with something where confidentiality is like the most important thing.

Yeah, that's a really good point, Like.

Attorney client privilege. That's what we're diving into today. Exactly
how is AI changing the game when it comes to
attorney client privilege?

Speaker 4 (01:41):
Right? And it's interesting because on the one hand, you
have this drive for convenience, but for attorneys who are
dealing with really sensitive client information using platforms like Zoom
or chat GPT, it isn't so simple.

Speaker 3 (01:55):
Let's unpack it. Let's start with video conferencing. I mean,
we practically live on on these apps these days. Well,
what does the research say about how video conferencing is
impacting attorney client privilege?

Speaker 4 (02:06):
Well, the thing is, confidentiality is so key. It's really
the bedrock of attorney client privilege, right, And if a
platform that's being used for client communication is collecting user
generated content, especially for something like AI training, that confidentiality
could be very easily compromised.

Speaker 3 (02:24):
And a breach of confidentiality could be really bad obviously
for the client, but also for the lawyer. You could
even like tank a case.

Speaker 4 (02:32):
Oh yeah, absolutely. And what's really interesting is we're not
just talking about hypothetical risks here. Okay, there are popular
video conferencing platforms that actually address this in their terms
of service.

Speaker 3 (02:46):
Really, so you're saying, like those quick and easy meetings
that we have all the time, those could actually have
some hidden implications, like what give me some specifics. What
platforms are we talking about here, and what makes them
potentially risky?

Speaker 4 (03:00):
So think about even the big names Zoom, Microsoft, Teams,
Google Meet.

Speaker 3 (03:06):
Yeah, we've all used them.

Speaker 4 (03:07):
They have really great features, for sure, but if you
look at their terms of service, they often mentioned collecting
data to improve their services and that includes training AI.

Speaker 3 (03:17):
Wow, I did not realize that. Yeah, so that's pretty serious. Ye.
So knowing those risks, what are some things that attorneys
can do to protect themselves and their clients?

Speaker 4 (03:27):
Well, there are some options, so opting for end to
end encryption, that's a good start with it. And you
know those privacy settings that we often just click through,
take a look at those. Actually, Viva really scrutinize those.
And then, of course getting informed consent from your client
is key. You want to be totally upfront with them
about the potential risks of using different platforms.

Right, so they can make an informed decision exactly. Okay,
So for those extra cautious lawyers out there, are there
any specific platforms that are considered to be safer.

Speaker 4 (03:58):
Yeah, there are a few that stand out. Yeah, so
the research actually mentions a few specifically. Oh really, Signal Wired,
jitsy Meet. Ok those are all designed with privacy as
like a top priority.

Speaker 3 (04:10):
Got it? Okay, good to know. So speaking of AI
kind of changed in the game, Let's talk about those
tools that seem almost like magic, like generative AI, this
stuff that can like practically write emails for you. Yeah,
it seems like everybody's using them. But what's the deal
with these tools when it comes to confidentiality.

Speaker 4 (04:28):
Well, this is where things get a little bit trickier
because with something like chat, GPT or Google's barred, Microsoft Copilot,
all of those. Right, we're talking about systems that learn
from the data that you give them. Okay, so that
means you're prompts, the AI's output, all of that is
potentially being used in their training process.

Speaker 3 (04:49):
Hold on, so you're saying that even if I'm just
trying to use these tools to make my life easier, right,
client information could end up as part of their training data.

Speaker 4 (04:58):
Yeah, that's the concern.

Speaker 3 (05:00):
It's a huge risk.

Speaker 4 (05:01):
It is a really big concern. And you know, some
platforms they do offer opt out mechanisms, especially for you know,
larger companies, But the research really stresses that you have
to be very careful because anonymization it's not perfect, right,
And those terms of service that we were just talking about,
they're important. Read them. They're not just there for show, yeah,
exactly how to.

Speaker 3 (05:20):
Actually like read through them?

Speaker 4 (05:21):
They tell you how your data might be used.

Speaker 3 (05:23):
Okay, good to know. So for legal professionals who are
excited about AI, which I think a lot of them
are sure, but also obviously need to keep in mind
their ethical obligations, right of course, what's the solution?

Speaker 4 (05:40):
Well, there are a couple of things. Okay. So one
option is to just prioritize tools that are specifically designed
for legal professionals.

Speaker 3 (05:49):
So they're going to be more expensive, I'm assuming, Well they.

Speaker 4 (05:51):
Could be that you're paying for that peace of mind.

Speaker 3 (05:54):
That makes sense.

Speaker 4 (05:55):
So for example, you have Cure Systems they're known for
contract analysis, and then there's Ross Intelligence. Yeah, they do
legal research, got it. So those are a couple of options.

Speaker 3 (06:05):
So you can offer one of those more specialized tools
or are there other options for maybe the more tech
savvy people out there.

Speaker 4 (06:13):
Yeah, So another route is to look into self hosted
AI solutions. Okay, that way you have total control over
your data.

Speaker 3 (06:21):
That makes sense.

Speaker 4 (06:22):
It's like having your own in house AI tailored to
your needs and your security concerns.

Speaker 3 (06:27):
Yeah, that makes a lot of sense, especially when you're
dealing with something as sensitive as client information exactly. This
deep dive is so interesting. It's amazing to me how
these everyday tech choices, yeah, can have such big implications
for something as important as attorney client privilege.

Speaker 4 (06:43):
Absolutely, And you know, it really just underscores how important
it is for the legal field to adapt as technology changes,
Oh for sure. And it's constantly evolving, it really is.
So having these conversations is so important.

Speaker 3 (06:56):
Yeah for sure. So as we kind of wrap up
this deep dive, what would you say is the main
thing you want our listeners to take away from this conversation?

Speaker 4 (07:06):
I would say, just think about this.

You don't want to compromise your client's confidentiality.

Of course, not that's the bottom line. Yeah, it's not
just about efficiency, it's also about ethics and trust. Absolutely,
it really makes you think twice about just using whatever's easiest. Huh.

Speaker 4 (07:37):
Yeah, it really does. And it all comes back to
just like staying informed, right because the legal feel it
changes so fast and attorneys really need to stay ahead
of the curve, especially when it comes to tech.

Speaker 3 (07:49):

to remember from our conversation today?

You know, I think it comes down to knowledge as power. Okay,
arm yourself with information, make good decisions about the tech
you're using, because ultimately your clients are trusting you with
their most important information. Absolutely, it's really your duty to
protect it.

That's a good way to put it. It's not just
a legal concept. It's really about trust and ethics, right.

It's the foundation of the relationship exactly, And that's something
we can all remember no matter what.
