And boy, a lot of people at the gun show,
so we'll talk.

In addition to some obvious things we're gonna be talking
about the Fifth Circuit? Did did did we? Does something
happen to the fifth Circuit? I thought we were friends.
I thought we were buddies. Anyways, A three judge panel
on the Fifth Circuit made an interesting decision, which I
don't know has a lot of.

People disappointed, but I don't think it's the end of
the world.

All right, we are definitely going to be talking about legislation.
Speaker 1 (01:22):

I think, what are we starting starting the fourth week
maybe of the session. Anyway, all I know is I'm
up there until early in the morning until the evening,
and there is no cafeteria anymore at the Capitol. So
I'm hoping when the new North building gets put in,
I hope there's a cafeteria. Those are the good days.

In addition to the legislation, I think, what did I say,
I've got, like, of the thirty five bills that were watching,
thirty five maybe thirty six, we're going to discuss some
very briefly, some in a little bit more detail, about
twelve of them, some very quickly, just to say they're dead.

So that's that's good. And John Lott has moved. I
am going to bring that out and tell you where
he has moved to. So anyway, it's it's uh, it's
it's exciting.

And then Bill also, we we definitely have to go
over the media's role. Don't they call it the fourth estate,
the fourth of state of government, the media. And you know,
because you've got the judicial, the executive, the legislative, and
then the media and which has you know, all the
others have checks and balances, but the media has no

checks or balances or at least anyway. So we're going
to talk about the role of the media in wasting
people's time, wasting the legislature's time, which is our money,
and in some in smer because they just don't get
it right. They just don't get it right. In fact,

and I'm going to point out that we're not the
only ones in Utah to have that happen with some
of our media. Is a classic example out of Arizona
that we're going to be talking about. All Right, So
what have we got, Bill? What you had something? Didn't
you You were going to bring up something?

Yeah, we're going to talk about that. Well, there's a
big calendar event going on with DWR. Make sure you

Let me tell you all right, So, because I want
to save a lot of time in second third segments
to go over the legislation, let me tell you what
happened in the Fifth Circuit, Fifth Circuit Court of Appeals
yesterday day before yesterday, in a case called the United
States versus Peterson. Mister Peterson was a Federal Firearms licensed

gun dealer who was operating out of his home perfectly fine,
and he ran a foul of the ATF because for
some other reasons, he was selling guns that he shouldn't have.
Not illegal necessarily, but he was kind of It appears
he was playing fast and loose with transferring the firearms
and that kind of stuff. And they weren't huge violations,
(04:39):
but they were enough for the ATF to get a
warrant to search his premises. When they searched his premises,
they found a suppressor which was not registered, which was
not in his inventory, which was appearing to be homemade
or something like that, and fully functional. Well, they charged
(05:01):
him with a crime, among other things, and they said, no,
no bueno, because a suppressor is a gun, and I
have the right to keep in bear arms and I
don't have to register this stuff and that kind of thing.
So that was a seemingly novel argument. I guess you'd
get some traction with it, especially now. Well what happened
(05:23):
was so it went, it went to the Fifth Circuit Court,
it got all the way, Well it didn't get all
the way. It went to the Fifth Circuit card and
it was a three judge panel, so not the whole court,
but a three judge panel ruled against mister Peterson. And
not just did they rule against him, but they said
that a suppressor is not arms, as in keep to

bear keeping bear arms, thus it doesn't trigger.

That was my word.

The Second Amendment protections, uh said it's a firearm accessory,
and a firearm accessory is not protected and says, in
a quote from the the use of a suppressor is
not necessary to the use of a firearm, so it
is not protected by the plain text of the Second

Amendment Bill. I'm a little worried if this is left
to stand.

Now. I'm thinking that it's.

Probably going to go to the full en Bank, the
full fifth circuit. But can you imagine I mean accessories
that we that we utilize. I mean, I'm thinking a
flash hid or a muzzle break, a magazine, I mean
I read dot. Yeah, yeah, we could start having bank

states ban these accessories and say, yeah, you can have
the gun, but you can't have a front side on it,
because you can still operate the coun without a front side.

All that thought. Because that's all right happening here in Utah.

That's right, Representative Stoddard's bill represents because I'm yeah, Representative
Stoddard's bill. That was yeah, like you said, Representative Representative Stoddard,
Democrat out of the something district.

I can't remember what district Salt Lake area.

He uh, he has a bill and I'm trying to
actually find where it is. I'm pretty sure it's nowhere
there it is, so oh, it actually got it went
to the Public Utility Subcommittee, so it will ban.

Here see yeah, unlawful possession, manufacture, distribution, or sell of
a machine gun firearm attachment. Well that open ended.

Well, you know, I just was at the store buying
machine gun firearm attachments to make it a machine gun.
And now he's going.

To ban that. Huh, how did that work?

It doesn't because I didn't do that, because I'm under
federal law.

a very interesting week up on the hill. I mean,
we've talked about this in the first segment, but part
of the media thing, why we need to help keep
the media in touch or kind of on the right
side of information, is to make sure they give out

the right information. This kind of sounds funny, and we're
used to it, you know, but we're running some bills
up there, and I'll tell you it's just some of
the things that we hear and are being said, it's
just completely on the dark side. It's almost like they
don't even uh uh uh kind of know what they're

talking about. So, but Clark, you had some experiences, Yeah,
there we go, you know, on an article in one
of the big news outlets here in Salt Lake, and
you had to give them a call and they actually
called you back. What happened there?

I won't, I won't. I won't mention the name.

But their second, their second, thanks Bill, But there's there.

They're second behind k n R S. So anyways, our
third I don't know.

Anyway, So we were talking about HB one oh four
gun safety education in schools.
Speaker 1 (13:41):
It's a great thing. Education is always better than ignorance.

And this is for all age groups kindergarten through twelfth.

And the bill would uh, I mean it did.
Speaker 2 (13:51):
It's in the it's on the full it's on the
it's it went to the full House now, so it's
waiting to be heard in the full House. But it
went through I think it was is it Law Enforcement Committee? Anyway,
I can't remember. But Representative rex Ship we've been working
with this bill and it would provide non political, not
pro gun, not anti gun instruction on safety what to

do if the kids see a gun, find a gun
in their home that's unattended or unlocked or something like that,
realize that their friend has a gun in their backpack
at school, or you know, something along these lines. And
it's age appropriate education, So it would change, wouldn't be
the same thing. And it's not going to be a
kindergarten teacher standing up there and teaching about guns, because.
Speaker 1 (14:37):
I don't know.
Speaker 2 (14:38):
Maybe maybe some kindergarteners teachers could, maybe a lot of
them could. But anyway, it's going to be a video,
and we're talking about anywhere from a one minute to
maybe a three or four minute video. It's age appropriate
and then ages or grade seven through twelve. You'd see
it twice in those years, but every year K through six.

Anyway, all it is is safety.
Speaker 2 (15:03):
So and and so I was reading some of the
comments on one of the message boards UH that was
talking about this, and so I.

Got to read.

So they're thinking, literally, they're going to teach kids how
to how to how to operate the firearm, how to
use the front sight, rear sight, how to load and unload, and.
Speaker 3 (15:26):
When you gotta have you got to have the students
there to reload the magazine. If there's a school shooting clerk,
they got to be able to reload the magazine. Tap
the magazine on the desk, get those get those that
AMMO lined up properly and properly feed it to the
teachers so they can drop the magazine and do a
quick reload.

You know what we're gonna We're gonna need to make
an amendment to the bill then to include that, because unfortunately, bill,
all it is is safety. What to do is stop, uh,
don't touch, leave the area, tell an adult, so on
and so forth, and and that's it. But you'd be
surprised at how many of them think that this is
a They were actually teaching them how to shoot and

and I don't know, take cover, concealment, return fire, engage
and that and then and I don't I don't doubt
that because when you look at the headlines and some
of the reporting that was done on say HB one
thirty three, one of the minor one of the also
(16:29):
included minor aspects of HB one thirty three, eight almost
nine thousand line bill, which is essentially ninety nine percent
of it's a recodification to make things easier to understand,
which didn't change anything at all, just just reformatted it.
And that would definitely allow an eighteen year old to
have a loaded firearm.

Shut her the thought, the horror, the horror, you'd say.
Speaker 2 (16:55):
You know, and then and but that's all it would be,
because right now they can already have This was a
huge shocker. I think an eighteen year old, yes, may
purchase a firearm a handgun, just from a private party,
and they can actually get a concealed carry permit if
they want to and conceal it, and they can have
a loaded handgun in their vehicle, you know, as long

as it's they're not otherwise prohibited, you know, but when
they get out, they have to if they want to
carry it, they can't conceal it, so it have to
be open carried. They can already openly carry that gun.
They just have to have an empty chamber. And that
empty chamber idea has been around for a long time
and we think it probably came from when guns weren't

so safe. They didn't have you know, transfer our safeties
and inertia fire and pins and stuff like that. But anyway,
so yes, it takes when I say, literally half to
three quarters of a second to get that round from
that weapon from unloaded to load.

Did in a pistol and a.

Revolver, it's just two poles anyway, So people are freaking
out and the media says, now, eighteen year olds can
carry openly. Okay, folks, they've already been able to They've
never not been able to openly carry. So we uh
so I did, you know, to their thing. I contacted
a couple of these media outlets and they did call
me back, and they did, to their credit, they did

fix some of their stories. But it's still, you know,
once the cat's out of the bag, so to speak,
it it just kind of went.

You know, they think that it's been.

Going to the top of the of the news list,
so to speak, are bad, you know.

But if that's but Bill, But Bill, if you know
what I'm talking about, if that's all they're talking about
this Bill, that's great.

But remember the most important part. So Clark and I
care about the most with the media. As long as
they spell our names correctly and pronounce them correct, that's
all we care about.

Yeah, now they're I mean, they're getting hard.

We know they're they're trying to do their darnedest and
there's so much to cover up there, you know, and
we wouldn't we wouldn't want to expect too much from
these folks.

let's talk about bills. I'm gonna run through these. We've
got like thirty five that were officially watching and interacting
with the legislators and the committees and that type of thing.
But I'm just going to run through some. Some will
take a little bit longer. On some we won't. Firearms

Safety and School's amendments. It has passed with an amendment
that basically says it is was it one time between
K through six or something like that, So it really
reduced the number of opportunities for kids to get safety education.

However, hey, you know what, we might get.

That fixed in the House or certainly in the Senate
back to its original intent. This is an opt out,
so it's by default your kids going to hear it.

What was a classic one from one of the from
one of the news forums. It said, Uh, if this
bill passes that this guy, why's thirty five or something
like that, He's going to sue the legislature if the
bill passes.

we're on third substitute and Bill tell people how to
get in touch with the legislature, how to follow these things.

to the top there's an alerts tab. Just click on that,
enter your email address, and you'll be then up to date.
Because we did have an alert go out this past
week on HB three on nine Clark, and it was

great because the representative apologized for all the alerts to
all the committee members.

Oh not this, not this representative, but yes, but the
others in the committee did.

Yeah, and so they do work, and your representatives do
get these, uh these messages and they hear it loud
and clear from our from our members and our listeners.
So yeah, go run out of Machine Sports Council dot org. UH,
sign up for the alerts and UH and you'll stay
up to date. Because I think, I honestly think Clark,

we're we're concerned on a few bills, there might be
more alerts going out.

get into the Senate, if they get changed or something.
Like that now or if they're if they're failian votes

video committees, that type of thing. All right, So that
was HB one o four Firearm Safety and School Amendments.
It is on the House third reading calendar, so that

means that it will be up for a full vote.

In the House probably next week maybe. All right.

Another one, HB one thirty two firearm Storage Requirements that
was heard in House Law Enforcement, and that one has
been held held has the effect of it's not going anywhere.
It was not a great bill. We didn't like it,
and so it is held. It could be reconsidered, but
we'll see HB one thirty three. That's the Biggie Dangerous
(23:26):
Weapon Amendments that's going along as planned. It is now
to the Senate, i think the Senate Rules Committee, which
will assign it to an appropriate hopefully an appropriate committee
in the Senate to be heard and then it'll go
to the Senate floor, so it still needs two more votes.
HB one forty three is still sitting in House Rules.
House Rules is where it goes before it is assigned
(23:48):
to a committee. Firem safety incentives. This means that they're
going to get you can get a fifty dollars tax rebate.
I think it's still at fifty dollars and if you
buy a gun safe for a safety device or something
like that for your firearm. So we're hoping that gets
out of rules and gets moving. HB one eighty three
Non Citizen Restricted Person's Amendments HB one eighty three, it's
(24:10):
on its first substitute right now. Representative Trevor Lee and
says that if you entered this country, so there are
ways for non citizens who have legally entered the country
to obtain firearms. You have to get a hunting license
and so on and so forth. But if you entered
the country in a quasi legal way, it's an asylum,
(24:32):
but it's not really anyway you can't have gun.
Speaker 1 (24:35):
That's what this bill says here in Utah.
Speaker 2 (24:37):
If you entered the country via an asylum order or
something like that, no, until that's changed to a regular
entry cannot have a firearm. HB one eighty seven Imitation
Firearm Amendments. We had some problems with this one because
if a kid were to take off the tip off
an orange tip off, a toy gun, not air softer,

I think, maybe not airsoft, but anyway, certainly not a
BB gun or a paintball. But if they were to
take the orange tip off, that would be one crime.
Then there'd be another crime of possessing it, not necessarily
possessing it in public. That would be a whole nother crime.
We had some problems with this. We think that disorderly conduct.
We think that all sorts of different things probably satisfy

the intent, so we don't need some more.

That was HB one eighty seven.
Speaker 2 (25:25):
It was held in committee, which again has the effect
of it's in limbo, so it's not going to do
anything right now. HB one ninety five Firearm Retention Amendments.
If you get a plea in abeyance, a plea in
abeyance means you can you plead guilty to the crime,
but the judge promises you that if you stay at
keep your nose clean for the next six months to

a year, we're gonna go ahead and wipe that off
like it didn't happen. Well, if you get a plea
in abeyance for a crime that would result in you
losing your gun right, it's like a felony or you know,
something like that, then and then they can they can
write in that plan Obeymance agreement that you can't have guns. Well,
(26:07):
then what Representative McPherson, say to be one ninety five
would do is say, hey, if you get a plan
abeyance for a crime that wouldn't have resulted in your
loss of firearm rights, then they can't write that in
the PLAAN abeyance agreement. So it's pretty simple on that.
HB two two to one two two one. Also another
one that's sitting in House rules that needs to come out.
Representative Jack on HB two two one says that if

a burglar comes in your house, somebody comes in and
starts messing with your gun storage device, whether it be
a cable locka a little mini gun safe, a big
one whatever, that's a separate crime, and that's no buenos.

So you're gonna turp that. That's a really good bill.
Speaker 2 (26:46):
It needs to come out Yeah, HB three h nine
Wildlife Amendments. We did send an alert out on this
one because it had some troubling language. But I talked
with the sponsor. That was not his intent and he
has since changed. That's what's great to have great working
relationships with great representatives. And it was not his intent.
It was DNR and that type of thing. So that

has been changed. There's a substitute on that. We're still
watching it. But HB three h nine, if you got
an alert from Utah Shooting Sports Council or anybody else,
that has been changed and it has been ameliorated to
the point that we're okay with that HB three eighty
seven Firearm Attachment Amendments Bill. We were talking about this
one that is a representative ANDREWS.

Stoddard.

That is the machine gun parts or attachments or something
like that that went to was it Public Utilities anyway,
that's a pretty good committee. I don't anticipate it going anywhere,
But if you want to contact your representative or the representatives,
whether they're your representatives or not, you can contact the

members of the House Public Utilities Committee and say we're
a Utah Shooting Sports Council doesn't like HB three eighty seven,
so I don't like it either.

This is well, it's actually a very small bill, but
it's really bad. It's HB four twenty five Representative Dunagan,
and I like Representative Dunagan.

But he's running this bill for Department of Public Safety
and BCI to basically double the out of state concealed

And in my opinion, this was done by mishandling the
money because all the money they get from concealed cary
permit fees doesn't go to the general fund.

It goes into a dedicated account.

I don't think they were watching that account very carefully
for the last two or three years, that is my opinion,
and it certainly could have been ameliorated later. So we
do not like HB four twenty five. The permit fee
increases and t more.

That one has some what I would call some implications
that we don't want to talk about or mention it
this moment, But that bill's gonna that's going to cause
some issues with some really good things that are going
on from concealedary holders. And yeah, it's for out of
staters today, Clark. But if they do it for out

of staters, they're going to do in staters as well
next exactly.

Now, it's it's bad policy the way they're trying to
raise these rates.

Last couple, private sale of a firearm is now is
waiting on the Governor's desk. All I do is was
a sunset review to make sure that if we're selling
a firearm privately, that we have the option of going
to the BCI app and seeing if the person was
selling it to is bueno or no bueno?

and there they expressed some concerns and I kind of
had to remind the individual it's current law today. It's
current federal law today, and Utah tries to follow very
closely to current federal law. And he's like, well, I

just I don't know if I can just accept that,
you know. And he's like, I'm really good friends with
our one of our listeners, Mitch, you know, those saying
he goes and but he goes. I just, you know,
and I'm a gun guy. I love guns. But there's
still a lot of misconceptions out there going on about
current law and maybe existing law. And one of the

things when you go to l Utah dot govn and
you're looking up these bills, you'll see the whole bill.

Well, the whole section of the code.

The whole section, yeah, the whole section of the code.
And there'll be stuff that might be removed, that will
be striped through, and there'll be new stuff that will
be added in usually a different color and underlined.

And under definitely going to be underlined. New stuff.

Stuff that is taken out that's no longer part, that
won't be part of the code if the bill passes.

But everything in the black and white is existing, and
so you know, it's always good to it. Just this

So here's the Arizona Mirror. This is out of the
Arizona Mirror. A GOP lawmaker. This is the title, A
GOP lawmaker wants to repeal Arizona's ban on machine guns
and short broreled rifles and short bled shotguns. Okay, And
so reading that, you would think, oh, Arizona has a

ban on the on machine guns, and this lawmaker wants
to repeal it so that now Arizonians can have them.
In fact, look at this the another article headline article
out of an Arizona paper, throwing gas on a fire.
Arizona's GOP lawmakers look to worsen our state's gun violence crisis.

Okay. So I got reading it and I'm.
Speaker 2 (34:14):
Like, well, I thought you could have I thought you
could have a machine gun in Arizona because I've been
to machine gun shoots out there, and anyway, all they're
doing is repealing the Arizona ban. But the Arizona ban
wasn't what you think it is. All it said is
you can't have a machine gun, a short borild rifle,
(34:35):
a short biled shotgun, a suppressor unless they are appropriately
federally registered.
Speaker 1 (34:42):
And that's how every state is.
Speaker 2 (34:44):
That is allowed to some states like California and you
know Massachusetts, and that you can't have them anyway. But
there was never a ban on machine guns in the
otherwise lawful possession. But here we have an example of
the media outlet. It's just freaking out. And so now
you've got probably a ton of people because those are
some of the big newspapers in Arizona. And can you

imagine build the number of phone calls they're getting, Oh yeah,
that are.

Saying straight in and out and Facebook shares and everything else.

So mean, my gosh. So anyway, did you find anything

safe outlet Dave's place, and I think I might be
picking up a news safe, an actual safe safe. Yeah. No,
he had a really good deal on Browning. It's called
the Yellowstone. It's really nice.

And they come and join us, and we meet ahead
of time before the committee starts, and we talk and
they'll come into the committee, and some of them have
even offered testimony, you know, from from their own personal view.
