Speaker 1 (00:01):
We have got a lot to cover, including the shocking
breaking news that Jack Smith's grand jury has brought a
new superseding indictment against Donald Trump, meant to work around
the recent Supreme Court ruling holding that Trump's official actions
as president were not subject to prosecution.
Speaker 2 (00:25):
What does this mean?
Speaker 1 (00:26):
In translation, they're trying to either bare minimum, put Donald
Trump in a courtroom instead of on the campaign trail
to interfere with this election that we're in right now,
or they're trying to lock him up and put him
in jail so that he literally can't be president of
the United States of America.
Speaker 2 (00:45):
The Biden and Harrish regime is.
Speaker 1 (00:47):
Obsessed with putting Donald Trump behind bars by any means necessary,
and that is exactly what this radical rogue government is
now doing with Jack Smith's grand jury that's brought these
new again superseding indictment against Donald Trump, saying all right,
Supreme Court, screw you, We'll just work around you, which
is not actually following the law at all.
Speaker 2 (01:10):
I'm going to get more into that in a minute.
Speaker 1 (01:12):
While that's going on, there's also something else that just happen.
Texas has removed one million ineligible voters from their voter roles.
They also found that thirty percent of non citizens previously
cast ballots.
Speaker 2 (01:32):
This is the.
Speaker 1 (01:33):
Biden administration has five hundred and fifty thousand more illegal
aliens they say could receive amnesty under a Biden Harris
administration executive order. And I'll give you the details on
all of that in a moment.
Speaker 2 (01:48):
Now.
Speaker 1 (01:48):
While all this is happening, there's another story that deals
with Facebook admitted. Yeah, we uh, straight up suppress censored
in silenced conservatives in the last election. And we did
it because the FBI and the Deep State told us
to do it, and the United States government met with
us under Biden Harris and said, we don't want these
(02:09):
stories to see the light of day. And that's exactly
what big tech did. Yeah, there's a lot happening. I'm
going to get into all of it now. Before I
get to that, I want to say, first of all,
thank you to so many of you that listen to
the show that have gotten involved to help the people
in Israel. The International Fellowship of Christians and Jews is
doing amazing work on the ground and we are quickly
(02:31):
approaching the one year anniversary of the horrific Hamas attacks.
Speaker 2 (02:36):
On Israel.
Speaker 1 (02:38):
The sad thing is the Holy Land continues to be
attacked on multiple fronts.
Speaker 2 (02:43):
We have had deadly threats.
Speaker 1 (02:45):
That are increasing in northern Israel, constant rocket attacks from
terrorist groups like HESBLA that have been fired at Israel
causing widespread damage, and even wildfires have destroyed precious farmland. Now,
since the war started, the International Fellowship of Christians and
Jews has been on the forefront of Israel, addressing the
(03:07):
needs of the most vulnerable. That's why I have partnered
with IFCJ and I want to ask for your help.
Your life saving donation will help provide emergency food as
well as critical security needs such as flat jackets, firefighting equipment,
armored vehicles including armored ambulances, bomb shelters and more. We
(03:30):
are looking for five hundred listeners to join the Fellowship
and me by donating one hundred and fifty dollars to
meet the urgent needs of the security needs of the
people in Israel. And thanks to a generous IFCJ donor,
your gift is going to be matched automatically, doubling your
impact in the Holy Land. Now, if you would like
(03:52):
to get involved and you want to make a gift.
Please call them eight to eight four eight eight IFCJ.
That's eight eight eight four eight eight IFCJ. IFCJ on
your phone is four three two five. You can also
go online to support IFCJ dot org to give that's
(04:13):
one word support, IFCJ dot org SUPPORTIFCJ dot org. Israel
needs our support now more than ever. All right, so
let's go back to one of these stories that I
think is incredible, and it tells you just about how
much corruption there is within our voting and our voting
(04:34):
roles UH in this country. And this is coming from Texas. Now,
why don't I use Texas as a barometer? Texas is
obviously a much more conservative state. And if Texas had
a million ineligible voters PERGS from their voter roles, imagine
what that number is in more liberal states. This is
(04:54):
shocking coming from the governor Texas. Governor Abbott announced that
since he's he signed Senate Bill one into law on
twenty twenty one, the state has removed more than one
million ineligible voters from its voter rolls. As Senate Bill
one aimed to uphold the integrity of elections in Texas
by establishing uniform voting hours across the state and banning
(05:19):
drive through voting and unsolicited applications for mail in ballots,
which is what Democrats absolutely loved, because that's where you
can use to your vantage for corruption. Illegal voting in
Texas will never be tolerated, is what the governor said
at the time, and that is why they passed this bill.
Now what's happened since then is Texas has removed from
(05:41):
its roles people who were non citizens okay, illegal immigrants, deceased,
or those who had moved out of the state and
were no longer residents. According to the press release from
the Governor's office in Texas, more than six thousand, five
hundred of those removed from the voter roles are in fact,
you guessed it, non citizens illegal immigrants. Abbott's office claimed
(06:07):
that one nine hundred and thirty of those individuals, or
about thirty percent, had in fact voted in previous elections,
So there were thousands that is an accurate statement of
illegal immigrants that actually voted in previous elections, canceling out
the votes of American citizens. The Secretary of State's office
(06:29):
is in the process of sending all one nine thirty
records to the Attorney General's Office for investigation and potential
legal action.
Speaker 2 (06:39):
That is a good start.
Speaker 1 (06:41):
Over six thousand of those removed from Texas voter rolls
had felony convictions. Four hundred and fifty eight thousand were
deceased and that's where the biggest corruption is. Dead people
yes voting, and four hundred and sixty three thousand were
on the suspended list now. The release noted that the
removal process is still ongoing. Abbot again saying election integrity
(07:06):
is quote essential to our democracy. Saying this, I've signed
the strongest election laws in the nation to protect the
right to vote and to crack down on illegal voting.
Abbot stated these reforms have led to the removal of
over one million ineligible people from our voter roles in
the last three years, including non citizens, decease voters, and
(07:28):
people who have moved to another state. The Secretary of
State in county voter registrars have an ongoing legal requirement
to review the review the voter rolls, remove ineligible voters
and refer any potential legal voting to the Attorney General's
Office and local authorities for investigation and prosecution. Illegal voting
(07:51):
in Texas will never be tolerated. The governor said, we
will continue to actively safeguard texans sacred right to vote
while also aggressively protecting our elections from illegal voting. Now,
on Monday, a Texas federal judge placed a temporary two
weeks stay on the Biden Harris administrations Keeping Families Together
(08:11):
program as well, that is a mass amnesty process for
illegal immigrants, spouses and step children of American citizens, following
a lawsuit filed by sixteen Republican led states, including Texas. Now,
according to the White House, there are approximately five hundred
and fifty thousand illegal immigrants in the US who could
(08:34):
now qualify for the program, which would entitle them to
parole in place while awaiting adjustment of their immigration status,
meaning amnesty. These thirteen states complain, and their complaints suggests
that it would extend mass amnesty instantly to roughly one
(08:54):
point three million illegal aliens, many of whom have been
residing in the country on the law awfully for decades.
The Texas Attorney General Kim Paxon, saying about this move
by the Biden administration of grant amnesty to five hundred
and fifty thousand legals quote biden zuparole work around unilaterally
grants the opportunity for citizenship to unvetted aliens.
Speaker 2 (09:18):
Those would be illegals first.
Speaker 1 (09:20):
Whose first act on American soil was to break our laws.
This violates the Constitution and actively worsens the illegal immigration
disaster that is hurting Texas and our country. Now, it's
very clear that the Biden Harris administration are trying to
buy votes ahead of election day. That's why they're doing
(09:40):
this right now, saying, hey, over a half million of you,
you've got family and friends that can vote, right, well,
we need you to get them to vote for us.
Let me break this down for you so you understand
exactly how this announcement came out. The Department of Homeland Security,
obviously under the direction of Harris and Biden, announced, and
(10:01):
this is part of their marketing and pr campaign, that
the quote keeping Families Together program, which is not actually
anything different than a mass amnesty program for at least
five hundred and fifty thousand legal aliens already residing in
the US, must move forward, they said, and their marketing
as well, We're just trying to keep families together, right,
(10:22):
because who would be against keeping families together.
Speaker 2 (10:24):
So we'll give it that name.
Speaker 1 (10:26):
So if you're against this, and then we can point
it and go Hold on a second, you're against keeping
families together?
Speaker 2 (10:31):
How evil are you? Donald Trump? How evil are you?
Speaker 1 (10:34):
Senator who's running for reelection Ted Cruz in Texas?
Speaker 2 (10:38):
How evil are you? Congressmen running for reelection?
Speaker 1 (10:41):
How evil are you to not want to keep families together?
Speaker 2 (10:45):
It's a talking point. Now.
Speaker 1 (10:47):
The federal government under Harrison Biden claimed that the new
process demonstrates that the Biden Airs administration has a quote
commitment to promoting family unity in the immigration system.
Speaker 2 (11:01):
So what does it really do?
Speaker 1 (11:04):
It unlawfully creates a program that effectively provides a completely
new way, a new highway, a new pathway, a new
roadway to citizenship.
Speaker 2 (11:16):
In this workaround that no one voted on.
Speaker 1 (11:18):
The program would allow illegal aliens, including spouses and step
children of American citizens to quote request parole in place
under existing statutory authority. If granted parole in place, then
eligible illegal aliens would be allowed to remain in the
US while they request an adjustment of their status. Now,
(11:43):
according to this press release from the US Customs and
Immigration Services, the administration estimates that there's at least a
half a million illegal alien spouses and at least fifty
thousand illegal alien step children of American citizens that would
then be given amnesty.
Speaker 2 (12:00):
Now.
Speaker 1 (12:01):
Notice the way they were that the administration estimates there
is at least a half million illegal alien spouses. That
number could be much higher. It could be a million,
because they're not going to tell you the real number.
They're going to wanted this to become like the new
law of the land, and then you'll find out years
later what the real number was. I wouldn't be surprised
(12:24):
if this number is actually well over a million illegal
alien spouses. Of the roughly half a million spouses of
American citizens on average, most have resided unlawfully in the
US twenty three years. The Department also reported to be
eligible for the program. They say spouses must have lived
(12:44):
in the country illegally since June of twenty fourteen. And
I've been married to a US citizen since June twenty
twenty four, So run out there and hurry up and
get married right by June twenty twenty four is the
message that they were clearly sending a few months ago. Now,
eligible step children, they say of American citizens must be
under twenty one and be unmarried, they must be residing
(13:08):
unlawfully in the US since June of this year, and
have illegal alien parient parent who is married to a
US citizen. So this is just a whole new way
of giving.
Speaker 2 (13:20):
A pathway to citizenship.
Speaker 1 (13:22):
And completely skirting what the immigration laws actually say in
this country. Right now, applicants, by the way, they say,
cannot have a quote disqualifying criminal history, which includes such
offenches as murder. Glad we have such a high standard
to become a citizen now. Rape crimes involving firearms or
controlled substances, aggressive assault, child pornography or abuse, and domestic violence.
(13:47):
They say, those convicted of other crimes can quote overcome
the presumption of ineligibility by demonstrating positive factors that can
be considered in overcoming this presumtion and showing that you
warrant a favorable exercise of discretion.
Speaker 2 (14:05):
Let me take a quick.
Speaker 1 (14:06):
Moment to tell you about an incredible company that stands
up and fights for our First and our Second Amendment rights.
They fight for the rights of unborn children, and they
fight every time you pay your bill to them for
our veterans, our first responders, and our wounded warriors. I'm
talking about Patriot Mobile. They are the only conservative Christian
(14:31):
wireless provider in the country, and when you pay your
bill to them every month, they actually take about five
percent of your bill and give it back to the
causes that I just mentioned at no extra cost to you. Now,
the reason why that's incredible is because if you're with
Big Mobile, you're actually supporting and funding the Left in
a very big way. Big Mobile gives big donations to
(14:55):
organizations that pay and advocate for abortion on demand. They
give big donations to Democratic candidates and causes at the local, state,
and national level. Another reason why you should make the
switch to a company that stands with your values. Now,
making the switch Patriot Mobile is easy. You can keep
(15:17):
your same cell phone you have right now, keep your
same cell phone number, or you can upgrade to a
new phone, and you don't have to worry about coverage
because in twenty twenty four, it is actually really easy
to make the switch, and you're gonna have the same
exact coverage that you are used to because they use
the same exact towers that you're using right now. So
(15:39):
call right now, nine to seven to two Patriot that's
nine to seven to two Patriot or patriotmobile dot com
slash ferguson. Now, when you use the promo code ferguson,
you're gonna get a free month of service. So don't
wait any longer. Stop giving your money to comanes that
(15:59):
literally hate your family values and hate your Christian values.
Make the switch, get nationwide coverage and make a difference
with every phone call you make. Nine seven to two
Patriot that's nine to seven to two Patriot or patriotmobile
dot com slash ferguson. Promo code ferguson. You'll get one
month of service for free. Now, even illegal aliens currently
(16:24):
facing removal proceedings, the Biden Harris team says, would be
eligible for the Biden Harris administration new program. So you've
screwed up your in current removal process, We'll just stomp
all that and you can stay because you have an
anchor family member, an anchor baby quote. If you have
(16:44):
a final executed removal order none disqualified criminal history, or
other derogatory information your case, you may provide additional documentation
that you believe demonstrates your pro is warranted based on
a significant public benefit or urgent humanitarian reasons and that
you merit a favorable exercise of discretion. Okay, now that's
(17:07):
what the US government said. So let's break that down.
Let's say that you're part of the removal process, and
we don't know how many are in that process right now.
It could be hundreds and hundreds of thousands or even
millions that would fall into these categories. That is a
new category right there that everybody should understand is another
(17:29):
way for them to give out actual amnesty.
Speaker 2 (17:32):
Like that's all this is.
Speaker 1 (17:34):
They're making up immigration law without anyone having to vote
on it. That is a problem. Like, no one is
having to vote on this, no.
Speaker 2 (17:43):
One at all.
Speaker 1 (17:45):
This is just straight up mut's make it up as
it go as we go. And how can we hamm
out amnesty right before election day or the appearance of
handing it out right before election day so that all
the family members will vote for us. This is what
you call buying votes. Now, notice that everything that I
did tell you right now, all of it that I
(18:07):
that I just told you right now, every single bit
of this has to do with one main issue. You
have a direct connection to citizens in the US that
can vote.
Speaker 2 (18:24):
Did you notice that that's what this is.
Speaker 1 (18:28):
They're telling you that you if you're if you have
a connection to someone who is an actual American citizen,
we want to give you amnesty so that we make
sure that that person votes for us, because we're the
one that gave MC. This is again another example of
what I've described before of buying votes.
Speaker 2 (18:49):
This is all about buying votes.
Speaker 1 (18:53):
You look at Harris and you look at their administration,
and you understand pretty quickly how how smart they are
when it comes to this, Like this is brilliant, folks.
I mean, I'm not kidding when I say this, Like
this is straight up brilliant. Right before election day, start
handing out amnesty. It involves millions of people at a minimum, okay,
(19:19):
and that's non exaggerated number, millions of people. And then
you get all the family members who and you already
know there's an American citisen involved in these families and
these situations. Everyone that I just described, the anchor is
the American citizen. And then you go to those American
citizens right for election, and you're like, hey, I'm trying
to give your family member right, you're the person you
(19:41):
married or your kids American citizenship, the dream. Who the
hell do you think they're gonna vote for. They're gonna
vote for definitely Kamala Harris, because Kamala Harris is offering
this to you now. On Friday, a group of sixteen
(20:02):
Republicans led a state filed lawsuit in partnership with the
American First Legal against the federal government to stop this program.
Critics have called the administration's executive order a mass amnesty
program without the authority to do it. But again, this
administration doesn't care about the authority. They just say we're
going to do it anyway, and they have the deep
(20:24):
state that backs them up. States that are involved in
trying to block these efforts include Texas, Idaho, Alabama, Arkansas, Florida, Georgia, Iowa, Kansas, Missouri, Louisiana,
North Dakota, Ohio, South Carolina, South Dakota, Tennessee, and Wyoming.
(20:49):
The lawsuit argues that the administration's claims that the process
would impact at least half a million of legal aliens
is likely a significant understatement quote unquote, saying that the
number could actually be more like one point three million,
which goes back to what I told you a moment ago.
The States claimed the program circumvince Congress as well and
(21:12):
would do irreputable harm to their communities because now, all
of a sudden, you have to take care of all
of these different people, right, that's a big deal. The
complaint accused the Administration of unlawfully creating a program that
effectively provides a new pathway to citizenship from well over
a million illegal aliens. Kim Paxson said, Biden zuopro work
(21:35):
around unilaterally grants the opportunity for citizens to unvetted aliens
whose first act on American soil as a breaker laws
to then all of a sudden be rewarded with American citizenship,
saying this violates the Constitution and actively worsens the illegal
immigration to spare that is hurting Texas and our country.
Speaker 2 (21:59):
All right, now, let me get back.
Speaker 1 (22:00):
To this third issue that's really important, and that is
is this America or is this the Banana Republic. I
asked that question because Donald Trump has been indicted again.
Trump was indicted again in an election subversion case brought
by Jack Smith. Now this is clearly I want to
(22:23):
state this election interference. It's going to be a headline.
It's going to try to They're going to use us
to try to influence the American people and quite possibly
tie Donald Trump up in court hearings that will take
him off the campaign trail. This is election interference by
Jack Smith.
Speaker 2 (22:41):
One oh one.
Speaker 1 (22:43):
Now, a federal grand jury in Washington, d c. Has
quote unquote reindicted Donald Trump on four feunty charges related
to his effort to subvert the twenty twenty presidential election.
Is what the indictment states. It's a thirty six page
indictment secured Tuesday by Special Counsel Jack Smith in an
(23:04):
attempt by prosecutors to quote recalibrate the case against Trump
in light of the Supreme Courts ruling last month that
concluded the presidents enjoy That would be all presidents, not
just Trump, that presidents enjoy sweeping immunity from prosecution for
their official conduct while in office. Now, CNN, you wan't
(23:28):
to know how they broke the news. Oh my gosh,
they were just so excited.
Speaker 2 (23:34):
We're after breaking news coverage moments ago.
Speaker 3 (23:36):
Special Council Jack Smith just filed a superseding indictment any
federal election interference case against former President Donald.
Speaker 1 (23:42):
Trumpet superseding right, we got big, We're excited, breaking news.
We got the banner going, We've got everything in here.
This is massive. We're so excited. We've got Donald Trump
and dit it again. I want to be clear, I
don't think this is going to have much of an
impact on this election.
Speaker 2 (24:01):
He's already been indicted a million times. What's another one?
Speaker 1 (24:04):
Right, Like, what's another one? I think many Americans are
also going to roll their eyes at this indictment for
the fact that they know it's the same guy that
just got his handslapped by the Supreme Court. I think
what matters more to voters now than ever before is
(24:25):
the real issues. For example, CNN had to come out
today and it meant that housing prices had a five
point four percent record jump. It's a rough market, is
how they described it. This is what's going to matter
because home prices rose at a record rate in June.
Speaker 2 (24:45):
We have millions of millions of illegal immigrants.
Speaker 1 (24:48):
Let me rephrase that, tens of millions of legal immigrants
that have come across the border that are competing for
lower price housing and apartments, which is driving the rates
of rent through the roof as well is driving the
rates of home prices through the roof, because when you
have twenty million more people looking for houses, well, then
prices go up. I think that's what the issues that
(25:11):
are going to matter to the majority of Americans more
than a Donald Trump indictment, and even on CNN when
they're forced to cover this listen.
Speaker 4 (25:20):
A just released housing index reveals just how rough the
market is, especially for first time home buyers. It showed
home prices for the nation's top twenty metro areas rose
five point four percent from June of last year to
June of this year, a record jump for that month.
Speaker 2 (25:35):
And renters, not just home.
Speaker 4 (25:37):
Buyers, are feeling a serious squeeze, especially in New York.
Moodies found New Yorkers dedicated a whopping fifty eight percent
of their income toward rent, compared to twenty seven percent nationwide.
Speaker 2 (25:49):
Let's talk about.
Speaker 4 (25:49):
This with CNN Business Editor at Large and anchor Richard quest.
Speaker 1 (25:53):
Now, by the way, this is damning because at the
bottom of the screen it says top twenty metro areas
are saying higher rent and higher home prices. So they
bring in Richard, right, and what does he say, because
she just said in her own words, right, she said
in her own words, it's a rough market. So what
does he say, listen carefully, fifty.
Speaker 4 (26:14):
Eight percent Richard, that's wild. But let's start with home prices,
because year over year they're so high, but month over
month there are actually some encouraging science.
Speaker 5 (26:25):
Yes, because they are starting to come down a bit,
or at least the rate at which they're going up
is starting to come down. And those were the worst,
of course, I mean New York, San Diego, Las Vegas.
Why are we not surprised when we see that? But
the inflation is inflation is moderating on and we know
(26:45):
it is, and so that is feeding through two house
prices which aren't going up as fast, but they are
still going up, and that I think plays into the
political as season. You've got, of course, Vice President Harris's
economic plan to give a tax credit to first time
homeowners or house buyers of twenty five thousand dollars. When
(27:07):
you see the numbers the first time buyers are having
to pay, you can understand that that will be an
attractive policy, assuming sheev works out how she's going to
pay for it. But that as a policy, per se,
is one of those things that will be attractive.
Speaker 2 (27:23):
And let's just pause there.
Speaker 1 (27:25):
So they're saying everything sucks, and then Richard's like, you know,
fifty eight percent is wild, but don't worry. Kamala Harris
is going to give you like twenty five thousand dollars
to buy your home and everything's going to be okay
if you're a first time home buyer. I don't think
anybody believes this, by the way. I think it's total crap.
(27:46):
I think everybody knows it's crap. I think they know
they're lying to them, the same way they lied about
paying off all of your student loans, for example. They
were lying to you, and I think everybody knows that
they are lying. Now, well, let me rephrase that. I
think enough people know. There are still idiots out there
that are gonna vote for her because they're like, Oh,
you're gonna give me twenty five thousand dollars and oh
(28:08):
she's gonna pay off my student loans and it's gonna
be amazing.
Speaker 2 (28:11):
Right, this is like the Obama phone day.
Speaker 1 (28:13):
So I'm gonna, you know, I'm gonna vote for him
because he's gonna give me an Obama phone. And if
I vote for him and he's gonna give me more right,
there's certainly some of that here. But I go back
to this indictment of Trump yet again. I just don't
believe that there is a ton of people that are
gonna have their vote swayed by another indictment from Jack
(28:38):
Smith after he's already been smacked around by the Supreme Court.
Speaker 2 (28:44):
I just don't. Now.
Speaker 1 (28:46):
Let me also let you hear what sentater Ted Cruz
had to say about this. We talked about this in
the podcast that I do with him, Verdict with Ted Cruz.
I co host that with him. But I want you
to hear what he had to say about this in
his own words. Take a listen, Center. This was one
of those headlines. And I'm not shocked anymore. As you
almost described in the intro there, that the left is
(29:09):
afraid Trump's going to win. So okay, let's try to
throw him in jail. Let's indict him again. But there
is some confusion. How is it that this guy was
told you did it wrong from the Supreme Court. Can
then go back to the federal grand jury in DC
and reindict Donald Trump on these four felony charges in
essence going around with the Supreme Court.
Speaker 2 (29:32):
That's what it seems like is that reality.
Speaker 3 (29:35):
Yeah, look, I understand that. Let me say, first of all,
put this in a broader context. A year ago, no
president of the United States has ever been indicted, no
major party candidate for the president had ever been indicted.
In the past year, Donald Trump has been indicted not once,
not twice, not three times, four separate times by rabid
(29:57):
Democrat partisans who are very concerned that the voters are
going to elect him. Every one of these indictments. They're
not about the criminal law, they're not about the rule
of law. They're not about actual conduct of Donald Trump.
They are about trying to stop the voters from voting
for him. In November, we are sixty nine days away
from election day, and Democrats are terrified he's going to win.
(30:20):
And so I got to say, after four different indictments,
to wake up and see yesterday a fifth indictment. It
almost feels like that classic Saturday Night Live skit with
Christopher Walken where he's a record producer and his solution
to everything is more cow bell, more cow bell. The
Democrats answered, everything is more indictments, more indictments. They just
(30:43):
want to indict Trump. So Jack Smith, Jack Smith is
like to use another analogy.
Speaker 2 (30:47):
I don't know.
Speaker 3 (30:48):
I feel a little bit like Dennis Miller stopped me
before I sub reference again. Jack Smith is like Javert
from Le Miz. He is going after Jean Valjean, and
Jean Valjean for him is Donald Trump and he must
get him. And so he filed a brand new indictment
thirty six pages, and he indicted Trump again. Now it
(31:12):
is you asked, is this permissible after the Supreme Court decision,
and the answer is yes, it is.
Speaker 2 (31:18):
So.
Speaker 3 (31:18):
The Supreme Court did not conclude that jack Smith had
no authority in charges. The Supreme Court did not rule
on whether jack Smith was properly appointed. That was a
basis for ruling from the judge down in Florida concerning
the Document's case, but that was not in front of
the Supreme Court. What the Supreme Court ruled is that
(31:39):
presidents of the United States enjoy significant immunity from prosecution.
And the line the Supreme Court laid out is that
the immunity presidents enjoy is an immunity for actions carried
out that are official actions that are carrying out that
are exercising their power as president, and significant parts of
(32:00):
the first indictment were in the direct exercise of Trump's
authority as president. Supreme Court said, you can indict a
president for that. Look, presidents do all sorts of things
that frankly, you and I can't do. Presidents send the
military into combat and kill people. If you and I
set someone out to kill someone, we would in all
(32:20):
likelihood be charged with potentially murder attempted murder. Presidents have
authority under the Constitution that ordinary citizens do not. What
Jack Smith did here is he refiled the indictment, and
you can do that. So one question, and you and
I were talking beforehand, and a question was, well, does
this violate double jeopardy? And it does not. So double
(32:43):
jeopardy is the protection of the constitution against trying someone
multiple times for the same crime. And the general rule
is that jeopardy attaches when a jury is impaneled. In
other words, when the trial, you get a jury together,
you bring the jury, you start the trial. That's the
point at which, okay, if the guy gets off, if
(33:06):
the guy is acquitted, you can't prosecute him again because
jeopardy is attached.
Speaker 2 (33:11):
At this point.
Speaker 3 (33:12):
Jeopardy has not attached legally, because an indictment has come down,
but a jury has not been impaneled. So the prosecutor
can indict Trump as many times as he wants to.
That is part of being a prosecutor. Now, indicting is
simply bringing a charge against him. And so what Jack
Smith tried to do here was narrow the indictment. He
as many of the same claims he had before, but
(33:33):
he tried to carve out to excise the bases that
were most connected to Trump's official exercise of presidential authority. Now,
I think this is going to fail. I think this
is not going to go anywhere. But as I said,
Jack Smith is like Javert, he is on a crusade,
(33:55):
and so he did it yet again.
Speaker 1 (33:58):
When I look at the timing of this, and this
is the next question, is you mentioned the Facebook story?
Speaker 5 (34:05):
Right?
Speaker 1 (34:05):
Mark Zuckerberg has now admitted that he played a major
part in election interference, along with, by the way, the
FBI and the Biden regime. So this story comes out
and actually, like, all right, let's indict Donald Trump again today.
Is there any threat that this could also be straight
up election interference from the standpoint that Donald Trump's going
(34:26):
to actually have to go back to court, be in court,
be in a trial between now in November.
Speaker 3 (34:31):
Now, I don't think there's any risk of that. Look, look,
we're sixty nine days out from the election. This new indictment,
a new indictment takes time. You're not going to see
a criminal trial between now an election day. We're just
too close that there's no prospect of that happening that quickly.
In DC, there might be some pre trial hearing or something.
It could conceivably take one day, but it's not going
(34:53):
to consume significant time between now an election day. And
what this means, Listen, if Trump wins and he gets
inaugurated as the president on January twentieth the next year,
this case will be dismissed on January twentieth because as president,
he has the authority to order the case to be dismissed,
and he will. So this is.
Speaker 2 (35:17):
Number one.
Speaker 3 (35:18):
It's another political shot at Trump for them to say, oh,
he's been indicted again. He's a felon. He's a felon,
He's a felaon. At this point, they already say he's
a fellain NonStop. When we have a debate between Kamala
Harris and Donald Trump, and by the way when we
do have the debate, this podcast is going to analyze
before the debate and great detail what to expect, and
then after the debate we're going to break it down
(35:38):
in great detail. I'll point out on this pod you
and I did a special pod the night of the
debate between Donald Trump and Joe Biden, and I think
it was a really consequential pod because that night real time,
we predicted and we said in my judgment the odds
were one hundred percent that Joe Biden would not be
(35:59):
the nominee of the Democrat Party, that this would prove
to be the most consequential presidential debate in US history.
That prediction proved right because just after a month later,
they remove Biden from the ballot. So we'll do the
same thing on this debate. But I gotta say I
actually am not terribly excited about this Jack Smith indictment
(36:19):
one way or the other. Yeah, he hates Trump, Yes,
he's willing to abuse power. We know that this is
nothing new. I don't think there are a whole lot
of political consequences to another indictment after there have been four.
I don't really see how a fifth indictment has any
more political bite to it, and I don't think there
are real legal consequences now. If God forbid, Kamala wins,
(36:42):
then this legal case will proceed and Trump may be
dragged into ongoing proceedings for years as a consequence of this.
But in terms of the election, I don't see any
significant consequences.
Speaker 1 (36:55):
