Ends up for the Trump administration. They've been winning in
court like nobody's business. Five fifty three is the time
here on Houston's Morning News. We're joined by Hans Van
Spokowski of the Heritage Foundation. I'm not surprised by the wins.
I guess there's probably some people who are, but I'm
not really surprised by the wins. Are you?

No? Because what's happening in the lower courts is you
have all the almost exclusively judges nominated by Democratic presidents
who are stepping in and issuing injunctions when they don't
have any legal authority to do it. It is judicial warfare,
basically trying to stop the Trump administration from putting in

(00:41):
its policies. But they've been filing they the Trumpet, they've
been filing emergency requests for stays. You know, that's asking
a higher court to basically freeze the lower court. And
they've they've been relatively successful on that. I mean, just
a couple examples. One that Texas a lot is that look,

Biden was issuing what we call mass parole, mass parole,
just allowing illegal aliens in illegally and saying, I'm giving
you a parole. We won't throw you out to half
a million, half a million illegal aliens from Cuba, Haiti, Nicaragua, Venezuela.

(01:25):
President Trump ended that, and you had a lower court saying, oh,
what the prior president granted, the new president can't do,
which is a nutty decision. Anyway, the Supreme Court stepped
in and said, no, he can end mass parole. Same
thing with what's been going on with DOGE. One of
things that the Trump administration did is they fired about

(01:47):
sixteen thousand federal employees at six different departments and agencies.
A lower court said, oh, you not only can you
not do that, you have to rehire them. The pre
court stepped did and said, no, he doesn't have to rehire.
The MBESITY can't fire them while the case is pending.
So it's been Look, it's it's frustrating, but when one

seas have been getting to higher courts, to the Supreme Court,
they've been reversing what the lower courts.

Speaker 1 (02:17):
Have been doing well and as good the Supreme Court
has been getting as involved in this as they have been.
What would be better, of course, would be if the
Supreme Court would basically put out some sort of an
eadingt to the lower federal courts about you know, what
their mission is, how far how far they can make
rulings for because I don't think it was ever the
intention for these federal courts to be able to do

(02:39):
a coast to coast rulings on some of these issues,
although many of them have tried to do so.

Speaker 2 (02:45):
No, you're absolutely right, and we are actually hoping that happens.
You know, the Supreme Court ends its term at the
end of this month, and on May fifteenth, they argued
had arguments in a case in the birthright citizenship case. Now,
there were three nationwide injunctions issued by three different judges

(03:06):
saying Trump could not enforce his order on that what
was before the court was not the substantive marriage. In
other words, is Trump correct or not correct his interpretation
what was before the court was the legitimacy of those
nationwide injunctions. And frankly, I'm hoping they come out with
an order that does exactly what you said, lays out

(03:28):
very strict rules that tells these judges look only under
very limited circumstances can you do this, And I'm hoping
that that happens.
