it's well far away from the Leeward and the Windward Island,
so it's out in the middle of the Atlantic forty
five mile an hour wind, so minimal tropical storm. Now,
the interesting thing about Aaron is that it will likely
continue mainly westward the next couple of days, so that

keeps it out over the open water toward the weekend.
Right now, the National Hurricane Center is saying it'll be
north of the Windward Leeward Islands and still north of
like Cuba, so still in the middle of the waters,
but getting closer and likely to strengthen into a hurricane,

perhaps a major hurricane. Toward the end of the weekend,
so we're going to be watching it. But we've got
a lot of time to watch it. And that's what
I want folks to know. Is there any confidence on
the path at this point or is it way too early?
You know, I would say yes, there's some confidence on
the path through this week, but beyond the weekend, you know,

that's when the margin of error expands. But yeah, the
steady westward progress, I'm pretty confident it's going to keep
doing that. I don't think it's going to hook anytime soon,
at least not significantly.

about going to places like China which are having it.
Doctor Mark Siegel, I'm Fox is explaining exactly what this
virus is.

It's two hundred and forty thousand cases already this year.
The vast majority of them, one hundred and eighty thousand
are in Brazil, coming out of the Ring Forest, coming
out of the Amazon, and they affect this mosquito. And
the mosquito is the rate limiting step here. It's the
reason we're not going to see a global pandemic because
you're not going to get it human to human. You

got to get it from this mosquito. On the other hand,
this mosquito is hardy, and this mosquito breeds very easily
on very little bits of water, and the eggs spread
on luggage and things like that, so you can spread
it via travelers that are sick or via mosquitos. Now
keep in mind, I just said one hundred and eighty
thousand cases from Brazil. We're not seeing a huge outbreak

trace to Brazil. What's concerning about China is that it
hasn't seen it before. We've seen cases in Southeast Asia,
but this is really the first big outbreak we're seeing
in China. And as you know, there's a lot of
travel from China to the United States, so there's a
lot of opportunity to start to see this emerging in
Florida in the southeast and in the Southwest where these

mosquitoes are here already. But it is not going to
be another COVID type situation. For the most people, it's
a nuisance, but for some people that can cause a
lot of joint and bone and muscle pain and high fever.
So it's not something to take lightly. But it's almost
never fatal, that's correct. About ten percent of the time.

It can cause it encephalitis.

Or infect you in the brain.

That's something you don't really want this virus for sure,
so you want to use a lot of precautions with
insect repellent and with clothing for it. But China is
definitely vastly overreacting to this with the draconian measures, you know,
spraying everywhere, wearing red vests, going door to door, examining
you and finding you if you have little bits of water.

This is typical of them, and it's what they've done before,
and it spreads much more fear than it controls virus.

The nation's small business operators are feeling better about the economy.
The National Federation of Independent Business as optimism rose last
month to the highest level in five months. More businesses
were making expansion plans, and one in five firms indicated
labor quality was their top concern. Economists say a new
inflation reading from Washington will likely show that teriff related

costs have begun to filter through to the cost of living.
A September interest rate cut was never a sure thing,
and any uptick in inflation would make a rate reduction
less likely. That report will be out before the markets
open this morning. As investors await that report, the futures

are seeing a new balance between buyers and sellers. Lots
of inventory, more and more interest also among potent buyers.

I'm an oldest. I'm not a middle I'm an old oldest,
and I have a sister who's the middle and another
sister who's the youngest. It has been my personal experience
that middle children are a little bit different, and I
think it has a lot to do with well being

stuck in the middle and kind of feeling overlooked. And
they realized that. I really do think they get overlooked.
I mean, you got the oldest child is the first one,
the firstborn always gets all the attention in the beginning, right,
and then there's the baby, the last one, the last
one out of the house, who usually has a really
super strong bond with at least one of the parents.

And then there's one in the middle that just kind
of got stuck between the two dominating personalities. And in
the case of my family, my personality has intends to
be a little bit on the big side, and so
it's my youngest sister, Denise is and is a little
bit more reserved. So it's it's interesting the family dynamics
that work around that. So it's been my experience that's

been children. I haven't looked at the positive traits of
middle children until I forced myself to do that today.
Here's how if your middle child, you can see if
anything relate to you. Middle children often characterized by adaptability, independent,
strong negotiation skills, I believe that, and a tendency to
be peacemakers within the family. The negotiation stills come from
(28:24):
trying to navigate between an older and a younger sibling,
and the peacemaking, of course, has a lot to do
with that too. You know, older kids and the baby
of the family. Sometimes you have little squabbles or whatever,
and the middle child acts as a mediator between the
two and is usually pretty dog one good at it.

but the National Hurricane Center that it's going to continue
on mainly a westward path and by the end of
the week, over the weekend, approaching near the Leeward and
Windward Islands, but staying north of there. So the good

thing is it's going to be out over open water
through at least the rest of this week, so it
won't be bothering anybody in that manner. But because it
is out over open water, not encountering any conditions that
would limit its development. What is now a tropical storm
with forty five mile an hour winds is likely to

become a hurricane and may strengthen into a major hurricane.
And that would mean wind speeds of at least one
hundred and eleven miles an hour. That happens by Sunday,
but again it's over the open water, and we'll need
to watch.

Well, you know, there are slow learners as students, and
there are slow learners as schools. And the slow learners
as schools are the ones that are still getting DS
and f's even after they've already had those kind of
report cards and you know, on the verge in some
cases being taken over by the state. HISD, I think
is a prime example of somebody who ended up getting
(34:34):
taken over by the state because they just couldn't turn
the battleship around or weren't that interested in turning the
battleship around. Now the grades are out, lawsuits are settled,
we'll find out this week what school systems around the
state got. Mandy Drogan joins us. She's at the Texas
Public Policy Foundation. She follows all things educational, big homeschooling proponent,
a big school choice proponent, and when it comes to
(34:58):
school choice, it helps to know how your school's performing, Mandy,
before you decide where you want them to go to school.
Speaker 12 (35:04):
Right, Absolutely, parents have a right to know can a
school educate my child or not? And if not, they
must have the right and the opportunity to go somewhere else.
Speaker 4 (35:14):
Is this information too a little too late at this
point for many families?
Speaker 26 (35:19):
It is?
Speaker 12 (35:19):
Unfortunately, I've seen all over social media the smiling pictures
of children going back to school, and the really unfortunate
part is that over twenty two percent of the public
schools in Texas are D or F rated schools. We
did see a massive drop in schools all across Texas
(35:39):
going down. This tells parents they're not educating their children,
they're not focused on the basics, reading, math, social studies.
To be clear, forty percent of kids in Texas are
proficient in math, fifty percent of kids are proficient in reading,
and just thirty percent of kids in social studies and history.
(36:02):
Those numbers are devastating. And yes, parents were not told
and they didn't have the option this year to select
a different school based on these ratings. And it really
is sad for a lot of parents whose kids are
back in school and they're being back in the schools
and the twenty two percent of schools that are and
F rated.
Speaker 4 (36:22):
Well, and those those schools involved in lawsuits to prevent
the information from coming out because they didn't want parents
to know. They're trying to sweep it under the rug.
Speaker 12 (36:32):
Always it's a game of hide the banana. And this
is what this system. You know, I've been talking about
this for years. We have a broken system. We have
to acknowledge where schools are failing and making mistakes. And
I heard you talk about Houston, I SD look, when
the state came over, came in and took over that system.
(36:52):
The new board, the Board of Managers, implemented sweeping reforms.
They basically said, we're not listening to the unions, we
have no tie to them. We're going to put in
merit based pay, We're going to put in an discipline structure,
We're going to put in all these different metrics, and
they now have no affrated schools. It was ugly, we
watched protests, but it worked. They got back to the basics.
(37:15):
And that's what we need to see the entire public
system get back to. Stop listening to radicals that want
to indoctrinate kids, start listening to experts that want to
get back to the science of reading, phonics, teach, teaching
high quality civics, social studies, mathematics. That is what Texas
schools must focus on.
Speaker 4 (37:34):
And it seems very simple, but the fact of the
matter is any take a state like Mississippi traditionally dead
last or very close to dead last when it comes
to public school education. They've completely turned that around in
Mississippi by doing exactly what you said, going back to
the basics. We've don't have time for all this other stuff.
We're here to teach math and reading and writing and history,
(37:54):
and if anything else gets done, great, but we're going
to take care of these core things first.
Speaker 12 (38:00):
That's exactly right. In fact, it's being hailed in education
circles as the Mississippi miracle, and it refers to that
traumatic change you're talking about. In their case, retul system,
they got back to the basis. They said, every teacher
is going to know how to teach phonics. You are
going to read phonics. They also said, if a child
cannot read on grade level at the completion of third grade,
(38:21):
we are going to hold them back and we will
not force them on through their education system without being
able to read. That's something that they focused on. That's
something they changed, and it has completely changed the trajectory
of their kids' lives there in Mississippi, and conversely, here
in Texas, we removed our retention policy. The same entities
(38:43):
I'm talking has, the Texas Freedom Network, these entities that
thought to remove Texas's retention policy in two thousand and eight.
They're the same entities that have supported hiding the a
thrift system, supported the lawsuits to stop parents from knowing
how their kids are. It's nefarious. It has to stop.
We got to focus on our kids and we will
(39:05):
not only have the Texas business miracle that we see
here where worth thriving economically, but we can also have
the Texas education miracle.

I mean, we already have a map drawn and compared
to maps from other states like Illinois and California. In Massachusetts,
it looks well, it looks a lot better than any
of the those maps do. It makes a whole lot
more sense. But there's a Supreme Court's case involving Louisiana
and the way they draw lines. They could have an

impact on other states is they figure out how they're
going to jerrymander around what Texas is doing. Because you
have California threatening to redraw their line so that they
get more Democrat seats.

Well, we're trying to drag around some of our lines
here in Texas, and the Democrats, of course, have taken
off for parts. Well I was gonna say parts on them,
but we kind of have an idea where they are
at this point point time. By the way, an hour
from now. Attorney General Ken Paxson, and the question I
have for him is where where is all the action
that we were promised? Where where is the you know,

the loss of committee membership or vice chairs of committee.
Where's all the where's all the fines? Where's all the
things that were promised by Governor Abbott. As far as
you know, getting these Democrats back into Texas and back
at their seats, I'm not seeing it anyway. I digress.
Let's talk about the Supreme Court case. There's one involving Louisiana,
(55:34):
and it may have an impact not just on Texas,
but it will certainly have an impact in any state
that's looking at redistricting and redrawing their lines, because there's
a lot of states that have used race as a
consideration for drawing the lines, and the Supreme Courts can
be making a ruling in this case in Louisiana, they
could impact that. Hans von Spakowski, I saw a story
that you're involved with on the federals for this tell us,
(55:57):
tell us what is up for grabs here in Louisiana
and how that may impact of the states.
Speaker 10 (56:02):
Well, the Louisiana case is really interesting because it was
actually up before the Supreme Court in their term that
ended in June, and rather than issuing a decision that
something's pretty rare, they said, we want to hear arguments
again in this case. So we're delaying the case until
the fall when they start up again, and we particularly
(56:24):
want to hear briefing on the issue of when is
it appropriate not appropriate to use race as a factor
in drawing new lines. And what happened to Louisiana basically
was that a federal court said to them, Hey, you
want to got one congressional district that's the black majority district,
(56:45):
you have to draw up a second one.
Speaker 2 (56:48):
And the.
Speaker 10 (56:51):
Legislature did that, and then some white voters sued and said, well,
wait a minute, you use race as your prime mary
factor and drawing up those lines, that's that's a violation
of equal protection, you know, the one person, one vote standard.
And a court agreed with them. So the legislature was
faced with two different federal courts telling them the exact opposite.
(57:16):
And that's what the Supreme Court's got to resolve. And
I suspect they're going to come out and say, using
race as a factor the way it was used Louisiana,
that's unconstitutional. And listen, Texas has has that problem. You
know what hasn't been mentioned, Jimman all of these news
reports about what's going on in Texas is that, you know,
(57:39):
the Justice Department sent a warning letter to Texas about
a month ago over the fact that four of the
congressional districts in Texas were drawn using race basically as
the primary factor. That these were Democrats wanted them, they
wanted them drawn up to favor them, and those four districts,
(58:04):
according to actually a Fifth Circuit US Court of Appeals
decisions from last year are unconstitutional racial gerrymanders. So this
redistricting isn't being done because Donald Trump is telling the GOP,
oh you should do this. It's being done to fix
those four unconstitutional congressional districts.
Speaker 4 (58:24):
Well, that's a great point to make. And I have
to wonder too, Hans fans Lekowski, how many other states
are going to be put in a position where they're
going to have to redraw their maps based on that criteria.
If the Supreme Court decides you cannot draw any districts
based on race, Oh, there are.

A lot of them.
Speaker 10 (58:42):
I mean that Fifth Circuit decision alone. Remember the Fifth
Circuit covers that Quarter of Appeals covers Texas, Mississippi, and Louisiana.
So those states alone would be covered by that Fifth
Circuit decision. And if the US Supreme Court comes down
the way I think they may come down, there are
congressional deskics throughout the country, and particularly in the southeast

and southwest, it may have to be redrawn.

the middle of a huge increase in home inventory.

I watched that number go from four months of inventory
to six months of inventory in the past year.

But the number of interested home buyers in Euston and

So Tropical storm Erin out in the Atlantic, expected to
stay there all week long early next week, approaching the
Leeward Islands. That's the northern part of that long island
chain of Leeward and Windward Islands, so somewhere near there
late in the weekend. The thing that's probably the most

interest is the fact that it is expected forecasts to
strengthen into a major hurricane. Up to around one hundred
fifteen mile an hour wins by the over the weekend.
So it definitely bears watching and not a concern right now,
and we'll have to continue to monitor it to see
where it heads.

them accountable for the laws of Texas. But that's within
the courts of those two states. And then of course

we've got the US the Texas Preme Court action that
the governor and I are both a part of trying
to remove. He filed an action to remove geen Wu
I find an action to remove thirteen legislators. We have
expedited opportunity to I think within two weeks get something
(01:33:51):
else in front of the court. And they are the
ones driving the timeline, and they are the ones driving
the decision. But we are doing everything we can when
we don't have the authority to make the decisions. We
only have the authority to make the filings. The court,
the text Supreme Court on these out of state courts
are the ones that actually make the decisions.

Yeah, and you say there's been a request for an
expedited ruling on some of these cases. Let me let
me ask you about these states. I know that the
FBI is cooperating as far as trying to find where
these people are in a hole hard they are to
find these seem to be calling a lot of news conferences.
But are you getting any cooperation at all from any
of these blue states as far as trying to extradite

these democrats.

No, I mean that's why they went to democratic states.
I mean, we know where they are for the most part.
I mean it's not like some secret they're not. They're
not hiding. Really, they're in plain sight in most of
these states. It's just that we don't have the jurisdiction
to go arrest them unless we have the participation of
the other states. So I don't I don't think the
FBI has authority to go arrest them because they haven't

commititated federal crime. So that's the problem. So we're that's
where we're in court, the court to honor under the
full State and Credit Clause of our US Constitution. Other
states are supposed to honor the laws of other states,
and that's what we're trying to get these other states
to do. Whether we can get a judge or judges
in these liberal states to actually follow law, well that's

all we can do. We can ask the courts in
those states please follow our laws, just as we would
follow your laws.

The governors basically said, if you want to get paid,
you're going to have to come pick up your paycheck
in person, which is a is a great tactic, I guess,
although the paycheck for a Texas lawmaker is not very high.
But I'm I'm a little bit surprised that the House
itself hasn't been done a few more draconian moves. I've
not heard about any effort yet. Anyway, There's been a
(01:35:46):
threat of taking committee co chairs away from Democrats, but
I don't think it's actually happened.
Speaker 21 (01:35:52):
Yeah, that's I mean, that's completely up the speaker. That's
an inside you know, the House kind of decision that
would be at the Dustin Burrough to make that call.
Craig Abbott couldn't't make that happen. I can't make that happen.
Those those decisions are up to Dustin Burroughs, and I'd
certainly encourage them to start exercising that power over these people,

to put more pressure on them to come back.

Yeah, as far as the ability of the state to
remove them from office, what does what does state law
say about removing a member of the state legislature? What
sort of rules have to be broken in order for
that to happen and to stand up in court?

Well, so this is a you know, and this has
never happened before. We're in uncharged territory. This was an
idea that my office put together in a legal opinion
three years ago, when the four years ago when the
members left for the same reason. So, you know, as
I said, we don't really know how all this works.
We just know that they are applicating their responsibility. We
(01:36:50):
filed against the thirteen members that were the most open
and notorious about their reasons for being gone and put
it out in public so that we would have the
best possible argument the Supreme Court. Hey, these people have
said they're advocating in their own words, Please give us
an opportunity to get legislators in there. That will actually
show up, do their jobs and vote.

Before I let you go, I'd like to ask you
a little bit about your attempt to win the Senate
seat away from John Cornyn in the primary. I know
that you've got a lot of support. You're a true conservative.
I don't think the same thing can be said for
John Cornan, although he's running. I'm sure you've seen the
television ads he's running right now where it makes it
looks like like he sides with Donald Trump on virtually

every issue.

Well, look, that's what I call the fake John Cornyn
that started appearing on April the eighth when I got
into the race. We all know that he didn't like
Donald Trump. He didn't support him in two thousand and six,
said he was an albatross, around twenty sixteen, said he
was an albatross around her neck, and in the last election,
would not support him. Basically insinuated that he had committed crimes,

that this whole Russian hoax was a real thing. He
was inagonistic to Trump on the border wall, did not
want to build a boarderwall, was antagonist to Trump on
many issues, and now suddenly he's a massive support of
Donald Trump. It's all fake, and that he's doing it
because he knows he's way behind. He can't win without

being dishonest about his positions because they don't match. I've
got you know, many many clips that anybody can go
look at on the internet where he has been very
disparaging towards Trump and very disparaging towards many of his policies,
and including you know, joining Joe Biden and restricting the
Second Amendment, which was a big win for Joe Biden

and a loss for Texans. But John Cornyn is more
on that side and making Democrats happy than he is
making us happy.

of money in the bank of the donor money.

Well, we outraised him in my first quarter of fundrais
only in two months. We raised two point nine million.
Max contribution was seven thousand dollars. He raised eight hundred
and three thousand, So outraised him and was four runout
raised every single US senator, a Republican US senator in
the country. I will admit Washington will spend a lot
of money. They have these special committees that I don't

have access to. They have sort of a rigged fundraising system.
So yes, he's going. He's already spent. I think they
said eight million dollars in the last month. But guess what,
he doesn't have anything to talk about other than making
up this stuff about Trump and making up stuff about me.
He doesn't have a record that he can go be
proud of and go tell the voter here's what I

did over the last you know, four decades of my career,
in the last two and a half decades in the Senate,
I do have that record. And I think the voters,
at least in the primary, I know, are smart enough
to see the difference and know when somebody's not telling
them the truth.

So we are joined by Breitbart's Alex Marlow, who has
a brand new book out called Breaking the Law, exposing
the weaponization of America's legal system against Donald Trump. All right,
what's the cure to it? You know, the Supreme Court,
I thought gave some pretty good guidance to the lower
courts about staying in their lane and being very careful
about what it is they're doing. But they don't seem
to be listening to the Supreme Court.
Speaker 29 (01:53:34):
Yeah, it doesn't seem like it. Thanks to me for
having me on. There's a two parts. I'm writing solutions for.
First of all, elected leaders, lawmakers. The first thing you
got to do there is you've got to get these
investigations going. They're just starting. We learned Jack Smith is
under investigation from a special prosecutor. Letitia James is under
investigation from the Department of Justice. We get to expand
(01:53:56):
that never half a dozen, maybe a dozen. I map
out everything the new to be investigated, every leaf that
needs to get turned over. But for the citizens, it's
a call to arms for people to be engaged, people
to be specifically responsible twenty four to seven. Getting more
involved in your community is getting more involved in your
down ticket races and not letting our guard down, not
being mopey, not being dissatisfied. If we don't get everything
(01:54:17):
we want within the first six months of the new administration,
we need to be fired up because the left is
fired up, the lawfare apperatus is fired up, and they're
working right now to try to figure out how to
subvert the next election.
Speaker 4 (01:54:27):
You know, that's a great point to make. The left
is always fired up, the conservatives not so much. You know,
we get fired up right before an election and maybe
right after an election, and then we just kind of,
you know, I want to go to my happy place
for a couple of years.
Speaker 29 (01:54:39):
It is the easiest advice I can offer. It's also
a sobering piece of advice, which is that I do
call us out as a movement for one to check
in every two years, maybe four years, and then we
go back to our families and our churches and our jobs.
And I understand that, but we can't do that anymore
because that's not how they're operating. They're building, they're raising money,
they're building infrastructure, they're trying to infiltrate a new institute
(01:55:00):
to try to take this down, and so we need
to understand that we need to meet that challenge today.
Speaker 4 (01:55:05):
Well, I think Texas might be a perfect example of
what you're talking about with this whole redistricting thing. The
Republicans in the Texas House. We have a speaker who
really is more Rhino than he has anything else. He's
not a true conservative, and they're making all these threats
about punishing these runaway Democrats, but so far, not much
of anything has happened.
Speaker 29 (01:55:26):
And what's interesting is that the voters reward action. They
reward it when you do things, and if you don't
do things, then you're constantly on defense, reacting to the
establishment media, which is another left wing institution, their narratives.
So you're way better off doing stuff. Look at how
Donald Trump operates in DC. It's been very effective for
him and just to try to rack up as many
victories as he can as quickly as he can, and
(01:55:48):
maybe you don't love everyone, but he's already on to
the next thing, and the media can't keep up, and
you're going to find something you like in the group,
and then you look back after a few months and think, wow,
it's a lot of stuff that got done well.

Speaking of President Trump, what do you think of the
I don't want to call the federal takeover of Washington,
d C.
Speaker 2 (01:56:03):
That's not what it is.
Speaker 4 (01:56:04):
But he's obviously wants to get tough on crime and
grime in the capital city. He's clearly fairly embarrassed by
the condition of Washington, d C. And Ford dignitaries coming
here and visitors from our own country going to our
nation's capital. We don't have a lot to be proud
of there right now. What do you think of this
movie he's making. Do you think this will get other
blue cities to react and maybe start taking a chunk
out of trime.

I have no idea, because the left doesn't value law
in order I go do this in the book, it's
not a value that they have. It's not a principle
they have. They would rather have chaos in order to
preserve their own power because it allows for them to
preserve their own power. But what Donald Trump is doing
is terrific. I was a DC resident for a long time.
When I got there about I said, about twelve years ago,
it was a vibrant city. It was fun, it was exciting,

it was beautiful. And when I laughed around the coronavirus time,
it was all boarded up and homelessness and crime and
the broken windows. It was terrible. The city totally deteriorated.
And Trump is saying no more, We're putting a stop
