Hey guys, welcome back. So there was a bombshell in
the Brian Walsh courtroom yesterday. We've got our reporter from WBCTV,
Penny Commit, on the phone. Good morning, Penny, Good morning.
I oh now you were there. Did anybody see this
coming at all? Did you have any warning this was
gonna happen? He pleads guilty to two of the three counts.
Speaker 5 (07:06):
Oh my gosh, absolutely not. When we're sitting in there
and we start to hear the words change of plea please,
you know, all the reporters were teping out, our labbers,
trying to get sit up for the day. We all
kind of like sit up straight or start looking around.
Oh boy, what's going on?
Speaker 2 (07:25):
Yeah, before we go any further, let's play that clip
from inside the courtroom yesterday.
Speaker 7 (07:31):
Sir, you're pleading guilty to these two indictments because you
wish to plead guilty because you are guilty.
Speaker 1 (07:37):
Is that correct?

That is correct?

Mister Walsh. Did you in fact willfully remove or convey
the body of Anna Walsh or her remains, not being lawfully.

Yes, Kara, do you now plead guilty to these indictments
willingly and voluntarily?

Yes, Kara. So Penny at the courtroom, was that a

Absolutely? Like I said, no one saw that coming.

But Penny, what, what's the strategy behind this? Do you think?

Who's to say? So he still is on trial for
first degree murder. Now, we've talked to legal analysts who
say there's a lot of different strategies here. Our head
legal analyst, Jennifer Roman, thinks that maybe what his defense
is doing is positioning themselves to get that first degree
murder charge drop down to second degree murder, make a

deal with the prosecution, Hey, we don't even have to
do the trial. He will plead guilty to second degree murder,
which would give him the possibility of maybe getting out
of prison one day. Because first degree murder you have
no possibility for parole. That is a full life sentence.
So that's one theory. What's interesting too, is that if
his trial does move forward, they do not take any

type of plea deal. It's going to be a totally
different trial. On Walsh's body has never been found, so
there's always been this idea of reasonable doubt. Oh, could
she have run away and no one's ever heard from her?
Do we know for certain that she died? During this
plea change, he had to admit that Anna Walsh unfortunately

is gone, which was totally different. So now the trial,
if it moves forward, would be less of if she
died and how she died.
Speaker 2 (09:21):
Yeah, because not only is she gone, but if he's
pleading guilty to moving the body, he knows where it is,
and that.
Speaker 5 (09:32):
Was something we've never had confirmation of before that there
even was.
Speaker 4 (09:37):
A body exactly, So help most likely take the stand.
Speaker 5 (09:43):
Oh, I would be shocked if he took the stand.
I would be kind of shocked. If the trial moved forward.
I'm leaning that they use this to negotiate some type
of plea deal to give him the possibility of proll
down the line. Of course, there is no way for
us to know for sure, and yesterday they acted like

they were moving forward business as usual. They called an
eighty four potential jurors, thirty five were interviewed and they
ended up seating nine.
Speaker 2 (10:13):
Right, Well, here's the part I still don't get. Many.
If he's pleading guilty to moving the body, why would
he have access to the body. If he didn't commit
the murder.
Speaker 5 (10:31):
Well, that's the question. They can maybe argue, oh, she
died accidentally. He was the only one that's there, and
you can't be forced to testify in your own trial.
They could paint some narrative of there's reasonable doubt that
anything happened. She tripped and fell and hit her head,
and he panicked and didn't know what to do and
moved the body, and then where she fell down the stairs.
Speaker 2 (10:52):
Okay, let's say that's the case hypothetically, right, why not
tell them now where the body is or what happened
to the body.
Speaker 5 (10:59):
Well, this happened way back in twenty twenty three, and
I'm assuming that part of this plea deal he doesn't
have to give information. I will say that the prosecution
was going through the statement of facts as they do.
You know, Brian Walsh has agreed to these facts. And
for a second they mentioned a dumpster, something about putting
a body in a dumpster, and I'm so sorry for
everyone listening to be so graphic this early in the morning. Yeah,
(11:21):
but the second the prosecution said that, the defense stood
up and was like, we are not agreeing to any
specific details. Just that a body was improperly disposed and moved,
so that whole line about the dumpster was taken out.
Speaker 2 (11:37):
But did you say a couple of minutes ago that
they may cancel the trial.
Speaker 5 (11:42):
Well, legal analysts have hypothesized that maybe this is a
big strategy to get him a plea deal on a
lesser charge. So right now he's charged for first degree murder,
which is a full life sentence. There's no way to
note for sure. This is just you know, legal mindset
ideas out there that perhaps he's trying to get that

first degree murder charge down to a second degree murder charge,
take a deal on second degree, and that would offer
him the possibility of parole down the line.
Speaker 2 (12:13):
Yeah, so just go off to prison, so that wouldn't
be the need for a trial. There's an agreement, we'll
see you by.
Speaker 3 (12:19):
And also he could be using the fact that he
knows where the body is as a as a negotiating tactic. Yeah,
give me that in the move, give me the second
degree murder charge. I'll tell you where the body is.
Speaker 2 (12:30):
Well, it will be.
Speaker 5 (12:31):
Really interesting to see what happens today. I think we'll
know today. I can't imagine they continue with jury selection
calling all these hundreds of people in if they plan
to take a plea deal. So I think we'll have
an idea today, but who's who's to say. I mean,
we could have several more days of jury selection left,
and these things take time. You know, these lawyers have

to draft these plea deals. And it looks like looking
at the paperwork they originally draft to this deal last week.
Speaker 2 (13:02):
Yeah, So as it stands now, the calendar would be
that opening statements I think would happened the Monday after Thanksgiving.
Speaker 5 (13:10):
Yep, wow, yep, Monday, December first.
Speaker 2 (13:13):
That was a shock, man.

The trial is expected to last three to four weeks.

similar the way his friend passed and my friend passed,
