John Judge, John Judge

(16:53):
held as follows. Further, even if the 911 call is
hearsay, the exceptions for present sense impression and
excited utterance apply as the statements made by the caller's,
IE, the surviving roommates, HJ and another friend who had
arrived were made immediately after HJ discovered Miss

(17:15):
Colonel's body and instructed the roommates to call 911.
So this is Mr. John Judge, who was the judge presiding over the
case while it was still in Moscow.
As we know, it has now been moved to Boise and there is a

(17:36):
new judge presiding over the case.
Then we also have regarding the emotion in the caller's voices,
Judge. Judge further held that the
evidence was relevant as to why law enforcement was sent to 1122
King Rd. on November 13th, 2022 as opposed to just EMS when the

(17:58):
caller was for quote, unconscious individual.
This testimony was deemed irrelevant to the effect it had
on Dispatcher Calvin and was notcumulative of Officer Nunez
testimony. So I know there was a lot of
confusion when this first happened and it was stated that

(18:22):
the initial 911 call came in as a call for an unconscious
person. And I know from when this
happened to even currently, now that we have the transcript,
there's a lot of questions aboutwhy is there no mention of
blood. There must have been so much
blood in this home. And why did they believe that

(18:46):
Zana was unconscious versus deceased?
And a lot of experts and other individuals who have weighed in
seem to think that as you are experiencing a trauma, your
brain can in a way shut down to protect you.

(19:10):
It's kind of a defense mechanism.
And so it is possible that HJ who went into the home and found
Sienna, his response, his body'sresponse to this trauma could
have been that he didn't notice or not so much notice as be able

(19:35):
to recount this for the dispatcher.
Because all of these individualsare in shock.
And based on kind of the stumbling over words and such
throughout this transcript, it seems that this was a very
emotional call and that all fourof these people on scene, they,

(19:58):
they were struggling. While I do think it's going to
come up that it was reported as unconscious versus what this
scene must have looked like. I don't know that it's going to
be as huge as it may seem it is right now.

(20:19):
So we also in these prosecution filings have received
transcripts of text messages. So it would appear that DM and
BF were texting. Now, this says that these texts
are from 4/22 to 4/24, which given the timeline would be

(20:49):
almost immediately, maybe a little bit after the murderer
left the home, after one of the surviving roommates seen him,
and after everything had happened and this person had
left the home. DM text BF, no one is answering.

(21:12):
I'm really confused right now. DM text Kaylee and says Kaylee.
Another text to Kaylee What's going on?
BF then responds to DM. Yeah dude WTF Xana was wearing
all black. DM responds.
I'm freaking out right now. No it's like ski mask almost BF

(21:38):
response to DMSTFU which means shut the fuck up actually.
DM then says like he had something over his forehead and
little in mouth. Now there are some typos

(21:59):
throughout this and I think thiskind of leads to DM had been
drinking, she may have still been under the influence but
what she witnessed was real. Hence the evidence left that
being 3 roommates and a boyfriend murdered, what she
seen likely did occur. DM then says to BF again.

(22:25):
I'm not kidding I am so freaked out.
BF replies so am I, DM says my phone is going to die.
Fuck. BF replies come to my room run
down here. That's three separate text
messages. So then it would it would appear

(22:51):
The girls then are in B FS room and there are several calls.
They were attempting to text some of the roommates.
They attempted to call some of the roommates.
It's believed that at some pointthey fell asleep and then around

(23:11):
10:00 AM they began trying to call some of the roommates again
and there's no answer. At this point, they reach out to
the two male friends and ask them to come over.
I don't know that this is as bigof a deal as some people have
made it out to be. It seems that these girls were
very frightened. They are getting no response

(23:33):
from their roommates. They reached out to two male
friends and asked them to come over and check and see what's
going on. After that, that is when the 911
call is placed. So we have a more timeline but
now we have more details as well.

(23:54):
And based upon these texts, I did see in another media outlet
on News Nation that when the suspects vehicle was seen
speeding away from the residencewould align with when DM then
becomes scared and is texting BFand they're trying to contact

(24:16):
the other roommates and there's no answer.
All of this coincides and the timeline is adding up.
Then we have some other items totouch on that, you know, the
saga of Brian Koburger and his defense team.
The horrors persist and so do they.

(24:39):
They're fighting the death penalty, as we know.
They really would like it taken off.
Idaho has implemented the possibility of the firing squad.
As we know the lethal injection,it is very hard to get the
medications at times or the correct doses.
Across the US, we have individuals who set on death row

(25:01):
for years and years, sometimes dying of natural causes before
they ever reach the death penalty.
So Idaho lawmakers now are putting the firing squad back on
the table, which has made Brian Koburger's defense team fight
that. Perhaps the death penalty should
be taken off of this case because the firing squad is

(25:25):
inhumane. I have opinions, many opinions
about this. I've voiced them before.
I won't voice them again. Create your own opinions.
Do your own research. Decide how you, the listener,
feel about the firing squad. To my knowledge, there are, I

(25:49):
believe, 5 people and it's unclear necessarily what Idaho,
how they intend to get these five people, but it's five
people. It could be voting citizens, it
could be military, but these people are brought in.
The suspect convicted person is then put with a target over

(26:18):
their heart. Every firing individual has a
blank except for one person. One person will fire the kill
shot. And because it's the heart,
because you're being shot in theheart.
This is allegedly a very fast death.

(26:40):
Some have said that it is nearlypainless or completely painless
due to how fast the individual dies.
Again, do your own research on Idaho, on the firing squad, on
what that looks like. Form your own opinion.

(27:02):
Then we also have Brian and 10 who is a reporter with News
Nation. He has been covering this case
since the very first day he has interviewed Steve Goncalves, who
is Kaylee Goncalves father. Since these text transcripts and

(27:22):
the 911 call transcript have come out and Steve Goncalves has
said that they got no update on this saying, quote, we didn't
hear a word, End Quote. We're finding out like everyone
else, it's rough. My wife has said from the very

(27:42):
beginning that hopefully the 911call never came out and if it
did come out, at least she wouldbe prepared.
So it seems that at least one multiple potentially of the
family members, they're upset that they had no warning that
these items were being released.And then the Gon Calviz's

(28:06):
attorney has also chimed in and he reported to Brian Enten and
News Nation. Quote, I'm just pissed, you
know, common decency victim advocates should contact me and
the victim's families to let them know about some of the
stuff that's coming down so they're not just surprised by

(28:26):
it. End Quote.
I sympathize with this. If I were, you know, a family
member, yes, I would want to know.
However, I also get that some ofthese family members involved
have been very vocal on media outlets.

(28:48):
They have maybe announced thingsthat prosecutors did not want
out there yet. And I think it's a it is a very
fine line. And maybe when things like that
happen, it, it's possible you hit a point where then
authorities are not telling you things anymore because they're
afraid of you putting that information out there before

(29:10):
they're ready for it or it beingput out there in an incorrect,
improper manner. I'm not sure.
And then, as I mentioned, Brian Koburger's defense might cite
autism in order to get rid of the death penalty.
So apparently their defense teammay ask a judge to take the

(29:32):
death penalty away as an option for their client by citing
autism spectrum disorder. And this was within a sealed
court filing that this information was gathered.
Just I, I don't amazing. I don't, I don't know.
And then that motion that they filed with autism, it is

(29:58):
stating, quote, motion to strikethe death penalty RE autism
spectrum disorder. So we have to kind of assume
maybe his defense team has had him evaluated by some sort of a
professional or multiple professionals because they would

(30:21):
then need to back up this claim that he is on the autism
spectrum. I know there was a little bit of
confusion as well, maybe a lot of confusion because we've also
found out recently that perhaps the DNA on the sheath that led

(30:41):
to Brian Koburger, perhaps that was not the only DNA found in
the home. It's been stated that there was
unknown male DNA on a glove outside and blood perhaps on a
stair railing. One of the updates I've seen on

(31:03):
this was that CODIS has very strict rules and regulations
that you have to follow in orderto submit ADNA sample for
searching. They had already tested the
sheath and ran it against CODIS and my understanding of the way

(31:23):
that this was explained was thathad they tried to pursue either
of these other DNA options it would then erase the profile
that was searched and collected from the sheath.
And because of the nature of thecrimes and the weapon used, it

(31:45):
was a a safer assumption to operate on that the sheath is
connected to the murders becauseit would house the weapon that
was used for the murders. And so the DNA on that sheath is
likely going to lead us to our suspect.
That was overall my understanding.

(32:06):
Again, do your own research. There's so much information out
there. And then one of the other new
things we've learned is that DNAevidence has potentially been
gathered from under Madison Morgan's fingernails.

(32:29):
So this could potentially give insight to if and what kind of a
fight occurred it it would standto reason there was a struggle
in a fight if scrapings from under her nails provided
anything substantial towards a perpetrator or a suspect.

(32:56):
We don't have a lot of information as of now on what,
if anything, was found or connected due to the evidence
collected from Madison Morgan's fingernails.
However, that is new informationthat has been shared from
following other cases. I think it is pretty standard

(33:18):
that throughout an investigationwhen the medical examiner is
conducting their, you know, report scrapings are taken from
a Victor victims fingernails. I don't think it's surprising
necessarily that these scrapingswere done.
However, I think it's interesting that this is now
being brought up and it's not fingernail scrapings from all

(33:42):
four victims specifically, it isbeing pinpointed, the scrapings
collected from under Maddie's fingernails, which kind of makes
me think there's something of substance that's going to come
from that. Again, we don't have the audio
yet for the 911 call. We just have a transcript and

(34:03):
that is available. I'm also going to put copies and
