On August 11, 2025, President Trump activated Section 740 of the District of Columbia Home Rule Act, empowering him to direct D.C. police during emergencies. This law allows federal control for 48 hours, extendable to 30 days with congressional notification, or longer with Congress’s approval, to safeguard federal interests like government buildings and national security. Alongside this, approximately 800 National Guard troops are deployed for logistics and securing key sites. The D.C. National Guard, under direct presidential command per D.C. Code sections 49-102 and 49-103, bypasses Posse Comitatus Act restrictions, enabling it to support law enforcement directly.
If unrest escalates, the Insurrection Act of 1807—10 U.S.C. §§ 331-335—authorizes deploying federal forces to suppress insurrections or violence obstructing federal law. Stephen Miller, a senior advisor, affirmed the legal foundation, stating, “The Founders made DC a federal city, under the sole & exclusive control of the federal government—as the nation’s capitol. This provision has been and remains in effect since the Constitution was ratified. It has never been amended or revoked. It remains in full, complete force.” He emphasized that emergency powers provide immediate flexibility, with Congress stepping in for extended control.

Clandestine on X notes, “Pretty easy to quell civil unrest when you bring the Russia-Hoax Syndicate if NG is already in place.” Rudy Giuliani calls the hoax a coup, warning of riots if its architects face charges. Vice President Vance reinforces this, stating “a lot of indictments” are coming for 2016’s lawbreakers.
