tell you something. I was at the best event I've
ever been to in my entire life yesterday.

Well, it was the most beautiful event I've ever seen.
It was the party in the park. It's a benefit
for the Emerald Necklace, which is all of our public
park systems in Boston. It's really important to raise money
to keep them beautiful because that's what we use. Like
we walk in the park. It's gorgeous and makes the
city so much better. I'm telling you, I've never seen
a crowd more beautiful in my entire life. The dresses,
the hats. People had hats made for them in different countries,

and a woman from Columbia was there and she had
a giannet from Columbia. It was like the clost event.
Ever I had a fresh floral almost like a fascinator. Yeah,
that was all fresh flowers. It was really gorgeous. And
shout out to David de Chico who does all the
floral design for this event. I've honestly like I've never

seen anything like it.

We've got one of those fascinators at home. That's something else.

Morning is a shout out to Lisa. I have met
her yesterday at party in the Park. Great organization helping
our park stagery and stay accessible to everyone. She did
a fantastic job and raise a lot of money for

in Lynnfield at Market Street in Lynnfield at All Modern,
which by the way is part of the Wayfair Empire.
Just a beautiful set up last night. I want to
thank chef Andy Husbands from Smoke shops and Mike Rocket
from the Salem Waterfront Hotel. I want to thank everybody
for coming out. It was nice. We had a lot
of fun, a couple of glasses of wine.

So the problem is the reason why they have to

is so contentious in this case. So you know, there's
so many times that they have to go to sydebard.
It always seems to happen that it's before a break,
before a launch. So then it just leads into you know,

you often see it, maybe it's ten thirty, ten forty five.
You see them go to sidebar, and then they say
We're just going to take the break now because the
sidebars are so extensive.

I have a question. Something unique happened this week. Karen
Reid got sick, Yes, she was not in court. How
does that? How is that handled? If someone has a
link the illness or like, do they have to prove
to the court that they're sick?

I mean generally, as offices of the court, as attorneys,
if we make a representation to the judge that you know,
our client is sick, can't come in, generally they'll take that,
you know, that information from us as a good faith basis.
You know, there's always times it depends. This is a
murder trial. She's shown up for every single court date,
and sometimes things in life happen. Sometimes people get sick,

Sometimes the lawyer gets sick, or the judge gets sick.
If it's something different, you know, in a different kind
of case where a client doesn't you know, has shown
not shown up multiple times, the judge might say, hey,
we need some proof or we're going to issue a warrant.

But that's certainly not the case in tust with mister.

Follow, will you allow does the defendant have to be
in the.

Courtroom the defendant has a right to be She has
to be present.

Sometimes what happens is, you know, if there's issue with
the defendant, sometimes they keep them, you know, behind in
the dock or things like that. But generally you have
to be in the coorum. That's usually only if there's
a security issue or something like that.

No, no, you know, there might be some circumstance where
they allowed it, but as a general rule, no, you
need to be there in person.

I have another cool story in terms of the obsession
people have with the Karen reidtrial. I went for a
haircut yesterday. Laurie, if you're out there, hello, Laurie. And
Laurie and her sister are so obsessed with the Karen reidtrial.
I'm sitting there getting a haircut and she has a
giant laptop on the counter right in front of my chair,

like she does not stop watching the trial for a
single minute. So I'm sitting there. That's when I saw
the judge possibly call the lawyer in a hole, and
then there was a two hour sidebar.

Quite frankly, I don't know how any of us are
get in any real work done, because it seems like
we're all doing the same thing, you know, watching and working,
watching and working.
Speaker 5 (26:11):
I read somewhere yesterday that the jury was surprised looking
when Heartnett testified that she never tested the swabs from
the solo cups, like what's going on there?
Speaker 1 (26:21):
She tested one, she said she didn't test them all
because she was told that they came from essentially the
same place. So they don't always test every single sample
that they get. If it comes, you know, from one
specific location, they'll usually test one or two pieces, things
like that. But you know, that's certainly something. The question becomes,
how you know, how relevant is the blood? Obviously this
(26:46):
is going to be at least some of its John O'Keeffe's.
But they get to make the argument, the defense now
that if you didn't test it, couldn't have you know,
gleaned some results that were somebody else. So that's one one.
You know, when we talk about when we talk about
the bricks build a wall of reasonable doubt, these are
the things that they're trying to poke holes in one
at a time.

But I guess the jury, you know that visibly thought
it was kind of peculiar.
Speaker 1 (27:09):
Well, it seems, you know, because if you think about,
what's the point of taking all the samples if you're
not going to test them. So that's you know, again,
that's one of these things that maybe they're not maybe
it's not a purposeful you know act, but does it
open the door to you know, wait, something else might
might have been there that you didn't test.

Well, I think it's without question the investigation was kind
of botched. I mean, this is like small time you know,
gang that couldn't shoot straight kind of a thing.

Yeah, well, and I think I think, I mean.

look at it. The only way we're really going to
hear more about Brian Higgins as if the defense calls them.
It's pretty it seems pretty certain at this point that

the call Walls is not going to call him as
one of their witnesses. They certainly don't need him to
prove any of the charges that they have against Karen Reid.
So I would say that's a to be determined based
on whether the defense calls him and what they ask him.

And I think I think he's a key I think
he's a key witness, I just for the trial. Like,
there's a lot of stuff about him that people you know.

So if he definitely, he's definitely a big part of
the conversation. But if you think about it from the
Calmwalls perpectives, so they're the ones who approve, you know,
it's their job to present their case and present the
witnesses that they think they need to prove the case
in order to prove her responsible of the manslaughter. Because
I really think the second degree is off the table
and it's not worth diving into that deeply. What does

Brian Higgins actually at Does he testify to anything that
you know, meets one of the elements for manslaughter. No,
but he certainly goes go to the defense theory, which
is Hank Burndon is really going this in a very
it's a risky but it's an interesting trial strategy. Basically,
he's saying, Hey, last time we defended ourselves against the

defense theory. This time we're just going to try to
prove our case. If you want to believe Brian Haggins
and Brian Albert. You can call them in your case,
so it'll be interesting.

What did you make of the niece's testimony yesterday? Was
there any significance to it?

So we didn't actually we did hear. I didn't hear
it myself. We obviously got this second hand because she's
a miner. There's no video or no audio recording. What
she was called to testify to was really relative to
the nature of the conversation, between the nature of the
relationship between John and Karen towards the end, as well
as the interaction with Karen that morning. You know, I
think it's difficult because she obviously does give some insight

into what was happening that morning, you know, the statements
Karen was making. She's really the first person who sees
her after she you know, comes back from thirty four.
Fair of you, but also you know, it's it seems
but based on all reports that it's very clear, you know,
she has real, you know, feelings of anger towards Karen.

And it's difficult.

I think anytime somebody who is a young person who
has been through this much trauma has to get up
on the stand and testify.

I never heard Karen Reid say she saw John O'Keefe
go in the house until this week, and that contradicts
what she's saying that I hit him, I hit him,

Yes, And so we haven't seen as much of the
as many of the statements from Karen read just yet
and again the way the COMMA has presented it is
a little bit more strategic this time. So what they've
done is presented all of her statements from these various
media interviews saying, you know, I said yeah, I could
have said I hit him. I thought, you know, he
was in kind of the spot where I left him.
(33:01):
Also the fact that when she was first questioned by
the state police and asked did he go in the house,
she said no. And so what Attorney Brennan is going
to try to do is now likely present the different
pieces of not testimony she calls it her testimony, but
the media interviews in which she says she saw him
go up the driveway. And of note, I think is
(33:25):
in each interview that she gives, which starts with the
dateline interview first and early fall of twenty twenty three,
I think she says, you know, I saw him walk
up the driveway, and then in the next interview, it's
I saw him walk up the driveway and you know,
kind of hand near the door. In the next interview,
it's walk up the driveway headed poke to the head
in the house. And then I think the last one
she says she sees him go all the way in.
(33:46):
So what they're the Komalth is going to try to
point out that this is sort of this conscious effort
to change the narrative about what happened that night.
Speaker 3 (33:55):
So, you know what fascinates me the most about this
trial what years in and I get the impression that
nothing's been proven.
Speaker 1 (34:06):
Well, you know, the difficult thing with criminal cases, I
think people often feel like there's going to be this
answer that's clear for everybody, and generally that's not the
way it happens. If there's you know, unless something's caught
on video or there is literally an eyewitness, you know,
testimony that says I saw a right that most criminal cases,
there really always is this rum of did they do it?
(34:29):
Do we know for sure? Is there ever really an answer?
And the closest we can get is the criminal justice
system as we have it, which is to prove the
case beyond reasonable doubt.
Speaker 3 (34:38):
It's all about doubt or not period. I mean basically,
there's no smoking gun.
Speaker 1 (34:43):
There's no smoking gun. And then most honestly believe, most
of the time in criminal cases, there isn't a smoking gun.
Speaker 5 (34:49):
It's stringing together pieces of evidence that's right to like
paint a picture that's right.
Speaker 1 (34:54):
So it's little pieces, you know, It's there isn't ever
generally one big piece of evidence that you go aha
towards the komwall thought towards the defense. It's you taking
all these pieces of information. What the jury's job is
to do is to look at them as a whole,
not say one equals you know, A equals B. It's okay,
we have all of these pieces of evidence. This one
we think seems more reliable than this. So do we
(35:17):
get to beyond a reasonable doubt with all of those
pieces of evidence?
Speaker 3 (35:20):
And if an aha moment hasn't happened yet, it's probably
never going to happen during this truck.

I think we had the aha aha moments the first trial,
you know, when we heard the text from Michael proct
and things like that. But I don't know that there's
going to be any new testimonial evidence that comes in
that we didn't hear the first time.

that Brian al but and Brian Higgins had like a
twenty second call sometime after two o'clock in the morning.
So it would be it's hard for me to believe
that they don't also know who we called it one
thirty since they have all those other phone calls.

You know, I think it's interesting if they want to
point the finger at him again in order to get
to the third party jury instruction, which is where they
want to be. They want the judge to tell the
jury you can consider these alternatives.

so in order to meet the motive, intended opportunity. That's
the standard in order to meet the third party culpriate prong.
