Episode 111: Scotus allows the destruction of sacred Navajo lands

SCOTUS just allowed the destruction of Native American sacred religious sites in favor of copper mining. In the case of Apache Stronghold v. United States, (U.S. S.Ct. 2025), the Supreme Court denied certiorari on the case, effectively upholding the 9th Circuit Court of Appeals ruling to allow mining on a large area of land in Arizona that the Apaches believed was where the world was created.

Through this case, the Supreme Court has effectively diminished protections for 1st Amendment religious freedoms of more specialized and smaller religious groups. This case also undermines the Religious Freedom Restoration Act of 1993 and the Supreme Court's prior decision of Navajo Nation v. United States Forest Service.
