A man was accused of shootingand killing a person in an
execution-style murder that wascaught on camera, and now this
dummy is hoping a judge wouldgrant him some form of release
from jail while he's awaitingtrial.

The big dummy in question isMarcus Ely.

He is accused of committing acold-blooded execution-style
killing on camera, and then thedummy took a selfie with the
victim's gold medallion that hejust snatched off his neck.
Now Ely, who is 22, was chargedwith first-degree murder and
armed robbery for the 23shooting death of 21 year old

Malcolm Avery Johnson Jr.
Ely's alleged accomplice, marioFogar, has pleaded guilty to
second degree murder and isexpected to testify against Ely.
Prosecutors have presentedevidence, including surveillance
footage and statements fromEly's mother and brother, to
support the charges against Ealy.

North Miami Beach.
Now, two years later, one ofthe accused killers is hoping
for a judge to let him go homeand wait for his trial.

As one man fought the victim,the other appeared to pick up

The robbery turned to murderwhen the thieves started

snap selfies.
Pictures showed the two posingwith the piece of jewelry just

it on the thumbnail, guys, the,the girlfriend and him.

She's sitting in court with himnow and supported his
foolishness.

Today, Ely's attorney
slammed the state attorney's
case as weak and requested hisclient get house arrest to wait
for trial.
But prosecutors were againstany form of release out of jail,
since they are confident Ely isa killer.
Of release out of jail sincethey are confident Ely is a
killer, especially since thesecond man seen on video took a
20-year prison deal and flippedon his co-defendant.

Defendant agrees that he iswilling to testify in open court
against Marcus Ely required bythe court of the state,
including testifying that MarcusEly fired the gun to murder
victim Malcolm Avery Johnson Jr.
Mario Fogler told police Ealywas the shooter.
Additionally, Ealy's brothercalled police to confess.
He recognized the man on thesurveillance video as one of his

to observe what's going on, andat the end of today's hearing
the judge denied granting him abond.
She felt the community would bea lot safer with him behind

bars, especially since policewere already surveying his house
through a secret camera beforethis chain murder even happened.
Ealy has pleaded not guilty.
