Jake Tapper, who moderated last Thursday's Presidential debate for CNN, calls out Sen. Chris Coons (D-DE) - one of Joe Biden's closest advisers and friends in Congress - for trying to chalk up the President's poor debate performance as 'one bad night.'

Other Dems seem to be circling like vultures, rather than circling the wagons. What will be the final straw that forces Biden out of the 2024 race?

This is Dan capless and welcome totoday's online podcast edition of The Dan Caplis
Show. Please be sure to giveus a five star rating if you'd be
so kind, and to subscribe, download, and listen to the show every
single day on your favorite podcast platform. Think about what we've confirmed today.
We've confirmed the capitalist theory that HunterBiden owns Joe Biden. Joe Biden will

(00:22):
do whatever Hunter Biden tells him todo because Hunter Biden has the evidence.
Hunter Biden can put Joe Biden injail or at the very least, get
Joe Biden convicted of felonies, atthe very least destroyed Joe Biden's legacy because
Hunter Biden was Joe Biden's bag man. So that's the moment we're living in

(00:42):
right now. I've been saying itfor a long time on this show.
Today it was essentially confirmed by anNBC News report. Cut double zero,
please, Ryan, breaking news. We're now learning that Hunter Biden is attending
some the President's meetings at the WhiteHouse, staying close to his father post

(01:03):
debate, and vaci's Monica Elba isreporting from Washington, DC. What more
can you tell us, Monica,Well, these are new details coming into
our team. Chris, along withmy colleagues Kristen Welker, Mike Emily,
and Sarah Fitzpatrick, we have learnedfrom sources familiar with the situation at the
White House that Hunter Biden has beenby his father's side ever since they were

(01:26):
at Camp David this weekend of thefamily where they had some discussions about the
president's potential path forward here and hisre election campaign, and that since he
returned from Camp David last evening withhis father, we understand that Hunter Biden
has even joined some meetings and conversationsthat have taken place between the President and

(01:48):
some of his most senior advisors andsenior staff. And while we should note
that it's not unusual for Hunter Bidento be at the White House, to
be in the residence, to beattending certain White House events which we have
certainly seen time and time again overthe last three and a half years,
where we have seen photos of him, and where he has appeared in public,
it is unusual, according to thepeople we spoke with, for him

(02:13):
to be participating at this level andto have the sort of regularity of some
of these contacts and conversations with seniorstaff. We understand again since returning yesterday
from Camp David, where they weremore huddled as a family, to now
as the President has resumed some ofhis more traditional meetings at the White House

(02:34):
with those key advisors. It's unusualbecause he's said, of course, it's
unusual. He's a guilty, convictedfelon crack addicts as well as a sex
addict. He would have nothing toadd on a policy level in any meetings.
That's why it's unusual. The onlyreason, and if you see a
flow in this logic, you knowwhere to find me is Prime would say
eight five five four zero five eighttwo five five text d an five seven,

(02:59):
seven through nine. The only reasonHunter Biden is in those meetings is
because he's the decider. He's decidingwhether Joe Biden steps aside is nominee,
whether Joe Biden steps aside as president. He's making those decisions based on what's
best for Hunter, what gives Hunterthe best chance of staying out of jail.

(03:20):
And Dan, I have a tweetto add to this, also from
NBC and a very reliable reporter forthem, a Kendalanian. He sends this
out on ac slash Twitter quote HunterBiden has joined meetings with President Biden and
his top aides this week at theWhite House. Four people familiar with the
matter tell my colleagues who are toldThe reaction from some senior White House staff
has been quote, what the hellis happening? Unquiet? I thought there'd

(03:46):
be a different word at the endof that. But yes, and that's
how it's leaked to NBC. Right, But again, can somebody please you
use your imagination be as wild asyou possibly can be. What other reason
would there be for Hunt to bein these high level White House meetings other
than Hunter making the decision on whetherBiden stays or goes, whether Biden resigns

(04:09):
as president? So what would youdo? And I'd love to hear from
folks on this. You can textDA N five seven seven three nine eight
five five for zero five eight twofive to five. You're Hunter Biden.
You make this decision. You getto make it. You get to make
it based on your best chance tostay out of jail. What do you
do? What do you do Ryanas survival for him at this point right,

(04:30):
like you've been illustrating. Yeah, what what's the path though, is
hunter. Do you say, Okay, Joe, here's what's happening. You're
going to hang in there no matterwhat. Yep, Because the only chance
that I have to stay out ofjail, the only chance both of us
have, is that you somehow winthis election. So you're gonna hang in
there and we're just going to betthe ranch on it, just like we

(04:53):
did in the beginning. Do youdo that or you say, Okay,
Joe, here's what's going to happen. We're going to do a deal with
Kamala. And the deal with Kamalais is going to be that she's going
to protect me. You're going toresign as president. Kamala is going to
have a few months of the presidencyto strengthen her as a candidate in November,
and then that's our best chance tostay out of jail. Is a

(05:14):
Democrat administration run by Kamala Harris who'sgonna protect us. And oh, by
the way, Joe, in themeantime, you know, hours before you
resign, you're going to pardon me? Is that what you do? Can't
trust the latter option. I don'tthink you can't bring variables into this equation.
I think even Hunter Biden is smartenough to realize that. But Dan,
the picture you've painted, while itlooks like a Picasso, is a

(05:35):
masterpiece. And I believe it's true, and I believe I have Hunter Biden
to thank for my Tomahawk Ribby stakeat Shanahan's coming up. Well, it's
the only chance you have, becausethe only way Joe Biden stays as the
nominee is if Hunter Biden decides he'sgoing to stay. Otherwise he gets run
out on a rail. Because HunterBiden is the only person who can trump

(05:58):
the left, because the left rightnow can say, Okay, Joe,
we're going to unleash all of thesetrue stories about your corruption. We're going
to unleash all these true stories aboutyour perversion allegedly, We're going to unleash
all that. But you know what, compared to what Hunter can do to
him, that's child's play. BecauseHunter was the bag man. And Hunter
could walk into a prosecutor's office, state prosecutor, federal prosecutor, and Joe

(06:24):
Biden's done eight five five or zerofive eight two five to five the number.
So which of those scenarios and maybesome other scenario is most likely but
make no mistake about it. Huntergets to decide. Think about the world
we live in right now, I'vebeen saying this for all Think about the
world we live in. Hunter.Biden controls the president of the United States.
What could possibly go wrong? Brianand Arvada. You're on the Dan

(06:46):
Kaplis show. Welcome, Well tobegin with Dan, he can be pardoned
immediately by his father. His fatherprobably has it in his will. Hunters
can be immediately. It won't workin the will. So you're right.
You can't just say die and thenat the reading of the will, Okay,

(07:09):
you get the beach house, Hunter, you get pardoned. You can't
do that, So Joe Biden hasto pardon him while he's alive. That
may happen very soon because Hunter Bidenknows his dad could die any day,
and at that point he's at consequences. What do you mean, you mean
if he's pardoned. If he's pardoned, then it doesn't matter whether his dad

(07:30):
wins or not. He's off thehook, right, No, no,
no, no, no. Youcan only pardon him for certain things,
and you cannot pardon him for statecrimes. Cannot pardon him for state crimes.
So well, I mean, firstof all, look at Donald Trump,

(07:51):
who committed no crimes and has beenconvicted in a politically motivated state court.
But beyond that, if you believe, as I do, that Hunter
Biden and Joe Biden have been engagedin widespread corruption selling access to the White
House with Hunter Biden as the bagman, well there are I think there

(08:11):
are a lot of different places thathappened, and a lot of different offenses
that may involve so well, andthen the other issue you get is is
the scope of the pardon that thescope of the pardon that Biden gives him.
Now, Biden can simply directly pardonhim at this point for you know,
the tax of Asian charge, thegun charges he just went down on.

(08:33):
But could Biden fashion a pardon largeenough to protect him from all of
the federal crimes that Hunter may beguilty of. Maybe, But I don't
think that's a sure thing, youknow, I think it goes a little
bit deeper. I think what wegot here is a free for all.
Okay, we got big farmer runningrampant, I mean give you know,

(08:58):
mutilate and children. Because Joe Biden'sobviously for sale. We know that we
know this guy's been inconfident, weknow this guy running anything. We wouldn't
trust him to watch our kids foran hour for crying out loud, you
know. But let me ask youthis question. War complex has got a
hold of them because more than anyof these Oh, I'm sure it's the

(09:22):
Catholic Church, right, because thisis the only call you've made to us
in months that him out. No, no, I'm not even to miss
in Catholic Church. Oh, okay, okay. I worry more about is
the deep state? Is the deepstate people like Mike Johnson who decided that
the Ukraine funding the Ukraine War wasmore important than we're losing almost one hundred

(09:43):
thousand military aged men due to thisinvasion on the border. But Mike Johnson
decided, Hey, man, well, I don't care about your guys a
sovereignty. Now he's on TV allthe time, running his mouth, running
on due hotel. That's the nexttime we do a Mike Johnson show,
we're gonna call you and make youour special guest. But but nobody cares

(10:05):
about Mike Johnson today. Republicans,we've got a Republicans. Hey, let
me ask you a quick question second, let me ask you a quick question
other than my sery that Hunter Bidenis deciding whether Joe stays or goes.
What reason would there be for HunterBiden to now be at the White House
involved in high level policy meetings? What other reasons? And I gotta go,

(10:28):
I gotta hit this break. Canyou think of one that's part of
the plan, Dan, But yougotta watch, you got you gotta dig
a little bit deeper. How manyother people are depending on this sellout?
We know it's a sellout. Howmany other people is the war complex is
big farm depending? Yes, alot of people are a lot of Republicans
got to hit the break. Thankyou, You're on the Dan Caplas Show

(10:52):
and now back to the Danaplas Showpodcast. So, with all the respect,
it is not it is not honestto say that this is just one
night. There have been moments likethis that people have seen in front of
the cameras and other moments but withoutwhat cameras not there. That's Jake Tapper

(11:18):
to Senator Chris Coons, who liesall the time, and the left not
only doesn't call them out, theycoddle them. But this is this is
one of the most beautiful things we'veever experienced, right, the Left turning
on itself because they've all been lyingto us for a very long time,
and now they've been exposed by Bidenlast Thursday night. It's now they're all

(11:41):
running for cover, all trying toprotect themselves, and it's it's just one
of the coolest things I've ever seen. So if you just joined us,
the capitalist theory was proven today.Remember I've been saying for a long time
that Hunter Biden owns Joe Biden.Joe Biden must do what Hunter tells him
to do, because Unter Biden canput Joe in jail or at least get

(12:01):
him convicted of felonies, because HunterBiden was his bag man. And so
it was confirmed today indirectly, butI think on equivocally by NBC News with
this report, and as you listenedto this, cut double zero, tell
me what other reason other than thecapitalist theory being true would there be for
Hunter Biden now suddenly being in highlevel policy meetings at the White House,

(12:26):
Cut double zero breaking news. We'renow learning that Hunter Biden is attending some
of the President's meetings at the WhiteHouse, staying close to his father post
debate, NBC's Monica Elba is reportingfrom Washington, DC. What more can
you tell us, Monica, Well, these are new details coming into our
team. Chris, along with mycolleagues Christen Welker, Mike Emily, and

(12:48):
Sarah Fitzpatrick, we have learned fromsources familiar with the situation at the White
House that Hunter Biden has been byhis father's side ever since they were at
Camp David this weekend the family wherethey had some discussions about the President's potential
path forward here and his re electioncampaign, and that since he returned from

(13:09):
Camp David last evening with his father, we understand that Hunter Biden has even
joined some meetings and conversations that havetaken place between the President and some of
his most senior advisors and senior staff. And while we should note that it's
not unusual for Hunter Biden to beat the White House, to be in
the residence, to be attending certainWhite House events which we have certainly seen

(13:33):
time and time again over the lastthree and a half years, where we
have seen photos of him and wherehe has appeared in public, it is
unusual, according to the people wespoke with, for him to be participating
at this level and to have thesort of regularity of some of these contacts
and conversations we senior staff. Weunderstand again since returning yesterday from Camp David,

(13:56):
where they were more huddled as afamily, now as the President has
resumed some of his more traditional meetingsat the White House with those key advisors.
Yeah, of course it's unusual. There's no legitimate reason for him to
be there. So the only reasonfor him to be there is because I'm
right, he's making the decision whetherBiden stays or goes, his nominee stays

(14:20):
or goes as president, based uponwhat's best for Hunter, what's most likely
to keep Hunter out of jail.So what do you think that decision is
if you were in hunter shoes? And Ryan, I want to correct something
I think I said earlier. HunterBiden was a crack addict. I don't
know if that's true or not.I do know he was a coke addict,
right, I can't remember all ofthose No, you're right on both.

(14:41):
There is video evidence on the laptopwhich was real, that showed crack
cocaine being measured out on a scale. So that was gray, And so
what do you do. If you'reHunter Biden right now, I'd love to
hear from you in this What doyou direct Joe Biden to do? Do
you direct him to just hang inthere to the end. It's the only
chance we have to protect ourselves frombeing criminally prosecuted and potentially jailed. So

(15:05):
you've got to hang in there,Joe. You've got to see this thing
through and we'll take our chances.Or are you telling him, no,
Joe, you need to We'll cuta deal with Kamala. You need to
go as the nominee. It needsto be Kamala. Are you telling him
you need to resign as president sothat Kamala has time in the office to
strengthen her as a candidate. Whatare you telling Biden he must do?

(15:28):
Because clearly at this point Hunter iscalling the shots. Let me get to
a text here, which is oneof several along these same lines. Dan,
can Joe Biden Hunter pardon Hunter beforehe's been convicted in the tax evasion
case? How do you pardon someonewhen you don't know what the charges or
conviction is? You are pardoning?Yes, my belief is and I don't

(15:50):
think there's any doubt about this somebodycorrect me if I'm wrong. That absolutely
the president can pardon a person forall crimes committed, all federal crimes committed
at least all federal crimes committed ina certain category. I don't think it
requires at all waiting until after aconviction. Now you can't commute a sentence,
obviously, until after somebody's been convicted, but a flat out pardon,

(16:12):
no, I think that can bedone before somebody's even prosecuted. And if
anybody out there believes I'm wrong, please let us know. Eight fib five
for zero five A two five fivethe number text d an five seven seven
three nine. So love to hearfrom you on that, boy, Ryan.

(16:33):
There are so many different ways thiscan go, right because Hunter is
Hunter is Hunter. But I haveto believe. I have to believe that
at this point Hunter is going tomake sure that pardons in hand. One
thing I don't know is if JoeBiden was to say, sign a written
order of pardon for Hunter Biden tonight, but not release it, just sit

(16:59):
on it, you know, Butit would have to be released before his
death because he loses presidential powers youknow, at the time that he dies.
So do they execute one now tobe pulled out if if Joe Biden
begins to fail. And I don'twish him anything ill on his health whatsoever,
but obviously he could just keel over. So yeah, that's that's another

(17:22):
interesting scenario because you got to believethat that hunter is making sure his pardon
is secured while his dad's still alive. Eight five for zero five eight two
five five the number. Hey,Finally a Colorado Democrat comes out and calls
for Joe Biden to leave office, not leave office, pardon me, Joe

(17:44):
Biden to withdraw as the presumptive nominee. Which Colorado Democrat has stepped forward.
Polus has been in hiding. Almostall the Colorado Democrats have been in hiding.
Why have they been hiding and whydid this one step forward that after
you're listening to the Dan Kaplis Showpodcast, it is a big, big

(18:07):
victory for Donald Trump. It meansthat the January sixth case, the case
before Judge Chuck in the District ofColumbia, is at a minimum delayed until
after the election. But I thinkwill never be tried because if you look
at how Chief Justice Roberts framed theissue. He said, that all official
conduct is not only off limits forprosecution, but there can't even be any

(18:32):
evidence presented about official conduct. That'sJeffrey Tuban on CNN And a related note,
today, the court in the wrongfulconviction in New York has delayed the
sentence scene until well after the RepublicanNational Convention. It had been coincidentally timed
for the week of the convention, now put off until mid September so that

(18:56):
the court can consider Trump's motion thatthe US Supreme Court ruling yesterday now eviscerates
his convictions. So in any case, the sentencing now, which you can
expect, will likely go forward inSeptember. Unfortunately, that sentencing will be
even closer to election day. Sodo you think that Hurtsore helps Trump overall?

(19:18):
I think it helps him. Andthen we'll get back to our jam
lines. And here's why, becauseI have always been very concerned, and
Andy McCarthy has spoken to this verywell. I've always been very concerned that
once there was an actual sentencing inthis case that never should have been brought.
Trump never should have been convicted.Once there's an actual sentencing, and
voters in the middle are thinking, wait a second, this candidate has actually

(19:41):
been sentenced to jail. What's thatgoing to mean for a presidency. I've
been concerned that that might hurt Trump. Now it could backfire as well,
right, but it's a wild cardthat's always concerned me. The fact that
this is going to be put offfurther into the future, I think is
better for Trump because I think he'sjust going to continue to build his lead.
You can argue that coming later inthe game it might hurt him more.

(20:03):
I think this is better for him. Let's go back to the gam
lines. If you just oh yeah, thank you, Ryan for reminding me.
I teased into this. Colorado Democrats, very typical for these elected Democrats
in Colorado, have gone into hidingwhen it comes to whether Joe Biden should
be the nominee, whether he shouldcontinue his presidency because that's their style,

(20:25):
right that they're not leaders. Theygo into hiding when they think it might
hurt them. But Adam Frish, the candidate and CD three has stepped forward,
who is raised about what fifteen millionbucks because the left thought he was
going to be running against Lauren andAdam Frish now calling for Biden to step
aside as the nominee, So AdamFrish obviously very worried that if Biden's the

(20:48):
nominee, it's going to take himdown. Adam spoiler alert, You're going
to lose to Jeff Hurd anyway. But that is the damn going to break
now? Or other Colorado Democrats goingto step forward? We will find out
together. Let's go to the phonelines. Our Alexa calling from beautiful Denver,
Colorado. Alexa, How you doing? How are you Dan? Great?

(21:10):
Thank you? What are you thinkingabout all this? Well? First
of all, happy early thirtieth dinniverse? Yeah, thank you, thank you.
The last day of our thirtieth yearof marriage, will be married thirty
full years tomorrow. Such a lovelycouple. Man, Thank you for that.
Half of it is one possible smallflaw in your theory. I think

(21:33):
your theory is great, But whatif the JEP state has more stuff on
Joe than Hunter does? Great question. The theory that Alexa's referring to is
that Hunter Biden is calling the shots. Joe Biden will do it under a
Hunter tells him to do. That'swhy Hunter Biden, as NBC reported today,

(21:55):
is now involved in high level WhiteHouse policy meetings, at the White
House itself. Great thinking on yourpart, Alexa. Under your theory that
the deep State is able to callthe shots because they have more on Joe.
Here's why I think my theory isbetter because if you're correct, and
you may be that the deep Statehas even more than Hunter does, the

(22:15):
deep State doesn't have the direct mechanismto use that against Joe. You can
leak it here, you can leakit there. But the quote deep state
can't walk into a prosecutor's office andsay, let's make a deal. Deep
State, you know, can't directlywalk into the Washington Post and say I
want to tell my story. Andit's indirect when you're working through leaks.

(22:37):
Hunter Biden, he's a bag man, right. He could walk in any
of those places and just lay itall out there. But the Deep State
could approach Joe and Hunter and say, you guys, don't bow out of
the race. This is what we'regoing to release, and you're going one
way or another. You can justchoose your timing in the next month.

(23:00):
Yeah and listen. No, no, it's fascinating, fascinating. I get
it. And all I would sayis, again, what is the mechanism
then for the deep State to deploythat information, if they'd have to work
through others, right, they'd haveto work through media people, et cetera.
But no, I love it.Thank you for that deep thinking,
pun intended Alexa, Thank you, take care of Thank you very much.

(23:26):
I'm sure tomorrow will be Chris inFremont County. You're on the Dan Kathla
Show. Welcome Big I. Howare you living the dream? Thank you
living the dream? Hey, kudosto you. Thanks. I haven't always
agreed with everything that you say,but the longer I listen to you,

(23:48):
which has been years, the moreI happen to agree with you. Thank
you. You know a couple ofthings I wanted to get touch on.
Was one of the things was duringthe to day they got into this deal
and Trump said, hey, let'snot be children. But they got into
a little uh kissel about golf andwhy. I mean, you know,

(24:15):
it's kind of funny, but youknow, when you get right down to
business and you look, you know, everybody super analyzes every single word and
syllable and everything else, but pointblank, they challenge each other to a
golf man and both of them agreed, and Biden actually said Hey, let's

(24:41):
do it, buddy, if youcan club the whole way. Now,
I would love to see any ofthe media, anybody quote unquote te off
with that one. Yeah, no, I love Chris. Just settle the
race that way. I mean,I have seen Biden's golf swing, okay,

(25:03):
and I'm not God's gift to golf. But Biden is a hack.
And the fact that Biden would say, oh, I was a sixth just
shows what a liar he is tohis core. And Trump could carry Biden
around the course, forget the golfbag. Trump could carry Biden around the
course and still beat him. Yeah. Yeah, And even even if they

(25:26):
just said, you know what, yeah, I know, we were kind
of be a little pushy there.Let's be friends, right, I mean,
we are Christians, you know, most of us conservatives some kind of
God that get right. I mean, we got to get our moral stance
from let's use the golf cart, right, Let's let's just go and see

(25:52):
what happens at that point. Youknow, maybe the two of them eighteen
holes of some sort of a stillwhole relationship and almost you know, the
two of those almost remind me ofmy ex wife and our relationship in regards
to my child. Yeah, butI doubt Chris, your f your ex

(26:15):
wife tried to put you in jailfor the rest of your life, tried
to cause you to die in jail, right, And I love your generosity
life spirit. I just think thatthis would take truly divine intervention. Chris,
You're a good man. Thanks forthe cod words. Want to try
to get everybody on here before thebuzzer. We do have one segment left.
Everybody in the lines hanging there.I'll get to you on the other

(26:37):
side if you just joined us.Really important news of the day, some
of the most important news reported, and it tells you more about where this
is headed than anything else you've heardreported. NBC breaking the story. Hunter
Biden has been at the White Housethis week in high level staff meetings with
Joe Biden and high level staff. You tell me, other than Hunter Biden

(27:00):
now calling the shots because he ownsJoe Biden, what other reason would there
be for him to be there? And what do you think Hunter Biden is
going to decide about whether Joe staysor goes. What's in Hunter's best interest?
You're on the Dan Kaplas Show, and now back to the Dan Kaplas
Show podcast. So, with allthe respect, it is not it is

(27:26):
not honest to say that this isjust one night. There have been moments
like this that people have seen infront of the cameras, and other moments,
but without what cameras not there.Wow, Jake Tapper calling out Senator
Chris Koons today, This is sobeautiful, right because everybody knows right now,

(27:48):
any of these Democrats, anybody whosteps forward and says, oh,
no, Joe Biden, he's competent, He's mentally competent and capable to be
president. Anybody who says that isjust instantly revealed as a jack sniffing liar.
So certain guys like Chris Coons andwhatever they're willing to go do that.
I don't know if Coons is upfor reelection this year, but I

(28:10):
bet there won't be many people whoare up this year who are out there
telling that obvious lie because everybody's goingto look at him and say, hey,
you're just a jock sniff and liar. So what about these Colorado Dems.
Where's the great leadership of Jared Polisand Michael Bennett and John Aikinlaberu Mike
Johnston. Are they out there speakingabout Joe Biden now, whether he's qualified
to be president or not. Don'tyou think they should speak on that.

(28:33):
It's left to Adam Frish, who'srunning Don and Lauren's old district, you
know, to come out and sayno, Biden should step aside, because
Frish knows he's going to go down. If Biden is the nominee, it's
going to drag the entire ticket down. Well, Frish is going to lose
any way to Jeff heard big newsof the day as we get back to
our phone lines, Capitalist theory confirmedthat Hunter Biden controls Joe Biden because Hunter

(28:56):
Biden knows where all the bodies areburied. He buried him there with Joe
Biden. He was his batman. So NBC confirming Hunter Biden has been in
high level policy meetings in the WhiteHouse this week. Obviously it's Hunter Biden
who will decide whether Joe remains thenominee or not, whether he remains president
or not, all based on what'sbest for Hunter Biden, what's his best

(29:18):
chance to stay out of jail. What an amazing, terrifying moment we're in.
Let's go back to the phone lines. I want to start though,
with one of the best text questionswe've received all year. Ryan. You
saw this text, Dan, whyhasn't Trump announced his VP pick? That
from jb He did, not,in my opinion, announce his VP pick

(29:41):
because he didn't need to. Hewas ready to announce if the debate went
poorly to change the channel, right, if the debate went poorly, he
was going to announce so that thefocus would shift to his VP. He
debate night went great, so hedoesn't need to announce. He'll save that
for another big bank. Yeah, and you want to delay this news cycle.

(30:02):
Looking at it from a media perspective, Let Joe Biden take all this
heat, all the focus, allthe spotlight, and Trump could just wait
till the convention. Really Yeah,no, that's right, And let's go
to the phone line. Spot whata VP Youngkin would make many You know
it would be nice to get Virginia. Let's go to Don in beautiful Fort

(30:22):
Collins. You're on the dan KaplaceShow. Welcome, good afternoon, Dan,
Thanks for taking my call. Sure, so, I guess you know
the Supreme Court ruling. Oh well, it does seem like it's beneficial to
President Trump. But my angle onit was this, uh so, official
acts, I understand would be immune. However, unofficial acts would not now

(30:48):
advise it warrant would be an officialact if the evidence to get that visor
war was legitimate. Correct, Well, let me ask you to and are
you saying that, Well, theSteele Dotsier was put to be false and
a campaign you know, uh byHillary took Clinton. So but Obama used

(31:11):
that Steele Dotsier to obtain the buythe war. Now understand you understand my
angle, and otherwise I do.Can I take a second to address it
because Obama libel or not right? And that will turn on at that point
whether Obama was acting as president orwhether he was acting as a political candidate

(31:32):
or the head of his party. And the Supreme Court addressed that within the
opinion, if he took that actionas president of the United States protected if
it's a core function, absolute immunity. If it's an outer perimeter function,
presumed immunity. But it can bechallenged. Now that would come back to
the factual finding of in what capacityhe took that action. My initial reaction

(31:56):
is no, that that would beto the extent if you had president Obama
involved in the Steele dossier, whichwas being done for purely political purposes.
My guess is that would not beconsidered an official act. That would be
you know, in his capacity asa leader of his political party, that
his act was not official. Wellright by correct, because what the Supreme

(32:23):
Court said is the burden is onthose who seek to prove it is not
an official act. And then whatthe Supreme Court critically did, and we'll
talk about this more in the weeksto come, is the Supreme Court limited
the type of inquiry the type ofevidence that could be submitted on that because

(32:43):
to get that evidence, such asinto the president's motives, you would have
to then again invade this separation ofpowers just through the probe itself. I
get you, I understand, butyou also understand a quandary involved with it.
In other words, you know allnow in the future. Don I

(33:07):
think we lost you there? Andyet, how on earth are you going
to prove How are you going toprove one way or the other that the
act was either official or personally motivated? How are you going to the same
way? And don let me endthe show with that, because we need
to get out in a hurry.Thank you for the great questions. I
hope you call back and we havea longer form discussion. My apology to

(33:30):
everybody else you didn't get through, but that will be done the same way
everything else in the process, inthe court process gets proven through the presentation
of evidence, through the presentation ofargument, through briefs, and directly through
the court, and it will largelybe a factual finding. Okay, in

(33:51):
what capacity was the president acting atthat time? And it can go beyond
that as well. Brian, tremendousjob. Thank you for all your great
work. Kelly, you as I'llbe off tomorrow to celebrate our thirtieth wedding
anniversary with Amy John Caldara. We'llhave this show. Have a great day
tomorrow on The Dan Kaplas Show
