if you don't mind, I know our own questions and
uh so we're coming up on a pivotal moment because
the defense is about ready to present its case, right
or did they start yesterday?
Speaker 2 (23:09):
They have not started yet, so they are the kalm
walth Is on their final witness that stuck to Judson Welcher.
He's cross examination, he's had a lot of time, yes,
and he's like maybe tomorrow again. Attorney Lessie said, at
the end of the day, I don't know if you
if anybody caught it. At the end of the day,
when the judge asked how much longer, he said, you know,
I'm about halfway through. And it sounds like based on
(23:33):
what he said, that we might go into Friday.
Speaker 7 (23:34):
And there it's only a half day today. It's only
a half day today. Why would happen There's a juror
that has an appointment, that's correct.
Speaker 2 (23:40):
And they try to accommodate if possible.
Speaker 4 (23:42):
Yeah, okay, So here's my opening question, counselor uh So,
the defense getting set to present its case, do you
think there's any possibility that they might be sitting on
something big, this is going to break this case wide open.
Speaker 2 (24:00):
I think that's unlikely. It's interesting to see we don't
know what the defense is going to present this time.
There was a little bit of an inkland some of
the filings earlier this week about they supplemented the defense
supplemented their list, so it is an indication that they
might not call Trooper Procta. The question really now is
do they present the case really against sort of what
(24:21):
the kom Wealth has presented. So we're talking about different experts,
you know, attacking sort of the brick as we talk
about that the commas trying to build, or do they
go with this alternate theory, the third party theory and
the planting. So that's that's one to be watched.
Speaker 4 (24:35):
And is anybody going to believe anything Procter says anyway
at this point?
Speaker 2 (24:39):
You know, I mean, that's an interesting question. From what
we've heard from the jury the first time, is that
they really took that he was not a good person,
that they were disgusted by the text, but it didn't
seem to really affect substantively how they viewed the evidence,
and it's it seems like he's likely not to be
called at all this time. So it's it's a tactic,
(25:01):
but it's almost more helpful for the defense to be
able to point the finger at sort of this boogeyman
of Michael Proctor and say, like, look at the Kamal
didn't even call the lead investigator instead of putting him
on and potentially the Komals rehabilitating him.
Speaker 7 (25:14):
Can we go back to this guy Welcher for a second, Judson, Yes, okay,
So how impactful was the paint exercise that they presented
to the jury with the transfer from the tail light
to the arm.
Speaker 2 (25:26):
I mean, it's it's helpful. I think the overall I
don't know if that specific piece in and of itself
was you know, this smoking gun. Again, anytime we have
an expert who's looking at the facts of the case
and the evidence that they have it and they're coming
to an opinion, what the jury is doing is looking at, Okay,
(25:47):
is this person reliable? Are they credible in their field?
Should we you know, what weight should we give this?
There's a lot of discussion about you know that he
wore similar to John o'keith's clothes. This paint on his arm,
I mean, I I think it shows the sort of
general idea of where he could have been hit. But again,
nobody can say for sure what exactly happened.
Speaker 7 (26:07):
But I thought the visualization of it was impactful.
Speaker 2 (26:10):
It wasn't because in one of the questions that was
asked towards the end, I believe by Attorney Brennan, was
about whether the paint went on the underside of the arm,
and it didn't and it was only on the top.
So it's the first sort of visual representation that we've
had at all in the case about what the kom
wealth actually things happened.
Speaker 4 (26:27):
Now I'm no expert, but I'm looking at those cuts
on the arm. I don't think those cuts can be
caused by a bump from a car.
Speaker 2 (26:34):
Like there were lacerations, right, So what his testimony was
that they were basically lacerations from not just the bump,
but from the brake, so that the if there was
a clipping or you know, bumping, that that caused the
break and then the brake caused the lacerations. In the
arms as mister O'Keefe was sort of being pushed away.
Speaker 7 (26:54):
And I loved how they basically said that he can
say that, based on what he's viewed, that a car
similar to Karen Reid's Lexus could have done this, But
you can't say that Karen Reid did this.
Speaker 2 (27:07):
Right, because that's really a conclusion of fact. Just because
he did say on the stand, you know, this is
what happened. He can't say that, but he can say
it basically exactly what you said. Is close to possible
that a vehicle of the same make and model as
Karen Reid's could have caused these injuries. And I believe
that they did cause.
Speaker 4 (27:25):
These They really paid this guy four hundred thousand dollars.
Speaker 2 (27:28):
It seems like it.
Speaker 1 (27:29):
I'm experts.
Speaker 2 (27:30):
This is an expert testimony is a big business in
civil and criminal litigation, but it.
Speaker 4 (27:35):
Seems weird that you're paying almost a half million dollars
for somebody you want to say what you have to
have him say.
Speaker 2 (27:41):
Well, the interesting thing about experts is that, I mean,
that's ultimately what it is. And that's why I think
it's always important from the observer's perspective to remember that
they are one. They are paid. You know, he testified
that he has previously testified for both the defense for
the state in different jurisdictions. But you know, ultimately the
(28:01):
hope is that you give an expert, you know, the
discovery of the evidence, and they come to their own conclusion.
You know, there is a world where you can the
comus could have given him everything and he didn't come
up with that theory, you know, or came up to
a different conclusion than they would have to provide that
to defense. But just the same as on the other side,
they'll have experts that opine as to their theory and
(28:23):
they'll be paid by them. So that's why sometimes experts
in a way sort of cancel each other out, because
the jury looks at it as like, well, they're all
being paid to sort of say what each side wants
them to pay.
Speaker 4 (28:34):
Well, speaking of the jury, Speaking of the jury, there
are a lot of little things that go on inside
the courtroom. This is a tiny room. It's much smaller
than it appears on TV. So you have the weird
stenographer with the mask on her face, right, and every
so often the stenographer will like roll her eyes or
look up and react to something and sometimes the judge
will like roll horriz or something. Is the jury phased
(28:57):
it all by that one way or another.
Speaker 2 (28:58):
I mean they pay attention to everything in my from
my perspective, in not every single jury, but the juris
pay attention to the lawyers, they pay attention to the defendant,
the court. The starcher read the stenography yesterday after when
Attorney Lessie said he would be long as she literally
took the thing offer mouth and her head went back
and she said, oh my god, I.
Speaker 7 (29:19):
Can ask you a question about that device that she
was How do you not get like a rash around
your mouth?
Speaker 3 (29:25):
I don't know, I just as a as a person.
Speaker 2 (29:29):
I know, I've never tried a lot of a lot
of trials. Now we have what's called the for the
rocket system, so it's all digitally recorded. But in big
cases they like to have a stenographer as a backup.
But I mean, think about the fact that she has
to be listening to every single person. It's a difficult job.
Speaker 4 (29:43):
And by the way, get a friend of mine is
a stenographer and she called me she doesn't use the
thing that there are some stenographers that don't loreen. You
know who I'm talking about there's some that don't use them.
Speaker 2 (29:53):

So we sit here every Thursday with Attorney Catherine Loftus
and we break down the Karen Reed trial, and we
take calls and questions from listeners and talkbacks and such
and and we have the conversation on air. But then
there's the conversation we have off the air, which I
really think we could put what I would love to
put on the air, but anyway, I don't know. Let's
(30:21):

Speaker 9 (30:23):
A lot of questions on the amount of money the
state is spending on these experts. We talked about that
with Katherine a couple of minutes ago.
Speaker 12 (30:29):
Okay, so why is it okay that the states spent
like four hundred and eighty thousand dollars, you know, all
these experts. But the defense was crucified for spending you know,
under thirty on their experts, just because you know, the
judge knew upfront about this.
Speaker 2 (30:46):
So I don't think it's forty. The number seems to
be to be going up Whichi's thinking. But this is
the thing. The patties get to do whatever they want,
and so it is a lot of money for an expert.
Expert witness testimony is big business and civil and criminal litigation.
They get paid a lot of money. These are engineers.
The question ultimately becomes sort of the comparison between the
(31:08):
Commonwealth paying aperture and the issue about the defense Ocer.
The question about that was who was paying Occer. It
wasn't actually about the money itself, because that was relative
to this allegation that there was not supposed to be
any communication between the defense and OCCER, and then there
(31:29):
was discovered there was a bill. So it's not actually
the dollar amount that that was in contention. It was
the fact that they paid them themselves instead of the fence,
and they didn't present it. That's correct, so right, and
so it wasn't turned over to either the court or
the prosecution because they were supposed to be you know,
they started off obviously as independent witnesses. They were hired
(31:49):
by the United States Attorney's Office for the federal investigation.
Subsequent to that, there was obviously communication with the defense,
and so, you know, but it's a lot of money.
No doubt that the amount paid to apertures is a
lot of money. But the common Wealth gets to do
present their case in the way they want and spend
their money that's allocated to them the way they want.
Speaker 4 (32:09):
And speaking of money, part of our off air conversation
was about jurors who were there for weeks and weeks
and some of them aren't getting paid. Some are, but
some aren't, so they lose income for weeks and weeks.
Speaker 2 (32:18):
That so right, So as we were talking about, nobody
will be sad on a jury if there's a financial hartship.
So if you're going to lose income, you're not going
to be paid, able to pay your bills or dake here,
things like that. That's called the financial hartship, and you
won't be sad on the jury. So there's a presumption
that everybody who's on the jury is either being paid
or doesn't need to be paid, and everybody kind of
(32:39):
gets flushed out the other people who would have problems,
but before they get sad.
Speaker 8 (32:43):
Wow. My question for Attorney Loftus is has she ever
seen the Commonwealth spend as much money as they have
trying to nail Karen Reid it's it's unbelievable how much
money it's costing of a legitimate question.
Speaker 2 (33:02):
Awesome, if it's a hung jury again, that's right, and
hopefully if it's a hung jury, then that's that'll be
that's the end of it, you know, that's the goal.
The yes. I mean, like I said, experts cost a
lot of money. So if you have complicated cases, it's
not unheard of that you'll have witnesses. You know, this
is an engineer, an engineering firm. I mean, they're build
(33:24):
out probably at hundreds and hundreds of dollars per hour,
and there was quite extensive work, so that adds up
pretty quickly. It is a lot of money, and I
think it's a fair concern. They believe that she's guilty
and seems like they were willing to run.
Speaker 4 (33:38):
It's a taxpayer money, that's correct.
Speaker 2 (33:40):
So if you think about it, it is taxpayer money.
It is allocated, so it's not as if it's so
it's you know, the diff separate issue. But the budget
is set every year obviously in July by the legislator
and each you know, the Public Defender's Office, the DA's
office is allocated a set amount of money and they
get to spend it anyway they want, whether it's on experts,
whether it's on New DA's things like that. But yes,
(34:01):
it is in fact taxpayer money.
Speaker 4 (34:03):
Part of me thinks you can pay a certain amount
of money that can tilt the case one way or
another based on how much you're spending versus the evidence.
Speaker 2 (34:11):
Well, ultimately that's what goes to the weight of what
the testimony is from the experts, and why I always
encourage people to remember that experts opinions are just that,
their opinions that you can take, as you know, in
addition to the evidence that you see presented. But just
like the Commonwealth pays their expert the defense always pays
their experts too, So you essentially have two sides who
are being paid to theorize something Differently.
Speaker 12 (34:33):
If Karen Reid has found not guilty at the end
of this freetrial, what's next for justice for Jonathans.
Speaker 2 (34:42):
In terms of the commonwealth, that would be it. If
she's found not guilty across the board, that ends the case.
They won't pursue anybody else, They won't try anybody else.
They believe that she's guilty. So I'm not guilty to
the commonwealth doesn't equal innocent. It just means that they
didn't prove it, so likely.
Speaker 3 (34:58):
That would be the end of it.
Speaker 2 (35:00):
The civil cases stem then all the civil cases. So
for for Mits Reid, there is obviously the pending civil
case filed on behalf of the estate of John o'keeith,
and then there is likely to be somewhat civil suits
from maybe some of the peripherals.
Speaker 6 (35:12):
So she could never be outside of court, like I mean.
Speaker 2 (35:15):
She's probably gonna be in court for a long time.
Speaker 16 (35:17):
Yeah, good morning everyone. I have been watching the Karen
Reid case for the last trial. Now this trial, the
judge just absolutely annoys crap out of me. But why
does she call a sidebar every time like Alessie gets
going or you know, wants to talk to them about
what they're talking about. I mean, does she not know
how they're going to do this? What's the point of
(35:39):
the sidebar to tell him he can't.
Speaker 1 (35:42):
Ask those questions like that.
Speaker 8 (35:43):
I'm just it happens every time.
Speaker 2 (35:46):
Yes, So there were there were a couple of issues
of contention yesterday. One of them was the basis for
the Voa deer at the end of the day, in
which the defense wants to ask doctor Walter about troop
of Paul and what information that he had prior to
reviewing the case. That was an issue of contention, as
you saw when that line of questions started, Hankbrun right
(36:07):
away objection of projection, of projection, they go to sideby
because we don't argue the law in front of the jury.
So anytime there's any substantive discussion that needs to be
had about what can come in whether you know, we
have to remember that everything still has to be follow
the rules of evidence, has to be admissible, competent evidence
and relevant to the case.
Speaker 3 (36:25):
Can't the jury still hear what they're saying?
Speaker 2 (36:27):
They can't? Actually this generally no, they there's a there's
a what we call a shusher that goes on. So
it's it's like a like in the courtroom that the
clerk's office presses yes so that you can't hear I've
never heard before, yes yes machine.
Speaker 6 (36:46):
It's like you can buy.
Speaker 2 (36:48):
So in the in the sort of recording system, the
clerk will press the So anytime there's a sidebar, because
they're supposed to be private conversations, that's that.
Speaker 3 (36:57):
I was like, the joy is sitting right.
Speaker 6 (36:58):
There and show us something else besides the fan. Yeah,
I mean, you know, really move it around.
Speaker 3 (37:08):
And it's a susar button.
Speaker 2 (37:09):
Yeah yeah. So it's like it's like in the computer system,
like in the recording system, but it will physically will
come out of the speakers in the Courtum, you'll everybody
will hear in everybody, all the attorneys and the judge.
We all know you talk kind of quietly, yeah at
sidebar anyway, and then you have the shush on it.
Speaker 4 (37:27):
So that does button have like a piece of duct
tape that actually says I don't I don't know, am.

Not a clerk, I don't know who presses the button?

Yeah, so the so the people one of the individuals
who are sitting in front of the judge, so they'll, yes,
they'll they'll press it.
