this week.
Speaker 2 (00:22):
I saw this story briefly the other day and it
was this guy at Queenslander. He had pepper spray and
he had a home intruder come through and he sprayed
him and it turned out that he got in trouble.
He got charged by police for using that and it
wasn't acceptable to use such a thing.
Speaker 1 (00:42):
Well, that's a bit crazy, especially in your own hot
I know.
Speaker 2 (00:45):
And there's there's rules, there's talk of would you bring
in should they change rules so you can defend yourself.
And I think it's called castle law where you're actually
defending your castle, so you know what I mean, defending
your house the oldie times. Yeah, yeah, So I thought
we just sort of well, first of all talk about
it and then get your opinion goal case. But I
(01:08):
feel like I guess if you have a home intruder
and your force is over the top, that that is
what the law is worried about.
Speaker 1 (01:20):
But how do you make someone stop and leave? Because
normally these people are doing whatever it takes to get
whatever it is.
Speaker 2 (01:27):
The the argument, the argument is from people that make
the law, is that your force has to be level
with the force of the person the other person that's
coming into your home. You can't use excessive force, So
I don't I don't know how you measure that because
(01:48):
you don't know what the the intentions of the person
coming in is obviously not good if they've got if.
Speaker 1 (01:53):
They're someone comes in with a machete or a gun,
that's what I mean, you are you would think that
they're not stopping until you're we'll take it out.
Speaker 2 (02:00):
The thing is, you don't know, so you should be
able to defend yourself when they're coming in and not be.
Speaker 1 (02:06):
Charged for it.
Speaker 2 (02:06):
I don't know how a jury or a court could
actually say you're in the wrong when when the intention
of someone intruding is not good in your own home,
in your own home, so but this, this person obviously
used it and he was charged accordingly right using excessive force.
So I think we should get to the bottom of
(02:28):
this and find out what gold Coasters think. I would
imagine that we would have a percentage of people saying
I would do what it takes to defend my fundly, absolutely,
So give us a call. If you have another opinion
and you think yeah, no, it needs to then needs
to be something in place for you not to go
over the top, then please call as well.
Speaker 1 (02:46):
