בשני דפ' דברים נאמר (בהמשך לדברי משה רבינו "איכה אשא לבדי וגו'", שע"ז אמר לו הקב"ה שיקח "שרי אלפים ושרי מאות וגו'"): "ושפטתם צדק בין איש ובין אחיו ובין גרו לא תכירו פנים במשפט וגו' והדבר אשר יקשה מכם תקריבון אלי ושמעתיו". וההוראה: כאשר יהודי צריך לשפוט את עצמו ולהחליט כיצד עליו לפעול בפועל, מצווה עליו התורה שהמשפט צריך להיות [לא עפ"י רצונותיו, אלא] "צדק"‏ – ‏עפ"י תורה! וכאשר ישנו ענין קשה שאינו יודע להחליט בעצמו‏ – ‏אינו סומך על עצמו אלא הולך לשאול אצל הראש-ישיבה וכיו"ב ומתנהג עפ"י הוראתו‏.

Synopsis

The verse states in sheini of parashas Devarim (following Moshe Rabbeinu’s words “How can I bear alone...,” in response to which Hashem instructed Moshe to appoint “officers of thousands, officers of hundreds, etc.”): “You shall judge justly between a man and his fellow, and between his litigant. You must not favor anyone in judgment…Bring to me any case that is too difficult for you and I will hear it.” The lesson is that when a Jew finds himself in a situation where he needs to judge himself and determine how to act, the Torah commands that he judge himself not based on his own desires, but with a just judgement according to Torah. And if the matter is difficult and he cannot decide on his own, he should not rely on himself but rather ask his rosh-yeshiva and the like, and follow their guidance.
