He's like, well, they're notlike totally furries. He didn't say it
just like that. But he saysthat the way that he puts it,
the group of students being targeted,because it sounds like the students that are
being bitten and scratched and all thatare being targeted. He says that they
said they come to school wearing headbands, sometimes they may have ears on them.

He does, and he's like,I just don't know if they actually
think they're furries. He doesn't thinkthat, you know, they think they're
furries, et cetera. And thatreally does not at all sound like what
the kids are saying. And consideringthe history that a lot of these school

parents of the kids who walked outfor misinterpreting the school's response saying that we

social media instead of discussing the issuewith the school district. It sounds like
they were trying to discuss the issuewith the school district and the school district

was speaking to folks about what isit. He goes, Scranton values are

voters have been shifting. Pennsylvanias aregrowing Hispanic population, particularly in the smaller
cities, and even though typically inthe past Hispanics have voted predominantly Democrat.

That's changed in the past several elections, and it's not a sure demo for
Democrats anymore. Democrats haven't been makinga lot of overtures towards that demographic other
than trying to call them Latin Xor Latin no joke. And so Pennsylvania
is changing. Trump won Pennsylvania becauseof new Republicans. And that's important to

remember because that can be that canbe he shifting sands type of uh win.
I mean, remember, elections aredetermined in the margins. You have
your bases that are going to votefor how they vote, but elections are
determined in the margins. And wherewho's in the margins. You got independence,
you got you know, all ofthat moderates, and so they've Pennsylvania

has been shifting quite a bit.Uh he. Let's see Trump won,
I mean barely won Pennsylvania in twentysixteen. He barely won Pennsylvania. He
took it by not even three quarterof the of a of a percentage point.

It was so close point, itwas so close. And then four
years later Biden beat him only bybarely over one percent, barely over one
percent, barely and so the I'mlooking at a couple of here, and

I sent some out to you ifyou get the radio prep let me pull
this up the November because he's losingPennsylvania Politics of Steel center stage in Pennsylvania.
There's there. There have been acouple of ratings changes in some of
these other Senate seats Senate races,and I think that you can use that
as a good indication of maybe perhapsup ticket as well. But in looking

at some of the averages RCP is, it depends on what polls they take
in their averages. Some of thepolling some of the averages that RCP has,
and I think RCP is a greatresource, But some of the polls
that they factor into their into theiraverages I think are not not every poll's
legitimate. Some of them are pushpolls. Some of them are literally nothing

more than firms that are working onbehalf of Democrat or Republican campaigns just to
get something out there that they canpoint to and say, oh, here's
a concrete number and then run withthat as a narrative. So you got
to kind of keep that in mind. Now, that's not every uh,
I don't think that that's every average, And I was looking at some of
the polling for the Pennsylvania one,so this is last night. I looked
at they had six polls that theyaveraged, and I think with the exception

of one, well maybe two,but definitely one, they're pretty even balanced.
They're not really it's not really Republicanor Democrat oversampled. And I think
it's probably one of the more cleareraverages of some of these states that are
going to be really close coming intotwenty twenty four. And so the average
has Biden ahead point one percent.That's how close it is. That is

how close. It is, veryvery close, very close. And the
uptick for Biden. It was weirdbecause Biden and Trump they both kind of
dipped in the polling a little bitin the beginning of March, and then
Biden it was Biden started on Marchfourteenth, he came back up. Now

they're they're kind of on the lowagain. It all goes with the economy,
it all goes with I think that'swhy he and announce this tariffs on
China, all this stuff to tryto try to that's all part of his
three day swing through Pennsylvania, announcingthat going through talking electioneering. I think
he's got some events that he's havingin Pennsylvania because they're worried about that state.

They are worried about it. Nowhere's the other problem that I am
very worried about. These polls arenot going to matter if there is no
ground game. And I have beenwarning you about this for how many months?
How many months have I been talkingabout Trump's boots on the ground in
these states? He doesn't. Trumpdoesn't have a lot of field offices.
This is a huge problem. Ihave been talking about this four months now.

minute, this is kind of bad. Newsweek finally noted this the battleground state
campaigning. Trump is so wofully behindJoe Biden. It's sad. I don't

four field offices in Wisconsin alone,forty four. They have fourteen field offices
in Pennsylvania the campaign. The Bidencampaign has thirty field offices in Michigan.

he's doing well and he was veryhappy that I was coming on to your

show. And he told me tosay hello you and to your husband,
and he was in really good spirits. He knew, we knew that this
was very likely to happen. Imean, it's a New York court,
New York judge and New York prosecutors, and so we're prepared for this and

(01:29:47):
this is going to be a longbattle. And I can talk more about
course, and for those Dexter hegoes by carbon Mike on social media and
he's just and I say it.I had mentioned this to Jeff Charles,
and I think I even told thisto Dax as a joke. I'm like,
he's not as a pejorative. He'sa nerd. I mean he's like
an engineering nerd. I mean heloves he's one of those guys who loves

(01:30:10):
to know and understand how things work. And he's done this built firearms for
his own personal hobbyist use, whichis a completely legal activity has been since
the beginning of this republic's founding.I mean it's still you know, part
of our federal statute that it's youdon't unless you're selling it. You don't

(01:30:32):
have to get a license, youdon't have to serialize it. There was
no evidence of his intent to distribute, intent to sell, nothing. He
just liked to build it and understandhow it worked. And the State of
New York rated his home NYPD andATF raided his home, knocked down his
door. They took him to jailonce. Now he's been convicted just the
other day. How many there wasa multiple felony charges with firearms possession and

(01:30:57):
building all the How many charges werethere. So the indictment initially was thirty
seven separate charges. They reduced it. They reduced it to fifteen for the
final vote, and he was foundguilty of those in court and came.
Really is no surprise. We werejust wondering how long they would be out

(01:31:18):
and unfortunately they were only out afew hours. So, you know,
we knew it, and we knewhe was going to go in and so
we had prepared for that. Hewas prepared for that. You know,
the judge you know, tied myhands, tied his hands repeatedly. You
know, she was the toughest prosecutorin the room. So you weren't allowed

(01:31:40):
to mention the Second Amen with it, as I understand it, you couldn't
even bring up any kind of SecondAmendment rights and not cite anything on that
precedent. Nothing. She would sayrepeatedly, both in front of the jury
and outside the President's jury when wehad legal arguments that the Second Amendment has
no place here in this courtroom.And those were her words. You know,

(01:32:02):
it's kind of like extending because youknow what, the New York is
bound by the Second Amendment. Sowhat you were saying earlier is that under
New York law, the current statutesand the way it is, Dexter did
violate New York law. And hewas aware of that. He didn't deny
anything. And basically the prosecutor whatDexter took the stand and look, the

(01:32:27):
only hope we had at this levelwas a potential jury nullification. That was
the So that concept is that thejury understands the law, but they choose
not to convict. That was theonly hope we had. Because Dexter is
admitting to possessing and making these firearmsin his home. So under New York

(01:32:48):
law, you're not allowed to do, which is new law. Is well,
we're talking for those who are justjoining. We're talking to Dexter Taylor's
attorney, Venue Marghesese, who's therein New York. Just actually visited him,
he said in Rikers earlier. Thenew because a lot of these laws
are new, and this is whatnot being a lawyer, that is why
I have you on. Because NewYork believes that you know, an unmilled

(01:33:11):
block of aluminum, you know,you can just go ahead and count that
as a gun. They count partsthat are perfectly legal to purchase as firearms
by themselves, and this is somethingthe ATF has been trying to do as
an inrun around Congress. But frommy understanding, when I read this case
and when I was looking at thecharges and the arguments that the that the
state was making, he's been doinga perfectly legal activity. New York decides
to arbitrarily, without any evidence atall whatsoever in terms of this being a

(01:33:35):
crime driver, decides to change thelaw. Of course, there's a lot
of litigation about that, which isa whole other issue. But it's in
conflict with what federal law is.But then it seems like they're going after
him ex post facto to try tomake him a felon when he's a perfectly
innocent guy who's been involved in aperfectly innocent hobby. So these gun laws

(01:33:57):
actually have been around for for yearsand years. These prohibitions on unlicensed firearms,
there are additional to state regulations.There were city code violations, so
New York City, so for example, having a pistol as long as you
had a license for it. BasicallyNew York and New York City, it's

(01:34:20):
still very difficult. What happened tochange was that they had to change their
licensing regime two years ago because ofBruin. But what they came up with
is really vague and basically the samething they've created this Before they had to
show to get a firearm in NewYork State, you had to show a

(01:34:42):
compelling reason to have one. Nowthey've changed it to this amorphous completely constitutionally
the concept of good moral character.We had the guy on who was the
custodium of records was a police officerfrom the New York City Licensing Bureau and
basically e basically said, it's justarbitrary, you know, because I asked

(01:35:03):
him to find good moral character heput in. He basically said, well,
it's you know, somebody has nocriminal record. Yeah, but that's
in the initial application, right,So if a guy has a criminal record,
he's not getting it in New Yorkin New York City. And then
he was like, well, nomental health okay, but that's in the
that's his separate part. So what'sgood moral character? Couldn't answered. He

(01:35:25):
couldn't tell me how many people hadapplied for licenses and gotten accepted and been
rejected, and he basically admitted thatsometimes he just rejects people. And so
it was a funny. It's funny, but sad. Yeah, realization of
what you're dealing with in New YorkCity on top of what you have to

(01:35:45):
deal with in New York State.It's a this this sounds like such an
absolute mess to try to unravel.We're talking with vinew of var Geese,
who is Dexter Taylor's attorney, andyou brought up the licensing as well.
And from what I read, thiswas something that was brought up obviously in
the arguments in court because New Yorkyou know, the city says, well,
you have to have a license,but they're not actually in the habit
of giving them out. And fromwhat I understand, there are a lot

(01:36:08):
of as you were just talking about, a lot of rejections, a lot
of refusals on this. So theysort of it. I mean, it
sounds like to me that they tryto set you up. Yeah, so
what New York State judges when Bruincame out New York you know, you
know, certain lost It's oh yeah, mine, let's just say, let's

(01:36:28):
say it that way. I'm notshort show, so certain things I can't
say for it, I'll lead itto what I'm able to say online.
So it's certainly lost its tech.And so what they did, I mean,
there was the rhetoric from from GovernorHockel and Mayor Adams. I mean,
it was just obnoxious. They basicallysaid, it's just so wrong and

(01:36:51):
it's create anarchy. And so whatwhat they did was come up with this
new criteria called good moral character,which is complete choke. But put that
aside for a second. What wediscovered, well, let me take a
step back. Judges in reaction,so they get a playbook, right,
So judges across the state are givena playbook on how to reject Second Amendment

(01:37:15):
challenges. So they followed this playbookand what they did was in every single
criminal defendant that alleged a bruined violation, they said he had no standing,
meaning he didn't have a right tochallenge the law because he never applied for
a license. So to get aroundthat, what we did is we subpoenaed.

(01:37:36):
Well, basically, we got afoil request on the New York government,
on the New York City Police Department. It took like eight or nine
months to get these records, andit showed that in the two years that
they were investigating Dexter, he hadonly they only gave nineteen percent gave a
nineteen percent of applications were accepted intwo thousand twenty one and only four percent

(01:38:01):
in twenty twenty two. Posts brewit. So we don't have the numbers
for twenty three and twenty four becauseyou have to you have to. They're
not readily available. According to youhave to have a license to even present
a defense on what you're getting licensed. Well, you have to have applied
for a lighte. Okay, that'sthe craziest thing. I have ever heard

(01:38:26):
for this. I mean, that'sthat's kind of well, you know,
we're not going to take you seriouslybecause you never applied for the license that
I mean, that's just wild tome. That the fact that you couldn't
even say two way, that's it'sI mean, if you there's the whole
discussion to be had on if it'seven a rite. At that point we're
talking to Veneuvar Geese, who isrepresenting Dexter Tailor in this case that we've
been talking about. This is well, obviously you're going to appeal this.

(01:38:49):
Yes, absolutely absolutely, so wehave to the next phase is sentencing.
He's going to get sentenced in lessthan four weeks. If you give me
a second. My son's little tooloud back there anyway, we can't hear
him. He's fine, he's fine, don't worry. He didn't come in
like that. One like that.One guy who's two babies came in the
room. You're good. So athome, I doubly not home usually in

(01:39:15):
my office. You are totally fine. So you have to get so you
got the appeal forthcoming for what yousaid, less than four weeks he's going
to be sentenced, which is crazy, and he's looking at eighteen years.
Yes, yes, he's gonna andthis judge is going to give him,
maybe not that total amount, butshe's going to send a message because basically
the argument is that that Dexter thinkshe was above the law, the law

(01:39:38):
of the Supreme law of New YorkState. And so in the trial,
look, it came out and atdifferent points the prosecutor, you know,
asked him why he didn't have alicense, and he said he had one.
You know, it was license givento him the day he was born.
It was his natural right, andso we we were ready for that.

(01:39:59):
Unfortunately, with the New York jurydidn't really care. And it's unfortunately
the people that expressed any sort ofaffinity to firearms, you know, they
were struck and so you know,and there were a couple of people who
said that they didn't think any whathe did was wrong. They were struck.

(01:40:19):
So we were pretty much everyone elsehad even those who said they didn't
even feel strongly about them. Therewere only a few of those. Most
people had strong views. It's sortof like the Trump trial. It actually
took us longer to get five jurorsin our case than it did in Trump's

(01:40:40):
case, because I was able tothen question and then show that they weren't
ever going to give Dexter a shot. But still with what we were left
with was unfortunately slim picking. Thisis just one of the crazy this case.
This has to be so frustrating toyou, and I know that this
is a long fight ahead. We'retalking with the new Varghese who's representing Dexter
Taylor. I are other gun rightsgroups are they offering to help because this

(01:41:05):
is a huge This could be alandmark case because you're you're looking at some
of the conflict between what New YorkCity and New York State want and what
the federal government says is allowable.I mean, there is conflict there.
So I can imagine that there wouldbe an interest for gun rights groups to
get involved in this because of theprecedent, the potential precedent that this could

(01:41:25):
set. So the the there's onegroup that's been that has shown their support
express and said that's the National Associationof Gun Rights from saying the correct it
but you know, we've we've reachedout to different people, but you know,
the NRA has been silent. Noresponse from no response but we have

(01:41:47):
right, so we we have theNational Association of Gun Rights. Chris Koffer
has been supportive. We were onhis podcast at one point. So this
word has to get out. Imean, what makes this case you need?
Why? I believe certain Let melet me just say, he has

(01:42:08):
to go through state court process.So unfortunately, he's going to be sitting
in jail probably you know, atleast two years before we can get to
federal court. So at least maybelonger with delays and things along those lines
in court congestion. Yeah, noodcan't budut. No, they're not going

(01:42:29):
to give him bail. Judge,no judge in New York State is they
just let a woman go for smotheringher baby with her couch cushions because she
was high on meth and she getsto walk. But Dexter Taylor's got to
stay in prison. Yeah they Idon't see a single appellate judge granting him
bail. But I want to haveyou back because we're getting ready to go
into a break. I want tohave you back for revenue. But really

(01:42:50):
quickly, what does Dexter need rightnow? What do you need for this
case? He needs support? Imean the the process is long, it's
lengthy, it's expensive. So youknow, if people just just word talking
about Dexter, you know, youknow, and and and support for the

(01:43:12):
financial support Gibson go I had.I also had people ask me can they
send him money in prison? Yeah? I mean they can look him up
on the New York City Department Correctionswebsite. I had a lot of much
more important Okay, yeah, theGibson goes much more important to send him.
His family can take care of hiscommissary and his toilet tries and things
like that. Okay, he won'tbe a large amount of money, but

(01:43:34):
really the legal, the legal incrediblyimportant because this is going to be costly
venue. I would definitely love tohave you back. Uh just we're so
grateful that you're taking on this caseand you're leading this fight because this is
going to affect everyone. And gunsare just a variable. This is a
legal formula that could be app appliedto a number of different rights. Uh
So we're we're very grateful for youfor for taking part in taking this case
