Welcome to your TuesdayCoaching.
Today I'm going to talk aboutthe counseling compact, diving

into how the compact is going toimpact our business positively
and possibly negatively, youknow, just kind of remains to be
seen.
I'm going to be totallytransparent.
I'm probably one of the oneswho is leaning against it a
little bit, but I mean notcompletely.
I think it's a great thing foraccessibility to care, but I, my
job, is to show you how it'sgoing to impact your business.

So we'll talk about how doesthe counseling compact work and
we will talk about the pros andthe cons regarding your business
.
All right, so let's start outwith what is the Counseling
Compact?
Well, you know how you have alicense.
We talk about the differencebetween a license and a
certificate, right, socertificate says you can do

something.
A license says you havepermission to do something.
Right, so you can have acertificate that says you know
how to drive, but only a licensegives you permission to drive.
Right, and so that counselinglicense that you have is
permission to practice.
And right now, the way thingsstand, and you have to get a
license in every single state,right?

(02:43):
It's not like your driver'slicense where you could just
drive to Tennessee and suddenlyyou're a driver in Tennessee,
right, those licenses for thingslike medicine and counseling
and other things they don'ttransfer like that.
So if you aren't licensed inanother state, you can't see
clients in that state and youcan go to another.

(03:04):
Training where we've talkedabout what is the definition of
counseling across state lines,remember, in Texas it's where
your client's feet are right.
So as far as Texas is concerned, counseling happens where your
client's feet are in that momentof services, right, doesn't

(03:25):
matter where they're a resident,they're on vacation, they're a
college student, but they reallypay taxes in Texas or however
that works.
So when we think about thecompact and I'm going to read
directly from my notes thecounseling compact is an
agreement among participatingstates that allows licensed
professional counselors topractice across state lines

(03:48):
without obtaining multiplelicenses, so more like a
driver's license.
Now, right, so it's going to bethis thing where I've got my
Texas license and now I canpractice in participating states
.
Now it's important to know thisis a privilege, right.
So in Texas, right, thislicense I have, right, it gives

(04:10):
me.
So it's also a privilege, right.
I'm not going to say a licenseisn't a privilege, because I'm a
mom and I've said it a hundredtimes driving is a privilege,
right?
But your license in Texas meansyou have taken the CEs, you
have passed the Texas exam, youare under the auspices of BHEK,
lpc, lmft, social Work,psychology, whatever member

board governs your license.
So with the compact it's alittle bit different, right?
Because you're not licensed inthat state.
So, as of April 1st, texashasn't joined the counseling
compact, but we do have billsthat are going before the
legislature.
It looks good that this willpass this year.

(05:00):
The compact licensedprofessional counselors in Texas
would be able to practice inother compact member states
without needing additionallicenses, provided they meet the
compact uniform licensurerequirements.
So what does that mean, right?
So in our case, right in Texas,we have a 60-hour license and

that was enacted a few years ago.
So folks were grandfathered inright Cause.
Like I graduated under a 36hour license, right, a long time
ago.
That means I had to pick uphours to become licensed as an
LMFT and I think I'm covered nowcause I have a PhD.
But you know that idea thatthere are folks out there and

(05:44):
this could be you and that'sokay, right?
If you have a 48 hour licenseand you were grandfathered in
before the 60 hour went intoeffect, that might affect your
ability to be able to sign theagreement with the compact.
Agreeing states so that's theone issue.
There's also going to be a fee.
Degreeing states so that's theone issue.

(06:06):
There's also going to be a fee.
So, yes, master's degree, 60credit hours passing the NCE so
that's good, right.
That's why Texas did this along time ago, because we knew
the compact was coming.
I'm not speaking for the board,but adopting the NCE as the
state license was part of thisfuture thinking.
So like for me, I've neverpassed an NCE, right.
I've been a counselor so long.

(06:28):
I passed the Texas exam backwhen you took it at the
beginning.
No, you got all your hours.
Then you took the licensingexam Super scary, so clean
disciplinary record.
And it mentions here if youwere grandfathered in you might
not be eligible.
So right off the bat, a lot offolks are going to need to look

(06:48):
at what exam they took and howmany hours went into their
master's degree.
I've been fact-checked andcorrected.
So here's the thing the statethat is part of the counseling
compact gets to grandfather infolks who may not have met the
criteria.
So if you're like me and younever took an NCE and instead

(07:10):
took an older version of whatwas then known as a Texas
licensing exam.
You're good to go, good news,right.
So when we think about how theCounseling Compact works,
there's going to be someinfrastructure in place.
So the Counseling Compactparticipating states will have
not necessarily a governing body, but more like an

(07:31):
infrastructure in place so thatthey can handle these.
Because really, when we havethis, state laws still rule.
Even if you're compact eligible, you still have to follow the
client's state laws on thingslike mandated reporting, scope
of practice.
You can't assume your homestate's rules apply everywhere

(07:51):
and licensing boards are stilllearning, right.
So the fact that we have thiscompact and then we're going to
have folks from you know adifferent state practicing in
Texas right, and they get introuble for breaking a Texas
rule right.
You can see that there's alittle bit of a conundrum there.
How's that going to work?
See that there's a little bitof a conundrum there.

So it is on you, just like youneed to know the rules of the

road in every county in Texasthat you drive through, or every
state that you drive through.
It's incumbent on you tounderstand the rules in the
state where you plan to practice, and so you know, obviously,
the next question is telehealthsupported and 100% yes, right,
that's what this is for.
This is you know, obviously.

My example was driving, whereyou're physically going from
state to state.
This is virtual right.
So if your client feet are inanother compact state and see,
I'm not even using another stateas an example in my examples
because I don't want people toget confused you can go and
Google which states currentlyparticipate in the counseling

(08:55):
compact.
But if your client's feet arein a state that supports the
compact and then you haveentered into an agreement
because you were eligible forthe compact, you still must obey
the rules for the state wheretheir client's feet are at.
Okay, so there are some things,and I even came up with what are

(09:18):
the top five questions peopleacross the US are asking about
the counseling compact.
So, number one which states arepart of the counseling compact?
We've got, as of today, 37states, so I'm not going to list
all of those who is eligible toparticipate in the compact.
You must have an active,unencumbered license as an LPC

(09:39):
in your home state.
And then you meet thosecriteria, as we mentioned.
And how does the applicationprocess work?
Well, it's not fullyoperational yet, but once it is,
you apply for a privilege topractice in other member states
through the Compact Commission'swebsite.
This involves submitting anapplication, paying fees,

undergoing a background check.
Each state may have its own feeand may actually require its
own jurisprudence exam, whichmakes sense, right, because you
want to make sure you know thatstate's code of ethics and their
rules.
When will the compact be fullyoperational?
The Counseling CompactCommission is developing the

(10:22):
necessary data systems andinfrastructure, aiming to begin
processing applications by fall2025.
Applications by fall 2025.
So, remember, texas islegislation.
Legislators only meet everyother year, so we are in a
legislative year.
So if it doesn't pass this year, we've got to wait another two

(10:45):
years, right, that's whathappened last time this was up,
for it was a proposal in 2023,but it did not make it to the
voting or I don't rememberexactly what happened, but we
had to wait two years, right.
So it looks good, and if itpasses, then in the fall we
should have some sort of aninfrastructure in place.

(11:08):
So this brings up somethingthat's important, because I get
asked a lot and I'm not the onlyone, others get asked too.
You know, why isn't the boardadvocating for this compact?
Well, this isn't a board thing.
I mean, the board can bepro-compact.
They have, in fact, they are.
They have, you know, they'vebeen on committees where they're

(11:29):
really trying to understand thecompact, obviously, because if
it passes, they need to be goodat this and get up to speed
quickly.
But this is a legislative issue.
It is up to our Texaslegislature to enact this right.
And, of course, it's all aboutportability, is all about access

(11:49):
to care.
We want to make sure thatclients Texas clients have
access to care, first andforemost.
And then now we've gottraveling.
Texans have access to care,great.
And now we come to the businesspart, where you guys have lots
of you out there have been, youknow, participating in online

(12:10):
groups.
How can I be a traveler?
How can I be a nomad?
How can I go all thesedifferent places and move your
feet to other places?
Right.
But then we've got those of youwho are like no, my feet are
going to stay in Texas and Iwant to see counselors in other
states.
Now, that's part of yourbusiness plan.

(12:32):
You're like okay, once thiscompact is enacted, then finally
I can see clients in, you know,whatever state that
participates.

So this is where I'm going tobring up one of my cons that I
talk about with folks.
We are a very, very populatedstate.
We knew that.
We knew Texas had a lot ofpeople in it.
Right, alaska may be thebiggest state, but we're big and

(13:56):
we are populated.
Right, so we've got California,we've got New York, those in
Texas.
Right, we're super populated.
So imagine if you only needed300 people this year, if you
only needed 300 people in yourpractice, that's, with new
in-catechs, new phone calls.

(14:17):
If you're a group practiceowner, double that.
So 600 people.
If you live in Texas, you haveaccess and do not quote me on
this, I'm not looking atpopulation numbers, but let's
just say you have access to 10million people 7 to 10 million
people to get into your practice.

(14:37):
Ok, so expanding this andsaying that being able to
practice in another, lesspopulated state is going to help
your chances of getting more.
And remember our KPIs more phonecalls, more contact, less phone
tag and more booked firstappointments.

(14:58):
Right, those are our three KPIsthat we focus on.
I think you may be a little bitI don't know shooting for the
stars there, but not really.
I want to be very careful andkind here.
I want you to be successful inyour KPIs.
I want you to have clientcontact, I want you to have
phone calls, I want you to havebooked first appointments, and
you guys are already so welltrained by me and other business

(15:23):
coaches to make sure that youare focusing your marketing
effort right.
The ideal client who are they?
What do they do?
Where do they eat lunch?
What do they need?
What's their pain point?
You know the people in yourcommunity and or you know the
people in your niche, right, youknow how to talk to them.

(15:45):
You know how to draw them in,you know how to be attractive to
them, be the shiny object thatcatches their attention and they
hit the keyboard and go to you.
Imagine now you've got to dothis for the whole country,
right?
Oh, now you got to knoweverybody.
All right, I'm going to giveyou another con, right?

(16:06):
Kids call me mom the dreamkiller, right?
It's like.
Well, there's your dream, I'mgoing to squish it.
These folks are all coming tous, right?
So remember, the counselingcompact works both ways.
It's not that our horizons areopening and we can now practice
in other states.
Other participants in theCounseling Compact may be like

(16:29):
oh my gosh, I was in such atherapist, saturated area of
fill in the blank name state.
I can go to Texas, where thereare more people.
Right, how many of you havecomplained that you are in a
therapist, saturated area inTexas?
Now, you're going to have otherpeople, right, they're going to

(16:51):
be Googling the zip codes wherethey can get the highest rate.
They're going to be Googling tosee which insurance companies
pay higher.
You know they pay higher in asuburb of Houston, or do they
pay higher in that little townin between San Antonio and
Austin, right, so they're goingto be doing their work to see
where they can practice.
Remember, this is telehealth, soopening the doors with the

counseling compact is going towork this way as well.
Right, and I really want tomake sure folks business owners,
big practice owners, solopractice owners, people starting
out, people who've been in thisa long time understand that
while we want the compact toimprove access to care and it

(17:34):
will, right, we want that forour clients we are going to have
to up our game when it comes tomarketing and making sure that
we're doing all the things sothat we're standing out in the
competition as well.
Okay, so I think that coverseverything I wanted to cover,
but let's review.
So we talked about what is thecounseling compact, we talked

(17:56):
about how the counseling compactwill work and then we talked
about pros and cons forpracticing counseling.
We talk about workforceportability, especially for
military spouses, digital nomads.
This portability means it'sgoing to reduce the friction in
maintaining your career if youor your partner is relocating.
