Memphis as it relates to the Tyree Nichols case. In

been fired and brought up on charges and one count
of second degree murder, all charged with one count of
second degree murder, aggravated assault acting in concert, and two
accounts of aggravated kidnapping, two accounts of official misconduct, one

account of official oppression. According to to court records that
we now have available to us, it is uh. It's
it's getting a little scary in terms of what people
are out there saying, UM, let me play for you,
and every single person that has weighed in on having

seen this videotape, the verdict is unanimous. What we're about
to see in less than four hours as a country
is going to be an unconscionable beating of this young
man by five police officers. The police chief, the Memphis
Police chief um herself says that the vact, the acts

here defy humanity, a complete disregard for life, and much more.
Listen Sunday mornings. When you first saw the video, that's
absolute right. And then when you saw it, what was
your reaction? Um? I was. I was outraged. I was
it was incomprehensible to me, it was unconscionable, and I

felt that I needed to do something and do something quickly.
I don't think I've witnessed anything of that nature in
my entire career. Really, really that bad, that bad. What
are we going to see then? Um, You're going to
see acts that defy humanity. You're going to see a

disregard for life, duty of care that we're all sworn to,
and a level of physical interaction that is above and
beyond what is required in law enforcement. Wow, pretty powerful

words from the Memphis Police Chief. Again, the officers have
all been fired, there are five of them. It turns out,
I know race always comes up in cases like this,
it's shouldn't. And actually this was addressed too by the
Memphis police chief, who I think rightly said and was

correct in saying that this show's law enforcement issues aren't
about race, but bias is on the table. Was her
specific comments. The district attorney in a press conference called
the second degree murder a knowing killing, in other words, intentional.
He died January tenth. I don't know how many of

(03:28):
you have seen the video of him in a hospital bed.
I mean it is. It will shock the conscience and
the soul. If it doesn't shock you, you don't have
a conscience or a soul. And there's nothing that warranted this.
This was not an armed individual. You had five police
officers against one individual that was incapable of defending himself

(03:52):
in any way. That and nobody even alleged that he
had a weapon at any point. The officers pulled over
Tyree Nichols around eight thirty pm. Confrontation apparently ensued he
was asking why he was being pulled over. He eventually
felt threatened ran away. Okay, let's say he ran away
for whatever reason. It doesn't matter. It doesn't give you

a right to beat this guy. You don't become judge, jury,
and executioner. I'm still sticking with I have not seen
the tape. I am just I am very, very very
troubled by the admonition, the warnings, the adjectives used by
everybody that has seen it. There is one hundred percent

agreement with the Memphis Police Chief in terms of the
analysis of this tape that it is that bad. So
my gut, my instincts tell me, oh, you better brace
yourself here anyway. So it's pulled over about eight thirty
and officers said another confrontation happened at that point, but
he had already at that point been detained. According to

the timeline that I'm looking at, it was after this
the police say that Nichols contained had shortness of breath,
was later taken to Saint Francis Hospital and critical condition.
You could see the condition he was in when you
get the images from the hospital bed. His attorney, Ben
Crump Showed said the video showed that Nichols was shocked,

(05:20):
pepper sprayed, restrained when he was pulled off pulled over
for a traffic stop. Preliminary report of Crump's independent forensic
pathologists said Nichols suffered extensive bleeding caused by a severe beating.
The family attorney said Nichols was kicked and was the
subject of multiple uses of force during what is he

(05:42):
called an unadulterated beating for three straight minutes. Memphis Police
Chief as I Said said the other officers are under
investigations for violations of department policy. The DA in Memphis
told the news conference, although the officers each played different
roles in the killing, there all responsible. The director of
the Tennessee Bureau of Investigation said during the news conference

that he saw the video found it absolutely appalling. Let
me be clear, what happened here does not at all
reflect proper policing. This was wrong. This was criminal. Second
degree murder is punishable by fifteen to sixty years in
prison under Tennessee law. One of the officers was accused

(06:26):
previously of using excessive force, and he was named as
a defendant in the twenty sixteen federal civil law rights
lawsuit will employed by the Shelby County Division of Corrections.
So that's where we find ourselves now. Now, I do
have some questions who thought this was a really good
idea to release this tape on a Friday night. That

(06:48):
doesn't make any sense to me. I would have released
it on a Monday morning when people are not off
for the weekend. Not if it's as bad as they're saying,
why would you release it at seven pm Eastern on
a Friday night. And we'll be covering this at nine
eastern tonight on Hannity. Anyway, the officers have been charged

(07:13):
with what officials other officials called to Hayne's beating in
the case of Tyree Nichols after this traffic stop, and
this bodycam video is expected to be shown, as I said,
in less than four hours, and law enforcement nationwide all
across the country are preparing for potential civil unrest tonight.

In Atlanta. In Georgia, Governor Kempish at a state of
emergency and has activated the National Guard. This in light
of what had happened a couple of weekends ago, the
weekend violence in Atlanta. The order calls for up to
one thousand Georgia National Guard troops to be called up
to subdue any riot or unlawful assembly. If you're looking

at for some of the media coverage of this and
predictions about this, The New York Times is reporting this
afternoon that law enforcement nationwide is preparing for trouble tonight.
A reach specifically from The Times. Police officials around the
country said they're watching the situation. Spokespeople for the police
departments in Philadelphia, DC said they had ample staffing on

hand for any protests or demonstrations that may follow the
video's release. In Texas, police and city officials in Dallas,
Austin San Antonio said that they were aware of the
imminent release of the video have not taken any special steps.
In New York City, the Police Department said in a
statement that officials were preparing for the possibility of protests.

(08:38):
The department has examined, adapted adjusted our response to protest
and is prepared to protect the constitutional right to peaceful
protests and works to ensure public safety for every New
Yorker exercising their First Amendment rights. That is all one big,
fat lie. Because of defunding, dismantling no bail laws in
New York, nobody in New York is safe any more.

Back to Washington, d C. The DC Metropolitan Police Department
is fully activated all sworn personnel in order to prepare
for the possible protests over this tape when it's released
down in less than four hours, all four thousand officers
in DC will be on duty for twelve hours shifts
ahead of any First Amendment activities in DC will remain

on those shifts until the activation protocol is lifted. I
don't know what First Amendment activities mean. The police are
being called out to protect the First Amendment. No, they're
being called out to protect against potential violence. Can you
just you say something for what it is. That's why
they're there, That's why they're being called up. And by
the way, I think it's the right decision down that

the US Capitol crews are preparing to set up fencing, etc.
Metropolitan Police Department said they respect the communities right to
demonstrate peacefully protest, but police will not tolerate any unlawful
behavior during the demonstrations. Police say they will take swift,
swift action against anyone breaking the law. So we've got
all of that, Um, we'll watch that now. We did

play the police bodycam audio and then I'll explain and
give you my thoughts on it. On the other side,

What are the gentleman? Uh here just waiting my way
to come back? Two twenty three, just when herst come back?

I guess left to wait? Okay, do you need police, fire,

a medical for anything? Eight seconds? Uh, I don't think so.
I don't think so. Zero two twenty three and eight seconds,
um the Capitol police around two twenty. No, my wife,

they're usually here, they're usually here a thousand protecting my wife. No,
that's Friday, eight twenty two. Okay, well seconds, Uh let

me let me step in here because I want to
give some context and not let you hear this. So
what you have, and it's very apparent in the nine
one one call is that the the person that is
about to assault Paul Pelosi is standing right next to him.
Later in this nine one one call, he id advise himself.

So he's he's kind of like a hostage calling nine
one one, and he can't say exactly. He's dropping as
many hits hints as he can. Um. Yeah, this gentleman's
waiting for my wife, Nancy Pelosi to come home. You
would have thought that maybe San Francisco Police, second in
line for the presidency, that they would have any call
from that home coming from that home or that address

to say, oh, this is this is serious. Although I
don't criticize the dispatcher because even though this was an
odd call, in the end she sent police. They were there,
according to most reports, within two minutes. And he said,
he asks the Capitol Police around, they're usually here at
the house, protecting my home, my wife, and that one

seemed to go over. The operator said, no, this this
is San Francisco Police is like, I understand that. Um,
I don't know. What do you think? And here's the guy.
You can hear in the background. So again, this guy's
got a hammer. He's trying to call nine one one.
He speaking in code, calls back. If you change your mind,
a lady says, and she said, he says, no, this

this gentleman just came into the house. He wants to
wait for my wife to come home. Do you know
who the person is? No, I don't know who the
person is. He's telling me not to do anything. What's
your address? He gives his address again, he says, my
name is Paul Pelosi. Anyway, this gentleman he's telling me
to put the phone down and just do what he says. Okay,
what's the gentleman's name. I don't know. And then the

guy jumps in and you can hear him. My name's David.
That Pelosi. The name's David. Okay, who's David Pelosi? Says,
I don't know. What's that? He says, Well, I'm a
friend of theirs, he says. He says, he's a friend.
And then the operator has but you don't know who
he is, No, ma'am, I don't. He's telling me that
I'm being very leading, So I got to stop talking

to you and I can stay on the phone with
you if everything is okay. Anyway, to the credit of
the operator, she did send the police. They were there
within two minutes. On the other side, we'll get to
all of these tapes in full and and we'll tell
you more about it. You know where. Now look, three
hours and forty minutes away from the release of the
Memphis tape if they do it on time. First, I

this Memphis tape comes out. UH New York Times pointing
out cities all across the country are bracing for potential
unrest tonight. I don't thinking it any more descriptive than
the Memphis police chief is in the Tyree Nichols case

saying that this video has acts that defy humanity with
a complete and total disregard for life. And it's it's
it couldn't be any more clear. Everybody that has seen
the video pretty much is saying the same thing. So anyway,
a lot of preparations for tonight around the country going on.

The tape will be released, will be on Hannity our
usual time, nine Eastern, following that story and hoping that
that doesn't that there is not unrest in any city,
in any place around the country, that people protest, that
it will be peaceful. You know, if there is violence
or rioting, we will identify it as it is because

as many people that won't, which is unfathomable to me.

Eastern and God only knows what will be going on
at nine eastern tonight when I get on TV. But
so the Paul Pelosi take comes out today, let me
just describe the scene now, just a matter of course.
I just want to remind people a lot of the

reporting on this became confusing. A lot of it turned
out not to be true. It didn't make sense. For example,
reports came out that said, oh, Paul Pelosi answered the
door and say don't come on in, he's down the hall.
It wasn't down the hall. When Paul Pelosi opens the door,
the assailant is there with a hammer in his hand. End. Now,

when Paul Pelosi makes his nine one one call, it
is obvious that somebody is there and he's not free.
He's not able to speak freely. In that situation, you
could arguably say he's a hostage. A guy's not holding
a gun to his head, but he's holding a hammer
that he's about to put into his head, which eventually

did happen. So he's being very careful on the phone,
but he's doing everything in his power to tell this
nine one one operator, who understandably doesn't quite get exactly
what's going on here, she got it enough to get
the police out there. In two less than three minutes
and two minutes and some odd seconds, So you got

to give her a lot of credit. In the end,
she probably saved this guy's life. The cops saved this
guy's life. And remember the reports that, well, he was
going to stay as long as it took till Nancy
got home, and then based on her answers, he would
decide if he was going to use the hammer on
her or not. One question that I do have, and
I it frustrates me, is you know, every speaker, you

are second in line. It's the president. If anything happens
to the president, the vice president becomes president. That anything
happens to the vice president, the Speaker of the House
becomes president. That you know, second you know in line
if something ever happens, God forbid to a president. So
why they don't have full time security at this house,
I don't know. We pay a fortune when she was

Speaker of the House. We paid a fortune for Nancy
Pelosi to take a private jet, and I think it
was appropriate myself. You can't have a Speaker of the
House second in line of the presidency saying Okay, here's
my ticket to San Francisco waiting somewhere in a terminal somewhere.
That's not a really safe place. I don't even particularly

think it's safe for even senators. We've seen senators harassed,
people like Ted Cruz even meant Romney and Lindsay Grant
doesn't matter what your politics are, is what strated me
about the January sixth Commission. Sure, okay, you kick off
Jim Banks, you kick off Jim Jordan. Fine, you politicize it,
you get it, all your digs against Donald Trump. But
one thing they didn't do. They never talked to the

Sergeant at arms. They never talked to Speaker Pelosi. They
never talked to the Capitol Police chief. They never asked
the Mayor of DC to explain why, in writing she
rejected the National Guard. They never They never asked for
their emails, their text messages, they never asked for their
phone records, none of that. And at the end of

the day, sure they got their pound of flesh with
Donald Trump. What have they done to make the capital safer? Nothing?
Because they didn't never focused on it. And if you
don't want something like that ever happened again, and I don't.
We've got to protect our elected officials. We got to
protect our institutions. By the way, that's our house, the
people's house. And if I had my way, I the

way they protect the White House is the way I
would be protecting the Capitol. You create a perimeter, and
you have those big cement blocks of cars can't be drawn.
You have a big old fence. You can make it
nice to one of the White houses. What do you

It made it looks nice. Joe's building a wall at

his house, Joe Biden, your president. But you've got to
protect them. Just a fact anyway. So these are the conditions.
So Paul Pelosi, and you'll hear towards the end that
the guy it's obviously he's on speaker phone. You hear
his voice describing himself. Now, notice during this one call

he mentions, Yeah, he's waiting for my wife to come
back Nancy Pelosi, hoping that that triggers in the operator's mind.
It did not. It didn't seem to anyway. Or you
would think that the police department, having the speaker in
their district, might have that address or that name flagged

of if it's ever mentioned in all and operators informed
about it, but that's a separate issue. Then he talks
about the lady asked he needed police, fire, medical, anything.
He answers, um, I don't think so, that's an odd answer. Again,
he's trying to talk. The guys right next to him
with a hammer about the clap him in the head.

Then he says, the capitol police around, they're usually here
at my house protecting my wife. That was a big sign.
And she said, no, this is the San Francisco Police Department.
I'm not being critical because she acted. She picked up
in the course of this call. Something was odd. Pelosi
then says, okay, well, um, I don't know what what

do you think? Then you can hear this other guy
in the background. Then Pelosi he says, he says, everything's good.
I've got a problem. But he says everything's good. He's
trying to telegraph get over here now. Hard to do,
hard to interpret. Again, no criticism of the operator at all.
No the sisdom of Paul Pelosi. He's a victim here.

It was obvious in this entire thing that he was
a complete victim. And in my view, this guy broke
into his house. You have surveillance video we'll show you tonight,
him pounding with his hammer the back door of their home.
That was prior to him actually getting into the home.
But anyway, so he says everything good, is good, but

I've got a problem. But he says everything's good, and
then the operator says, Okay, call us back if you
change your mind. At that point I said, oh, she's
not getting it, but he goes on, no, no, no,
this this gentleman just came into my house and he
wants to wait here for my wife to go home.
So anyways, then she asked the right question, do you
know this guy is? Do you know this person's No,

I don't know who this person is. He's telling me
not to do anything. Then she asked for the address.
From the minute that address comes in, I can tell
you that phone call was made to the police. Good
for her, so she really, you know, it's they get
old sorts of calls and all the time at nine
one one centers, and you don't you know, you get
lunatics calling all the time too, So sometimes you're just

not sure. What is your name? My name is Paul Pelosi. Anyway,
this gentleman, he's telling me to put the phone down,
and just do what he said. Okay, okay, what's the
gentleman's name? I don't know. Then the guy steps in
and he says, my name's David. He Pelosi goes, the
name's David, and the operator said, okay, and who is

David Pelosi? Paul Pelosi's I don't know what's that. Then
the guy with the hammer goes, I'm a friend of theirs.
He Pelosi says. He says he's a friend. Operator says,
but you don't know who he is. No, ma'am you know, bingo,
she's on it now. And then Pelosi says, he's telling

me I'm being very leading, so I gotta stop talking
to you. Operator. Okay, are you sure I can stay
on the phone with you to make sure everything's okay
this point, the police have been notified. I can tell
you knowing how a nine one one operations work anyway,
and he wants me to get the hell off the phone. Okay, operate, Okay,
thank you, bye. This is the nine one one call.

I guess three seconds, San Francisco Police, do you need help? Oh?
What are the gentlemen. Uh here just raising my wife

for a day? So I guess left to wait. Okay,
do you need police fire a medical for any day?

right thing. Then the police show up two minutes later,
and when they opened the door, the guy's right next
to Paul Pelosi. You know that wasn't the way it
had been report. Remember they said, oh, come on, and
he's down. He's over here down the No, he's right
next to him with the hammer in his hand. Listen

to what happens? Hi, how are you doing? What's going on? Man?
All right? Dropped the hammer? Hey? What is going on?

Every four? Ever? Send back up the three? Pretty scary.
The police you know. So all of a sudden they
had put down the hammer, and he said nope, and
then he attacked, immediately started flating. He took that hammer

and went right for Pelosi's head. Police were actually pretty
quick and amazing. Um what you know. It just goes
to show you when reports come out, there always could
be wrong, and he was a victim in this case.
Now separate and apart. You never blame a victim. He
had no idea, he doesn't know how to defend himself.

He was a victim here. And it's not political. I
just hope that. I asked people on the left all
the time, what are you going to do? God forbid somebody,
please for all of you. Always anticipate the worst, because
there's a lot of evil people in this world. If
we haven't learned that in the last year, last years,

so many people nuts absolutely raving mad and he's thank god,
he's okay. Those police officers were amazing, They got there
so fast. Lady was amazing. Pelosi did everything you could
possibly do, and in the end that he turned out,
he's okay. Thank god. I don't like to see people hurt,
innocent people hurt by crazy people. I just don't. All right,
