Готувати систему кримінальної юстиції України до повернення на деокуповані території потрібно вже сьогодні. Очевидно, що при поверненні виникатимуть ситуації, які наразі не мають правового регулювання, але з якими треба буде оперативно працювати. Серед найбільш дискусійних є питання, що робити зі «спадщиною» окупанта у сфері кримінальної юстиції. Про це говорили під час JustTalk дискусії зі спікерами:
- Ігорем Поночовним, керівником Прокуратури Автономної Республіки Крим та міста Севастополя, керівником робочої групи з розробки моделі повернення кримінальної юстиції на деокуповані території
- Аркадієм Бущенком, суддею Верховного Суду
- Альоною Луньовою, директоркою з адвокації Центру прав людини ZMINA
- Павлом Демчуком, експертом робочої групи з розробки моделі повернення кримінальної юстиції на деокуповані території
Подію модерувала Лариса Денисенко, адвокатка, правозахисниця. Зокрема під час дискусії міркували над такими питаннями:
- Який статус надавати рішенням окупаційних судів у кримінальних справах за період окупації: визнавати, виконувати, переглядати чи вважати такими, що не мають юридичних наслідків?
- Які наслідки матимуть ці дві різні моделі ставлення до рішень окупаційних судів?
- Чи можемо ми визнавати докази, зібрані окупаційною владою після деокупації? Аргументи «за» і «проти».
- Яким критеріям у випадку визнання національною правовою системою такі докази мають відповідати?
