ד"ר בן שמש הוא בעל תואר דוקטור בפילוסופיה פוליטית, מאוניברסיטת צ’אפל היל. בעבר הוא שימש כעוזר משפטי לנשיא בית המשפט העליון (בדימוס) פרופ’ אהרן ברק. כיום הוא מרצה בכיר למשפט ציבורי בקריה האקדמית אונו, ומופיע באופן תדיר בזירה הציבורית בסוגיות משפטיות מגוונות שעל סדר היום.
