we're actually going to do a fullshow on a story that is happening
out west in the state of Wyoming. If you have not heard of it,
it's called the Corner Crossing Case.Land Towny from Backcountry Hunters is going

to join me, and there wasso much information we decided just to do
a full show on it. Butbasically the bottom line is, and this
could affect hundreds and hundreds of thousandsof hunters. The judge has to decide
whether the airspace above a fence lineis public or private when you step across
it. So that's the bottom lineon this case. So probably want to

some news they release some you know, people always wondered what the DNR does
for stocking. So in twenty twentytwo, they stocked six million fish in

Wisconsin lakes and actually I have thenumbers for that. One million, six
hundred thousand walleyes were stocked, eighthundred thousand trout that is brown trout,
brook trout, three different species oftrout, and then plus the lake trout
was another eighty thousand, forty twothousand muskie, forty eight thousand northerns and
twelve thousand, five hundred sturgeons.So think about that. That's six million

fish stocked into Wisconsin lakes to boostour fisheries. That's good stuff. That
is pretty cool. And also withthe wallets, you know, remember Scott
Walker had the Governor's and Wallete Initiative. They put another five million in the
budget in Wisconsin to stock fish andimproved two fish hat trees, and they

stocked to extra well, let's see, five hundred thousand just into Lake Mendota
and several other floages like the Minoquaarea got just intense stocking. So you
know what, Campain, that's prettygreat. We have so many good fishing
opportunities in wiscon well, and youcan see the boost for Lake Mondola.
Yeah, it's an eighteen inch sizelimit, but it is going out there

fishing and just catching a number ofwalleyes. Otherwise, walley coming out of
eye casts. Here's some pretty hotnews because we're all rigging boats and trying
to figure out what we're doing withbatteries. Dakota Lithium Battery Company has now

there was so much controversy with thesestarting batteries whether mercury would warranty motors,
but this looks like this is goingto be the answer to starting batteries.

visiting with a fellow named land Tawnyout in Montana and it's in regard to
what they called the Corner Crossing casewhere basically four hunters were charged with stepping
over a four corner where a privateand public came together. So we got

I was there, So that wasthat was pretty cool if that all comes
back from twenty some years ago.So Land, we wanted to have you
on board. This is a prettyinteresting deal. So we're gonna we're gonna

kick this off. I mean youwe should let you know your fifth generation
Montana wild Wildlife Biology from the Universityin Montana. You've been in the outdoor
world, uh, join the TheodoreRoosevelt Conservation Group. So let's kick this
off, this corner crossing case.So you want to fill us in Land

a little bit about um, youknow what, what how did all these
corners and private land come to be? How did how were they formed?
And how did that get the wordstoday? Right? Well, thank you
for the question, and thanks againfor having me. So corner crossing and
really, if you look at amap in the West, you'll see you
(09:33):
know, public land, private land, public land, private land, and
that was done and really that checkerboardlook at that land was done to help
expand railroads and development in the West, and so as the railroads were coming
west, it was an incentive andthen also helped finance these railroads. Ultimately,
the railroads, you know it didn'thold on to them themselves. They
(09:54):
sold them to private entities. Andso that's really what eight I would say,
this checkerboard ownership in the West.Yeah, and so do you have
an amount of so called landlock publiclands? Do you have a amount of
how many lands are actually basically it'skind of staggering. It's kind of staggering.
(10:16):
Yeah. On X who is ayou know, mapping and kind of
app that hunters can use to areport along with the Theodore Roosevelt Conservation Partnership,
and it was nine point five millionacres. Now that's not just all
corner crossing that can be you know, public land that's donated completely by private
land, but nine point five millionacres in the West that is public land
(10:39):
that is really inaccessible to the averageman and woman. Well, and that's
why it's important for people listening torealize what this case is and you know,
it's going to be the outcome forchanges in in you know, this
land ownership and stuff So in twentytwenty one, four hunters were charged with
trespassing after setting a ladder over afour corner property where public and private lands
(11:03):
meet. So where did this happen? At land? And then chargers were
Eventually the landowner eventually charge these hunters. Correct, So you're correct. So
there's four Missouri hunters. They've beencoming out to whelming a couple of years
and they saw a piece of publicland they wanted to get to, and
so they called the local sheriff,they called the local game ward, and

they said, this is where wewant to go. We've built this ladder
to make sure that we do notstep on private land. And so they
went ahead and did that, andafter you know, they came back,
they were harassed by the land managerfor this big ranch. It's twenty two
thousand acres. They did not againstep on any private land. They were
(11:46):
harassed. Nothing happened there, andthen that man manager called the county attorney
nineteen times, and study of thecounty attorney charged these folks with with chessma.
So land and basically back Hunter HuntersAssociation jumped in and created a goal
(12:07):
fund me account for these hunters legalfees. You want to tell us about
that and how much you raise.We got about a minute and a half
left or so. Sure back upthree hundreds and anglers. You know,
we saw that there's for individuals havedone everything right, we want to make
sure that they were supported financially,and so we started to go fund meing
page that ultimately raised one hundred andthirty thousand dollars both for the criminal case

and then you know what happens afterthat with the civil case. Yeah,
and that's why I stressed to ourlisteners Land, and you do too.
You need to you need to joinsome type of conservation group for you know,
a political voice and so on.So Land last question for we jump
out of this break and Land's goingto stay with us for another segment.
Land, So does does Fish andWildlife Force Service BLM? Do they have
(12:54):
access to any of this public landersthat only buy a helicopter they've got you
know, they've got agreements with privatelandowners and in most cases they can access
that public land to help manage thoselands. But it is very difficult.
And so you know, I thinkthere's a lot of opportunities to try to
block up that land and maybe dosome exchanges. But no, it's very

it's not as easy as it asit should be to manage the people's land.
Right, Hey, before we getout of this segment, land,
just so I understand. So thereal question here is is the airspace above
the fence public or private? Is? That's the real question. That's a
judge as to designed that. Thatwas the question. That was the question.

County from Back Hunters Association group isjoining me. Land is out of Montana.
We're talking about the Corner Crossing casein Wyoming where four hunters were charged
from a landowner. So Land.Good to have you back on to kind
of mop up this story. SoLand. In twenty twenty two, a
trial date was set for these fourhunters charge. Do you want to talk
(15:52):
about that? Sure? So theywere charged crimley again and in the spring
of twenty twenty to have their trial. The judge very quickly decided that they
did not criminally chest fast because theydid not set foot on private land,
and so they got off on criminalcharges Right after that, though not too
(16:14):
much longer, the landowner filed acivil case so and said that damages that
they caused were up to seven milliondollars, which is absolutely crazy. Even
if they did step on that privateland, I can't believe that that,
you know, seven million dollars ofgrass was damaged. So basically the landowner
(16:37):
was saying that they devalued his landbecause they stepped on it, which eventually
could open up millions of acres ofpublic land and make his less valuable,
something like that in my clothes,you're very close. Absolutely, He said
that basically that public land that isyou and I and everybody else listening to
as land, was his own andthat was part of the value of his
(17:00):
ranch. And so ultimately, youknow, that's where he came up with
those charges and Eric, excuse me, those penalties, and you know,
we were just this last spring toa year later, judge ruled that that
was not the case, and hereferenced a couple of things. He said,
again they did not step foot onthe private land. And then he
(17:22):
also referenced in legislation it was justpassed in whalement that we helped put together
and said you'd have to trespass,you have to be stepping on private land,
and then also making it illegal forprivate landowners to post public land like
it is private. And so itwas a big win, i would say,
for the people that said all thesethings are appealed, and he just
(17:45):
filed for an appeal to the pentCircuit. And so this conversation is not
over yet. No, So thisjumping back to the seven million dollar lawsuit
Land. What happens there with thislawsuit? Ultimate that lossuit was thrown out.
Well, it's found that there wasno penalties, which was great,
(18:07):
but that ruling has been appealed tothe Tenth Circuit and so we're waiting for
that child day to be set,should be later this summer, and then
we'll go from there. But wefeel pretty confident with both the ruling the
legislation that happened in Wyoming, wefeel pretty confident that WILL four will succeed
again. So in December twenty two, the lawyers filed the amicus brief and

support of changing the corner crossing lawsand and in Wyoming, how was this
and we should mention just to refreshthis. The corner crossing is basically where
four public and private fences come togetherand you legally you could not legally cross
that until depending on what's going tohappen now. But how how did the
(18:53):
judge accept this amicus brief plan?Yeah, so we had an amx if
just on behalf of the people andfor back the three hundred and anglers in
particular, and the judge accepted itright away as in support of So that's
a support of the brief and ofthe case, and so we're pretty excited
that that happened. And um,you know, again supporting the people,
(19:17):
not only the Missouri for but allAmericans that have you know, should have
the rights to access their own publicland. So then in May twenty twenty
three, the courts find it legalto cross private airspace when stepping from private
to public or public to public.However, that is a little confusing even
(19:37):
after you you read about it afew times. But is this now that
you mentioned there's an appeal being filed, But this is only for the state
of Wyoming depending on what happens withthis case, not other Western states.
Correct, it is, and that'sthe way the judge ruled too, is
it was very specific to the case. You know, I said it earlier
in the first segment that the Missourifoard did everything right. They called the

sheriff, they called the wardens.They knew exactly where they were because they
had the on X mapping on theirphones, and they knew exactly where they
were. They did everything right,and so we said in this case they
will not be charged civilly or criminallyultimately before so you know, everybody that
is thinking about corner crossing in Wyoming. Just got to do your due diligence
(20:22):
and make sure that you're doing everythingright. Yeah, and then when will
let's see peel appeal be heard Lamb. Yeah, it looks like later this
summer. You know, all thingscan be changed when it comes to legal
stuff. You know, sometimes there'sa timeline that is put forth, but
we're looking at probably late August forthis kid. Heard again in the tenth

a difference when it comes to thepolitical fight. Sure, a lot of
people in this country don't think yourvoice counts anymore. And you know there's
big interest that you seem to carrythe day, and that's absolutely right that
your voice doesn't count if you don'tuse it. And so belonging to Backgroup

three hundred and Anglers, you helpedraise that voice collectively. And so whether
you you know, we make iteasy for you to get involved at a
state legislative level, at a federallevel, we can help you get on
the ground and do some stewage ofactivities. Maybe you just just want to
be a member, which is justfine. Collectively we have a stronger voice

and we can carry the day onmany issues. And so today you know
the number one reason people stop huntingand fishing is because of access, and
we make sure we work are everysingle day at back Country hundred and Anglers
to make sure that you have accessto public LANs and waters and then the

happening up on Late Vermillion. Fiftythoust This was actually came out to sp
fifty thousand fines, fifty thousand dollarsin fines for moose poaching incident. This
was a two year investigation. Alodge near Lake Vermillion was also fined,

but fifty thousand in fines, andthen the judge tacked on another twelve thousand,
five hundred dollars and it's called victimsurcharge fines, which I am not
familiar with, but that was filedagainst the individuals and the lodge and a
(25:36):
lot of it was shooting out ofa boat. It's not legal to shoot
out of a boat. Plus theyhad some moose that you know, weren't
really go sure, so but twoyear investigation. So you know, once
again, Wally, these wardens,you know, just investigate one incident.
It's a two year investigation to getenough evidence to convict these people. And

it's you that's why they're just notenough to go around. Well, we
have a saying if you see something, say something. So if you see
somebody violating, don't be afraid tospeak out because it's just affecting all the
good you know, sportsmen that doeverything the right way. So absolutely,
time now for the Dakota Sunset ResortField Report. Fishing in Devil's Lake,

North Dakota has been fantastic. Lotsof beautiful walleyes are being caught from seventeen
inches to twenty one inches and largercasting plastics, trolling crank baits with planer
boards and using bottom bouncers with crawlerharnesses has been great. All three techniques
are working well right now, Captain. Things are good. Otherwise, some

news State of Minnesota. They issueda news release that said their fishing license
sales has been a loss this yearsince two thousand or last year since two
fourteen. They're blaming some of theweather and so on, which I'm surprised
that it would be the lowest sincetwenty fourteen in Minnesota where there's supposedly ten

thousand lakes. But maybe all thefishermen are moving out, Wally, I
don't know. That's kind of acrazy story, but maybe it's just the
economy and so on too. Hey, here's a good thing now. The
Clearly Open House is taking place acrossthe nation. It's August third, fourth,
and fifth, Thursday, Friday Saturdaywith great deals on Cleary buildings.

that are thinking about it. Soand we'll have Mic on from Clary talk
about that too. Otherwise, Wallylittle statement coming out from Walleyes for tomorrow
that they're no longer going to offertheir ariated pontoon boats for release of fish
during tournaments. So evidently they havebeen loaning these out to some tournament circuits

for phish release. And they cameout with a statement and that's up in
Oshkosh. They said they're no longergoing to be offering those. They are
encouraging people to go to the FishDonkey app or the Catch Photo Release app
where everything is released over the sideof the boat. And that's more good

news for the fishery. Yeah,that's really smart. Just to mention,
Marco Ziki's casting for kids has alwaysran that way where you take a photo
on the bumpboard of the fish,also the angler holding it and you let
it go right on the spot,so it's far less stress on the fish.
