of several burglaries over the past few years, and she

and neighbor's yards for evidence, and while many on this
street still aren't sure what led to that shooting, most
agree it's ultimately tragic.

leading to a homicide investigation by the Sacramento Sheriff's Office.

That property manager fired a fatal shot at an alleged
intruder while his grandchildren were with him. Your reporter covering
Sacramento County Tory Alpadaca spoke with that man about how
it all happened.

Tory Steve, that seventy year old property manager, says that
he pulled the trigger to protect his family. No one
is in custody right now for that deadly shooting, but
the Sheriff's office here believing that that property manager acted
within the law. At this point in the investigation, time

he shot and killed an intruder who broke into his
Rancho Cordova motorcycle parts shop in the middle of the night.
He says he also lives in a room behind the shop.

front part of the shop and then was trying to
bust through the door to the living quarters, where Robert
was sleeping with his fourteen year old and four year

Chevron parking lot.

the safety of themselves and their children.

Local attorney Justin Ward, unrelated to the case, says Robert's
actions will likely be justified because the law doesn't require
him to know the intention of the burglar.

Boys from Rochester continued to investigate a weekend shooting that
left a man dead. Officer stated twenty eight year old
man was with a gunshot wound early Sunday and tried
to save him, but he died at the scene. Investigators
say the person who called nine on one reporter he
had shot a man who entered his house and assaulted him.
The homeowner was taken into custody and later released.

Chris, Well, it's not clear at this point really what
led up to this shooting in Lantana last night. We
do know that the homeowner both suspects fired weapons and
that both suspects were shot.

One of them is dead.

Take a look at the scene last night, this shooting
happening just after eight point thirty on Hibiscus Tree Drive
in Lantana, that is east of I ninety five. PbSO
says when the homeowner found the two suspects in the home,
there was an altercation and both suspects were shot again.
One died, the other sent to a local hospital. Is
not clear what that suspects condition is at this time.

intruder breaking into his home. Seven News reporter Jacqueline Allen
looks into how Colorado's law gives homeowners more leeway than
it does in other states.

The Colorado law really goes far in granting immunity to
people who kill intruders.

Unlike other states, in Colorado, you don't have to be
in fear of death or even give a warning. In fact,

out of Boulder, prosecutors said, see you student Zoe Ripple
was drunk and stumbled into the wrong home, ignoring the
homeowner's warning. The homeowner shot her in the hip and
was not charged.

As belated, but we now know the suspect shot and
killed by police today. Was first spotted on the property
trying to cut down a tree before making his way
inside the facility and an attempt to attack residence with
a chainsaw.

In a Sunday release, the Saint Charles Police Department says
just before nine am, witnesses reported a shirtless man holding
a chainsaw and attempting to cut down a tree on
the property. The suspect then entered the lobby and began
confronting residents with the chainsaw. The release goes on to
say arriving officers attempted to de escalate the situation, but
the suspect containing his attempts of using the chainsaw against

residents of the building and the officers. A taser was
used on but the suspect continued his attack.

Charles Police go on to say an officer was then
quote forced to fire his service weapon, striking the suspect.
They say first aid was immediately rendered. However, the suspect
was pronounced deceased at an area hospital.

I'm supposed to do a job from one of the residents,
and I called the resident and it took her about
an hour to even get in and get cleared, and
they brought her in through a maintenance garage entry.

People visiting the facility on overa what happened were turned away.
A spokesperson for the facility says they are both working
with law enforcement and the process of reaching out to
family members of residence to inform them of the investigation,
telling WGN, we are deeply grateful for the swift action
of our team and law enforcement. We want to emphasize
that our community is secure and all residents and staff

members are safe. Police say residents and officers were treated
for minor injuries. The suspect's identity is not being released
at this time until next of kin has been noted.
Per policy, Illinois State Police will be investigating the officer
involved shooting.

the jury in Manhattan in the Daniel Penny case has
been asking you a lot of questions. They've been they've
been deliberating for far too long. And we have some

Lord, We are on verdict watch in the New York
City criminal trial of marine veteran Daniel Penney. The jury
just sent a note to the judge. They are deadlocked
on the first count in this case, this is manslaughter
in the second degree. See be cotton at the courthouse
in New York City. Seebe tell us what you.

Know, Hi, Dagan. That's right. The jury just passed a
note to the judge saying it's unable to reach a
unanimous decision on the most serious charge in this case,
second degree manslaughter. The judge said in the courtroom that
he thinks he now needs to instruct the jury on
an atlan charge, which is essentially telling the jury you

need to go back into the deliberations room, talk more,
consider the viewpoints of other jurors and try to reach
a consensus. At that point of the jury comes back
again and still does not have a unanimous decision. The
judge would then have to declare a mistrial. But of
course we know if there is a conviction on this
most serious charge, there are high stakes for Daniel Penny,

who would face up to fifteen years in prison. But
so far the jury says it's not able to reach
a unanimous consensus on that charge. We know all eyes
are on this case across the country. It's really initiated
a lot of conversations across the country, conversations on race,
policing and the criminal justice system. Jurors have asked to

review lots of key evidence so far in the case,
to include the video evidence of the choke hold, the
twenty five minute TAKEE interview Daniel Penny had with police,
said the precinct when he waived his Miranda rights to
answer detective's questions, he didn't know Neei had died at
the time. The jury also wanted to see yesterday a

one minute clip of the choke hold that was captured
by a high schooler who was on the subway that day.
They also wanted the definitions of recklessness and negligence read
back from the judge. So a lot more to watch
here at the courthouse for sher Dagan.

But the second, let me back up and Alan charge,
you would think the judge would wait to read what
they also referred to as a dynamite charge if the
jury was deadlocked on both of these charges.

So, based on the note I'm getting from the courtroom, Dagan,
a judge is telling both the prosecution and the defense
that he doesn't believe he can instruct the jury to
deliberate on the second charge because they don't have a
unanimous decision on the most serious charge, second to great manslaughter.
So to my understanding, right now in the courtroom, he's

trying to figure out what to do next now that
yourors can't reach that consensus on the first charge.

Speaker 19 (21:00):
It's interesting, So there had been eight notes that had
come out to so far as of this morning before
the jury reconvened at ten am and Lower Manhattan Tour
about scheduling. But they definitely seem and please correct me
if I'm wrong, seemed to be looking into what was

(21:20):
the judgment of the corner about the cause of death,
because that was evidence that was really pushed by the
defense about was it definitively the chokehold that caused the
death versus what about the drugs that were in the system,
about pre existing conditions like sickle cell disease or great diggan.

Speaker 21 (21:45):
So, jurors wanted to rehear portions of medical examiner doctor
Cynthia Harris's cross examination when she talked about issuing a
second death certificate for Neelie. She testified during the trial
that she issued that death certificate ruling Jordan Neely's death
choke hold without toxicology results, and she said during the

trial that toxicology results wouldn't have changed her mind, and
she said that the results could have come back with
sentinel and her decision was confirmed on the basis of
what she saw in that widely circulated video showing Penny
restraining Neely. So jurors were particularly interested in that portion

(22:27):
of her cross examination where she talked about issuing the
cause of death without the toxicology results. And I've been
talking to a lot of legal experts about this case, Russ.
This is particularly interesting.

Speaker 3 (22:39):
We feel. What make sure you understand is when you
have a hung jury, when they say they can't reach
a verdict, it could be one person. And so when
you hear that they're wanting to rehear the testimony or
have the testimony re read to them about, for example,
the medical examiner and how she would not change her opinion,

that doesn't necessarily mean that there is one holdout to
either convict or equip. It could be that whichever side
they're on, the other side is just trying to say, well, now,
let's go back and listen to this again. So we
don't know whether it's one person holding out for an

(23:22):
acquittal or it's one person holding out to convict. I
would like to be believe if we're going to be,
if we're going to be in this position, that it's
one person holding out to convict and the other eleven
are like, are you kidding us, Let's go back and
listen to this stuff again. And if you listen to
this stuff again, clearly if you remember they wanted the

(23:43):
one the sixty second clip of the teenager that took him,
that took the video of Daniel Penny holding Neely in
that holding him around the neck. Well, that could be
that could run either direction. The one juror who thinks
that that was that's the key that that proves beyond
reasonable doubt that he committed manslaughter. That could be the

(24:06):
evidence that they want to see to convict the others
the other eleven, or it could be the opposite direction.
So don't read a lot into this. It just means
that they can't reach you and a mm's agreement. Now,
the judge does have a difficult question here if they
come back they hadn't even gotten to the second charge,
the lesser charge, because if they reach an agreement on

the first charge that he is not guilty, then it
stands to reason he's not gonna be guilty on the
second charge. So the fact that if they have returned
or told the judge they cannot reach a verdict on
the most serious manslaughter charge puts him for what's called
this Allen charge and Allen charges where you tell the
jury you've got to go back, you need to take

(24:50):
into consider it. There's a whole litany of things. If
they have to instruct the jury, you need to go back,
if you you know, depending on which side you're on,
you need to take into consideration the views of the
other jurors. You need to listen and consider those and
everyone and everybody in the jury room needs to do that,
and you need to rethink where you are. In other words,

(25:12):
try again. And it's almost like dad sending the kids
back into the bedroom. See if you can't find some
common ground, See if you can't figure out a way
to work this out. One last effort to see if
they can't reach a unanimous verdict. That's difficult to do
when they have no idea where they are on the

(25:32):
second charge. My guess is they date the jurors themselves,
the jurors, depending on the foreman, probably saying, you know,
let's deal with this serious charge first and see where
we are. And if they've been deliberating for several days
and can't reach a decision on the most serious charge,
they probably even gotten the second one. So I'm not
quite sure. If I were the judge, I would probably well,

(25:57):
I can't say I can say what I would do
because because it's me, I declare a mistrial and force
the DA to make a decision whether or not to
file charges again. And and of course I'm afraid the
DA will in this case, because this is no longer
about whether he committed a crime or not. This is
about so called social justice. And because you have a

(26:19):
white guy that is alleged to have killed a black
guy and now the family is suing for wrongful death.
Oh my gosh. Well, so if you've got a progressive prosecutor,
of course they're going to refile charges. If that's my logic,
then maybe I would send them back in with an
Allen charge and I would tell him to try again,

(26:42):
even though I run the risk that maybe I'm pushing
the jury toward a conviction when I as the judge,
although the judge could rarely happens, but the judge could
direct a verdict based on everything I've heard, I'm going
to dismiss the charges or Daniel Penny. And in the

(27:04):
midst of taxpayer relief shots, well we're talking about I mean,
we've reached the stage in this country based on some
of these prosecutions where you can no longer defend yourself
where you can't defend others, Which makes me more adamant
about continuing to do tax not that anybody's trying to
stop me from doing taxpayer relief shots. It makes me

more determined that you're gonna hear these stories every single week,
because we need to remember that in this country, in fact,
not just in this country, but I think humanity in
general has a right to defend themselves and others from harm.
And to get away from that and to focus on
social justice shows what an abomination our judicial system has become.

you probably shouldn't do that in Polk County because the
people of Polk County like guns.

They have guns.

I encourage them to own guns, and they're going to
be in their homes tonight with their guns loaded.

And if you try to.

Break into their homes to steal to set fires, I'm
highly recommending they blow you back out of the house
with their guns.

However, it turns the tables on his accused attackers, leaving
two people with gunshot wounds. Memphis police tell us the
turn of events happened during an attempted robbery at a
Parkway Village hotel. Wrig's Alan Self brings us the latest
in the case.

Speaker 11 (29:57):
Tonight, Geff's Police Safe Morning, a man and woman were
both shot by the man they tried to rob. Investigators
say the incident unfolded at this classic in on American
Way around six A crime this guest that the hotel
says happens far too often.

Speaker 12 (30:13):

According to police, the victim met the female suspect at
the hotel and was lured to the back of the building.
That's when she pulled out a gun and domnic the
victim's belongings. A second suspect appeared, also with a gun then,
and a surprising to us, a loud noise distracted the
two suspects, and the victim menaced to snatch the gun
from the female suspect and began to fire. The bullets
hit both the man and woman. The victim then took

off running, but was not physically injured. One woman staying
at the hotel wished to remain anonymous, but expressed fear
after hearing about the incident.

The male suspect was shot multiple times and is in
critical condition. The female suspect was shot in the arm
and is being treated at Regional One, and a record
we obtained police wrote they believe one of the suspects
was connected to another report they've recently taken. Officers also
noted surveillance cameras at the hotel and nearby businesses, which
hopefully can provide more insight into what unfolded Friday morning.

that's being robbed, I think in somewhere in Louisiana, and
the well, I don't know what this story says, but
the one that I saw, the gunmen are kind of,
you know, trashing around the convenience store, and then they

reach for the register. They knock the clerk down, and
then they turn their back on him and they go
around the counter to start stealing more stuff. And you
can see him kind of reaching down to get his pistol,
and then he stands up and leans over and just,
I mean just blows them away.

Speaker 29 (32:46):
You at this hour shocking video of an exchange of
gunfire between a store clerk and an armed robbery suspect.
According to New Orleans Police, one of the suspects. A
juvenile was killed during a shootout. Paul Murphy joins us
Now from Sam's meat Market in New Orleans East with
the story.

Speaker 27 (33:02):
Paul Wells, I spoke with the store manager a short
time ago, and he told me that his staff is
pretty upset by the shooting. It happened just before eight
o'clock last night on the IT service Road off of
Prouder Boulevard, and that manager did share some security video

(33:22):
with us of the shooting. It shows two young people
enter Sam's meat Market with guns. The manager said all
of the gunmen would say was cash, cash.

Speaker 30 (33:33):
Cash.

Speaker 27 (33:34):
You can see one of the arm robbery suspects pointing
a weapon with an extended clip at a clerk working
a phone counter. At one point, the clerk grabs his
own gun and shoots at the suspects. One of them,
described as a juvenile, was killed in the shooting. In
the video, you see the suspects still moving on the
floor when the clerk returns and fires again. The other suspect,

(33:59):
identified by police as eighteen year old Tioni Juaruez, was
shot once.

Speaker 31 (34:08):
We was like just normally they working and there's two
guys come in from out of nowhere, no car, who
was just walking and like you see in a video,
they came in. They put the gun in the cashier face,
another gun and the phone guy. They took all the
money that we already had working all day for and

(34:30):
they took some phones and duhy. They was feeling dangerous.
So that's why they started shooting, and for our safety,
protecting ourselves. That's why what has happened has just happened.

Speaker 27 (34:49):
The police initially classified the crime as an arm robbery
by shooting, but it was later reclassified as a homicide
with an arm robbery after further investigat So far, the
store clerk has not been charged with any crimes. We're
alive in New Orleans, East pal Murphy WWL, Louisiana.

Speaker 3 (35:09):
And if you see the video, there's no way in
hell that the store clerk should be charged because they
clearly threatened him with a gun so intent to kill,
and then they shoving down. Now, they do walk around
the counter, but so what, you still have a fear
for your life because if you move, they're going to
blow you away. This is a great example of FAFO.

(35:30):
Absolutely a DUI suspect.

Speaker 32 (35:33):
Arch police presence near the fifty seven Freeway in Brail
last night after a shooting involving officers unfolded near the
on ramp. Police were given a tip for a possible
DUI driver near Lambert and the fifty seven just before five.
Officers later found this Ford bronco up against a retaining
wall in the area at some point a shooting unfolded.
Police say the man was taken to the hospital where

he died. It's still not clear what led to the shooting.
Lanes on the fifty seven are not impacted for you
commute this morning, but you should avoid the Lambert on
and off ramp.

We're also learning more about a man shot and killed
by police this morning at the Bellmar shopping district in Lakewood,
passing their South Bank Street and West Alaska Drive. That
is where we begin our coverage for you tonight. You're

shopping district in Karen. You're learning more about what happened.

Yeah, Michael, and this all unfolded early this morning at
about three point thirty am, long before any of these
stores were opened, but police were on scene throughout most
of the morning collecting evidence. After this deadly shooting. Early
Monday morning, Lakewood police were called to an empty Bellmar
shopping center. Security there had reported an unwanted party. Officers

contacted that suspect behind the Best Buy store for The
interaction quickly escalated when.

Speaker 30 (36:59):
Liquid police attempted to talk to the suspect. The suspect
first began to walk away and then pulled a gun
on our agents.

Speaker 33 (37:07):
Blake with Police spokes first in John Romero says agents
ordered that suspect to drop the weapon before two of
their agents opened fire.

The suspect did point a gun at our police. That
is when our agents fired at the suspect.
