2025年3月11日，菲律賓前總統杜特蒂在馬尼拉機場被菲律賓警方逮補，移送位於荷蘭海牙的國際刑事法院。杜特蒂在2016年至2022年的任期之間發起「掃毒戰爭」，警方未經審判即當場處決目標對象，導致數千至萬人喪生。
杜特蒂 Rodrigo Duterte 曾於菲律賓第三大城市達沃市（Davao City，又譯作納卯市）擔任市長、副市長，他在市政府的二十多年期間組織了「達沃行刑隊 Davao Death Squad」，私刑處決人數眾多。
2022年，菲律賓緝毒署 (PDEA) 統計掃毒戰爭中死亡人數為6,252名，國際刑事法院 ICC 檢察官則指出實際死亡人數可能高達三萬人，並於2025年3月7日對杜特蒂在2011年至2019年間可能觸犯「違反人類罪」的行為發起逮捕令。
藉由這起逮捕事件，Zoe 來聊聊國際刑事法院的運作、杜特蒂在菲律賓擔任市長與總統期間的鐵血歷史，以及了解歷史與法治觀念為什麼對人權至關重要。
國際刑事法院（International Criminal Court）簡稱為 ICC，是建立在目前共125個國家所簽署的「羅馬規約 Rome Statute」之上的法院，具有調查、起訴、逮補與審判在締約國範圍或國籍下，於締約期間犯下以下四種罪行的罪犯：滅絕種族罪、危害人類罪、戰爭罪和侵略罪。需留意的是，ICC 僅能起訴「個人」，並不能起訴「國家」。

杜特蒂任職總統期間，菲律賓本也是羅馬規約的締約國，直到國際刑事法院在2018年2月對杜特蒂任職市長與總統期間眾多未經審判的處決事件發起調查，杜特蒂隨即在隔月宣布菲律賓退出羅馬規約。即使如此，基於時間管轄權原則——也就是行為發生時是否為締約國範圍或國民——國際刑事法院認定杜特蒂做出可能觸犯違反人類罪的行為時，菲律賓仍屬於締約國，杜特蒂的行為仍受國際刑事法院管轄。
2025年3月7日，國際刑事法庭正式向杜特地發起逮捕令，現任總統小馬可仕表示會全力配合。杜特蒂最終於3月11日從香港返回菲律賓時於菲律賓的機場被捕。
出身自政治世家的杜特蒂政壇之路充滿家族勢力的影響，父親為南達沃省省長，兒子如今為達沃市市長，女兒則為現任菲律賓副總統。回顧其執政時期，私刑盛行之下雖犯罪率下降，但謀殺發生率卻上升了一點五倍。由於杜特蒂允許警察當場擊斃「毒販」與「吸毒者」，造成許多人也許並不是毒販或施用毒品者，卻遭誤殺或刻意栽贓持有毒品而死。
Zoe 再次強調，罪刑法定之所以重要，正是為避免錯罰無辜，以及做出不符比例原則的懲罰，侵害到人權。而歷史需要被借鑑，更是為了將來不要再發生類似的悲劇，無論在哪個國家，都該引以為戒。
