Stephanie (00:29):
Alright folks,
welcome back to another episode
of The Lethal Library.
I am Stephanie.
Dani (00:36):
I'm Danny,
Stephanie (00:37):
and we are a True
Crime podcast.
We talk about cases mostly inthe Pacific Northwest.
and today Danny's gonna betelling us a story of yet
another dumb criminal.
What do we got on the plate?
Danny?
Dani (00:50):
I didn't even write an
intro for this.
I didn't know where to start.
So let's just get straight intoit.
Let's jump in On August 3rd,1983 in Shoshone, Idaho, Jamie
Charvin was shot by MarilynArbor.
After an alleged sexual attackof Marilyn's youngest daughter,
(01:14):
age 13, yikes.
Marilyn unloaded her 22 calibergun into the side of Charvin O'S
truck.
While he was in it, bullets hithim in the right elbow and leg.
She was charged with aggravatedassault.
Salt in August of 83, butearlier that year in January,
(01:40):
Marilyn and her father James hadwent to the Jerome County
prosecutor, Dan Adamson, in aneffort to put OW in jail,
Marilyn had bruises from areported fight with Char, but
because Marilyn admitted tohitting char in the head with a
frying pan.
Adamson said the couple hadengaged in a mutual combat and
(02:03):
that he was unable to presscharges to
Stephanie (02:08):
hit someone in the
head with a frying pan.
If that's how it starts, that'sone thing, but if that's what
you do to try to stop it, thatmeans it was pretty intense.
I've almost hit someone in thehead with a frying pan once.
No shit.
I'll tell you the story later, but, yeah, like literally, you
(02:29):
know how you can, I'm reallygood at flipping a fry pan in my
hand from working at like fastfood restaurant or like
restaurants.
so I was like, you're gonna getit.
You're gonna get it.
I'm doing the shit it withsomeone attacking someone else.
Oh,
Dani (02:43):
okay.
Stephanie (02:44):
Not attacking you.
So that's why.
But so if a frying Pam'sinvolved and it's not the
initial contact.
Someone's probably acting up,
Dani (02:53):
but she also, while he was
in his truck, I'm assuming
trying to leave.
Yeah.
You can't shoot people whenthey're sleeping, just unloaded
her
Stephanie (03:01):
gun, pop, pop, pop,
pop, pop, pop, pop.
A lot of people don't know that.
They're like, even, even ifsomeone was stabbing you, if
they are running outta yourhouse leaving, gotta be careful
with your gun laws in yourstate.
They're different everywhere.
Take a concealed carry class.
They'll let you know what, what's under the law and what
isn't.
You can't just shoot someone'cause they're on your property
(03:22):
in most states anyway.
Dani (03:28):
charges against Marilyn
were later dropped right before
her trial because of an incidentin Jerome County where Char
Bruno attacked Maryland.
I.
Lincoln County prosecutor DougRose, stated he had instructed
ow to stay away from Marylandand avoid any contact, but char
ow com compromised the case bycontacting her and I don't know
(03:52):
the level of the, I don't know, attacked I, there was no
details, but there was someinteraction there that he
Stephanie (03:59):
was where he
shouldn't have been.
Dani (04:00):
Yeah.
It's like, oh, the lady thatshot you up?
Yeah.
Don't fucking talk to her.
Do not be around her.
Stephanie (04:08):
Don't go to her place
of work.
Don't, eh,
Dani (04:10):
you see her
Stephanie (04:11):
in the grocery store.
Dani (04:12):
Turn the other way.
Yeah.
Something happened.
So
Stephanie (04:16):
anyways, drama all
over the town.
Dani (04:19):
And we're just getting
started.
Um, so I don't know.
Marilyn was off the hook forshooting, unloading a gun into
the side.
They said, uh, you know what?
Yeah.
Okay.
On June 13th, 1984, Marilyn, age36 and Char.
(04:44):
24 had their divorce finalized.
They had only been married for ayear before they separated.
Stephanie (04:52):
Ooh, that escalated
quickly.
Dani (04:54):
Yeah.
Uh, they met in July of 1982 andhad a very stormy relationship.
So, I mean, we're two years intothis relationship.
Divorce has already filed backand forth fighting, whirlwind
Stephanie (05:08):
of drama.
I mean, I think we've all seenthat kind of relationship
before, whether it's your own oryour friends or your families.
I think we're, we're getting thevibes here.
I just
Dani (05:18):
think if you're shooting
at your partner.
Stephanie (05:22):
Red flag, at least
one.
Where's the red flag guy?
Yes.
We need the gigantic red flaglike this.
It's gone too far there.
I don't know how you reclaim arelationship after things like
this.
No.
And this is happening after likea year?
Dani (05:39):
Yeah.
Stephanie (05:40):
How do you get back?
I don't care who the therapistis.
You're not therapy yourself.
Out of this.
Dani (05:47):
It's not fixing.
No, they were in a constantstate in those two years of
breaking up and getting backtogether and apparently shooting
each other and, or shooting,
Stephanie (05:59):
shooting, frying,
pan, all of that shit sick.
Dani (06:04):
A warrant was issued for
Char in late June, 1984.
He was charged with first degreekidnapping and rape.
Oh my God.
Marilyn told police that on June21st, sharp, Bruno kidnapped her
as she left work as Marilyn wasleaving her waitressing job.
(06:25):
At the Butte Cafe, he enteredher car and refused to leave.
Do you think this was the onlyrestaurant in Butte?
Stephanie (06:34):
Is it the only
restaurant in Butte?
I,
Dani (06:36):
I kind of feel like it
was,
Stephanie (06:37):
there's maybe two
Dani (06:40):
small town charvin.
sharper note, then choked heruntil she became unconscious.
When she woke up, she was inLincoln County where he raped
her.
Marilyn was able to finallyescape while her car was stopped
at a stop sign.
She escaped from the vehicle.
(07:02):
Marilyn's car was later foundhigh centered on a rough road,
and completely burned in YheCounty.
Yeah.
Stephanie (07:10):
Completely burned.
Dani (07:12):
Mm-hmm.
And also, I did read reportswhere the VIN had been removed.
This is so funny.
So I, I'm sorry.
It's funny.
So the VIN had been removed inthe obvious places, where you
see it, you know, yeah.
Back in the day on the door inthe, in the dash, whatever.
But.
(07:32):
One.
One newspaper reported, but theyfound the VIN in a hidden place
that's only known to police.
Stephanie (07:42):
Oh, super.
Secret police, vin.
Well, I mean now most of thesecars have like the computers in
them that can tell em exactlyhow fast you were going.
Did you break?
But yeah, no, that's a greatidea.
Even for just stolen cars tohave a secret vin and why
wouldn't they?
How much does that cost?
Dani (08:01):
But there was a secret vin
hidden secret vin, Later her
backpack was found.
In Battle Mountain, Nevada.
Stephanie (08:12):
Damn.
Dani (08:15):
You're gonna see what's
going on.
And lemme just tell you aboutChar.
Stephanie (08:21):
Tell me about Char.
Dani (08:24):
He was a rodeo man.
I.
Stephanie (08:27):
Oh, so the Montana
and everything's coming into
play here,
Dani (08:31):
and Hawaii County.
Yeah.
And all that stuff.
He, even pictures of him, he isdressed in like those cowboy
shirts that have like, they'rebuttoned and then they have that
extra flap.
Oh yeah.
Yep.
Yeah.
That's over.
Mm-hmm.
(08:51):
Like, and the little bow tiething.
Bolero.
Like the string, not the string, the actual scarf.
Stephanie (09:00):
Oh, okay.
Yeah, yeah, yeah, yeah, yeah.
Are you feeling the vibes?
I feel the vibes.
Okay.
And listen, rodeos around thispart of the country, not only
this part, but there's manystates where rodeo is a huge
thing and these boys are likerock stars, even if they're not
making it big or winning all thetime.
Dani (09:22):
And he, he's 24 and she's
36.
Yeah.
What are we doing?
What are we doing?
I, I don't even think I couldrelate.
Stephanie (09:32):
I thought it was the
other way.
I didn't realize that.
I wrote down the ages, but notwith the names.
So thank you for clarifying.
Yeah.
Dani (09:38):
and also you're going to
hear about Marilyn's daughter
who was 17.
Awkward.
Not good.
No.
And, and, yeah, there's, it'sjust
Stephanie (09:52):
the fuckery is real.
Dani (09:54):
Yeah.
I don't, I mean, Marilyn wasbeautiful still.
I just, for me, the, the findingthat commonality, like, yes.
Thank you.
Is that a word?
Stephanie (10:08):
Yeah.
Look at, look at the vocabularyon this.
One I do read.
Have you been in your thesaurus
Dani (10:22):
on July 1st, sharper, went
to Marilyn's home in Jerome,
Idaho and let her horses out ofthe corral.
Marilyn saw they were out andwent out to gather the horses
back in, into the corral.
Mm-hmm.
at 11:38 AM Marilyn's twodaughters called the Jerome
(10:43):
Sheriff's Office and said theyheard shots fired.
Tiffany Arbaugh, Marilyn'sdaughter picked up her mother's
rifle and went to the barn.
Marilyn was sitting on theground and Sano was standing
over her.
Sano turned and pointed the gunat Tiffany and told her to
leave.
(11:04):
Marilyn also told her daughterto leave.
She did.
She's like, go.
Stephanie (11:09):
Both of them were
saying to leave, but very gutsy.
Grabbing that rifle girl.
I'm very proud of her being, oh,she wasn't loosen up
Dani (11:15):
wasn't, she wasn't fucking
around.
I love that.
See what's going
Stephanie (11:17):
on out here.
But then both of them tellingyou to leave, like, ugh, for a
kid.
Mm-hmm.
Dani (11:26):
Uh, au told Tiffany he was
going to take her mother to the
hospital.
Tiffany went back into the housewhere she heard more shots.
Oh my God.
Yeah.
I can't even imagine how scaredI would be
Stephanie (11:42):
today As an adult.
Dani (11:45):
Yeah,
Stephanie (11:45):
as a teenager.
Fuck
Dani (11:49):
Tiffany then grabbed her
mother's car keys, so Char Bruno
couldn't leave.
Smart girl.
She ran back to the barn to findMarilyn lying on the ground and
Char Bruno was gone.
The daughters called the Sheriffagain saying their mother was
dying, and that Char Bruno hadfled into a field near the barn.
(12:11):
Marilyn had been shot 15 times.
You got
Stephanie (12:15):
to be shitting me.
That's out of fucking control.
Especially knowing that someoneelse knows, knows that what
you're doing out here, like I amso happy that he didn't go for
those girls because
Dani (12:30):
isn't it, we just, at that
Stephanie (12:32):
point you think your
brain would be like.
Well, she already knows thatwe're out here and I've got a
gun.
She heard the shots.
I gotta go take care ofbusiness.
So I'm just so glad that I thinkhe knew that she was gonna shoot
him.
Dani (12:47):
I think so too.
Sharp.
Bruno was arrested a short timelater.
In the field behind Marilyn'shome.
Just to kind of give you an ideaof what Jerome, it's Jerome is
desert
Stephanie (13:01):
and like some
farmland,
Dani (13:03):
a lot of farmland, but
also a lot of sagebrush.
Mm-hmm.
Uh, so when they say a field, Ijust imagine just sage brush and
dirt.
Yeah.
Out there.
I mean, it could have been a.
It could have been a farmer'sfield.
actually now that I say that, Ido believe it was a wheat field
(13:23):
now that I'm remembering myresearch, because they were
looking for items out there andit was very difficult.
So yes, it was a wheat field, but still there's lots of stage
brush.
And Jerome, it's.
It's fucking, it's NevadaDesert.
Stephanie (13:36):
Yeah.
High desert.
Dani (13:37):
you think of the hangover
where they meet in the desert.
Yeah.
That's southern Idaho.
Stephanie (13:45):
And a lot of people
don't realize what High desert
is because they're like Idaho.
You get so much snow.
How could it be a desert?
It with the amount of actualprecipitation you get.
It is, it's a different desertthan like sand dunes.
Even though Idaho does have sanddunes.
Surprise, surprise.
Dani (14:03):
The largest sand dune in
North America.
Stephanie (14:06):
We've, listen, Idaho
has everything, so, and then
some boom.
Um, but yeah, high desertclimate.
And so it affects like whatplants you can have here.
A lot of people come here andare just so surprised how dry it
is and all their house plantsdie because, or they buy like
(14:28):
whole house humidifiers becausethey just like it better or they
have lots of plants.
So it's a very interesting anddiverse climate that Idaho has.
So high desert.
Look it up.
Dani (14:51):
Char Bruno 24 was charged
with first degree murder, first
degree kidnapping, and grandtheft in Jerome County.
He was also charged with rape inLincoln County.
And these are, I just, drum andLincoln are like,
Stephanie (15:08):
they're besties.
Dani (15:09):
Yeah, they're besties,
they're bestie counties.
they're right next to eachother.
Defense attorney Golden Bennettasked Jerome County officials to
move Char Bruno from the JeromeCounty Jail to another location
for his safety.
Someone had apparently banged onan outside jail window and
(15:29):
shouted your dead meat in thearea where she was confined.
Stephanie (15:35):
Well, so was it two
though?
How did they know if he didn't?
There's other inmates in there.
Dani (15:40):
Didn't it say, Mr.
Jamie, ow, you're dead meat.
They just said you're dead meat.
But also,
Stephanie (15:48):
and this somebody was
really saying that in a
threatening tone, was that lingoso popular that you would say,
you're dead meat.
Dani (15:57):
83,
Stephanie (16:00):
you are dead me.
And it's a serious threat.
Now.
That's like something I would, Iwould, I would, it was probably
some
Dani (16:06):
15-year-old kid that was
dared to do it.
Stephanie (16:08):
Right.
Go tell those.
Dani (16:10):
And how do you touch the
jail windows?
I just, yeah, I don't know.
I just walk up to the ADA CountyCanyon County jail and just bang
on some windows.
Stephanie (16:19):
Knock, knock.
Hey, how y'all doing?
Dani (16:21):
You're dead
Stephanie (16:21):
meat.
You're dead meat.
I'm gonna start use, I'm gonnabring, we're gonna, we're
bringing it back.
We're bringing dead meat back.
Well, I guess I can't recommendthis for everyone because your
HR might not make a point tookindly.
But maybe the next time Rickpisses me off.
I'm gonna say, you're dead meat.
Will you record a please, pal?
(16:44):
Listen, pal, you're skating onthin ice.
Dead meat.
Meat.
You're dead meat.
So now he needs a transferbecause of that.
Wow.
Very sensitive.
Dani (17:00):
I do have to tell you.
No, I'll tell you later.
Okay.
Uh, in August, Charvin Oakpleads not guilty to all the
charges.
Oh, NAMI, NAMI.
I was
Stephanie (17:16):
nowhere near there.
Dani (17:18):
This is, this was bizarro
to me.
Do you like my made up wordthere?
Bizaro.
Stephanie (17:23):
I think that's a fish
probably in the dictionary.
Dani (17:27):
Two trial dates are set.
October 1st is for the murdertrial.
And December 3rd for thekidnapping and grand theft
charge.
Stephanie (17:40):
Are we putting the
horses before the cart or the
carriage or whatever the sayingis?
Dani (17:46):
Why?
Stephanie (17:48):
Because if you get, I
mean, te test your theories on
the kidnapping and if you losethat.
Sucks.
Oh, well now you have.
Now you know what the defense isgonna do, strategery.
Folks, what is happening here?
Dani (18:04):
The trial dates are set by
the case number.
The murder charge paperwork wasreturned to the judge before the
other charges.
Therefore it will be triedfirst.
Stephanie (18:17):
I feel like as a
lawyer, you've gotta find a way
to slow down one over the otherthen and be like, oh, we're
waiting on a such and such.
Can't do that one.
It
Dani (18:26):
really wasn't the, and
listen, it was the prosecutors.
They're the one that files thecharges.
So maybe it was some strategery.
There's another made up word,Mr.
Golden Bennett is not happy withthat and he wants to move the
trial date.
It's plus
Stephanie (18:45):
slave queen.
Dani (18:46):
He has a vacation planned.
Super slave queen.
Golden said.
No one consulted him about hiscalendar.
When the dates were set, judgesaid, not my job.
I'm here to make sure we have afair trial not to consult
others' calendars.
Stephanie (19:05):
Especially for a
vacation.
I mean, let's think of a betterexcuse.
This is But Golden
Dani (19:09):
wanted to go.
I'm supposed to be in Cancun.
No, he is probably going like,oh, let me picture what his
vaca.
He probably was going to Reno,
Stephanie (19:24):
like he's going that
far or is he going to jackpot?
Dani (19:27):
No, I feel like they could
Stephanie (19:28):
get there easier.
Yeah.
Dani (19:30):
I not even that feel like
the
Stephanie (19:33):
Reno
Dani (19:33):
jackpot would be beneath
him.
Vegas, he would be too far abovehim.
Mm-hmm.
So I feel like he's a Reno.
Kind of a gonna cry.
Stephanie (19:43):
Hey, I can respect
it.
Dani (19:45):
I think he's an Reno kind
of an attorney because he is
literally working out of Jerome.
Stephanie (19:54):
Listen, they had a
suite on the corner in Reno.
At the Motel six, a suite, butjudge didn't care, so
Dani (20:09):
Judge said You're burnt.
Cancel your family.
Vacate to Reno.
Golden.
Probably had all of his kidsloaded up.
They're gonna take him to theCircus.
Circus.
Stephanie (20:18):
Yes.
Drop'em at Circus.
Circus.
We're good.
They're, they're, this is allmade up because they're like
Dani (20:24):
fucking, they're like
eight and 10.
They give'em like 40 bucks andbe like, yeah, mom and dad will
be back in like three hours, hours.
Don't talk to strangers.
Stephanie (20:33):
Six business weeks.
We'll be back.
Dani (20:39):
Oh, Okay, golden Files a
motion to exhume Marilyn's body.
Stephanie (20:51):
Oh Lord.
Dani (20:52):
He is claiming that
Marilyn's daughter, Tiffany, age
17, shot her.
Ooh, that is dirty.
Do you see why I said Reno?
Yeah.
Okay.
I mean, I
Stephanie (21:06):
understand the law.
The thinking behind it.
But that is, I mean, I know thisis in eighties, but surely they
know the difference between arifle and what was he using?
Dani (21:18):
A pistol.
Stephanie (21:19):
Oh, they got a,
Dani (21:21):
okay, please.
No, Steph.
Stephanie (21:24):
Oh my God.
Dani (21:25):
Wait.
Hmm.
Golden.
Might have been on to.
A reasonable
Stephanie (21:34):
reason for this.
Okay.
Oh gosh.
It's gonna come up now.
I'm terrified.
Dani (21:38):
No, it's Charvin is
claiming he saw Tiffany.
Shoot her mother.
And I wanna apologize, Tiffany,if I am saying your name wrong.
'cause it, it's not Tiffany.
It's Tiffany.
So I'm trying to really say itcorrectly.
Okay?
(21:59):
Okay.
Golden wants a detailed autopsysaying the pathologist.
Failed to make a completeautopsy and testified during the
preliminary hearing that he hadleft some bullets in Marilyn's
body.
Golden wants those bullets to beretrieved and tested.
Stephanie (22:20):
I mean, if it's true,
that's a valid concern.
They, I feel like that shouldnever be.
Left because that's evidence.
Dani (22:29):
Same.
Same.
But listen to this, oh Lord.
Deputy Sheriff Larry Webb saidexhuming, the body is
unnecessary.
He personally was there for theautopsy.
And the bullets that were leftin Marilyn's body were too
fragmented to be useful in anytest.
Stephanie (22:49):
This is
Dani (22:50):
83.
Yeah.
Yeah.
In another motion, the defenseis asking for a jury to come
from northern Idaho becauseMarilyn born, raised there.
Lots of family, lots of friends, and this newspaper.
Mm, they were.
Stephanie (23:10):
Spilling T?
Yes.
Okay.
Dani (23:13):
Um, yeah, they were all
about it.
Also, Mr.
Goldie is talking shit.
Stephanie (23:23):
Alright, Goldie, what
you got?
Dani (23:25):
He said he's surprised
that the Jerome County
prosecutor, Dan Adamson, has notremoved himself from the case.
Adamson's brother John wasformerly married to Marilyn,
Stephanie (23:39):
a former
sister-in-law.
Yeah, he has a valid point, butI, and I, listen, I gotta say I
like the delivery.
Oh, I'm surprised.
It's so like 14-year-old teenagegirl.
Yeah.
Like.
Oh listen sweetheart, that's soweird.
Dani (23:59):
Adamson basically said eat
shit golden.
I would prosecute my formersister-in-law.
Suspected killer
Stephanie (24:08):
and what suck it.
Appeals be damned motherfucker.
We do what we want.
Very Idaho.
Very Idaho.
Dani (24:17):
You're not the boss of me.
Even if you're No, and I'm in myresearch, Adamson was like, I
have no ill will against, like,I have no ill will against my
former sister-in-law.
Like I, why would I even have?
But also on the flip side, nowthat I'm thinking about that own
(24:39):
argument in my head.
If Adamson might be a littleshady because of the alleged
abuse against
Stephanie (24:50):
obviously being,
seeing her beat the heck outta.
Yeah.
Dani (24:55):
So there's kids involved
and I don't know the
relationship with the kids.
They weren't his nieces, but
Stephanie (25:02):
it was very, it was
volatile, no matter how you want
to look at it.
Yeah.
Even, you know, if we're gettingto the point of shooting and
bruises that make someone dropyour case about a shooting and a
frying pan, this is out ofcontrol.
No level's good, but this is farbeyond.
Dani (25:25):
He was the one though.
Stephanie (25:27):
Oh, who was,
Dani (25:29):
Adamson was the one.
I'm gonna go look.
Adamson was the one when Marilynand her dad.
I believe he was the one thatwas like, there's no, I can't
help you.
It, he was so
Stephanie (25:46):
what?
A tangled web.
Dani (25:48):
so, uh, golden.
Did you not look at that?
Like Adam's uh, he sounds likehe's being pretty fair.
Stephanie (25:55):
Yeah, he already, she
probably would've had a valid
case and he said, it's not thatvalid.
You don't have enough.
Dani (26:01):
Right.
He wasn't take, and that'sprobably why they went to him.
Mm-hmm.
Instead of the poppo.
Stephanie (26:08):
Oh.
Because they want advice.
They they know someone.
Yeah.
Dani (26:11):
Yeah.
Stephanie (26:12):
That can give them
advice.
Dani (26:17):
The request for exhumation
is denied.
The district judge wants moreevidence before he'll allow it.
The pathologist said the bulletsthat were left in Marilyn's body
were in her lower extremitiesand that it did not cause her
death.
She died from a bullet thatsevered her, a main artery near
(26:40):
her aorta, and from collapse ofthe lungs.
Mm.
Stephanie (26:45):
Well, I mean, she was
shot 15 times.
Good ness.
Dani (26:52):
And the judge also said,
you're outta luck, Goldie, boy.
We're not combining the trialsnor setting new trial dates.
Dunno why.
Stephanie (27:02):
SOLI think the judge
is just a, is my house not your
house?
I don't care.
I don't care.
You're going to Reno bud.
Dani (27:11):
You're picking up on some
good vibes.
Okay.
A motion to dismiss a firstdegree murder and the related
charges against charnow arefiled by Golden Bennett in the
motion.
He declares charges againstCharnow.
Should be dismissed because ofgross mishandling of the case by
the Jerome County Prosecutor andSheriff's offices.
(27:34):
Golden said he had a verbalagreement with Prosecutor
Adamson.
But he ignored the agreement,
Stephanie (27:43):
A verbal agreement.
I don't know what the
Dani (27:45):
verbal agreement was.
Stephanie (27:46):
Uh, can you not
charge him with the murder?
Maybe just the kidnapping.
I.
Eh, that they had a drunkenhandshake at karaoke night or
what?
Dani (27:59):
Probably.
Probably at the Butte Cafe.
We talked about this.
Golden also said several piecesof evidence that were proved
sharper.
Note did not kill Marilyn hadbeen purposely suppressed.
Stephanie (28:14):
What are these, you
say?
Dani (28:17):
Adamson said the motion is
frivolous and typical of Colby's
actions throughout theproceedings.
In the case, golden says Charvinadmitted to wounding Marilyn,
but he did not kill her,
Stephanie (28:33):
or did you just not
see her die?
Dani (28:37):
He also wants the grand
larceny and kidnapping charges
dropped.
The charges are unfounded andthere is evidence that proves
the incidents did not occur.
Dunno if said evidence, but youknow, Goldie says Golden also
says the Jerome Sheriff's Officewas aware that there were two
guns at the murder scene, butthe sheriff's office was only
(29:00):
interested in one of them.
He said it is now known thatthere were three guns at the
murder scene.
Guns On guns.
On guns.
During the motion for dismissal,Charvin testifies that Marilyn's
daughter fired the fatal shotthat killed her during the 10
days after the alleged rape andkidnapping.
(29:23):
He hitchhiked through Nevada andinto Jordan Valley and then back
to his grandfather's ranch inHawaii County.
In search of work shoeing horsesfor ranches.
So this next little bit that, that, and this next little bit
is actually his testimony.
Okay, so this is all allegedlyfrom the horse's mouth, though
(29:48):
unable to find work.
He returned to Jerome and stayedin the barn of Marilyn's home
several days before the Sundaywhen she was murdered.
Sharper stated that he andMarilyn made love.
Looked at the 22 caliber riflehe had purchased for her
daughter Tiara.
(30:08):
I hope I'm saying that right,Tiara, and got along well.
Although Char Bruno said hewasn't hiding, Marilyn did not
want her daughters to know thathe was there.
Stephanie (30:21):
Mm.
Dani (30:22):
I could, with all the
Stephanie (30:24):
drama, I could
especially, you know, I'll give
your, your daughters are oldenough to be like, what is
literally happening?
If that's the case, I could seeit.
Dani (30:34):
And Tara was 14 and
Tiffany 17.
They're fully aware of what'sgoing on.
Oh, yeah.
And they're, and I could seethat being legit, like.
What is out about all this?
Why in
Stephanie (30:47):
the hell is he here?
Dani (30:48):
Yeah.
Like, what are we doing?
So I could, I could see that.
Stephanie (30:52):
Mm-hmm.
Dani (30:54):
he said, but then there's
Bullshittery, so here we go.
I mean, here we go.
This is his testimony.
But he slept on the floor andwent without food from Thursday
until Saturday evening, untilMarilyn brought him lunch.
Stephanie (31:11):
He was hangry if he
was there willingly.
I can't see how that wouldhappen.
That's what if we have horses,oh, I forgot to go do this with
the horse.
Right.
It would've been an easy excuse.
The only thing that the kidswould've recognized is, I'm sure
they were helping with thesehorses.
Mm-hmm.
With bedding and feeding andwhatever.
They may have noticed that theydidn't have as many chores, but
(31:33):
there's always a reason to goout there.
You can make up a reason.
So
Dani (31:40):
out of the unbelievable
story, I do believe that if he
was there, Marilyn was like,Hey, but I don't know.
I think would be reasonable.
Yeah.
For her to be like, the girlscan't know you're here because
I'm not ready to deal with that.
(32:00):
Mm-hmm.
Because I shot you and also youjust kidnapped and raped me, so
you can't be here.
Yeah.
So on Sunday, Marilyn came tothe barn and told him she would
finally tell the girls he wasthere.
(32:21):
She then took the rifle to thehouse to show Tiara because he
had bought that gun for Tiara, the rifle, which would not be
outta line, considering the timeand where they lived.
Mm-hmm.
Nope.
Teenagers are having guns.
Yeah, totally normal.
she later returned with the gunand they were going to side it
(32:43):
in, so she came back to the barnwith a gun and they were gonna
side it in.
Marilyn, then loaded a handfulof bullets into the gun.
And that's when Char Bruno askedher where she had spent the
previous night since her vehiclehad not been home.
Stephanie (33:03):
It's an interesting
story.
I feel like most women aresmarter than this if someone's
staying on your property, but
Dani (33:10):
I also kind of feel like
Marilyn didn't give a shit.
I, I do feel that I, it's likeI'm not hiding shit from you.
She was to that point.
Mm-hmm.
I mean, we've known people.
I've, I've been that personlike, Hey, I don't give a fuck.
Stephanie (33:28):
Yeah.
I, I'm helping you out byletting you sleep in the barn.
Dani (33:31):
Yeah.
And I'm gonna do what I do.
Stephanie (33:34):
Yeah.
Dani (33:34):
And if you don't like it,
get the fuck out.
Yeah.
Stephanie (33:39):
Very.
Interesting web of crazinesshappening here,
Dani (33:46):
but that question provoked
her.
She got pissed.
like, why are you even ask andfair?
Who's staying in whose barn?
Yeah.
Like, we're divorced.
I'm letting you stay here.
Hiding from the police.
I mean, this is all assumingthat his story is correct,
(34:06):
right?
But
Stephanie (34:07):
logically, like all
of these factors would come into
play, right?
Yeah.
Like.
It doesn't fucking matter whereI'm at.
At your dad's?
Mm-hmm.
When you were trying to shoehorses, you're here.
I've given you what I can give, which is sleeping in the barn.
Dani (34:23):
So she was pissed.
It provoked her and she grabbedthe gun.
Uh oh.
Allegedly, all of this is histestimony.
Marilyn told him not to startthat again.
Eh, I could see that.
Like, quit asking me what thefuck I'm doing, dude.
Like we're done
Stephanie (34:43):
possible.
Sure.
Dani (34:47):
And then Char Bruno told
her that her parents thought she
was crazy.
Her daughters thought she wasplaying around with her
boyfriends.
And that he thought she wassleeping with everyone else,
Stephanie (35:01):
then why are you here
exactly for table scraps?
Dani (35:04):
Right?
Char Bruno said she told himthat she couldn't live with him,
but couldn't live without him,and warned no other woman was
going to get him.
Stephanie (35:16):
Hmm.
I don't know if I trust thequoting parts because, yeah,
whatever.
It was clearly a toxicrelationship though, where
people were trying to make, noteven trying to put like a square
peg into a round.
Hole, worse than that, trying toflush a cat down a toilet, it is
(35:39):
not going to work.
And you're gonna get cut and bitin the process.
this isn't love, this isn'tromance, this like whirlwind and
up and down.
And some people get addicted tothat.
Mm-hmm.
And this sounds like that.
oh, we're just so crazytogether.
We're so crazy.
No.
Y'all are fucking weird.
(35:59):
And it's weird for everyonearound you.
I know that you guys can relate.
You either were that person oryou've been around that person.
It's fucking weird.
Dani (36:08):
Yeah.
Stephanie (36:09):
Like nobody likes
this.
What is happening?
You're making it strange foreveryone.
Just go your separate ways andstop being, do whatever they
doing.
Know what?
Dani (36:20):
They don't even have like
cell phones, so it's not like
they were like drunk texting orfucking no.
They literally had to like meetup anyway and be very toxic.
Stop this nonsense.
Immediate Charvin o said that iswhen he pointed the loaded rifle
at him and said.
(36:40):
You are dead.
Dead meat.
Sorry.
I'm so sorry.
He heard a click and thenrustled the gun away from her.
He said he was scared.
He closed his eyes and beganshooting the rifle.
Yeah, he fired three or fourshots and when he opened his
(37:03):
eyes, Marilyn was on her kneeson the floor.
Clutching her shoulder.
Then he saw Tiffany coming tothe barn with a gun.
He went over to Marilyn and sawshe had been shot and told
Tiffany to call the ambulance.
Bull Ow.
And Marilyn told Tiffany toleave the barn.
(37:27):
He said he was afraid Tiffanywas gonna shoot him fair while
she was ready.
So he ran from the barn.
He could hear talking while hewas outside the barn.
And when he peeked back in, heclaimed he saw Tiffany standing
over her mother aiming the gunwith both hands at her.
He said he heard a shot and sawMarilyn's hair fly up.
(37:53):
He closed his eyes again.
He can only recall hearing oneshot.
Stephanie (38:00):
Mm.
Of course it's all plausible, but a lot of this, I gotta call
bullshit because it's just sonovella, it's so soap opera,
right.
Of like,
Dani (38:13):
no thank you when cross
examined.
He could not explain the 15bullet entries into Marilyn.
Oh, that's tough.
How
Stephanie (38:25):
did those get there?
Dani (38:27):
When asked about the
kidnapping, he said Marilyn
drove the car to Shoshone andshe made the suggestion to make
love.
She kidnapped herself.
Stephanie (38:37):
I wanted to go home
because I have a home to live in
by myself, the barn, and she wastaking me
Dani (38:49):
away from my home.
She jumped from the car.
And flagged down another vehiclethat took her to goodie Sharino
said he left her vehicle at thetavern in Jerome, where she
would surely find it.
That's a dig.
I knew she'd be at the bar.
(39:10):
So he then hitchhiked to Nevadabecause his truck wasn't, wasn't
running.
Probably'cause it his full bull.
Stephanie (39:17):
Sorry.
Dani (39:19):
And of course, judge
Philip Becker denied the motion
to dismiss.
He said, shut the actual fuckup.
Anyway, but he did vacate theDecember 3rd trial date to give
both teams more time to prepare.
Stephanie (39:34):
I think that's good
because we do not need these
speedy, speedy, speedy, speedy, speedy trials, of course, within
your constitutional rights, butwe're not arresting on a Friday
and prosecuting on the nextFriday.
Dani (39:49):
We've, oh, we've seen some
fast trials.
Char's mother, Betsy Mcil, wroteto the Times News in early
November.
They printed her letter in theeditorial section.
Stephanie (40:05):
Okay.
Dani (40:06):
I'm gonna read it to you.
Stephanie (40:08):
Let's hear it
Dani (40:10):
outside.
I feel the season's changing.
A soft rustling of the leaf.
That quickly haste.
Since the passing clouds with apromise of snow and a new winter
that is sure to come.
Stephanie (40:25):
Is she a
meteorologist?
I'm sorry.
I'm such a bitch.
Dani (40:30):
It seems that summer
passed had suddenly gone,
leaving only despair and lonelydays.
In the lifetime of trauma thatnow faces a young man and the
tragedy of the death of hiswife, of a lost love, a lost
marriage, and a divorce that wasto end.
(40:54):
With a terrible chill.
Stephanie (40:58):
She's going for that
award that we've never heard of
from that other case.
She, that's, that's, I mean,it's very eloquent.
Dani (41:09):
I have listened to the
media and read of your
outrageous statements concerningJB Ow.
And with little or no thought orregard of his rights as a human
being, never checking the facts, only listening to hear or read
the bloody gossip, which is onlymeant to the media.
(41:32):
One more paper sold, one morewattage on air at the cost of a
human soul.
And we ask ourselves what price?
Glory.
I am preaching now I do feelreally bad for her.
(41:56):
Because she believes in her sonso much.
Of course she does, but shecalled him a young man,
Stephanie (42:00):
which he is a young
man.
This is not a toddler though.
No, this isn't a teenager.
Okay.
This isn't a 19-year-old.
Lemme preach.
Dani (42:10):
Have we all lost the
meaning of justice to the real
meaning of innocent until provenguilty Has the new media so
turned to blood to raise themetabolism of the public?
What has happened to the goodold American heritage of
innocent until proven guilty?
I read Lie After Lie After Lie,and that's what's asked by
(42:35):
several people to have aretraction in your paper because
they have been misquoted A youngman's life lies in Half Truth
and lies that have been writtenby the reporters at the Times
News in Twin Falls.
Yes, your words have left themedia breathless and astonished
(42:57):
as such a crime of July 1st,1984, but has only taken one
time to fill the eyes and earsof your readers with the sounds
of truth and rightful justice ofwho's right and he's wrong.
Stephanie (43:13):
That was the perfect
one to do at fucking TikTok
Dance two.
Dani (43:20):
She is not done.
You're fucking joking.
Stephanie (43:25):
Hold on.
I gotta stretch because I was, Iwas pulling out some of the big
guns on my one.
Dani (43:32):
Oh Jesus.
Ooh, one year ago.
August of 1983, Jamie wasleaving Marilyn.
He told her that he loved herbut could no longer live with
her because of her mental statethat he couldn't live with her,
(43:52):
always trying to kill herself.
Marilyn told Char Bau that if heleft her, she would kill him.
He got up into his pickuptrailer.
To leave.
Marilyn then unloaded her guninto the side of Hi Jamie's
truck, hitting him in the rightelbow, and once in the right
(44:13):
leg, the bullet still remains inJamie's elbow.
The doctor at St.
Alphonse's Hospital in Boisecould not remove the bullet for
fear.
Jamie would never use his armagain.
Jamie and Marilyn tried again towork things out for their
marriage.
(44:34):
Marilyn again tried to killherself.
Jamie felt sorry for her andwent to court for his wife's
behalf after she was arrestedfor shooting him.
Only her defense being thatJamie had molested her two
daughters.
Both daughters denied theseaccusations under oath in Mr.
(44:56):
Rose's office and Shoshone.
Jamie loved and treatedMarilyn's daughters as though
they were his own having none ofhis own.
Marilyn was released from thecharges of shooting Jamie after
she divorced Jamie.
She still would not leave himalone.
She called him.
(45:18):
Wrote to him, went to his jobsuntil he agreed to come back to
her.
Then she told him she didn'twant him in the house and she
made him a bed in the barn atthe house she rented.
Marilyn again, tried to killJamie.
She already had a loaded gun inthe bar.
(45:40):
She aimed at Jamie's head andfired it being a fully automatic
gun.
It had to fire once to bring thebullets into the chamber.
Then the gun begins to fireautomatically.
Jamie and Marilyn then begin tostruggle over the gun.
(46:01):
The gun went off striking thelower extremities of Marilyn's
body.
Being on the ground in the barn.
Marilyn then pulled Jamie to hersaying that she loved him and
that she was sorry foreverything.
Jamie then left the barn andwent into a nearby field to
await the arrival of the policeto give himself up and to avoid
(46:26):
further trouble with Marilyn'sdad.
Marilyn's father hated Jamie forbeing with Marilyn.
We have all lost a sense ofhuman compassion as to better
feed and take care of animalsthan a human life.
Even though a person may beincarcerated for a crime in jail
(46:48):
that only shows, that onlyallows two meals a day and a
shower only when permitted or toinvade a person's right to
privacy.
Stephanie (46:56):
The, they are very
against hangriness.
Are they talking about like thetwo?
They had him in a barn.
You weren't feeding him.
Yeah, and, and they get twomeals a day in jail.
Like, sorry, you don't have ajob, you don't have nothing, no
Dani (47:18):
DoorDash for you fucker.
You get a
Stephanie (47:19):
free roof over
Dani (47:21):
your head and
Stephanie (47:21):
some meals.
Dani (47:23):
And sometimes people come
and knock on your window and
scare you.
Dead meat.
You're dead meat.
The authorities in jail stealingthe inmate's mail, especially
that of confidence between alawyer and a client that
happened to Jamie in the Jeromejail.
Is this the American way ofjustice, independence, and
(47:46):
innocent until proven guilty.
Jamie got a piece of steel inhis eye from the soap dish in
jail.
Not the soap dish.
The soap dish, sorry.
His eye became swollen andinfected before his lawyer could
get the Jerome gelatin to takeJamie to the doctor.
(48:08):
Then the Jerome authoritieswould not let the eye be treated
the the way the doctor askedfor.
Thank you so much for yourpatience.
I only hope and pray thatjustice will be done in my son's
case.
And that some reporter orsomebody cares enough for the
freedom rights in our country ofAmerica to see that justice is
(48:30):
done and that even though ahuman is jailed, they are still
human.
Stephanie (48:38):
Wow.
Mama.
That was, I mean, put her onthis.
She, why isn't she the counsel?
She, she thinks that's her job.
She's fucking right.
She's like, ride or die.
I could give you every singledetail of how it happened.
Was I there?
No.
Was I anywhere around?
No.
Um,
Dani (48:56):
but Marilyn's a crazy
bitch.
And my son's innocent.
Ugh, eh.
Just, and I'm, oh, I'm veryAmerican, by the way.
I am so American.
Stephanie (49:12):
Yeah, we're American,
like we live in America.
And
Dani (49:18):
I found it very
interesting how it.
Started out almost like a likepoetry, like she was writing as
a rustling of the leaves.
Yeah.
And then she's like, my son gota sliver of metal in his eye
from a soap dish.
Stephanie (49:36):
What the fuck were
you doing around the soap dish
for that to happen?
Dani (49:40):
I don't know about you,
but my eye is never near a soap
dish.
Stephanie (49:44):
I've never gotten a
sliver in my eye.
From anything, especially not asoap dish.
How vigorously are we washingour faces, folks?
What's happening here?
The fuck you don't Headbutt thesoap dish.
Stop.
Headbutting the soap dish.
Somebody assisted him in washinghis face.
(50:06):
Is that what we're trying tosay?
I feel like Marilyn.
I feel like his mom would'vesaid that.
Dani (50:11):
Good old Betsy.
Yeah,
Stephanie (50:13):
Betsy.
But yeah, I appreciate it,Betsy.
I, I know how a mom would feel, and I feel like this is, we see
a little bit of toxic mom here.
Where, where I wonder if, ifthis young man, as she says, was
ever able to schedule anappointment on his own or get a
(50:34):
power bill in his name withouthis mom calling to do it for
him, that kind of thing, whereit's like, eh, I'm getting a
little bit of those vibes
Dani (50:46):
and I, I kind of getting
like, I don't know this for a
fact, but I'm kind of gettinglike only child vibes too.
Stephanie (50:53):
Yeah.
Yeah.
Dani (50:54):
You feel
Stephanie (50:54):
that an only child
son vibe?
Yep.
Where it's like thetriangulation of the
relationship mm-hmm.
Is very little off here.
Anyway, that made me very don'trun vibes.
Guys.
This is not scientific.
This is not journalism.
This is just.
Uh, put your own spin on it.
(51:16):
What do y'all think?
Dani (51:17):
In December, the rape
charge in Lincoln County was
officially dropped.
The prosecutor, Doug Rose, isasking for the dismissal due to
the lack of evidence.
He said quote, it is not becauseI feel the crime was not
committed, but rather becauseMarilyn Arbor the only witness.
(51:39):
It will be difficult to prove.
And of course, with all thisdrama going on with the case,
prosecutor Adamson also lost theelection in November.
The county has a new prosecutor, mark Gouss.
Adamson filed an affidavit for aspecial prosecutor to handle the
(52:02):
case due to Gauss'sinexperience.
Special Prosecutor House willtake over.
So it's a fucking shit show downthere we got.
But he's basically filing andbeing like, yeah, like, well,
this is a whole thing.
So the case is supposed to startin the middle of January.
And, but he is not theprosecutor anymore.
(52:25):
Mm-hmm.
And he's been on it this wholetime.
Right.
And so now they have, and I wentthrough the whole, I'm just tell
shit show there was people thathad no business running for a
prosecuting attorney.
One guy that ran, I can'tremember his name, but um.
(52:48):
He went to law school and passedthe bar, and then he went and
got a job at a, I wanna say itwas like a chicken farm.
It was something ridiculous likethat.
That's just what my brain istelling me like, and then he is
like, Hey, I'm an attorney.
(53:10):
I could be prosecutor, I'm gonnarun, I'll put up some signs.
Anyway, yes, basically this is,it's a very small county, slim
Pickens, very small county, andodds are he had a good chance to
win if he's a good old boy andhad lots of family there.
So anyways, but this new guythat's coming in Gauss is just,
(53:34):
he doesn't have any experienceand so he is like.
All right.
I'm gonna reach out and findsomebody that can handle this
case, so that's fair enough.
That's where we sit.
We are in 1985.
God, it's been a long two years.
(53:56):
Yeah.
What's happened?
Uh, Goldie.
Mr.
Goldie asked for a change ofvenue.
He also files a motion fordismissal and an exhumation of
Marilyn's body again,'cause he'dalready asked for this.
The change of venue is grantedand the trial will be moved to
(54:17):
Ada County.
Let's go.
The judge did not decide on theother motion.
The Northside News sues theJerome Sheriff.
Over access to Char Mano.
The paper is trying to interviewhim in jail and they were turned
away by the sheriff.
Char Beau wants to talk to thepress regarding jail conditions.
(54:39):
All uh, who was that motorcycle
Stephanie (54:42):
gang?
Yes, the motorcycle gang.
That was like, um, the sanitaryconditions here are terrible,
unacceptable.
And they move to another jailand they're like, actually.
All of those articles andinterviews that I did, I Please
take me back to the other jailbecause here it's real bad.
Mm-hmm.
And
Dani (55:01):
yeah.
Stephanie (55:01):
Yeah.
Dani (55:03):
But Goldie is totally okay
with it.
He is like, talk to the press.
He,
Stephanie (55:08):
uh, no media
training.
I mean, this is the eighties, soI get it.
But, well, and we can see thatwith the mom's letter too.
I feel like she was encouragedto write that.
I do too.
They're trying
Dani (55:21):
to sway and everyone,
during my research, mom, I read
that first letter.
Mom wrote multiple letters.
Char wrote letters.
Goldie wrote letter, likethey're going on a whole
different, everybody wroteletters to the editor, which
Stephanie (55:39):
is pretty unique.
For the time, I would say, shutthe fuck up, please shut the
Dani (55:45):
fuck up.
Sheriff Hall says If he lets onereporter in, he'll have to let
'em all in.
Good old boy.
He's a hey.
Huh?
Just one month before the murdertrial, good old Goldie requested
to withdraw as sherburnattorney.
(56:06):
Ooh, I'm done.
She.
Anyway, I'm out.
Well, char Bruno had stated hehad lost faith in his attorney
for several weeks.
I don't know if he stated thisto other people in jail, in
court, or if he took the adviceto go to the press with it,
which, what a mess.
But he had already just fullywas like.
(56:28):
Yeah, I, I don't like, and, andyou're gonna see her.
This, is gonna become a commontheme.
Golden said he couldn't do anadequate job knowing how Serino
feels about him.
Him fair.
(56:49):
So he's appointed a publicdefender, Randy Stoker.
Ooh.
But Golden says he hasn't beenfired by Chao's Mother who is
paying him and wants to stay onthe case, and he plans on
staying on the case to assistStoker.
Okay.
And the judge.
Okay.
The plan to combine the trials, which makes sense.
(57:12):
Let's get her done.
And one big thing I thought, Isaw through all my research was
the cost of all of the shit tothis tiny county.
They're like, can we condensethis down a bit?
Yeah.
Stephanie (57:27):
people were
Dani (57:28):
pissed.
They wrote, I mean, severaltimes to the paper, people were
just pissed.
There was so many articles aboutthe cost of this trial, the cost
of this trial, the cost of this, the cost of that.
'cause it was a lot of moneyback in the day.
I mean, it's still, but it was
Stephanie (57:47):
a very tiny county in
the eighties.
Dani (57:50):
I think the county, I
wonder it was like 18,000
people.
Hmm.
Yeah.
And they're footing the bill
Stephanie (57:59):
for this guy.
They're like, okay, can we justmove it?
No wonder these trials within afew months were happening.
They're like, we better get iton the books, or we're gonna
get.
Attacked
Dani (58:11):
and a lot of the
complaints were lit.
'cause you know, appeals, appeals, appeals are coming,
they're literally draining
Stephanie (58:20):
their whole budget
and their resources for other
cases too.
On this
Dani (58:25):
guy, they were over it in
April.
The trial begins in Boise.
A jury is finally seated, consisting of six men and six
women.
(58:46):
It took nearly four days tointerview 46 people before the
jury was selected.
Defense attorney Stoker istrying to get the statements
made when OW testified during amotion hearing the previous year
to not be entered in asevidence.
Oh, do you remember thatpreliminary hearing?
(59:07):
Yeah.
that everything was, that youhad his testimony?
Yeah.
Goldie was like, Hey, you wantthis?
Dismissed.
Get up there and tell him yourstory.
Oh, yikes.
Stoker says Charvin O wasill-advised from his attorney.
That's still partnering on.
Stephanie (59:26):
I know.
It's so weird.
It's just so fucking weird.
Imagine having that said incourt and you're sitting there
also at the defense table, like,uh.
Dani (59:34):
This attorney sucked.
I mean, he's still on our team, but that was, that was a shitty
move.
That was, that was a bad move.
The drama, judge Becker said,Nope.
Anyway, he was like, Ipersonally advised you of your
right to remain silent and youstill fucking talked.
(59:54):
Yeah.
Stephanie (59:55):
There's only so much
you can do.
Like esp, we've all seen theones that wanna represent
themselves and the judges arelike in every single way.
They're like, this will be worsefor you.
Your attorneys can give youtimes to talk or comment, but
they know the rule of law andthe procedures and what goes and
doesn't go, and these people arelike.
We'll figure it
Dani (01:00:16):
out.
I can do it.
Fuck, fuck my attorney secret.
I'm way, way smarter than myattorney.
Stephanie (01:00:20):
Yeah.
Dani (01:00:21):
I'm in jail for murdering
somebody way smarter than my
attorney.
I know what to do.
In opening statements.
Prosecutor Hawes said AU washiding out.
In a potato cellar across thedriveway from Marilyn's home.
He had a Remington rifle and twoboxes of ammunition that were
(01:00:44):
purchased just three daysearlier in Hagerman.
Oh, haw said on, and this just afriendly reminder, he was on the
run for 10 fucking days for thekid Nap and Ray.
Stephanie (01:01:02):
Yeah.
And he was across the street.
Dani (01:01:04):
Yeah, so he, he had a
warrant out for his arrest at
this time, but he is like, I'mgonna go buy a gun.
And only in the eighties couldthat happen anyway.
haw said on June 21st, Marilynwas eating a taco salad after
her shift ended at the Butte.
(01:01:24):
When her ex-husband walked inaround the same time, another
patron walked in and offered tobuy a round of drinks for
everyone.
Which Irk Char, no,
Stephanie (01:01:37):
I'm sorry.
When has that ever been Badnews?
Dani (01:01:40):
Apparently it was Au
wanted to know who was buying
Stephanie (01:01:45):
her a drink in
addition to everyone.
I mean, maybe there was onlythree people there who knows.
It's the Butte.
Yeah, maybe.
Dani (01:01:55):
But she
Stephanie (01:01:58):
also works there.
People are gonna wanna buy herdrinks regardless.
Right?
'cause you have your littleregulars that are, you know,
they have that pair of socialrelationships.
They think you're besties.
Dani (01:02:11):
When the two went outside,
Charvin Noah, abducted Marilyn.
The next time she was seen wasabout 2:00 AM in the morning.
Two women from Lewiston werestopped at the intersection of
Niagara Springs Road and BobBarton Highway near Wendell.
I wanna look up who Bob Bartonis.
You'll recognize the highwaywhen Marilyn jumped from the
(01:02:33):
hatchback over a Fiat stationwagon.
Marilyn cried out to the women.
Please help me.
He's had me out all night andwon't take me home.
Marilyn claimed the red marks onher neck were from sharper, no.
Trying to strangle her defenseattorney Stoker said the marks
on her neck was from a skinirritation, which she had been
(01:02:56):
seeing a doctor for.
It was eczema.
Hmm.
A coworker of Marilyn's, ChrisSmart, testified that she had
been invited to go to Gooding.
With her on Saturday the nightof the kidnapping.
Marilyn later changed her mindand said she decided to go to
Twin Falls instead because owhad supposedly been spotted in
(01:03:20):
the Gooding area and that shewas afraid of him.
Fair sis.
Stephanie (01:03:25):
Okay.
Dani (01:03:26):
Chris also testified that
Char's standard line of
introduction was.
Quote, I don't know if you knowit or not, but I am Marilyn's
husband.
Kind of a big deal.
Kind of a big deal.
Uh, I know a little
Stephanie (01:03:47):
cringe it.
Dani (01:03:49):
Very
Stephanie (01:03:50):
fucking church.
Again, I know we say vibes, butintuition and.
Just discernment and women trustyourselves because you're just
seeing a micro thing.
(01:04:10):
That usually is tied to a macroproblem.
Dani (01:04:16):
Oh my God.
Look at you.
Boom.
Gary stole a cowboy from Elco,Nevada said he spoke with Char
Burnow on June 26th.
I'm say there's real cowboys inthis like.
Yeah, yeah.
Char Beau claimed to be a rodeoclown from Arizona who was
(01:04:39):
counting studs for thegovernment.
Gary gave Char Beau a ride fromSouthern Hawaii County for
approximately 2025 miles North.
Char Beau told him rattlesnakesscared away his horse and his
pickup was out of fuel in theSheep Creek area.
Stephanie (01:04:58):
That's a lot of
problems for one person.
Dani (01:05:00):
It really is.
But sharper, no.
Was a cowboy.
Yeah, he was a rodeo.
Something I don't Rodeo.
Clown.
Clown.
Yeah.
Stephanie (01:05:14):
Affiliate.
Sure.
Dani (01:05:25):
Another man, Albert Baraga
said Char Bruno introduced
himself as Sam at a Simplot campin Hawaii County.
Sam claimed to be counting wildhorses for the government and
said he was from Montana.
Ow.
Gave him the same story aboutthe horse.
But with no rattlesnakes.
(01:05:46):
He said, my horse ran off.
Stephanie (01:05:48):
Mm.
Horse ran off out I gas.
It's a country
Dani (01:05:52):
song for sure.
Both witnesses remember Charnowcarrying a backpack similar to
the one Marilyn used as a purse.
Ooh, that backpack was laterfound stuffed in a building on
Marilyn's property.
Okay,
Stephanie (01:06:07):
interesting.
Dani (01:06:10):
And her car was again
found in Wahe County on a
property that Char Bruno'sgrandfather used to own,
Stephanie (01:06:18):
so known to the
family.
Dani (01:06:20):
All of VINs, except for
the secret VINs.
Stephanie (01:06:22):
Mm-hmm.
Mm-hmm.
Dani (01:06:26):
the girls testify.
Okay.
Tiffany testified she was upsetand confused when giving her
original statement to thedetectives and her tearful
testimony.
She said that she saw Charnowwith a rifle standing over her
bleeding mother.
She said her mom came homearound 10:30 AM that morning.
(01:06:48):
And went to move horses thatwere in the wrong corral.
She was reading when she heardshots fired.
She ran to the horse corral withher mother's 22 caliber gun.
Tiffany saw her mom sitting inthe alleyway and Charnel was
standing over her holding a gun.
(01:07:10):
So there's been some, the firstreports is that she was in a
barn.
But apparently between thecorrals and the barn, there was
what they quote called thealleyway.
Okay.
So they both asked her to leave.
Tiffany then ran to the shopacross from the cellar and
(01:07:32):
called the police station andtold them Jamie had just shot my
mom.
And then she went back to thehouse and got her sister out of
the bathtub.
And changed from her pajamas tostreet clothes as her younger
sister also got dressed.
Both the girls ran and tookcover behind a wagon near the
(01:07:53):
corral.
It's a real wagon.
It's a sheep wagon.
Okay.
Tiffany accidentally fired oneshot from the gun she had.
They heard another series ofshots and ran back into the
alleyway.
Tiara brushed her dying mother'scheek and ran to call an
(01:08:13):
ambulance at Tiffany's demand.
One minute she was looking at methe next, she wasn't.
I knew she was dead, so I closedher eyes.
Shaana was gone.
On cross examination.
The issue of Tiffany being theone who shot her mother never
came up because remember thatwas, they knew
Stephanie (01:08:37):
it was a BS story.
Dani (01:08:39):
Yeah.
Goldie's like, uh, yeah.
For what you just need toconvince.
The jury that her daughter
Stephanie (01:08:45):
shot her and a man
with a gun ran away instead of
stopping it or overpowering theperson.
Sure, sure, sure.
Dani (01:08:55):
Deputy Ernest Coates
testified that former county
prosecutor Adamson told him todispose of a 22 shell casing
found in the sheep wagon.
He quoted Addison as saying thespent casing wouldn't be needed
and it wasn't pertinent to thecase and it could be discarded.
(01:09:17):
Mm.
Sto her asked cos if thesituation was a little
embarrassing, and COA was like, yeah, it is.
Prosecutor Oz, ask Coates if henormally took orders from the
prosecuting attorney rather thanthe sheriff.
Quote, usually I don't, but thatday I did.
(01:09:39):
Good old boys.
I'm just saying.
Stephanie (01:09:41):
Creating fuckery.
Dani (01:09:43):
Mm-hmm.
Coates put the casing in a filmcanister and threw it out after
Char Bruno's preliminaryhearing.
Shady.
Stephanie (01:09:53):
Yeah.
And you're just making this shitworse.
Dani (01:09:57):
Adamson later testified
that he told the deputy to
dispose of the of the shellcasing because he didn't think
it was important because itwasn't found near the body.
You don't dispose though.
Stephanie (01:10:09):
You can say, Hey,
this isn't relevant.
They shoot guns all the timearound here.
This is probably from, there's alot of other reasons and they
should be able to be proven.
You don't say throw it away.
Dani (01:10:24):
And a film canister, which
don't even whoop, whoopsie.
Yeah.
Uh, St.
Stocker made the point thatMarilyn had 16 bullet wounds,
but only 14 bullets were missingfrom the ammunition Char Burnow
had purchased when the gun wasretrieved, there were still
three.
Live rounds in it.
(01:10:48):
Math is not math.
It's
Stephanie (01:10:49):
relevant, but,
Dani (01:10:55):
okay.
Robert Ramsey, the pathologistthat could conducted Marilyn's
autopsy, gave some explanation.
He said his examination showed16 bullets had entered her body.
But only found 15 exit wounds.
He said he may have missed oneof the exit wounds or two
(01:11:18):
bullets might have left the bodyfrom the same hole.
Or one of the bullets could havefragmented it before it struck
Marilyn causing multiple entrywounds.
Or a bullet could havericocheted and entered her body
twice, or she may have coughedup a bullet lodged in her throat
(01:11:40):
before she died, or a 17thbullet that grazed her arm could
have penetrated her bodysomewhere else.
Accounting for an extra entry.
Or, oh my God, sorry, I'mlaughing.
Or a bullet that went throughher hand could be responsible
for the extra entry.
Stephanie (01:12:03):
Yeah.
All great ideas, but it feelslike there was some laziness or
not thoroughness at the firstone.
Like this is literally your job.
And literally we should havedoted these i's and crossed
these T's.
And so I'm gonna give a little
Dani (01:12:23):
props to Goldie for being
like, Hey, hey, let's exhume the
body because the doubt.
Sure.
But goldie's still crazy.
I Judge Becker dismissed thecharges of kidnapping and grand
theft against ow after thedefense team presented a motion
(01:12:44):
to dismiss.
In the motion, Stoker stated,Jerome County had no
jurisdiction in the case becausethey couldn't prove that it
happened in that county.
Stephanie (01:12:53):
Sure.
And again, there's pressuresfrom all over of like, get her
done.
We don't need 17 cases.
So now they're really relyingon.
The murder charge, right?
Yep.
Dani (01:13:10):
Testimony is completed and
Judge Becker advises the jury.
They can consider four verdicts.
I need to do research on this.
I don't under, I thought it waslike this count or this count.
I, we talked about this onanother case.
Yeah.
I don't understand this.
So he said,
Stephanie (01:13:26):
which I can kind of
understand the first versus
second, like, did they plan itor did it come about in the
moment?
Sure.
Yeah, that makes sense.
But doing like an involuntarymanslaughter or like accidental
vehicular manslaughter, likeincluding all of that in, not
specifically this case.
(01:13:47):
It's
like just let's just charge'emwith everything.
Yeah, which is basically whatthey did.
These are the charges, or theysaid that, uh, what they could
consider for the verdicts.
First degree murder, seconddegree murder, voluntary
manslaughter, or involuntarymanslaughter.
All of them.
(01:14:09):
After 13 hours of deliberation, the jury found charvin guilty of
first degree murder.
One juror stated the verdictwould've been returned faster if
the state didn't throw awayevidence.
You're throwing a
wrench in the gears.
That already move in most cases, very slowly,
Dani (01:14:34):
the death penalty is on
the table.
In December, a pre-sentencinghearing, the prosecutor Hawes
asked for the death penaltystating there is no mitigating
circumstances in the burner ofMaryland.
He said if Charna was everparoled in the future, he had
(01:14:55):
posed a threat to the lives ofother members of Marilyn's
family.
We made it to 1986.
86.
Stephanie (01:15:07):
Let's
go on.
January 29th, 1986.
Charmin O was sentenced to deathfor the murder of Marilyn
Arbaugh.
Here we go.
Appeals.
Appeals Appeals.
A post-conviction reliefpetition was filed by Jim May
Char O'S new attorney.
One issue raised on appeal wasthat golden.
(01:15:28):
Bennett's re representation ofCharel Golden allowed charel to
be sworn in and give testimonyat the pretrial hearing.
Again, if a judge,
they literally are like, are you
on drugs?
Are you drunk?
Do you understand how thiscould, could benefit you or be
(01:15:49):
like a detriment?
Like.
Uh, they go over all this, like,
Dani (01:15:54):
that's what Judge Becker
said, like I personally advise
you.
Golden also allowed ow to beinterviewed for more than two
hours by an investigator for thestate without being present.
Okay.
Stephanie (01:16:09):
Whose fault is that?
Dani (01:16:12):
Mm.
Goldie's.
And look, I outta thatfrustration.
It's just, it's not, and theclient for sympathy, it's just
like you're a fucking idiot.
Golden and Prosecutor Stokerfailed to seek financial
assistance through the court fora private investigation into the
ballistics and the mental, capabilities of the defendant.
(01:16:38):
Uh, the post-conviction releasewas denied by Judge Becker.
He said it hasn't been explainedwhy the defense counsel took
certain actions, but the courtcannot second guess strategic
and tactical choices made by atrial lawyer.
And if the errors were madethere were of harmless nature.
Stephanie (01:16:59):
But again, I don't
see because.
Even if you pay a lawyer, youcould be paying big bucks for a
shitty lawyer, and whose faultis that?
If they have passed the barexam, they are allowed to
practice law.
Even if the lawyer is doing acompletely shitty job on the
(01:17:20):
stand and the judge is like, areyou fucking dumb?
Who knows?
Is this all a farce Because youhave some big punchline coming,
some gotcha moment.
Who's to say?
Dani (01:17:32):
And it's not the judge's
responsibility to make sure that
Stephanie (01:17:35):
no, especially they
have a good
Dani (01:17:37):
attorney
Stephanie (01:17:38):
because some of this
was a paid attorney, which
should in theory be better thana public defender.
So you're like, this is who youchose.
They are licensed to practice, like having a license to drive.
Um, maybe they like to take napswhile they drive, though.
Mm, I love that analogy.
(01:17:59):
Uh, death warrant for OW wasissued for December 10th.
Of course, a stays issued fromthe Idaho Supreme Court
as it always is.
1987 a new attorney is appointedto Char Burnow, and Char is
pissed.
Oh gosh.
He wants me to continue to behis attorney.
One problem.
(01:18:21):
May has been appointed to be ajudge.
Oopsie got a
promotion.
Dani (01:18:27):
Charnow said if he can't
have May, he will represent
himself.
Oh, great choice.
Greg Fuller is appointed torepresent Char Burnow by the
court.
Fuller.
Asked for a new trial.
He said the former attorneyGoldie.
I'm sorry, golden Bennett basedhis defense strategy on
(01:18:47):
clairvoyance and other quote,supernatural phenomena.
Stephanie (01:18:51):
Again, whose fault is
that?
If you chose a lawyer that'slike, let's consult the tarot
cards.
Reno
Dani (01:18:57):
baby, including regular
contact with the spirit of
Marilyn.
Golden stated, he never believedin that quote, clairvoyant crap,
and that fuller is grasping atstraws.
Maybe
Stephanie (01:19:16):
what if your client
asks you to, and they're paying
you so much an hour and they'relike, I heard that Get off the
Ouija.
I saw a psychic on Etsy thatsays that they can pull some
room stones or tarot cards andthey can figure out a murder.
Dani (01:19:31):
I, I really think in 80,
84, I think they're looking at
Stephanie (01:19:36):
the Ouija, the
classified ads in the Ouija
board.
Yeah.
Wanna solve a murder.
It's in the classified.
I will use my, what are thosesticks that find water?
A witching stick?
Some they, that they're like,oh, should I do this?
Yes or no?
Or pendulum Did some Yeah.
This happen?
Yes or no?
(01:19:56):
If, if you, if your client isasking for that for one, who are
you to say no, or if that ispart of your strategy that you
feel that works and someone'spaying you and you are a
licensed professional in yourfield?
Choices, people Choices, good
Dani (01:20:15):
choices.
Fuller submitted an affidavitfrom Prosecutor Adamson.
It said that sometime.
You remember Adamson, theex-brother-in-law, it said that
sometime in July of 84 after thepreliminary hearing, but prior
to the trial, he was approachedby Goldie and his investigator
(01:20:37):
James Coakley Golden told him heknew Sau wasn't guilty because
his niece in California had aseance with a deceit.
Stephanie (01:20:47):
Stop.
Okay, let's drop the charges.
Dani (01:20:55):
And the seance, the
deceased indicated that she
forgave her daughter for firingthe final shots.
Stephanie (01:21:04):
Teenage girls with a
Ouija board.
I don't know if they'reteenagers, but it sounds like
it.
To me it's Anise.
Dani (01:21:10):
And another affidavit
filed Golden's, former legal
secretary, Diana McDonald, stated she witnessed several
conversations between Goldie andColey concerning various
supernatural and clairvoyantphenomena related to the guilt
or innocence of Dale.
Stephanie (01:21:31):
It's sounding like a
theme here.
I hate to say it more than justmy clients asking me to or.
Gave me the number.
I don't think this is asked of,
Dani (01:21:40):
just, yeah.
No.
Mr.
Coley was in regular contactwith the spirit of the victim
and reported the results ofthese contacts to Goldie.
Okay.
Coley couldn't be reached forcomment.
Why?
Mm-hmm.
Why camping?
Vacation.
(01:22:00):
No.
Well staycation, he is serving asentence in the state
penitentiary on a theftconviction for unlawfully using
goldie's credit cards.
Stephanie (01:22:11):
Alright,
Dani (01:22:13):
what a shit show.
Stephanie (01:22:15):
Very stable and
appropriate.
Yes.
Uh, judge Becker
Dani (01:22:20):
denies the request for
retrial.
He said, I'm actually
Stephanie (01:22:25):
done
Dani (01:22:25):
with
Stephanie (01:22:25):
this
Dani (01:22:25):
shit.
Uh, move along.
I want you to keep that commentin mind later.
Okay.
Char Oak Fires fooler, but JudgeBecker warns him.
Quote, you've already gonethrough several lawyers.
Your rights have been moreprotected than the victims.
(01:22:47):
She didn't have any lawyers.
Stephanie (01:22:50):
He's saying, let's
look at the odds, bud.
Yeah.
If, if this is Vegas or Reno,um, you're betting on the wrong
horse, bud.
Dani (01:23:03):
Mm-hmm.
Fuller was totally taken bysurprise at the request.
He's like, wait, what?
I'm getting fired.
He really was.
A few days later, fuller wasreappointed.
Oh.
Four is was working for$50 anhour, half of his normal rate.
And mind you, this is an 83,right?
(01:23:24):
84.
That's
Stephanie (01:23:24):
good money.
Dani (01:23:26):
Judge Becker told, ow, I
didn't go out and find you a
cheap attorney.
The reappointment was not arequest from Charvin.
The court was like, you're anidiot.
This is who you got.
And fair enough.
(01:23:46):
1988 OW appeals his deathsentence, of course, to the
added Supreme Court forinadequate counsel.
And guess what else?
Hmm?
Class.
Idaho's death penalty isunconstitutional because only a
jury can impose the deathpenalty, not the judge.
(01:24:09):
Plus all the other things, judgeletting charvin o be interviewed
without counsel present andletting him testify at a
pretrial hearing.
Plus, uh, uh, stroker shouldhave asked for a continuance for
the trial based on the shorttime he had to prepare.
(01:24:29):
He was like, put in three weeks.
Yeah.
Before you
Stephanie (01:24:35):
need more time.
So, Val, so many
Dani (01:24:38):
fucking attorneys we're
moving up a year.
Stephanie (01:24:42):
89
Dani (01:24:43):
In April, 1989, the Idaho
Supreme Court Order SHEO to be
resentenced due to severalerrors made by Judge Becker.
Stephanie (01:24:51):
Becker
Dani (01:24:52):
during the sentencing
hearing, Becker improperly
admitted unsub, anunsubstantiated letter from
Marilyn's father that includedhearsay Beck word for multiple
syllables.
Stephanie (01:25:06):
I'm proud of you.
Dani (01:25:07):
The court ignored the
issue of jury versus judge
handing down the death sentence.
They're like, we're not gonnaeven fucking deal with that.
Stephanie (01:25:16):
There's bigger
problems, but yeah.
Okay.
Sure.
Dani (01:25:20):
The court did say that
Judge Becker seemed to rely on
up.
Oh my God.
Unsubstantiated claims thatMarilyn would have survived if
char Bono did not shoot a secondround of bullets.
The court rejected 17 pointspresented in the motion.
(01:25:41):
There was no impact statementsallowed at this time in a death
penalty case.
Mm.
So Marilyn's dad presentedtestimony about how they were a
shit show.
Um, no.
No, no, no.
DV I'm sure.
Right, but they're saying thatwas un.
(01:26:02):
Substantiated nailed it.
And, uh, that, that couldn't bepresented.
I can see that.
'cause I mean, it's
Stephanie (01:26:10):
third party,
Dani (01:26:11):
but it's still a victim's
impact statement.
Yeah.
So,
Stephanie (01:26:14):
no, there's ways to
get it in and ways to not, and
so of course they're looking forany loophole, which is, this is
how it is with a legal case, everything has to be by the
book.
Mm-hmm.
And if it isn't, it's gonnacause a problem later.
So you can't take the easy wayout.
Even if you're like, we gottainclude this.
Can we include it without itbeing a shit show later?
(01:26:37):
That's a big question
Dani (01:26:40):
In 1990, uh, apparently,
uh, for the attorney, she did
not want.
Fuller is making progress.
Stephanie (01:26:57):
Well go Fuller.
Let's see what you got.
Dani (01:26:59):
Fuller files a petition
for a new trial because a former
Sheriff's deputy caller CarlTaylor was convicted of a
misdemeanor.
Carl had taken a loan of$6,000from a man that the sheriff's
office was investigating.
Carl had testified in Charmin'strial.
(01:27:20):
And Fuller says the jury shouldhave not given any consideration
to his testimony based on Carl'scharacter, by the way he
committed that crime years afterChar Bruno's trial.
Stephanie (01:27:31):
That's a stretch to
me, fuller
Dani (01:27:34):
and.
It, it had something to do.
His testimony had to do withsomething with a confession.
I didn't Yeah.
But still later
Stephanie (01:27:44):
they're pulling out
every stop.
Yeah.
Dani (01:27:46):
Yeah.
He, he's, he's trying, workingfor the money.
Yep.
Fun fact, the drum, the drumcounty jail does not have an
exercise yard.
For shame.
Well, that's why he can knock onfucking windows, bro.
Yeah, go find the person who'ssaying dead meat.
(01:28:07):
Inmates are guaranteed fivehours of exercise a week, so the
sheriff improvises,
Stephanie (01:28:14):
they get a Jane Fonda
aerobics.
What do they get?
Dani (01:28:17):
Every few days the sheriff
drops in on ow and tells him to
put on his coat.
The sheriff drives out to aremote area and ow with
handcuffs on, they go for a walktogether, can run around and
Stephanie (01:28:31):
play.
It's like taking someone to adog park or to like a remote
area.
And I'm not trying to equatepeople and dogs here, but I'm
saying like, oh, we got this dogthat might bite.
Let's take him out.
Dani (01:28:44):
To where no one's gonna
be.
No.
And they act, go run here.
Fetch P, the, uh, un, the un.
Super dangerous people, I guess,or the other inmates.
They would handcuff them alltogether and take'em to the
park.
Stephanie (01:29:03):
Yeah.
Where you guys can't coordinateand escape, handcuff together.
No.
Crazy Red Rover game.
That would be, you ain't gettingthrough the Hudson, but the
sheriff was
Dani (01:29:13):
like, let's go for a walk
bro.
Ya ain't gonna fucking sue me.
They're literally
Stephanie (01:29:18):
like, um, time for
walkies.
Yeah.
Dani (01:29:23):
They don't have an
exercise yard, but the sheriff
didn't wanna get sued, so he islike,
Stephanie (01:29:29):
take him on there,
run
Dani (01:29:30):
or whatever.
Let's go out to
Stephanie (01:29:31):
the desert boy,
anyone got a Frisbee?
And they would talk,
Dani (01:29:39):
like, they would literally
go on a walk together.
And the sheriff said that hewould.
Talk to him.
I bet
Stephanie (01:29:44):
a lot of prisoners
would prefer this.
A walk in the, even in the highdesert, like imagine like a
really remote trail.
Dani (01:29:51):
He was in flip flops and
san ugh.
Stephanie (01:29:54):
Or if it's snowing.
Ugh.
Dani (01:29:57):
Can you imagine that?
You know that fine.
Fucking I That fine.
The fucking dust, the moon dusttakes on.
Sheriff's, like, I'm bootsfucker, bitch.
How does that feel between yourtoes?
You know what I'm talking about?
Yes.
That shit.
And you're just like, oh my God,I need to wash my feet.
Anyways, kudos to the sheriff.
Uh, doing his best, beingcreative to not get, to not get
(01:30:20):
sued.
Stephanie (01:30:20):
Out of the box
solutions.
Go, sheriff,
Dani (01:30:24):
can you, ima I'd be so
pissed off at his chair.
I'm like, get up, have mycoffee.
I'm like, fuck.
Time for walkies, Danny.
Oh, I have to go take walkiestoday.
Fuck, this guy annoys me.
I do not want to be out therewith him, but also doing my job.
I'm not gonna get sick walkingin the desert.
(01:30:46):
Can you imagine?
Just fucking I Just after thedenial, char O figures, this is
a great time to have aninterview with the press.
Stephanie (01:31:01):
Great strategy so far
hasn't filled you yet.
And
Dani (01:31:05):
in an interview with Anita
Dennis from The Times News, char
au said The world would be safeif he was paroled.
Stephanie (01:31:13):
Mm-hmm.
The world.
Dani (01:31:16):
The world.
Stephanie (01:31:17):
Wow.
Okay.
When
Dani (01:31:18):
asked if he was dangerous,
he replied, no, I'm not.
I know I'm not.
Let's wrap it up, folks.
He stated, if you look at thecase, who knows what they would
do if they were put in apredicament to defend
themselves?
No matter what.
One person might say, lookingfrom the outside in, might say,
(01:31:41):
I would've done this.
I would've done that, but younever know until you're that in
that predicament.
Stephanie (01:31:48):
You never know.
Folks,
Dani (01:31:50):
I do know now because I
was inside there.
I wasn't looking in fromoutside.
Stephanie (01:31:56):
Yeah,
Dani (01:31:58):
I was inside looking and
it was a tragic thing.
I wish I would've had thementality then that I do now,
the ability to let logic controlmy emotions and in the heat of
that moment, then I would'vebeen able to think it through
and make proper judgment.
Stephanie (01:32:18):
Honestly, I'm proud
of him for the speech.
I can tell that it.
He's been waiting a while to saythis, which like we said all the
time in the world, you can putsomething together.
I feel like it was
Dani (01:32:29):
like so rehearsed.
Like a statement.
Yes.
Stephanie (01:32:31):
Uh, it was, um, his
Dani (01:32:34):
press
Stephanie (01:32:34):
secretary wrote that
for him.
Yeah.
For real.
Mm-hmm.
But it's like, there's just toomuch
Dani (01:32:44):
in June.
Stephanie (01:32:46):
Tell me
Dani (01:32:47):
Judge Becker steps down
from the case.
Stephanie (01:32:51):
Okay.
Becker
Dani (01:32:52):
Attorney Dunlap filed a
motion for a new judge.
Becker was like, thank God, no,for reals.
Thank God he didn't say that,
Stephanie (01:33:00):
but he was done.
He's like, I'm going on my ownvacation now.
You fuckers
Dani (01:33:04):
to Vegas, not Reno.
You cheat bitch Goldie,
Stephanie (01:33:08):
who might go to
Hawaii.
Dani (01:33:12):
He granted the motion.
After being on the case for sixyears.
Becker said, quote.
I am so sick and tired of him.
Stephanie (01:33:23):
Very candid.
Not even like kid gloves typelike media messaging.
This guy.
Dani (01:33:30):
If he could have said to
the press, fuck this guy, I'm
out.
He would've said it.
Yeah.
Fuck
Stephanie (01:33:38):
you,
Dani (01:33:38):
fuck you, fuck you, fuck
you.
Stephanie (01:33:40):
You're
Dani (01:33:41):
cool and I'm out.
Fuck you.
Yeah.
Oh.
Becker was placed by Judge Hart.
In September, the Idaho SupremeCourt replaced her per request
from ow.
The new judge is George GranadaJr.
Stephanie (01:33:58):
Georgie Junior.
Dani (01:34:00):
Here we go.
In January, 1991, char Ow filesa lawsuit against his own
attorney for a million dollars.
Stephanie (01:34:09):
Gimme a million,
billion cajillion dollars.
Billions and billions andbillions.
Gimme your money.
He,
Dani (01:34:17):
he, he claims Dunlap was
not providing adequate
representation.
It was dismissed.
Stephanie (01:34:25):
Thank you.
Dani (01:34:26):
And everybody's getting
smart.
The state decided they will notask for the death penalty and
the recent resentencing of owbecause.
You sucked
Stephanie (01:34:37):
at it this far.
Let's just
Dani (01:34:39):
money, money, money.
Let's
Stephanie (01:34:41):
lower our
expectations now.
It's,
Dani (01:34:44):
it's all about the cash.
Mm-hmm.
I'm telling you.
It is.
The cash.
The cash.
They will instead seek life inprison.
On October 10th, 1991, charBruno is sentenced to life in
prison without the possibilityof parole.
In 1993, there's another appeal.
(01:35:06):
The Idaho Supreme Court upholdshis life sentence.
And then we're just Appeals.
Appeals, appeals, appeals.
And in 2015, Charnow was granteda new trial.
You're choking.
Stephanie (01:35:23):
Yeah, let's go.
Let's do it.
What do you got?
Sharpie.
Dani (01:35:27):
Uh, a letter was found
written by Tiara.
Marilyn's daughter from 1989that states she was told to
withhold information and therewas another letter from a former
Jerome County Sheriff that werediscovered.
(01:35:50):
District Judge LG said theletter showed evidence of
misconduct
Stephanie (01:35:58):
and there was a
sprinkling of it that we know
about.
So it's not,
Dani (01:36:02):
yeah, let's throw away a
bullet casing.
Yeah,
Stephanie (01:36:05):
just throw it away.
It's not even important.
Dani (01:36:07):
The reason the letters
weren't discovered until then is
because the state had concealedthem.
Brady,
Stephanie (01:36:14):
those Brady
violations aren't gonna screw
you every time.
Dani (01:36:21):
I think Judge Ji was kind
of disgusted because he allowed
Charvin to be released after 30years in prison on a$20,000
bail.
Stephanie (01:36:35):
And again, it
probably came down to the money,
like this is now gonna be a howmany years old case.
Mm-hmm.
On letters that were found wheresomeone may have very well been
a little shyte when, if theyjust wouldn't have done that.
Just like with the bullet, keepit in.
Yeah.
You could, you should be able toeasily disprove it.
(01:36:57):
Right.
Or.
Even if it isn't easilydisproven, your other evidence
should be able to outline.
So I'm not saying that, oh,people should just go free when
you start doing this shadystuff.
Mm-hmm.
You are casting doubt on theentire investigation.
And now look at where we are,how many years later we're like,
(01:37:20):
let's just let you go.
We don't even have theresources.
Time, money.
To rehash this case after it'salready been rehashed this much.
Mm-hmm.
Ridiculous failure of lawenforcement and judicial.
A hundred percent.
Dani (01:37:34):
Yeah.
No, don't be shy, Ty.
Char was bailed out in May ofthat year, 2015, and everybody
was exci.
I saw the pictures likeeverybody's so excited for him
to get out.
By the way, did I tell you?
Did I mention his poetry?
Stephanie (01:37:55):
No.
Another award-winning poet of anaward that no one's heard of,
or, yeah.
Dani (01:38:02):
Cowboy poetry.
I should have included that.
I, I didn't write any.
I'm sure it
Stephanie (01:38:06):
was, you know, you've
got a lot of time in jail, so
Yeah.
And you have to find ways toexpress yourself and so Sure,
sure, sure.
Do it.
Dani (01:38:14):
And he was so committed to
being a cowboy like.
Yeah, there was an incident onetime because they always let him
change into street clothes whenhe went into the judge and then
after a bunch of his fuckers, they're like, we're not gonna
let you change into streetclothes anymore.
You were gonna treat you likeevery other fucking inmate here.
(01:38:38):
And there was a little kind ofscuffle, and he had a bloody
nose when he went into one ofthese hearings.
Because he probably, I'mimagining he was trying to fight
to change and he was
Stephanie (01:38:49):
bucking and
bronching.
Dani (01:38:50):
Yep.
And they said, Nope.
You get the same prison guardthat everybody else is getting
Dick.
Yeah.
Enjoy your walks and your flipflops fucker on.
Uh, so he's out.
Out and about.
Um, February 15th, 2016, charBruno is arrested in Star Idaho,
(01:39:15):
not in Star.
In star.
That afternoon, a woman arrivedhome and she found Char Bruno
hiding in her closet.
Stephanie (01:39:24):
That's unsettling and
very much escalated.
Like what?
This is less than a year later, nine months, where someone's
we're in someone's closet.
Dani (01:39:37):
He threatened her with a
crossbo.
What the fuck is some of thecross bows?
A fucking crossbo.
Stephanie (01:39:45):
Go and learn.
Get a hobby bro.
Get RC cars.
Let's what
Dani (01:39:53):
she ran out of the door
and called 9 1 1 a few minutes
later, sharper, who's now 56,called ADA County Dispatch and
said that he had been heldhostage by a woman at the home.
He told deputies he had escapedand drove to a parking lot where
he called police.
He was charged with aggravatedbattery with a deadly weapon and
(01:40:16):
burglary.
Stephanie (01:40:17):
Good because that
made me wanna punch myself in
the face, hearing someone helpme captive with my cross bone in
their closet.
Dani (01:40:25):
Please stop.
The woman had briefly dated OWfor about two months before
breaking up with him and hadrecently filed for a protection
order.
That's weird.
The protection hearing was setfor the day Charna was arrested.
So the day that he is like crossbowing in the house, that was
(01:40:49):
his, that was the hearing chareeyou
Stephanie (01:40:54):
need, was there not a
halfway house or something?
Like We're just gallivanting.
Dani (01:41:02):
I wonder who put up the
bond too.
For reals.
Uh, days before Char had hadbroken into the house, he had
visited the FBI office in Boiseto report that his ex-girlfriend
was illegally selling liquorwithout a license and that she
had mafia ties.
These motherfuckers,
Stephanie (01:41:22):
you gotta be fucking
delusional and just not fit like
for.
Get outta here.
Get
Dani (01:41:29):
out of here later.
He also told police she hadkidnapped him and driven him to
the Hawaii's where she let himgo.
Stephanie (01:41:42):
I feel like we're
deflecting at this point, sir.
Like, anyway, move on.
Dani (01:41:48):
When the victim was
contacted by the police about
she's kidnapping.
She began seeking the protectionorder.
She's like,
Stephanie (01:41:59):
this fucker, this
fucker's crazy.
He said, I kidnapped him.
Dani (01:42:03):
Hmm.
During the time he wassupposedly kidnapped.
The woman was out of town.
I ey.
And as far as being heldhostage, the police have ow on
surveillance footage from aconvenience store during the
time.
Stephanie (01:42:22):
He wasn't used to
that.
He thought there was no camerasanywhere and you could just be
whoever you wanna be wheneveryou wanna be them.
Ooh, good try, bub.
Dani (01:42:32):
In 2017, the Idaho Supreme
Court reversed Judge lgs order
and remanded the original caseback to district court.
Like,
Stephanie (01:42:43):
you know what takes
these backseats?
Dani (01:42:47):
Oh, I feel like lg, like,
I don't know.
I should have looked him up,but.
He, I would quit.
Yeah.
I would be like, I'm done.
I'm gonna retire early.
Uh, not make, I would take
Stephanie (01:43:02):
a basket weaving or
something.
I'm gonna open up a coffee shop.
Dani (01:43:09):
Espresso, anyone?
In 2018, char Noah was sentencedto 25 years in prison for the
star incident.
Oh my God.
This time is to be servedconcurrent with his other life
sentence
Stephanie (01:43:24):
because they're like,
you know what?
We're done.
Dani (01:43:26):
We're done.
Stephanie (01:43:27):
You are done.
Dani (01:43:29):
So currently, char Bruno
is 65 and residing at the Idaho
State Correctional Institutionin Boise.
Stephanie (01:43:41):
Have fun.
I'm.
You got a, you got your walkies, which most prisoners.
I mean, I think, I feel like ifyou ask people now if they're
like, what if the sheriff cameand took you on a walk?
They'd be like, yeah, yeah, let's go.
Let's outside.
Not in the prison yard.
Let's go.
Dani (01:43:59):
Let's grab a McGriddle and
a hash brown.
Fuck yeah.
Stop it.
Mickey, please gimme a happymeal.
I'll take a small coffee.
Three creams, 15 sugars.
Stephanie (01:44:15):
Gimme that, sugar,
that real shit.
15 sugars.
Please, can you, Hey boss, canwe go inside and we can just,
you know, they have the littlething.
You can just grab like 57 forme.
I could take it back in my, Icould sell that shit.
Can I put that in my pocket?
I could sell that shit for.
People love that shit.
Dani (01:44:35):
Oh wait, I don't have
pockets.
Can I put it in my undies?
Can I tuck it in my booty cheeksunder my B sack?
How do we digress?
Stephanie (01:44:46):
We're out of fucking
control.
The vodka is vodka
Dani (01:44:49):
for me.
It is.
Stephanie (01:44:50):
And this case, I just
gotta tell you, I once again, I
gotta tie it back to theseextreme.
Weirdo relationships.
I know people in my personallife who haven't necessarily
escalated this much, but insome, I hope not.
I know friends of friends wherelike they used to get in drunk
(01:45:11):
in fights and all the time, andlike someone accidentally, maybe
purposefully in the moment dueto alcohol, like hit someone
with a car or the car startedrunning backwards when someone
was pulled from a car.
Just this messy, messyrelationships and guys.
Gotta stop doing that.
(01:45:32):
I know that we, listen, I'm nota perfect person.
I certainly, you know, I speakmy mind, but one of the things
that I value so much in arelationship is not having a
constant fighty, fighty dramabecause I just simply don't have
(01:45:52):
the energy.
Dani (01:45:53):
Mm-hmm.
Like
Stephanie (01:45:54):
we can fight over
things.
Sure.
But if we're fighting every dayand getting into escalated pan
throwing glasses, if you'reemptying
Dani (01:46:04):
your gun into the side of
your partner's vehicle, eh,
probably should take a look at,let's move on and maybe move
away.
Stephanie (01:46:11):
Yeah, let's probably
should take a look at that
relationship.
Let's not.
So just, again, I do just wantto even point out, there was a
strangulation thing earlier andif, if your partner ever chokes
you, man or woman.
It's like a 700% chance they'regonna kill you the next time.
Yeah.
So just reach out to yourresources, start getting a safe
(01:46:35):
exit and.
Let's not,
Dani (01:46:38):
and don't let them back
into your lives.
Even a fucking snitch.
No, don't call, don't text,don't write.
You can love, don't talk totheir friend from afar.
Yeah.
Definite.
You can
Stephanie (01:46:51):
respect and
appreciate.
Yeah.
Dani (01:46:53):
You know what I'm talking
about.
Yes.
Those relationships like creepback in.
Stephanie (01:46:56):
I just need a little
help.
And they're living in yourfucking barn again.
We're done.
No.
So anyway, look out foryourselves.
Look out for your friends andstory.
I hope Goldie enjoys his fuckingReno vacation.
I hope he got to eventually.
I mean, it sounds like he wastied to this case for fucking
(01:47:17):
ever.
So sorry about your family vacaythat got ruined.
Um, hopefully your marriage isstill intact.
