the courts courting disaster by alienating conservatives, Court Schlucher, joined

other conservatives are angry about this. But what do you
mean by courting disaster?

branches of government.

You got the Congress, you got the executives, you have
the judicial, and in.

Our constitutional system, they are.

Supposed to have checks and balances on each other.

Problem here, and the problem that we're experiencing is we
have an executive who's directly elected by the American people
who's attempting to put into practice the things that he
was elected to do. And you have a court system
of essentially democratic district court judges who've decided, now, we're
not going to let him do that. We're going to

take procedurally and substantively meritless theories and use them to
try and stop the president. Then we're going to we're
going to play with some of the procedural techniques to
make it difficult for him to challenge that, and in
that way, we're going to stop him from executing his duties.
But of course that can't work because the executive is

not going to roll over and take it. So we
have a problem. We have the least powerful branch, which
is a judicial They don't have anybody with guns. And
at the end of the day, as Chairman Mao said,
all power flows from the barrel.

Of a gun.

Well, yeah, that's a good place.

So, well, that's what happens when you're a trial lawyer
who's also an army infantry. You kind of a you know,
an interesting perspective on things. So the bottom line is
what we've set up is these democrat vigilant He's attempting
to stop Donald Trump from doing what Donald Trump was
elected to do. And the way they're doing it is

judicial nonsense. And there are a lot of people out
there going, well, it doesn't seem right what's happening in
the courts. You know, congratulations, you've correctly assessed it. It's crazy,
it's nonsense. It bears no relationship to the actual law
as it is and should be practiced in every.

Other Kirk, When do you think we crossed over that line? Though?
I mean Democrat Shenanigans have been going on for a
long long time, but it is, you know, in history anyway,
it's a relatively recent thing that we have judges, regardless
of their normal party affiliation, willing to go along with this.
There used to be a duty to the law more
than the was a duty the party. When did that

all start to switch in your mind?

Well, look, I mean there's always going to be a
certain percentage that's nonsense happening in political cases. Now it's
become the norm, and we're seeing it again and again,
which is ridiculous decisions both procedurally and substantively. And when
I say procedural, I mean how the law, the mechanics

of the law, How where you file something, who has
jurisdiction over whether the court can even rule on it.
How a temporary restraining order works. Okay, there are very
strict rules for that, and they're all being ignored or abused.

Speaker 3 (03:39):
And that is the actual law itself. What's the law? Said?
A lot of says you can't drive through a red light.

Speaker 2 (03:46):
Okay, Well you've got courts' saying well, it's a green light,
but I'm gonna.

Speaker 3 (03:50):
I'm gonna say you can't drive through it anyway. Well, okay,
that's that doesn't help.

Speaker 2 (03:55):
And then you have an appellate system with the circuit
courts of appeal and the Supreme Court, and you have
different circuit courts of appeal, some of whom tolerate this stuff, some.

Speaker 3 (04:06):
Of whom don't.

Speaker 2 (04:07):
For instance, when I'm living in the California, I have
to deal with the Ninth Circuit, which I've argued in
front of. It tends not to actually enforce the law
on its district courts. But when I'm living in Texas,
I'm dealing with Fifth Circuit. They tend to make the
district courts obey the law. So at the end of

the day, it all drops on John Roberts place. He's
the senior guy in the judicial branch, and he's got
to make a decision. Am I going to be Is
my institution going to do what institution should and do
its job, or like almost every other institution in American society,
I'm going to allow it to be taken over by
leftists and start not doing its job and still demand respect.

(04:52):
Because he ain't going to get respect especially at Dald Trump.
