Die Staatsanwaltschaft lehnte den Vorschlag zur Einstellung des Verfahrens ab und stellte stattdessen einen Befangenheitsantrag gegen die Kammer. In ihrer Begründung führte sie unter anderem an, dass die Präsenz zahlreicher Pressevertreter während der Verhandlung für sie problematisch sei. Michael Ballweg kommentierte dazu: "Ich dachte, wir leben in einem Land mit öffentlicher Gerichtsverhandlung. Die Staatsanwaltschaft scheint ein anderes Verständnis von Pressefreiheit zu haben."
