刑法第 185-3 條規定了公共危險罪之下的「不能安全駕駛罪」，也就是一般社會大眾所知的「酒駕」與「毒駕」。2024年3月上路的新版本修法內容主要在第三款：「三、尿液或血液所含毒品、麻醉藥品或其他相類之物或其代謝物達行政院公告之品項及濃度值以上。」
與前版本的「三、服用毒品、麻醉藥品或其他相類之物，致不能安全駕駛。」相比，將「至不能安全駕駛」的這個觸法前提，更改為「達行政院公告之品項及濃度值以上」。

然而，這個「行政院公告之品項及濃度值」的標準，與毒品陽性反應的標準是一致的。這點為什麼不合理呢？因為這表示，「毒駕」這件事從「具體危險」變成了「抽象危險」。
嚴格禁止毒駕的立意可以理解，但規範數值方式卻未謹慎梳理真正影響駕駛判斷的具體數據，很可能導致並非真正處於物質效果作用下，僅僅是體內有殘留物的駕駛被視為罪犯，此為 Zoe 認為不合理之處。
總而言之，毒駕絕對是不對的！但立法與處罰人民的原因需正當且明確，這也是法治社會的重要精神。這堂法律小教室獻給各位聽眾！
