Speaker 1 (03:32):
Here we go.
Speaker 2 (03:36):
The Bill of Rights. You may have heard of those before,
hopefully if you don't know what they are. There the
first ten amendments to the US Constitution. The amendments were
a response to the fierce debate over individual liberties and
federal power during the route the Constitution's ratification process. Now,
(04:01):
the Constitution, we know about seventeen seventy six Declaration of
Independence and all that, but the Constitution. US Constitution was
actually ratified in seventeen eighty eight, laying out the framework
for the federal government. But many states, however, voice concerns
about the absence of explicit protections for individual rights. The
(04:28):
Bill of Rights is what makes our country really unique.
We are a constitutional republic. First of all, we're not
a democracy. I heard it all over and over again
this election process. We're not a democracy. We're a constitutional public.
But the amendments to the Constitution, called the Bill of Rights,
(04:49):
really cement and make us unique as a nation in
what the government cannot do to the individual. So the
states that are all rights constitutions in place, but now
(05:10):
we need to start amending it to make sure there
are protections for the individual. Influential states like Virginia York
ratified the Constitution on the condition that the amendments would
be added to safeguard personal liberties, kind of like the
old political wrangling. Okay, I'll do it. But the key
(05:33):
advocates on opposition to the Bill of Rights include James Madison,
who was initially skeptical of a Bill of Rights but
then became its chief architect. He recognized the political necessity
of addressing anti federalist concerns people not for a big
federal government, so he realized it would be crucial to
(06:01):
roll out smoothly this new constitution by addressing anti federalist
concerns to unify the nation. The federalists argued that the
Constitution structurally inherently protected freedoms. Hey, we don't need to
do amendments. The constitution structure just it's already implied. It
(06:28):
is inherently there. But public pressure for explicit guarantees won over.
The First Congress acted swiftly, drafting and proposing twelve amendments
in seventeen seventeen eighty nine, just a year after the
ratification of the Constitution. Ten of these were ratified by
(06:52):
December seventeen ninety one, becoming the Bill Rights. So the
Constitution paused in seventeen eighty eight. By December fifteenth, seventeen
ninety one, the Bill of Rights, the first ten amendments
were law. The quick timeline underscore is how critical these
(07:13):
protections were in securing trust in the new government. What's
in the What are in the Bill of Rights? What
are the ten How about the First Amendment? The protections
(07:37):
for dealing with religion, free speech, the press, assembly and petition,
Second Amendment, the right to bear arms, Third Amendment, the
quartering of troops. The Fourth Amendment, Search and seizure. The
fifth Amendments grand jury, double jeopardy, self and crimination, due process,
Sixth Amendment Criminal persecution, prosecute, criminal prosecute, jury trials, right
(08:01):
to confront and to council, Seventh Amendment, Common lawsuits, jury trial,
Eighth Amendment, excessive beil or fines, Cruel and unusual punishment,
Ninth Amendment, Non enumerated rights, Tenth Amendment Rights reserved to
the States of the people. Powerful stuff. So the First
(08:28):
Amendment is as follows. Congress shall make no law respecting
an establishment of religion, or prohibiting the free exercise thereof,
or abridging the freedom of speech or of the press,
or the right of the people peaceably to assemble and
to petition the Government for a redress of grievances huge.
(08:54):
So Congress could not pass laws forcing you to go
to a church or participate in a government religion, or
preventing you from the free exercise of you worshiping in
your religion of choice, or preventing free speech, or preventing
the press from reporting whatever they feel led to up
(09:17):
to liable or dishonest, obviously, or the right of people
to peaceably assemble or to petition the government when they
had issues with the government. Second Amendment, the right to
bear arms tenth Amendment huge, and we'll finish with this.
(09:37):
The powers not delegated to the United States by the
Constitution or prohibited by it to the States, are reserved
to the States, respectively or to the people. So the founders,
because of pressure from the States, put in the Bill
(09:58):
of Rights. So do me a favor. Make sure you
know the Bill of Rights, because the Bill of Rights
are what keep the federal government in line. So thank
you for listening. This has been Give me five again.
