night and now look at this. There's a shootout the house.
So we find out there's a home invasion and the
bad guys and this is something I lecture. You can
imagine how much fun this is for them. I lecture

have gates and gates inside of gates. But if you
order food or anything.

her parents. She has a one year old and a

he emailed at about noon. We interviewed him, We discussed
the situation with him at about twelve thirty yesterday afternoon.

He left the hospital here around three o'clock this afternoon.
We know that he's been with HPD for roughly nine
years in the patrol division. This is exactly what he
and his partner were doing at the time when they
arrived at that home this morning, and the police chief
telling us. As soon as they got to the front
door and they started entering the home to assess things,
they were met with gunfire.

We went into a walkway or an area, I'm not
a walkway doorway, and the suspect came out of what
we think is a living bedroom and shot immediately at
the officer. The officer return fire did not strike the suspect,
but that was a suspect that ran out the back.
The second officer proceeded to clear the home and he
caught the other suspect, secured him, and then came back

and administered life saving first daid to our police officer.

An officers got to the home in a matter of minutes,
according to police Chief Noe Daz, thanks in part to
a neighbor who thought something was wrong and called it in.

come and knock on the door and then saw them

Yes, well, I received your email. It's been a traumatic
day obviously, with your permission, I'll read this email and
we can begin our conversation. Sure you say, I am
the homeowner and so headline officer involved shooting in Spring Branch.
This is on the same street as a friend of mine.

And first of all, so I know one of your neighbors.
And secondly, I was advised by an HPD officer who
was on the scene when Officer Scott Durphy was shot that.

He had been shot and.

That they were on their way and I was getting updates.
So when I got your email, I am the homeowner
and two armed gunmen forced their way into our home.
My twenty six year old daughter was there with her
one and three year old. She's traumatized. Officer entered and
was shot in the leg. The bad guys returned fire.

Two men apprehended, but still looking for the driver of
the stolen camry. We haven't been let back into our
home yet. I heard on the debate the other night
that violent crime is down. Facts on the ground do
not indicate that, Ben. By the way, facts on the
ground and actual data do not prove that you are

absolutely right. But what you're experiencing, we're seeing all over
the country. And I'll bet these guys are going to
turn out to be out on a warrant with a
long criminal record, and one of Rodney Ellis's criminal judges
will have released them again to go out and do this.
But walk me through if you would, Ben, I guess
first of all. First things, first, nobody in your family

is harmed.

is wounded, but he's going to survive, so that's good news.
So tell me what was happening at the house and
were you there at the house when this happened.

I was not.

I was in work and it was on because I've
been texting my daughter about something else. And the next
thing I know, my neighbor called me. He's like, are
you at the house. I'm like no, and he says
you should get there. There's a a bunch of cop
cars and gunshots. I heard gunshots, and so I kind

of dropped everything and headed over there. So I since
had an opportunity to talk to my daughter and look,
I've got a ring I've got ring cameras on the
front of my house. So I actually saw the guy
who was He had kind of pulled up, he walked up,
walked back to the car, walked up, walked back to

the car. Third time. He came up with a red
door dash bag and said he was there for food. Delivery,
and my daughter shouldn't have, but she opened the door
to telling me he's that the wrong address, and he
forced his way inside with a gun held on her,
and then a second bad guy ran in and they

closed the door. They zipsied my daughter and they started
ransacking the house, and they kept asking her like, where's
the safe, where's you know, where's the jewelry, you know,
and you know we're not we don't have a safe,
we don't have expensive items. So but it just she
(13:26):
was just really terrorized by the old situation. But my
neighbor saw them casing the place and he called the police,
and the police arrived within five minutes. They entered the
house with the bad guy still inside. One was in
the back room and one was right there, and they
(13:46):
fired on that officer and then they returned fire. And
I really don't know, I think they had they have
apprehended both of these guys. They're sitting in the back
of a cruiser by now. My daughter did her best identify.
They were wearing COVID masks, which is convenient, I guess.

Yeah, very So at what time did this happen?

This was at nine thirty six, nine thirty six is
when they came. And the officers came like five or
six minutes from the time they went into the house.

And there were two who entered the house and one
who was outside in the stolen white to ad a camera.

Correct, And they're still looking for that camera. But I
think I think they've got a bead on it, but
it has stolen plates or something like that.

Well, of course it does, because they're in the middle
of a crime spree. They're just committing crimes all day long.
What do these guys look like?

How old? What's their skin color?

I mean, they're really covered up, but they sound they
seemed to be Hispanic males. But that's what I heard
the police say.

So did they speak to your daughter when they came

speaking to her.

of the rooms and they were like, where's a safe,

were demanding that she wasn't being very cooperative and threatening
to kill her.

So then, so was she zip tied during that or
they zip tide her after that?

No, she was zip tied during that.

So when the officers arrive, is the door still closed
she's in? How does she stay out of the middle
of being taken as a hostage.

family room, and when the officers came in, I think
she ducked down behind the couches and and so I
think she was able to avoid the cross fire.

And the bad guys start shooting at the cops. Officer
Durfy fires back. Obviously they hit him. Were the bad
guys ever hit.

of the casing where it ran down to its terminus
at about nine thousand feet, and we would monitor all

the way back up the casing. We could tell when
the electronic charges or the explosive charges that were designed
to frack or punch through that pipe casing so you
can push fluid and then recover dads. We could tell
if they had a misfire on our equipment, So we
(30:50):
would have to tell the people that were running the
crane and that we're running what they call the guns. Hey,
you got one of those caps did not go off.
It's going to be live when you pull it out
of the pipe. They reuse these tools, these these guns.
When they're done, they take the gun apart. The shape
(31:11):
charge is only about as big a round as a
half dollar if I remember correctly. They're fairly small, and
they'll cut through almost three quarters of an inch of steel.

When I first heard this, one of your buddies, actually,
Alan Neederlitz sent me an email about the story, and
that was kind of the first thing that came to
mind was wild they're playing with shape charges that they've
cut down and decide to make them fit into that
kind of a package.

I mean, I'm just processing how you can get that
level of a charge, that level of an explosive in
that all of a space.

I mean, I can understand these even.

They called them, they call them guns, but all it
is is just a big cut piece of pipe that
is hooked up to a winch, cable whatever, and they
push it down with pressure into the pipe casing where
whatever depth they want. And we're monitoring this with fiber
(32:28):
optics and we can tell them, you know, tell about
what depths they're at. When they set off. All the
charges will get eight spikes because they do them in pairs,
so we can make sure that they've all got them gone.
And this has happened a couple of times they would
only have seven of them go off, so we have

to tell the crew, hey, you're bringing up a live charge,
be careful.

How did they react to that.

They're very thankful that we're paying attention that they know that.
One of the weird things was we were kind of
We were an independent company on some of these gaz
pads in Pennsylvania, so there was a little bit of
animosity between crews, but most of the time they were

you know, they were pretty well forward about how they
were doing it and what they were doing, and just
safety reasons. We'd have to give them an update. Hey,
you know you're pulling one out that's still active.
