Happy Monday. Let's start with the case that we've been
covering for fifteen years because our system refuses to deal
with hardened criminals. We pretend that hardened criminals are somehow
like the rest of us. When we're not, when they're not.

We go back to twenty ten, a sophomore in high
school Elsick High School named Chad Holly. There had been
a stakeout in a neighborhood and the police had an
eye on a house that they believe was going to
be burgled. So the cops have this thing surrounded and

there go the bad guys, so they go in break in.
The stakeout is effective, the cops jump out to go
and arrest. Well, Chad Holly goes on the run, and
he's pretty fast, little feller, and he gets a pretty

good lead on him, but he's not built for endurance.
And after a while some of the cops circle around
a couple of blocks away, they pull up, They get
him down, and they arrest him. And immediately there was

a press conference by Kwane Lax who said, oh my goodness,
they beat this poor boy. Oh my god, they beat
this boy. This terrible he's old enough to break into
your house and steal everything you have and kill you
if you're home, because he can't have you identify him.

But now he's just a sweet little boy. He's sophomore
in high school. Well, it turns out the angle of
the video and that the approach that it required to
get to him meant he wasn't beaten. After all. He
was found guilty and sentenced to probation. Because nothing will

show Chad Holly quite like, hey, we caught you, go
do it again, Okay, all right? So two years later
he's just come off probation. In April, he's again arrested,
this time by the Harris County Sheriff's Office along with

three others evading police. They were again burgling a home
a witness reported to break in. They gave nine one
one a description, a license plate, the whole thing. Officers
respond to the burglary in process, pull it over, take
all four into custody. Kwan Alex said, very well, you

gotta understand Chad Holly is a good kid. He was
off his medications for mental illness. Oh okay, he was
off his medications for mental illness okay. And he's a
special education student. Oh is that right? Don't play all

your cards now, because there's going to be some more
arrests and that he does not comprehend the consequences. Oh,
so the laws don't reply to him because he don't
even understand this is all wrong. Well, then why does
he run? On December twelfth of twenty sixteen, Hollywood was
charged with capital murder. What excuse will we find for this?

His feet were hurting, his hemorrhoids flared up the summer,
the swimming pool was closed down. Uh, he didn't get
hired at What would be the reason for this. It
was the shooting death of David trey Ho Gonsalez, forty two,
during a robbery in September of that year. Now, this

all goes back to twenty two probation twenty twelve. They
don't punish him twenty sixteen capital murder. Well, as you
will find out, they didn't put him away because since
twenty sixteen he's had forty seven probation violations forty seven

and by the way, they declined to indict him. Back
in twenty seventeen, they declined to indict him, and since
then he's had forty seven probation violations. KPRCTV with the
story back in.

Twenty sixteen, after the video of fifteen year old Chad
Holly being beaten and kicked by Houston police created a
national furor, Holly was convicted of burglary and completed a
probated sentence. What followed were years in and out of
jail for burglary, theft, and trespassing, years punctuated by dozens
of probation violations, culminating in charges of ca capital murder.

That's the last person who should have gotten probation.

Speaker 2 (05:02):
Holly had completed probation on the original burglary charge when
he was convicted with a second birthry in twenty twelve,
again sentenced to probation seven years, this time under a
deferred adjudication agreement.

Speaker 1 (05:15):
Just don't give somebody probation on a second burglary when
they've already had one burgery conviction.

Speaker 2 (05:21):
In twenty fifteen, Holly violated probation and was jailed for
a while, but then released. A check of court record
shows that over a four year period, he was cited
a total of forty seven times for probation violations. Brian

Experience, a single violation is enough to get you sent
to the penitentiary like that.

The violations included reports he repeatedly broke curfew, failed to
report to his probation supervisor, and failed to pay court
costs and restitution. In October, he was arrested again on
probation violations and charges of theft and trespassing. He was
in jail when he was charged in the murder of
four two year old David trey Ho Gonzalez, who was

killed during a robbery.

I got my timing off that story was from back
in twenty sixteen. So twenty ten is the first arrest
for the burglary. That's when they fired the officers for
supposedly beating him. They didn't. Twenty twelve we get the
arrest again. From twenty twelve to twenty sixteen, we get

forty seven probation violations. In twenty sixteen, he gets charged
with murder because he's robbing somebody and kills them, gets
off again. Well, I don't know how many times he's
been arrested since then, but I was tipped off this
weekend that he was arrested over the weekend. Again, it

has not hit the news, and as you know, I
don't like to break news, so at this point I'll
leave it as a tip. But if in the next
couple of days that story hits, then we will address
again how many times this guy has committed crimes and

and thirteen year old boys arrested for the murder of
a marine veteran. The marine veteran was working as a
ride share driver in northwest Harris County, and the three

little goons murdered him, stole his card, and went on
a joy ride. The story from Khou with the.

Patriot Guard at his side, Friends and family gathered to
say goodbye to twenty eight year old Jake Win, a
marine veteran studying to be an emt. His life was
tragically cut short when he was killed back on September fourth.
His body was found dumped on the side of the road,
discovered by someone passing by.

What a tragedy that was the thought, and I hope
that the guilty people are called quickly.

Speaker 4 (11:27):
Harold Woolly was one of those Patriot Guard members standing
by to honor Jake. Now the Harrison County Sheriff's Office
as they've charged three suspects, a fifteen year old who
now faces capital murder, a fourteen year old and a
thirteen year old, both accused of tampering with evidence.

Children like that have let themselves fall to that low level,
but they created an adult act, executed it, and they
need to pay the consequences as an adult.

And that could very well happen for two of those teams.
According to our legal expert Carmen Roe, what are.

The chances that these teams could be charged as adults?
So in Texas generally you have to be fourteen years
of age or older to be certified as an adult.
So in this case, we're looking at two children who
could be certified and face felony charges in an adult courtroom.

Speaker 4 (12:25):
Roe says a juvenile system is designed to rehabilitate, with
many being released after turning eighteen, but murder cases are
often treated differently.

Speaker 5 (12:35):
This is the reason we have certification of miners to
be charged and punished as adults is for serious felonies,
including murder and including capital murder.

Speaker 1 (12:50):
So you've got a guy who served this country, who's
taking care of his sister and his mother, and he's
out driving and three punks. You know, I dare say,
in all my years in Orange, I don't think there

was ever a case where three young people thirteen, fourteen,
fifteen years old that kind of age murdered an adult.
This happens in certain communities and doesn't happen in other communities,
and it's only getting worse. This concept of get what

you can while you can life doesn't matter. These people
are trash. Those three individuals are trash. No matter what
you do. They will have problems harming other people for
the rest of their lives until another savage just like
them shoots and kills them because they get too close

to that guy's bowl he's eaten from. Because that's what
this is, that is complete and utter animals. I went
to school with a guy named Tony trinn Uah, and
he was working in his parents This is nineteen ninety seven,
working in his parents Sonny's grocery store is an HPD officer.
The guy saw that he was an HPD officer because
he had his badge over with his wallet, shot and

killed him. He was ready to leave, shot and killed
him because he was a cop.

In the radio business, there is a well understood strategy
behind how commercials air.

And so when an advertiser, and this is true on
any station by the way, any station, any format, you
name it. When an advertiser starts on a station, they've
got a budget. Let's say the budget is ten grand
a month, and then they see the pricing. What they'll

do is they'll say, well, I want, I want, and
usually that's over several months, and they'll say, I want
one per week for this many weeks, and then I
want one per week per station. So put it on
six stations and then we'll find out what works. The

problem is a random spot by itself won't get any results.
But you can't tell people that. They think you're gonna
put that spot there and it's gonna man, it's gonna
get results. And if it doesn't get results and it
didn't work, radio strategists will tell you you have to
have what's known as frequency. So if you're going to

be on a station with three spots per week. Don't
spread them out one morning, one evening, and then one
five days later. Put them as close to each other,
you know, in a three hour period, put them at
jam them as close as you can. Because frequency gets
people's attention. You notice something, you hear it the first time, moh,

it's interesting. Oh, there's a say of time, and by
the third time it has an effect even though you
don't hear it again for a month. That frequency is
going to get you better results. Well, there is a
strategy in billboards quite similar to that, and that is
instead of putting a random billboard on the Houston's big city,
a lot of freeways, instead of putting one billboard in

Katie and one in Baytown and up one up in
the Woodlands, you stack them back to back. You've seen
that BUCkies does that. Well, there's a law firm that
had a that has had continues to have as far
as I know, a very effective strategy with regard to
doing this. And I think a lot of people notice

them because of this. And it wasn't because of how
many boards they have, they do have a lot, it's
because they stack them one, two, three back to back.
It's like when you drive into a little town and
they've got the the guys selling got a vegetable stand
over on the side, and he'll put, you know, fifty
signs within a quarter mile of all the things he

has and get your attention instead of spreading those out. Well.
The two lawyers behind that are named Push and Win.
The Push is I think it's an Eastern European name,
puscch and Win is n guy in the Vietnamese name.

But their strategy was we push U Win and then
they would put their names down at the bottom. Nobody
knows how to spell their names, but it doesn't matter.
Push Win became due to their billboard campaign, very very
well known, and my understanding is they've won some pretty
big cases, so more cases, more billboards. But there have

been rumors that all was not well within the Push
Win law firm, and that I think PUSH's father is
involved in somewhere or another. I don't know. I don't
know them. We're at the same restaurant the other night
and they were Push was sitting right next to us,
but that was only because some people we knew knew him.
I didn't speak I don't know him. That's as close

of any connection as I have. But my understanding at
least what has been reported is that when was accused
of having done some side deals without Push and transferred
some money or transferred into count or changed a website,

(18:36):
or that he was accused of some nefarious things that
affected the partnership, and so all was not well. They
got back together for some period of time, and now
the news has broken that the firm has pushed When
out of the firm and they have added an attorney

to replace him. When the name is Push Win and
the Win is n g u y e n, but
your billboards say p U s h w I N,
what do you do? Well, you go find a fellow
named David Win. Is that right sent? Oh sorry, Bob
Win w y n n E. So the push Win

name continues on. Since April, Anthony Push and she Hung
David Winn have been in a legal battle that has
split the firm. So now it appears that they have
pushed Win out of the firm and replaced him with
a dude named Bob Win. My guess is that Bob

Winn's whole job is to stay alive and have the
last name Win. An Instagram page for the firm has
been updated to reflect the firm's new name, with the
profile picture now featuring Win, a stocky, long haired lawyer.
The profile has been scrubbed to remove images of she
hung Win. To Houstonians familiar with the punny, eye catching

billboards of Push and Win, the rebrand may come as
a surprise, but behind the scenes, the duo has been
engaged in a bitter dispute over the firm's trademarks. On
October second, Harris County District Judge Christine Williams issued a
temporary injunction against Win. Under the order, Win has been
shut out of the firm, blocking him from accessing the

firm's computer systems, online accounts, revenue, and using the firm's
intellectual property. Win is also blocked from using the firm's
trademark slogans, including We Push You Win and avocados at law.
Judge Williams gave Win until October thirty first to transfer
trademarks to Push and Win. The court also ordered that

Push and his father, Girard, phase out any usage of
When's name or likeness from the firm's billboards and other advertisements.
The firm was ordered to phase out the use of
the name Push and Win spelled out in full, with
a complete transition to a new name. By October twelfth,
Push seems to have complied in his own way, replacing
when that Vietnamese version with when wy nne. The court

finally ordered that clients of the firm should be notified
that she hung David Quinn is not currently associated with
Push and Win. Just as Anthony Push and David Win
marketed the Push and Win firm using the mark we
pushed you when Anthony Push in a new partner conveniently
named When seek to market their new firm using the

mark we push you Win. Oh that sounds familiar or
variations are the same. Lawyers for David Winn wrote on
October eighth, David Winn says that Push sprung Win the
new partner on him, just mere weeks after Minster Winn
alerted this court of the name, image and likeness issues
inherent in plaintiffs continued use of the Push and Win brand.

Planiffs suggest that they have managed to add a partner
who's surname Win just so happens to be a homophone
of When. What are the odds? I suppose it could
happen right. Win claims that the rebranded firm Push and
Win seeks to capitalize on the reputation and goodwill of
the Push and Win brand. That is, the reputation and

goodwill that was built on and is inseparable from the
personal identities of mister Push and mister win. Win also
alleges that using the new branding with win, w WYAT
and me will result in confusion for potential customers who.

New college football rankings are out and coming in at
number one, the Ohio State Buckeyes. University of Texas went
into the first game of the season in Columbus ranked
number one and narrowly lost fourteen to seven to Ohio State.

Had their quarterback, whatever you may think of him, been
as good as Quinn Ewers was last year, they would
have won that game. The defense played fantastically, but they
came up a touchdown short against the best team in
the country, which right now is the best team in

Indiana a school that has made use of the NIO
and become a winner and in my opinion, made college
football more interesting. It's fun to see teams that normally
didn't break the top ten break the top ten, and
you see more and more of those now. Number three,

that their coach, Mike Elko, was not happy after the victory.
That's some Nick Saban level stuff. We did not play well.
We should have won by more. I'm not proud of

with a lost to Arizona State. I was hoping they
would win out and have a great rivalry game with BYU.
They can still win the Big twelve, and I think
they will. They are playing with their second string quarterback
at number fifteen, Missouri at six and one, number sixteen
Virginia higher than they typically are six and one, Tennessee

at number seventeen, five and two, South Florida at number eighteen,
six and one at number nineteen at five and one
after they beat was a Miami number twenty LSU. They
fell back having lost twenty one Cincinnati six and one
UT one and fell back. They were at twenty one.

his fellow players under the bus after the game, and
Nick Saban making some statements about that's not the Tua
that I know making statements like that. So Quinn Youwers
moving into the backup quarterback role and I wouldn't be
surprised to see him playing this year, which would be
quite interesting if quinn Ewers ends up the one with

the successful NFL or at least making at least making
it on the field as an NFL quarterback. This year,
he fell to seventh in the draft when most folks
thought he would go top four, and last year all
you heard from fans was bench him and put arch
Manning on the field. I think it's pretty clear now

that arch Manning a year ago, assuming he got any
better this year, that the arch Manning a year ago
was not the right decision, and the arch Manning a
year later has not been what everyone hoped arch Manning
would be. Now. There are a lot of different reasons
for that. I have argued that he has to be injured.

There's no way that he's throwing the ball worse a
year later. Some folks I know that are close to
the team and close to the kids tell me that
he's just got the yips, And every golfer knows that
even the best, even Tiger Woods, will go through a
period of the yips. It doesn't help that the expectations

were so unreasonably high for this kid to start the season,
and maybe the pressure got to him. But there is
no doubt if you watch the Longhorns play. He's not
an accurate passer right now. I don't know if he
can become an accurate passer or not. But you cannot
lead a top five program in college football and your

quarterback cannot make accurate passes or fifteen of fifteen yards
or less and consistently misses his receivers by several yards.
Can't lead them. The catches that they do make are
because the wide receiver made a good catch. Now there
were a couple of drops this weekend, but it's disappointing.

You know. I went to UH undergrad. I always root
for the Cougars. I went to UT law school. I
root for the Longhorns because I grew up rooting for
the long Horns. I root for the Aggies because I've
got a friend, Dj Hicks, who plays d line for them.
Steven Woodard's son, and have had a lot of friends
over the years play for the Aggies, and I love

RC Slocum. I root for Texas Tech because I've got
friends who are supported to the programs. I realize that
hardcore supporters of individual programs don't want you to root
for multiple programs, but I do, and that's Okay, if
my split fandom rooting for those teams bother somebody, then
he'll just have to bother them. I'm having more fun

because if you only have one team you root for,
there's a very good chance that pretty early on, you're
going to be disappointed in most seasons. Whereas I just
enjoy watching football and I do root for Texas football teams.
That's just the way it is. But I think that
the expectations for arch Manning were so unreasonably high, and

(30:41):
I think it's a silly notion to believe that there
is some sort of a link to a bloodline that's
going to make him any better than the next guy
in line. And by the end of the season, I
predict you're going to see Caldwell come in, and when
he does, that's going to create a real problem for
everybody that was a Manning partisan. I believe that, and

that's gonna be I think that's the only reason Sarkisian
won't put him in now. He doesn't want to have
a quarterback controversy like he did last year. They hate that.
It becomes a distraction. But when that kid comes in,
if he can accurately pass, it's gonna be a real
problem because right now arch Manning can't. And I actually
feel sorry for arch Manning right now because his head,
it doesn't look like that O line wants to block

for him. If you notice, they don't ever communicate. That's
a dysfunctional relationship. That is not a good environment right
now
