an article in the journal onSunday which was fascinating and
actually very well done and gothrough a variety of issues.
These are really interestingissues.

it's unbelievable.

They're really saying this,they're putting this out there,

land of make-believe is what itkind of feels like.

appreciate.
But Joe Rogan's mouth also islike a truck driver mouth.
So you, got to get beyond that.

He dives into the Doge part andwhat he specifically has found
and he goes into what we'retalking about a lot today is why
are the Democrats, why are theystaying so, like you know,

Like, why are they pushing sostrongly on that?
He goes into the whole UFOthing, which I thought he'd be
on one side of the aisle, andhe's not so interesting enough

think this is happening, whyyou're seeing an entrenchment on
issues that are complete losers, which is fascinating to watch

well even for America.

Okay, we have a lot to get okay yeah, we're going to
start the legislative sessionsdown to its last week and we've
talked about some of the badbills here.
You know many times a lot ofthese targeting energy, which is
a devastating approach.
I still it's still happeningright now.
They're trying to raise yourtaxes on energy so that they can
continue to bring more moneyinto Santa Fe when they have
record surpluses, which is justunconscionable to me.

Okay, but that's not what we'regoing to get into today.
Today we're going to talk abouta couple of different bills,
especially one bill that failedin the New Mexico legislature
here, and it's the front page ofthe journal on Sunday.
Here's the headline.
It says malpractice bill stallsin Senate committee.
Ok, now, this is not yourcommon.
Hey, Republicans, get behindthis bill.
Every single Democrat hates thebill, and so obviously there

(06:42):
are more Democrats thanRepublicans, so it fails and all
the Republicans get mad.
That's not what this is.
This was a bill supported by 24different sponsors.
12 of them were Republicans, 12of them were Democrats.
Both groups seem to understand.
We have a devastating situationin the state of New Mexico.
We have some of the worsthealth care in the country.

(07:03):
If you've tried to get a doctor, odds are that doctor has.
If they've treated you at all,they've treated you once or
twice and then they've left.
We cannot keep doctors.
Malpractice insurance is waytoo high.
We sue more than any otherstate in the country and when we
do sue, people get massivesettlements and doctors look at
it and go I'm not going to workthere, I can't do it.

(07:26):
If a doctor gets sued or has tosettle, that basically goes on
their record.
Right, that goes on theirrecord so people can see wait a
minute, look at what's happenedhere.
Now I'm not saying doctors don'tever make mistakes, but we've
created an environment here,thanks to the trial attorneys,
where it's easier to sue thananywhere else.
You can sue for more money andwe've chased away doctors and
the result is hardworking NewMexicans can't get health care.

(07:48):
It's just that simple.
It's dangerous in this statenow and it has been created by
an extremist legislature that isreally hurting the state.
So 24 different legislators,senators, come out and say let's
do this, let's do this.
12 Republicans, 12 Democrats.
We got to fix it.
It's Senate bill 176.

Now you can go read the journalarticle and there are plenty of
times and else you can throw upsome of the quotes.
I don't need to read them all.
I clipped the whole article.
I put the whole article and putit up here, and then I'm like I
can't just read everybody thewhole article, right, but.
But I wanted you to get some ofthe sense of this thing,

because basically, what it woulddo here is it start to cap how
much you can sue people for Okay, doctors, for it would bring
more doctors in here, okay, butthey kill it in committee, okay,
and it's absolutely devastating, okay.
And you saw people on bothsides of the aisle say wait a
second here, it's crazy.
So I want to go to a clip forElla, let's go to clip four, and
I want you to read that becausethat's one of the bill's

sponsors who talks about this.

Says the bill's failure to emerge from committee
essentially kills any chance ofa medical malpractice measure
passing in this session, saidSenator Martin Hickey, who's a
Democrat of Albuquerque, asponsor of SB 176.
The quote says I actually thinkthat we were able to get the
facts out.
The trial lawyers are bringingcases without merit and getting
settlements, said Hickey, whotestified Friday in favor of the

bill.
The bill's failure will hamperthe state's ability to expand
the physician workforce, he said.
Hickey told committee membersthat physicians and practice
groups often feel compelled tosettle lawsuits before trial to
avoid the risk of a largepunitive damage award.

Okay, so that's interesting, right?
So you say well, what do youmean by this, right?
Is this really happening, ella?
Clip 6 in this article, andagain a very well done article
by the journal, because itactually laid out the perilous
situation that we're in and howbad this is.
So listen to this.
The number of reported paymentsmade in medical malpractice
cases involving New Mexicophysicians has increased from 84

in 2020 to 130 in 2024.
Remember, our legislaturewanted to do this.
They passed it, so this wouldhappen.
This is a giveaway to the triallawyers.
The problem is, when you givethis away to the trial lawyers,
you destroy healthcare for everysingle other New Mexican.
Okay, it doesn't matter whatparty you're in.
Clearly, this is even splitRepublicans and Democrats.

Let's go back up with that sameclip.
And if you look at some othernumbers here, it says Hickey
also testified that severalmalpractice lawsuits have
resulted in historically largejury awards in recent years.
Now, you're not going tobelieve this story.
This is a crazy story,including a $412 million jury

verdict in 2024 in this state.
He described it as the largestmalpractice award in US history.
Are you ready for this?
All right, now we're going totalk about this.

Okay, okay, so here is thestory at $412 million.
Okay, no, no, a whole communitywas not wiped out.
Okay, no, they're not all deadand, in fact, no one's dead.

They are fascinating.

The case involved a 66 year oldRio Rancho widower who sued the
now-closed New Mail MedicalCenter in Albuquerque after
receiving alleged dangerouspenile injections in 2017.
The clinic was part of a LasVegas Nevada chain that filed
for bankruptcy in February,according to court records.
Now, the 2000 lawsuit allegedthe widower sought treatment for

fatigue and weight management,but was misdiagnosed and treated
for erectile dysfunction.
According to his lawsuit, as aresult, he was left with a
scarred and nonfunctional penis.
the lawsuit alleged A jury tookless than four hours to award
him $37 million in compensationfor his lifetime medical needs.
Okay, but that's not it, Plus$375 million in punitive damages

I mean I'm sorry, that's ridiculous.
Okay, now, I don't even knowwhat happened in theitive

$400 million is ludicrous, okay, it's absolutely ludicrous,
okay.
So then you start to transitionin this article to the Democrats
explaining why, the ones on thecommittee who killed this thing
, why they voted against it.

Okay, and you had, uh, senatorangel charlie, who's from a dac,
uh, the uh akama democrat whosaid you know, she doesn't want
a cap on attorney's fee.
She says that means attorneyswill not take medical
malpractice lawsuits.
That's actually not true at all.
Okay, and she, she, her concernis she does not want people to
effectively end up having todeal with medical care.

That's as bad as it is on thereservations, but it is.
It's bad everywhere.
Okay, that's the problem here,but the one that was really
amazing here.
So I want to tell you thepeople who voted against this
thing, first of all, and thenthe people who voted for it.
So, committee members who votedagainst, the Linda Lopez and

Shannon Pinto Okay, they killedit.
They're the extremists whokilled it.
Okay, supporters were Jay Block, larry Scott, senator David
Gallegos and Hickey a Democrat.
Okay, I mean just unbelievablehere.
Now here's one of the quotes Ithink was amazing.
I'll let's pull quote seven,clip number nine Lisa Curtis and

Albuquerque medical malpracticeattorney.
Okay, the kind of person who'scausing all this cheered the
bills defeat.
Here's what she said.
It's a horrible bill.
It does nothing to fix theproblems.
She blamed the malpracticesuits on hospital corporations
that engage in ruthless costcutting and pay positions uh,
physicians rather based on theirproductivity.

Nobody's willing to talk aboutprivate equity guys and they're
choosing to put their money inthe New Mexico healthcare system
because it's so profitable.
Hey, lisa, no one's talkingabout profitability.
We're talking about doctors.
Nobody cares aboutprofitability in this case.
We care about doctors beingable to come to this state and
because of people like you, wedon't have doctors and people

(14:09):
die because of it.
They do.
There's no doubt getting doctorsin the state is a competitive
endeavor.
They can go to Texas, they cango to Arizona, they can go to
Colorado, they can go to Utah.
They don't have to stay here.
But people like you, you fatcats who go and sue everybody,
and you lawyers, are richthere's no question you guys
have gotten rich who go and sueeverybody, and you lawyers are

(14:30):
rich, there's no question.
You guys have gotten rich, nodoubt about it, congratulations.
It's at the expense ofhardworking New Mexicans who
cannot get health care, andeverybody who lives in the state
knows it.
There's no one that I havetalked to in the state who's
like, yeah, health care is great, things are going well.
You've destroyed health care inthis state and you continue to
destroy it.
So now you have Democrats andRepublicans pushing against you
and your extremists in thelegislature help you do it.
It's disgusting and I'm soangry because we're all dealing,

everyone's dealing with this.
I'm sorry.
We talk about it all the time.
It shouldn't be a politicalissue.
Then cut the crap in thelegislature because these people
are dangerous, what they'redoing to the state of New Mexico
and it's hurting everybody,everyone.
So if these people are yourrepresentatives, stand up and
say wait a minute, this has tostop.

Right and vote these people out.
I mean for the love of.
I mean another add on this isyou got 50% of people that are
part of Medicaid program in NewMexico, right?

cannot travel out of state toget healthcare.

So if you can't find the specialist here and you're
not allowed to travel toColorado, Texas, Arizona, a
nearby state, to get yourhealthcare, what are you doing?
And we were supposed to be thistop retirement community.

Place to retire?
Great, great weather, Great,you know, this was a big like.
I remember moving here wherepeople said, oh, that's a great
place to retire.
I never forget that hearingthat 25 years ago.

Great place to retire, Greatplace to retire.
How do you retire if you don'thave health care?
I mean, of all the times thatyou need health care, the most
is after you have retiredusually, and it's crippling.
Another thing I wanted to talkabout was this House Bill 593.
It was also up for vote.
It also did not pass.
Very similar to what you weretalking about with this journal

article.
It would have dealt with a lotof these same issues, but for
rural doctors, which wassomething that we really talked
about a lot on the campaigntrail.
We heard from so many peopleacross the state.
We need real doctors.
We need to have doctors andhelp in rural communities.
So we're not driving four hoursor five hours to have a baby or
to have a medical emergencytaken care of.
However, this gets killed.

(16:33):
So here's.
What's interesting is that,according to Jerry Harrison, he
runs this nonprofit health carerecruitment company and he
testified All right, so he's theone that's out there saying
listen, I'm going to tell youwhat's really going on and why
we can't find the doctors here.
Okay, number one it is themalpractice issue.

(16:54):
Right, very clearly he saidthat's a huge issue.
Then he goes on to find outthat he said that there were 769
openings from employers forupper end healthcare.
That means practitioners likedoctors and nurse practitioners.
Last time at this year thatnumber of openings was about
half.
That means that need has grown,has expedited it's, doubled
it's doubled on how much weactually need.
So he just said, okay, part ofhis organization is recruitment.

(17:15):
So he reaches out to 2,500health professionals, mostly out
of state, to say, hey, can weget you guys to work here?
Out of that he only received185 resumes out of trying to
reach to 2,500.
The biggest, some of thebiggest reasons, obviously he
mentions that that thatmalpractice insurance is crazy.
He said that it's also aproblem because we don't pay

(17:36):
them very much, right?
So he said the average doctorrate in other cities is about
300,000 for a generalpractitioner, which is a lot of
money.
Here in New Mexico it's about200,000.
And then you add on things liketaxes.
You know gross receipts, taxes,you know you have high crime
rates, the things that we'vetalked about.
On and on and on.
So again, this also gets killedin committee.

Speaker 3 (17:56):
Yeah, and just think and you made such a good point
on the fact that the people whoare hurt most are low-income
families on Medicaid, becausethey can go nowhere, they can go
nowhere, nowhere, they can gonowhere.
And so if they don't get goodcoverage, or they don't get good
care at all or they're neverable to see a doctor because
that's what more and more peopleare saying I just don't see a
doctor.

Speaker 4 (18:15):
Right.

Right, and so you may be seeing somebody who's doing
their best, but they're just nottrained like a doctor is
because we don't have enoughdoctors.
Those are the people that endup being victimized first.
So this is this is what I mean,when we've seen the total
political shift in this country,where the people who work
hardest and do everything theycan to play by the rules are

being forgotten.
No question and this is a greatexample the New Mexico state
legislature the legislature thathas more money than they can
possibly spend are busy nowchasing every doctor out of this
state.
The extremists are Meanwhile.
People on both sides are sayingstop doing this.
If we don't come together as astate and get these extremists
out, I'm telling you you're notgoing to live in this state, and

if you have any opportunity todo anything, you'll leave, and
no one wants to see that.
It's awful.
It is awful, and so the themeof this show is we are watching
a party disintegrate in front ofus, and it's not good news.
I will tell you.
We're conservatives, we knowthis.
It's not good news to watch theDemocrats destruct like this.

It is bad, okay, and thenumbers on it show it, and all
the issues show it as well.

Well, before we get to the actual numbers, I want to
show those numbers.
Wasn't there something in thatarticle about how many trial
lawyers are actually makingcampaign donations to these
legislators?

Yeah, I mean the trial lawyers are the are one of
the biggest supporters of theNew Mexico state legislature.
First of all, we have a ton oflawyers in our legislature.
And then, number two, they makelaws that benefit themselves.
It's so very clear, it's.
It's staggering, ok, it's awful, ok, and that's got to change
too.
But again, if you don't standup and you don't realize what's

happening here, then these guysare just going to keep doing it.

They're going to keep doing it.
Well, I just sadly think thatpeople like especially like
legacy medias.
I think they're just reportingon here's the headline, this
building pass and not reallygoing into the depth of why it
didn't pass, why you know maybethat some of these folks are
getting their pockets lined bytrial lawyers, and then you you
know I'm sorry, but that is areality check when you're taking
money from the wrong side ofthings, and then it forces you

to vote a certain way and it'snot for the betterment of the
people.

Well, no, you're right, but no one's, no one's
doing that work in, really,though, even the legacy media,
even the big TV stations and thenewspaper.
All they have to do is reportthe basics.
Forget diving into the triallawyers you know greasing their
palms, I get all that.
That's, that's horrible but atthe same time, just report the
facts.
I mean the facts are.
Doctors are leaving, and wehave a legislature that is

ushering them out the door likethat, that destroys everybody's
way of life, like what?

Yeah, I don't know how thislegislator has stayed the same.

I don't get it Well and again, this is one of those
issues.
Look, you have 12 Republicansand 12 Democrats like go start
rolling over these people andmake them pay for hurting the
state.
This is I'm sorry.
I'm so fired up over this.

Let's talk about how theirrecord low in popularity is just
taking a nosedive.

The Democratic Party in general down now, their
popularity is 27%, yeah, and soNBC News just came out with the
latest poll, and so thepopularity of the party now the
lowest level in decades, decades.
And what do we talk about allthe time when you're constantly

, but I actually joe diaz way.
I started my career workingunder Joe at Channel 7 for four

years, from 2000 to 2004.
Joe was a great boss.
He was a guy who always wantedyou to do well.
He always put tools in place atChannel 7 to make the
meteorologists better.
He really is a great guy.
I love him to this day.
We still stay in contact and,yeah, we competed against each
other for a long time but beforethat I wouldn't have done

weather and I wouldn't have goneto school for it and wouldn't
have done everything I didwithout Joe Diaz and he is a
great guy.
He's going to leave Channel 7coming up in May and he will be
missed because he truly is areally good person, a really
smart person, and he runs a very, very tight ship at Channel 7,
meaning he does a good job, he'snot difficult to deal with and
he gives you tools you need tobe successful.

There's a little constructioncone that's tipped over Right
and we got a big bear coming upto it and basically it's up to
the bears now to take care ofthe fallen cones.

Oh yeah, no, so that's critical.

I loved it because the bear actually just tipped
the cone back up it keeps ongoing.
And then he just keeps on going.
It's like he knew the job wasto basically like take care of
it, let's just take care of thecone.
I see it, it's knocked over.

The guy who used to do this clearly has been laid
off.

Speaker 4 (48:22):
He's been laid off, so I'm going to go over and I'm
going to take care of it.
I know people.
I promise you we're not takingjob cuts, not seriously.
So please don't think that.
But I just thought this was asweet way, it's hilarious.
And um bears.
I mean I don't want to actuallyrun into a bear ever, but um,
let me tell you, somebody hasdone it.
It's not easy.
