billions of dollars in money that is specifically coming in
from their oil sales, which are supposed to be basically
sanctioned right now. But America is not enforcing the sanctions.

told by somebody that were as bad young people don't

say I got us out of Afghanistan. That is the
moment when Iran and all these other countries and all
these other bad people in the world realize we can

what any country should do in this moment.

even visit, much less live. And Alvin Bragg has made
it clear he's making a living off of a going
after his political opponents.

Hey, now that I'm going after Trump and I've indicted Trump,
and I'm teking him on a sham trial. I need
your help, I need your support, And he's raised a
million bucks because he indicted his political opponent. I thought
that lawyers were supposed to have some sort of like
code of conduct and ethics. There's just to be you know,
above reproach with this stuff like where's the where's the bar?

How does this guy stay of his law license when
he's actually running on the idea that hey, regardless of
the facts, I'm indicting him, vote for me, and I'm
indicting my political opponent, Donald Trump right the other side,
vote for me. All right, Now that I've indicted him,
I needed your money. Give me a million dollars, and
I'll keep going after my political opponents, the people that.

You hate like that, I.

Would assume that that's got to be some sort of
violation of your of your oath.
Speaker 2 (27:32):
Is a is a lawyer? Is a is a a
person of the court? Haha? No, not not New York apparently.

So we've got wall to wall coverage, which is helping
Joe Biden because people aren't having to deal with watching
what's really happening in Israel. And now you've got these
people on TV that are saying things, for example, like
our founding fathers would be in dismay if they saw
Trump today.

We've been noting that this is the first time in
American history that a former president is on trial, and
Donald Trump is also challenging that very premise with his
upcoming Supreme Court case, arguing that he should have immunity,
that it is unconstitutional for him to be on trial
at all. But this is not only a test of
the American legal system, is also a test of constitutional democracy.

Joining me now is Michael Beschlass NBC, his presidential historian,
and John Neachum historian and the Rogers Distinguished Professor at
Vandebolt University. So glad to talk to both of you.

what do you see as at stake in terms of
the history, in the way this trial is conducted, in
the way the way it turns out.

Well, let's have a very brief and I promise brief
visit to our founders in seventeen eighty seven writing the Constitution.
I think they felt that they had created a political
system that would choose people as presidents who were not
too likely to have been to be accused of criminal conduct.

I think that's safe.
Speaker 11 (29:14):
So if they came back in twenty twenty four, the
first thing they would say, I think is, you know,
our system did not work.
Speaker 2 (29:22):
What happened.
Speaker 11 (29:24):
But you know, you were talking a little bit earlier,
Andrea and also the others were as well, you know,
have we seen anything like this in history? And actually
we have in nineteen seventy two. Richard Nixon as president
June in nineteen seventy two, on that famous tape, probably
obstructed justice and did so to keep damaging information out

of the minds the knowledge of the public so that
he could be sure to win election as president in
nineteen seventy two. That has a parallel here Nixon when
he quit in nineteen seventy four because of this thought
he was going to jail. And I think we should
say that if Gerald Ford had not pardoned him, Nixon
(30:05):
probably would have been put on criminal trial, and most
legal experts think that he would have been convicted and
sent to jail. So the point is that this has
happened before. But what should we say if people just
say there's something wrong with our system, this is a
setup for Donald Trump. You know, the problem is not
with him, it's with the system. That's something that people
(30:28):
did not say about Nixon in nineteen seventy four.
Speaker 2 (30:31):
So there you go.

Our founding, our founders writing the Constitution would say, quote,
our system did not work. If they saw Trump today,
our system did not work.

What happened?

That is the propaganda wall to wall on TV as
we speak. They're out there totally obsessed with this and
they want to lock up Okay, they want to lock
up the president of the United States of America.

What's the best way to make sure you get a
fair jury for a Republican president in a largely democratic city.

Well, Jake, here's the problem with what you just said.
Most people, I think the way even you phrased it,
Manhattan and the surrounding burrows. You know, the bronx, the
Staten Island, Queens, Brooklyn.
Speaker 4 (31:52):
People think that's where you pull from, but you don't.
Speaker 13 (31:54):
When the Manhattan d eight files charges, you only pick
from the island of Manhattan. So you know, you need
that cop from Staten Island, you need that firefighter from
Queens to kind of balance things out. But your subset
is the island of Manhattan. And I just can tell
you my personal experience was that that's not a great

demographic in this case, my thoughts from having done it once.
Speaker 12 (32:20):
So how given I appreciate the correction I did, You're right,
I did think that Staton Island to be part of it.
Stateton Island obviously went for Trump, the only borough to
do so in the twenty twenty election. So given the
limitations of Manhattan, how do you do it? How do
you find a fair jury?
Speaker 13 (32:37):
Well, I'll tell you, Jake, when we were doing it,
and Judge bart Shawn is a very serious man, he's
very smart, he's extremely courteous. I mean, I'm not getting
into people's biases or prejudice.
Speaker 4 (32:50):
I'm not qualified to do that.
Speaker 13 (32:52):
I can tell you having spent seven weeks with the man,
he's a gentleman and he gave us as much time
as we needed. However, you know, he wanted to get
a jury, so we had a lady b I'm.

juris for about thirty five years.

She looked good to me, a lady in.

The mid forties of Irish extraction.

She spoke with a brogue.
Speaker 13 (33:28):
She worked in an Irish pub and in our questionnaire
questions twenty nine and thirty said do you have any
four do you have any strong feelings about the former president?
And if so, would they affect your ability to be fair?
And she checked them, so I said, well, ma'am, you know,
would they be positive or negative? Feelings.
Speaker 2 (33:45):
And she says, oh, I despise that mine.
Speaker 13 (33:47):
And I said, I guess it was late in the day, Jake,
And I said, I'll come on, don't sugarcoat things for me.
Speaker 4 (33:52):
Speak your mind. She says, oh, speak me mind.
Speaker 13 (33:54):
I hate him and Jake, I, you know, three and
a half decades since Ronald Reagan was president, been knocking
around picking juries.
Speaker 4 (34:02):
I was floored.
Speaker 13 (34:02):
And I looked over at Judge Berchon, expecting him to
meet my gaze and dismiss her. And he said, now, well, now,
wait a minute. He's got his robe on and the
pomp and circumstance of the court room. If I instructed
you on the law, could you put those feelings aside
and be fair? And she said, like most people say
when they see the judge in that black robe.
Speaker 4 (34:20):
Sure, Judge. So she made it to the second round.
Speaker 13 (34:24):
I got her out a different way, but it was
like rows of shark teeth, they just kept coming. And
she wasn't the dangerous Jew or Jake because she answered
the questions the Jura who just answers no questions.
Speaker 4 (34:37):
And you just have a gut feeling.
Speaker 13 (34:39):
You say, if it's a male jury, say Sarah, you
seem to be the perfect jew on paper. There's nothing
about the former president that gives you put nah, I'm fine,
put me in.
Speaker 4 (34:49):
I'll be great.
Speaker 13 (34:49):
And that's the Jura that I worry about, the Jura
who has some type of ulterior motive to get on
that case to settle a score.

Leave it to Jake Tapper to laugh at these seriousness
of the situation.

Like, oh, this is so funny. Ha ha ha. We're
gonna lock up Donald Trump.
