За два роки повномасштабного вторгнення вже напрацьовано певні загальні підходи та алгоритми в розслідуванні воєнних злочинів. Водночас ця категорія кримінальних проваджень продовжує бути унікальною з огляду на специфіку складу злочинів, умови розслідування, значення результатів розслідування.
В умовах, коли судова практика за цією категорією справ тільки формується, в органів правопорядку є певна невизначеність щодо стандартів їх доказування: які саме докази мають підтверджувати ті чи інші обставини, яка кількість доказів може вважатися достатньою, як не припуститися помилки, яка може призвести до визнання судом доказу недопустимим.
