It was a shelter that was forillegal immigrants. So it's a shelter specifically
for illegal immigrants. And these cops, I don't know if you've seen this,
but they I mean they were hiton. I mean they were just
getting attacked, getting attacked by peoplecame into the country illegally. I was
watching this one woman swing herbiton likelike it was like it was choreography.

But that's no. And you wonder, you want to know why we've got
such a problem with recruitment. Youwant to know why we got such a
problem with recruitment. When a concernedpolice the sanctuary city of New York City,
I was reading another story more hospitalsunder crunch and other sanctuary cities,
maybe a whole bunch of headlines hereabout this. This is happening in cities

all across the United States. Nowthese cities get a taste of what Texas
has had to deal with this entiretime. Now they get a little bit
of a taste of it, andthey've been diverting, been diverting the funds,
their resources. They say that,well they have to, because you
know, they're just besieged. Buty'all didn't care. Y'all didn't send any

resources to Texas border towns. Nobodydid that one of the hospitals or one
of the headlines, I have concernswith rural hospitals, concerns rural hospitals.
They said, all these hospitals servingpeople at risk of closing. Texas,
Kansas, Oklahoma. They're at therisk of losing these hospitals. Interestingly enough,
some of these hospitals are in areaswhere you've seen an influx and illegal

immigration. Other hospitals told you lastweek about Colorado, about Denver's hospitals that
are that are now in the redbecause of the influx of illegal immigrants coming
in. This This is you knowwhat I'm talking about. The there's a
limited resources resources. I mean,stuff costs. You can't expect doctors to
work for free. I'll never forgetone of the smartest arguments against illegal immigration.

It was in a weird spot.I was it was on vacation,
because I like to OFFICI on vacation. We were out, had a boat.
We were out somewhere in the Caribbean, and I was we were Turks
and Caicos. Before they all shutdown, though, because the vaccine and
the pandemic was out in the boat. And I think that there is this,
definitely amongst the left, there is, but I think that there is

this prevailing viewpoint that, oh,Democrats have worked for a really long time
to make different identity factors things thatpeople cannot control, to patent those like,
if you're black, then you haveto support Democrats. If you're Hispanic,
you have to support Democrats. Ifyou're a woman you have to support
Democrats. If you're gay to supportDemocrats, et cetera, et cetera.
And then when when those things areincongruent, when those two variables are incongruent

with one another, it's you know, it can be very very shocking for
for some people on the on theleft. And I forget, we were
out on a boat and uh uhwe were talking with the you know,
just the casual captain of this boat, right, and we'd been not fishing
and all this stuff. And thiswas I guess the day after when I
was on the beach just chilling,you know, having some rum punch,

and I saw this boat on thehorizon kind of going back and forth,
and all of these dudes with likefull actual auto stepped out, all kitted
out and swat gear and they startright gear and they stepped out and they
waited for this boat. And Iasked one of the guys who was armed.
I said, you know, becauseI think some of the other people
on the beach were freaking out.And I asked him, I said,

I'm not nervous that you have this. I actually feel a lot better.
I'm gonna have another rum punch.But I said, I'm just curious as
to what y'all are out here for, because we've come here, you know,
many years, and you know,we we've gotten to know the area
very well. And I've never seenthis before. And he said, well,
he said, that boat out there, you see it and I said
yeah. And he goes, that'sa boat full of people who are trying
to come onto the island illegally fromHaiti. And he said there's about forty

or fifty people on that boat.And I go wow, And it was
shocking because it was a rather smallboat. And he said, yeah,
we can't have that happen. Andthen as the boat got closer, they
went and they detained every single oneof them. Well, apparently it was
the talk of the island for thewhole week. Oh my gosh, so
talk of the island. So we'reon this fishing boat and we're talking to
this the casual captain, because he'svery chill. We're talking to this guy

and he said, did you hearabout the boat? I go, the
boat from Haiti that was coming hereyesterday, and he goes yeah, And
I said, I saw that,and I go, we got some of
those that come across the rio everyday. And he goes, oh,
I wouldn't stand for that. Hegoes, are you in Texas, Arizona?
And I go, We're in Texasand he goes, I wouldn't stand
for that. And the other guywas helping him with the stuff on the
boat. He's like, yeah,we would, none of us would stand

for that. And I go,well, tell me why you're so you
feel so completely unashamed to say that, And so many Americans are terrified to
say that in the United States.And they said, we got to look
at your resources. And he gaveme the facts that he could rattle off
the top of his head, andhe said, you know, the population
of our island as of last monthwas I can't remember what he said XYZ

and he goes, and that's thethat's the population people who live here year
round, day after day. Andhe said, you know, you,
you got to be very careful withthe number of people that come here.
We have only so many resources,we have only so much medicine, We
have only so many fish right herein the areas where we're able to fish
out of. And he says,there's and he went on this laundry list,

and he said, you destabilize that. He goes, You don't just
destabilize the ecosystem, he goes,you destabilize our resource system. And it
was just a great and I lookedat him and said, my gosh,
I just want to put you onTV so bad, Mike, because you
just explained in the smartest, easiestway that I think even the most remedial
progressive would understand. You just explainwhy a nation has the right to be
able to determine who comes and whodoesn't and when and where they enter.

And they said, we never Theyboth agreed they both could not understand why
people in America were so terrified toassert sovereign rights. And they said,
you guys are doing this to yourselves. And they had no qualms about saying

was out there saying that you can'tcall them thugs because that's racist to call
them thugs. He said that wasa he was going after the governor,
Mike Parsons of Missouri. He wasgoing after the governor saying that it was

always so good to have you.And my first question right off the
bat when I heard the figure forthis, which I'm going to ask you
how we got to that number.But we're normally with me pretending to be
a lawyer, You an actual lawyer. When you have damages like this,
you usually the damages go to someonewho has been who's lost out financially,

(01:29:44):
someone who was defrauded or affected,et cetera. But that doesn't seem to
be there's no fraud here, Sowho gets how does this end up?
Who who is the victim and whogets the money? Danny, you don't
need a JD for this. Youneed LSD. The only way I could
actually figure out where they came upwith this number. So you're quite right.

(01:30:05):
They don't have a victim. Theydo have lots of evidence that he
inflated his assets. It's it's veryinteresting because you know, we have nine
million people in New York and Idon't know how many you know, big
stakes businesses and you know, bigwigs in the financial world. I'm sure

(01:30:26):
none of them ever inflate their assetlike Trump is the first one who ever
did that and invented this practice.Now, no one ever done it in
the history of business or anything.It's only Trump. Goodness. Yeah,
it's just you know, it's it'sunbelievable. But what O'Leary said is exactly
right. And I say this,Look, I grew up in the Bronx,
I worked in the city. Ilove the city. Talking down New

(01:30:49):
York City is like the last thingon the world that I'd want to do.
I stay at the city now becauseit's hossible to people who believe what
I believe. And if I hada business, there's no way on earth
I would set up a business.And as he said, it's not to
do with Trump, it's that ifthey do this to him, they can

do it to anyone. And Trumpmay be the like personal embodiment of everything
that progressives hate, but he's notthe only thing they hate. And they
hate a lot of things about business. They hate a lot of causes.
And if they would do this toTrump, there's no reason to think they
wouldn't do it to say, youknow, a firearms manufacturer, or the

fossil fuel industry, or any otherthing that they just, you know,
whatever the trendy piety of the lefthappens to be that week, you got
a target on your back. Sothis is really bad for New York.
But at the same time, youknow, every time I go on a
rant about this, I have tohold myself up because unlike the federal system,

(01:31:57):
where the president appoints the prosecut us, in the state system, everybody's
elected the prosecutors are elected, eventhe judges are elected. This judge is
an elected progressive Democratic judge who rununopposed on a slate. So people are
getting what they want in New York. This is what they voted for,

(01:32:19):
and you know it's going to buythem, but they chose it. And
this is just one of a numberof cases that Trump is embroiled in.
And of course this is this ManhattanSupreme Court justice inger on this, this
judge, and with this, Imean, I think with the interest in
that it pushes it up above thethree hundred and fifty oh one hundred million
in interest, so four hundred andfifty five million. And the argument that

(01:32:42):
you know, any bank or anybodyelse was defrauded, I just banks aren't
usually silent about that stuff. Butnope, they never, nobody ever made
a complaint about this at all,which really seems to kind of undermine his
ruling here. Yeah, that's right. So they have this monstrous law in
New York called Section sixty five twelveof the Business Law, and what it's

(01:33:02):
really intended for is consumer protection.So it's a method so that if you
have a business that's engaged in persistentfraud against consumers under circumstances where you know,
every consumer is paying a few bucks, but nobody has a real interest

(01:33:24):
in, you know, taking onthe burden financially obsuing to recover. You
have this thing where the Attorney General'soffice can can jump in in that situation.
What they've done is they've taken thisthing that applies to consumer protection and
they've applied it to a situation whereeverybody involved in these transactions was a sophisticated

(01:33:45):
financial player who was doing his owndue diligence. And anybody who thinks,
like, you know, do youreally think like JP Morgan Chase or Deutsche
Bank took Donald Trump's word for itthat you know, this is what my
asset's worth. These guys that arein the business of appraising risk and that's
what they do before. They don'twant to get you know, they don't

(01:34:09):
want to get stuck on a loanagain. Some of these loans are I
saw in Florbes today. I thinkTrump has like a four hundred and twenty
five million dollar loan payment that's duethis year in connection with Trump Tower.
I mean, we're not talking aboutlike everyday transactions. And the thought that
these people would either lend Trump thatkind of money or cover his insurance risk

(01:34:34):
without doing their own investigation of whetherthey wanted to buy onto that risk or
not. Is not That's it iscrazy. Talking with our good friend Andrew
McCarthy. Is it the way thatI understand it? For Trump to appeal
the verdict in this, does hehave to put up the entire financial penalty

(01:34:55):
here before he can go further plusinterest? Yeah, the whole four hundred
and fifty five million, half abillion. Yeah. And here's here's where
this gets really dicey for him,you know, because we're not talking just
about this monstrous verdict that he justdot. But you know, on January
twenty sixth, the federal jury camein and the second Egene Carol case with

(01:35:19):
that eighty three point three million,And that's on top of six million from
last year. So if you accumulatethat, just take the interest at it's
almost half a billion, even withoutinterest. And in these jurisdictions, whether
it's federal court in New York orNew York State Court, you have thirty
days to appeal. Unlike criminal cases, civil cases you actually have to put

(01:35:46):
up the money to appeal because thecourt needs to be satisfied that you're not
appealing for purposes of delay and thatyou will pay what you owe if you
lose. So's he's put up themoney. Now, he doesn't have to
be liquid, he doesn't have toput up you know, a cash amount,
but he's if he's going to getbonds, he's got any bondsman is

(01:36:11):
going to require him to secure thebond with an equal or greater amount of
property that he can execute on ifTrump were to not pay the bond.
I mean, that's the way thisworks, right, So he's either going
to have to put up the fullamount in order to appeal in cash,
or he's got to put enough upenough that he can get a bond secured

(01:36:33):
by his other property, which isheavily leveraged. And he's got to do
it within thirty days because if youwave your right to appeal, if your
thirty days come and go and youdon't appeal, then the judgment is final
and the PLANEFF can start executing onyour property, meaning you know, go
to court and try to seize partsof your property if you don't pay the

(01:36:56):
judgment. So we haven't even gotinto the criminal cases yet. And he's
in Really, he's got he's gothe's got to manage half a billion dollars
in judgments that he wants to appeal, but he's going to have to tie
up funds to appeal with. He'sgot these criminal cases coming. He's you
know, he's he's rounding up legalfees, which a lot is being paid

(01:37:21):
by campaign contributions. But there's alot of people who want to challenge that
practice because these are private lawsuits,they're not really campaign matters. We haven't
even gotten to a criminal trial yet, which is supposed to happen next month.
And he's in a real crunch becauseit's not like his you know,
his business debts that are existing haven'tgone away. He's got to pay those

(01:37:44):
two. This is one of themost insane things I've ever heard, the
way this process works with us.We're talking with our friend, former chief
assistant US attorney, best selling authorAndy McCarthy. Because essentially, you you
have to help the court bankrupt yourselfand destroy yourself before you can actually further
seek satisfaction and appeal. And Iknow that some people are asking whether or

(01:38:08):
not the Supreme Court can weigh inagain my limited understanding, I doesn't he
have to appeal before they can evendo that too? Doesn't that have to
get kicked out to a federal court. Yeah, that would even have to
happen if this was federal Like Ordinarily, even if you were allowed to appeal
something from a tred like this immunitylitigation that we just saw in the federal

(01:38:30):
court, you have to go tothe Court of Appeals first before you can
go to the Supreme Court. Rightin a state case, it's even worse
than that for the litigant because youhave to run the full gamut of the
state system before you can raise anyfederal appeal. So he's got to go
to the Appellate Division in New Yorkand if he gets any satisfaction or if

(01:38:53):
he loses there, it probably won'tbe a clean result one way or the
other. Then it goes to theCourt of Appeals in New York. We
have the idiotic nomenclature of the trialcourt in New York is bull the Supreme
Court and the highest court in thestate is Goaled, the Court of Appeals.
You know, you want to knowwhy everything screwed up. It screwed

(01:39:13):
up even in nomenclature it's screwed upfrom the beginning. But he would have
to run that whole thing before hecould appeal to the Supreme Court. And
you know a lot of people say, maybe the Eighth Amendment applies here.
You know, maybe this it's notthat he didn't do anything wrong, but
the punishment is so out of whackwith what the wrong was that maybe there's

(01:39:34):
a federal constitutional plane. And maybethere is, but he's going to have
to convince a state court of itbefore he ever gets to the Supreme Court.
Last question for you, our goodfriend Anie McCarthy on the phone with
us best selling author, and yousee him on Fox, read his stuff
on an row, read his stuffeverywhere. It really does, regardless of
what one thinks of Trump, orregardless even of where someone falls on the

(01:39:57):
merits or maybe even lack their insome of these cases, this does seem
and this is me, this islike a downplaying way of saying it,
very punitively prohibitive on per like thisis there there out to ruin him.
They're out to bankrupt him and makehim make it to where he can't defend
himself. I mean, I knowyou and I talked about you know,
the mar Lago case and some ofthe documents there, and I think we

(01:40:19):
were in agreement on, you know, some of the legal questions there.
But this is just crazy. Thisis just punitive for the sake of being
so yeah, and what I findreally disturbing about it most of all,
especially because I come from the legalculture in New York such as it was
at the turn of the century.I'm not saying which century, but it

(01:40:44):
would have been. It would havebeen disqualifying for a prosecutor to try to
seek office as Letitia James did,as ag as Alvin Bragg did. It's
Manhattan DA to say, if youelect me, I'll use the power of
my office against you know, Xperson, which is a very Soviet sort
of thing to do. And Ithink twenty years ago someone who tried to

do that would not have any chanceof winning office. But now the culture
has changed. Progressives are all infavor of using process in a punitive way
against the people that they dislike.And when Chiss James ran on that platform,
she won in a landslot. Sothis is a cultural thing in New

(01:41:28):
York, It's not just a legalsystem. That's a really great point.
I mean, and Ultimately, itmeans I don't see what pathway to relief
he has. I really don't,you know, Look, I don't know.
You know, he did get crediblyaccused of inflating his assets. And
the reason I point that out iswe don't really know how rich he is.
You know, Forbes said he wasworth about two point six billion I

(01:41:53):
think in the most recent appraisal,like six months ago. So maybe he's
flowed to fund all this, butthis is a monumental challenge. And again
we haven't even gotten to the criminaltrials yet. And in the criminal trials,
he's got to be in court everysingle day of these trials. Golly,
