FACTURAS ELECTRÓNICAS (CFDI). SON DOCUMENTOS PRIVADOS CON VALOR PROBATORIO INDICIARIO QUE REQUIEREN ADMINICULACIÓN CON OTRAS PRUEBAS PARA ACREDITAR EL ACTO DE COMERCIO CUYO PAGO SE RECLAMA EN JUICIO MERCANTIL.
Hechos: Los Tribunales Colegiados de Circuito contendientes sustentaron criterios contradictorios al analizar el valor probatorio de las facturas electrónicas emitidas por la parte actora en juicios mercantiles en los que se reclamó el pago por la entrega de los bienes o servicios amparados en ellas. Un tribunal sostuvo, esencialmente, que tienen valor indiciario sujeto a corroboración con otras pruebas; mientras que el otro les otorgó valor probatorio pleno, basado en su validación mediante el sistema fiscal digital operado por la autoridad hacendaria.
Criterio jurídico: Las facturas electrónicas (CFDI) son documentos privados unilaterales que, como tales, tienen valor probatorio indiciario, de modo que su eficacia demostrativa para acreditar la acción de pago en el juicio mercantil depende de que sean adminiculadas con otros elementos de autos.
Justificación: La naturaleza unilateral y privada de las facturas impide concederles por sí valor probatorio pleno, máxime si son objetadas; de modo que por sí solas no acreditan la materialidad de las operaciones comerciales que consignan. Si bien su validez fiscal documental asegura el cumplimiento de requisitos tributarios o su autenticidad como documento fiscal, ello no demuestra la realización efectiva de las transacciones descritas. Por eso, aun cuando las facturas electrónicas sean autenticadas por la autoridad hacendaria mediante sellos digitales, mantienen su naturaleza de documentos privados y unilaterales, y su valor probatorio indiciario será grave o leve según las particularidades del caso, como son los otros hechos probados o no controvertidos, objeciones u otros elementos probatorios que se desahoguen.
Por tanto, es indispensable que éstas sean adminiculadas y corroboradas con otros elementos de autos para acreditar los elementos de la acción de pago en el juicio mercantil.
