it was like a bad cold. You know I was
lucky I didn't hit me too hard. I got neurovirus
two years ago. I was basically dead.

I was laying in bed thinking like what, I don't understand.
This is the worst thing that's ever happened to me.

prosecution rested its case in the Brian Walsh murder. I've

Hey guys, welcome back and happy Thursday. Weather wise, Lisa,
what's going to be today?

Oh, it's so We're going to start in the thirties
and the temps are actually going to go down as
we go through the day. It's blessedy, cold, windy tempts
in like the low twenties.

Speaker 1 (03:24):
Very very windy, wendy. So big day in the Brian
Walsh murder trial in Dedham. Yesterday, first and foremost, the
prosecution rested its case. There was a key witness, maybe
a couple of key witnesses, and we've got WBZ reporter
Penny Commit on the phone. She was in the courtroom.
Hey Penny you there, Hey everyone, good morning. Hey. Was

it a surprise when they rested the case so fast?

Speaker 6 (03:49):
Yeah, certainly. It only took them eight days of testimony.
The judge originally told us the entire trial would be
about two to three weeks, not including jury selection, so
they moved a lot faster than we were anticipating.

Speaker 4 (04:04):
Go ahead, Lisa, all right, So the defense starts to
present their case today. So there's nobody, there's no confirmed
cause of death, there's no weapon and no motive established.
So what are we talking about, Like, how are they
going to do this?

Speaker 6 (04:17):
Well, that's the biggest hurdle the prosecution has, of course,
is that there's no body, so they have to prove
that not only did Brian Walsh kill his wife, but
that he planned to kill her beyond a reasonable doubt,
and premeditation is really what they're trying to nail down. Yesterday,
they probably have their two most important witnesses on the stand,
two of the last people to interact with on A

(04:39):
Walsh before she died, two very good friends of hers,
and they were trying to paint the picture that on
Ahead express that her and Brian were having marital problems,
that she was getting fed up. So the prosecution again,
they have to prove pre meditation for first degree murders,
so they're trying to drive home that Brian Walsh had
this motive. He was unhappy in his mayor age. Maybe

there was also financial issues if they did that.

Speaker 7 (05:04):
I don't know.

Speaker 6 (05:04):
Our legal analysts think that they fell a little short
of that. But a jury, if they don't want to
convict Brian walsher first degree murder, they do have the
option to drop it down to second degree, so that
could be up for the jury to decide.

Speaker 1 (05:18):
Here's the part I still don't understand. He's admitted to
misleading the investigation and police. He's admitted to moving the
body isn't the first question. So where's the body and
why did you feel the need to get rid of
it and chop it up?

Speaker 6 (05:38):
I think we're all hoping that the defense puts Brian
Walsh on the stand. I mean, there's so many questions,
there's so many things left unanswered. But of course, someone
does not have to testify in their own trial. And
you have to remember, the jury does not know that
he had these other two charges. They don't know that
they existed, they don't know that he pleaded guilty to them.

(06:00):
They only know what was presented in the courtroom on
a trial for first degree murder only. So it'll be
interesting to see if the judge ends up giving them
that information. She says that she's still deciding, and really,
if we want that information, Brian Walsh is gonna have
to take the stand, and that'd be a risky move
for the defense, but maybe it's what they need to do,

(06:22):
because you know, they're claiming on A Walsh have this sudden,
unexplained death. Who would know that other than Brian Walsh.

Speaker 1 (06:28):
Well, one of the earlier witnesses was a guy who
apparently was having an affair with an A. Walsh. Couldn't
that be a motive for murder?

Speaker 6 (06:38):
Yes, they were really holding on to that testimony. But
I gotta say it was not maybe as juicy. I
don't know if that's the right one.

Speaker 1 (06:48):
I agree, Yeah, we.

Speaker 6 (06:50):
Wanted it to be. He said, Anna Walsh really respected
her husband. You know, we were having an affair, but
she wanted to be the one to tell him she
did really care about him. She respected him, so he
didn't like paint their marriage in the negative light as
much as I think the procitution was hoping.

Speaker 1 (07:08):
Now, they kept showing videos of him buying tools like
hacksaws and hammers and pliers and everything else, and then
they showed those same tools with bloodstains on them. Have
they confirmed yet that that is the blood of Ana Walsh?

Speaker 6 (07:22):
Yes, we had one witness confirmed that it was blood
at all, and then we had another witness confirmed that
her DNA was on those items. And I got to say,
that's for vailin s video. If someone's sitting in the
courtroom tho were some of the craziest moments of this trial.
I mean, it just it is. It's one thing to
talk about these things happening, but to actually see it,

(07:45):
to actually see him in lows and home goods. It's
just I think I think that really helped the prosecution
because for the jury to actually see it, they're trying
to paint Brian watsh in.

Speaker 1 (07:56):
A certain light, and he kept creeping leap looking up
at the cameras.

Speaker 5 (08:01):
Yes, yeah, Penny. So if Brian Walsh testifies, do you
expect the prosecution to come out and ask him where
is the body?

Speaker 6 (08:11):
I think they have to how did you not? And again,
it's so rare you have a defendant testify in their
own trial. I think they're going to ask him everything
under the sun, and they want to try and kind
of catch him, you know, they want to kind of
to get him. So yeah, I'm curious to see what

(08:31):
happens there. If you guys, remember when we talked during
opening statements, the defense Parne said, you will hear that
Anna Walsh died in bed suddenly out of nowhere. How
could we hear that other than from Brian Walsh. So
I'm kind of thinking he is going to testify, But
that was a week ago. Strategies could have changed by now.

Speaker 1 (08:51):
I was kind of surprised to learn he was the
sole recipient in the will.

Speaker 6 (08:57):
Yeah, of some pretty hefty life insurance policy. Is one
of them worth a million dollars. Boy, that's one of
the motives for the prosecution that he needed the money
because he was facing those art fraud convictions and he
had a restitution of over four hundred thousand dollars. So
one of their potential motives is not only the marital problems,
but also that he needed that life insurance money.

Speaker 1 (09:19):
Yeah, he was already wearing the ankle bracelet right, yeah.
Confined to home.

Speaker 6 (09:24):
Yeah, And a pretty big piece of evidence yesterday, which
I don't know if it got maybe enough credit because
we were so focused on on his friends. But his
probation officer testified that he had pre requested to have
time out of the house on January first, because when
we know Anna died, so that helps the prosecution's case

(09:46):
of premeditation. Look, he already requested this time. He knew
he was going to need to be out of the
house on January first because he planned to kill an Now,
if that's the case, who knows. But I think that
was a pretty big piece of evidence.

Speaker 1 (10:00):
Oh boy, you know, I noticed it's finally getting some
national attention in the news. But it's not getting Karen
Reid attention. Do you see people outside the courthouse crowds
of people.

Speaker 6 (10:12):
We did on the first day, maybe a handful of
people protesting Michael Procter's involvement in the case. Otherwise, it's
been pretty quiet outside of the courthouse, nothing like Karen Reid.

Speaker 3 (10:23):
Well, do you think it's because this is just so
gruesome in nature.

Speaker 6 (10:29):
I think there's not as much debate here over what happened.
I think a lot of people have similar opinions on
what they believe happened. I think this case is a
little bit more about attorney strategy. Well, the attorneys be
able to pull this off. What is their strategy going

(10:50):
into the trial, which maybe to the average person is interesting.
I think it's fascinating because this is my job, but
you know, to everyone it might not be as juicy.

Speaker 1 (10:58):
Well either way, I think he goes to prison as
he's already admitted to a couple couple of really serious
about crimes. Anyway, Penny always has always great job and

Those two things that you just mentioned right, like getting
engaged to the love of my life, getting all my
music back, those are two things that just never could
have happened. They could have just never happened. It wasn't like, oh,
it's just a matter of time, Like both those things
could have just never arrived in my life. And I'm
so grateful for both of those things happening, you know,

and my fans are why I was able to get
my music back. You know, I'd like, hear the song

wise approach to life to me.

I love that I just saw Stevie NX last week. Yeah,
and she's definitely an icon, And I love that Stevie's
still performing and that she has that kind of relationship

I work with Max Martin, who I think is like
one of the greatest, most legendary creators, producers, songwriters that
I think we're very lucky to live in the time

One More Time for Britney's Peers. Reinvented has sound so
many times. And I think that what I look up

to the most in people is career longevity and career longevity,
friendship longevity, longevity in their relationships. You know, how do
you keep a good thing going? I think there are
certain corners of our society that really love that and
look up to longevity. There are also corners that are like,
give someone else a turn. Can't you just go away

so we can talk about how good you were?

and at least I thought about you when I was
watching it. Because she talks about her favorite book, Yes,

She listens to audiobooks and her favorite book is a
classic nineteen thirty eight Gothic novel called Rebecca, and she
said that she likes family drama books and troubled romances.

Wow, I love that Rebecca books both a surge and salesman,
I know I was thinking the same thing.

And by the way her two big problems launch, they
drop tomorrow. Meantime, the love of her life, Travis Kelce,
hasn't had his best season, had a pretty bad game
last Sunday and got pretty emotional on the podcast yesterday.

It's been a tough go around for the past two days. Yeah,
it's just you put in.

All this work and hopes that it pays off, and
right now it's just for whatever reason, man, it's little things.

I feel like I've always had the answers in years past,

biggest breakup day of the entire year.

The Tuesday before Valentine's Day is also a big breakup day.
And it's just because people this time of year are
reevaluating things for themselves. Plus it's hard this time of
year about gift giving and all that kind of stuff.
So if you break up today, you don't have to
spend the money.

Or people breaking up just to save money.

It's one of the reasons absolutely get expensive. Yeah, especially
if you're on the fence.

If you're breaking up just to save money for the holidays,
you should never have been together to begin with, which.

to your family and be like, you know, what happened

is typically in the fall. Yeah, you know, so maybe
you cuff someone and then you want to uncuff them.

Wow, I don't know. Should I call home just to

I think I think you'll be okay. I think you'll
be y. Yeah. I had a girlfriend once that you know,
we were together for probably, you know, nine months or so,
and you know, it was a kind of a toxic relationship.
But we had gotten into a fight, and in the
fight she had said to me, we're done, but I
didn't hear that. I had like selective hearing, So in
her mind we were broken up, but not in my mind.

So I ended up seeing her. We didn't talk for
a few days, and then I saw her like walking
with another guy, and I confronted him and go what
what's going on? And she's like, we broke up and
I'm like, no, we didn't. She's like, I told you
we were done, and I'm like, you did.

Did you get in a fight with the guy?

Speaker 5 (26:23):
No? No, no, I it was over anyway. It was
past it's expiration date. But yeah, breaking in Listen, breakups,
We've all gone through them and not easy. Yeah, you
have been to a breakup bill.

Yeah, but you know, I'd rather be the breakup er
than the breakup. You know, being a breakup it's okay, No, what.

Especial when you don't see it coming.

like two weeks later. It was such so so so lame.
