five hundred people have, been exonerated losing over thirty one
thousand years to ron, for convictions and that is data

From The national Registry. Of exonmaserations texas is constantly among
the top states, for exoneration with, hundreds cleared many tied
to faulty forensic practice. And Misidentification black america are about
thirteen percent OF the, us population but a poor Y'ALL

of the incarcerated. And exonerated studies show that there are
several times more likely to be wrongfully convicted or, serious

a little bit about your background and what drew you
to community Advacy.

TEXAS well i have a BACKGROUND and, uh theology when
also a little BIT in uh social work, As well
and what drew me to activism and.

Helping the community is actually my own life and just
watching out the people's lives, as well going through the
legal system on, both sides whether it was their, own
incocerration their families. In conseration, FOR myself i was formerly
incarcerated myself. As well and so what drew me to
being an activist in this space was actually When the

Trader Of mountain martin. Case happened it actually caught my
ATTENTION as i started learning how to do four year
requests and find out and do more with deep guys
into the people system around the country and find out
living about. The LAWS and i was fighting then towards
the stavage of the standing ground laws that they were

trying to Pass in texas at the time that was
already Passed, In florida and so what drew me to
this case was really just being from that area and
hearing the young people talk about it. That day it
just it grabbed my HEART and i was drown to
the case at that point, in TIME and i just,

couldn't SLEEP and I think i just really placed it
in my heart at that point. In, time so with
a lot of other, circumstances happening it really just dialed
me in and gave me a tunnel vision to be
a full time activist amongst everything Else that i'm doing
to help and advocate for those who can't advocate for

themselves and who find themselves in the judicial system and
whatever capacity it. May be.

So what first made you want to get involved in?

Speaker 2 (07:34):
This, CASE well I was i was actually working on
some stuff for my own business at, the TIME and
i saw a Post on facebook and another POST on
i believe it might have Been on instagram that was

some young people talking about what just happened at the
school and that Was on april second, this year AND
so i started reading those AND then i started get
phone calls from from the PEOPLE that i know that
had knowledge of what the situation was and telling me.
About IT then i started sitting on, the news AND

so i started paying attention and just listening to what
the kids. Were saying most of them were probably middle
school and young high, school age and their Mindset was
i'm glad that this person speaking of off the metals
would learn to keep at tank to. Himself now and
that alarmed because those the young people saying, that one

this person has to be doing this type of, stuff
before and then two for these young people still be,
at school and then tweeting out and lets the messaging
out about something that was fresh that was still happening
at that moment in. That state it allured me and
it caught. My attention and THEN when I Started carmelo

anthony being traded through, the news the local news media There,
in DALLAS the, dfw AREA and i saw, a face
it just. Grabbed me and at that point my mind
WAS that i am not going to step by and
let this young man take the roads that a lot
of people myself and others have taken In the texas

final system and the railroaded and especially from just listening
to the beginning troups of what happened on that day at,
that time it caught. My attention what really direct to
this this MOMENT was i was actually, on TikTok may

have been maybe a few weeks later after. THE event
i was paying attention. TO it i was getting my,
own INFORMATION and i was just. PAYING attention i was
going on tay TALK and i saw an actual page
that people were, all ALIVE and i saw these two
people going back and forth AND and i just heard
him cursing at, each other and one was a, black

LADY and i saw that no one was coming to her,
defens well these other people were jumping. On HER so
i went into the line and got up on the
PATHELINE and i just kind of just came to. Her
face AND once i came to, her defense the people
started talking, to me and one lady that was going
after her was saying that she had saw the video

and that she. Had STRAPPED so i started talking about
that moment that, you know how dare you go into
a space as public when you know, You SAID and
i think that got the radar attention of those people at,
that point and they start coming after me at, that
POINT and i think THAT'S when i was pushed into
this this moment because we were talking about through that,

time space and probably three weeks four weeks, after that
talked about, what saw what was seen on the video
that was being Shown at crisco as the for for a,
few weeks and the people who know what happened but
speaks to opposite of, the truth they were upset about

that truth, getting out and so those people started actively
trying to stop people from talking. About it so that's
what pushed me into the forefront of, this case WHERE
before i was just paying attention from, my house in
my own life and praying and making sure that, you
know my prayers went up for that family and that.
YOUNG man i guess having the audacity to protect the

black woman that was being attacked because of what she
saw and what she, was telling and then growing myself
and seeing that video and seeing that she would tell
the truth and being attacked also. For that it pushed
me into an, activist Mode which i'm not, unfamiliar WITH
but i just wasn't doing it at, the.

Time right so for educational purposes for those that may
not know about, this case what Does the texas law
generally say about self defense or stand?

Your ground texas law is actually just a SELF defense.
Uh law it's not written like most of THE other
uh standing ground laws where it's actually stand your. Ground
Law what texas did is they actually took they meet
the other say standing, ground law so all the all

of the written part, of it and they and they
adapted it or adapted into our self. Defit laws and
so now what our laws say In the State of
texas is that you're don't have a duty to retreat
and that in that moment as you feel and that's
basically what. It's saying that if you feel in fear

for your life in, that moment that you could be
have physical, solni armed or if you feel that they
may be able to do physical boomly harm even including
unliving for TikTok and or, you know murdering you on the,

regular platforms you can use whatever force that you. Be
necessary and that's up to any including unalliving force as
well or being able to, you know take someone out
of here with whatever force you. Be necessary that's What
the State of texas law. OF state i know a

lot of people talk about provacation all the other things
that they, talk about but when they passed, this law
it reads just like any other state or any other
red state In The united states that has staying. Your
ground if we go back and we look At The trade,
martin case we all know from looking at that Case

That george memory was in the room from, the beginning
all the way up until that moment he follows a
young man and told not to he kept. On going
he attacked the. Young man what happened is tring ground
got the best of him and start. Beating him in.
That moment According to florida staying, Ground Laws george dinern
fear for his life in, That moment so at that

point it didn't matter all the things he had. Did
before in, that moment he feared for his life and
he was able to use the force necessary to neutralize.
That threat matter, to what staying ground gives you the opportunity,
to do and all of the standing, ground states and
specifically to Stay, to texas you're able to not retreat

as the greatest comfort too. Towards you you do not have,
to run you do not have to. Leave you if,
you're fearful you could neutralize That dreat and that's what the.

to be how does the factor like provacation and unlawful
possession of a weapon effect the self defense Claim in texas?
In General because i've heard a lot of people on
a lot of these panels That are austin supporters want

used in this in, This case so how does that
factor into? This case how does provocation in the unlawful
possession of a weapon effect self Defense?

In Texas, in texas provocation is something that has done
to do with. Self, DEFENSE okay i know people like
to talk about provagations because provocation is probably richen in
every code in every state and even in some countries
outside Of The united States. Of, america however provocation is you.
Provoking someone that's all that that roop where it. Is

provoking you're provoking someone to do something THAT means i
am coaching you to do whatever harm that you're doing.
To me in, This Situation carmelo anthony was sitting down
mind his. Own business you did not have any words
to even call over off The Medcalf hunter metcalfe or
the other two gentlemen that was. With them he did
not call them over and told them to come over

and stayed in front. Of them he then called them
over and told them to put their hands on them
and started pushing the getting in something or whatever they
were doing. To him he did not call them over to.
Do that they came on their own And by hunter's
own extemn from his first interview he gave fresh off
this Situation on august, THE second i mean on the

eighth of the second of. This year he stated that
his brother and two friends were coming from the heights
of middle school stayed in middle school In, print row
and he said that they walked up and They saw
carmelo sitting there and They asked carmelo. To move that

is nothing. About provacation provocation would. Mean that it Means
That carmelo anthony that has to come up to them and, told,
them hey you're. Gonna fight. That's provacation and so all
these people making those arguments case law states against them
in the State, of texas and you really in All

second part is they talk about the weapon or. The
knife in the State, of texas they passed a, house
bills so it's a wall in the City of texas
that any knife that believed is five point five inches
or less is legal for you to carry anywhere in

four year old can have a knife on, their side
which a lot of Kids In boy scouts And, cub
scouts they're usually given a utility knife which has, you
know the school drivers and the scissors and all that stuff.
ON it i carried IT when i Was, in WHITEHOUSE
when i was in school back in the day Under.

school and so. They're, there now whether your school has
a politican gist there, or not that's a whole different
thing Because when i'm talking, about policy which talks, about
law and so the law in the State of texas
said that that night that we still don't Know Who.

have a picture that he was carrying in his pocket.

Been austin it could have been a lot. Of people
BUT what i do know from saying the video is
that when They approached, carmelo happening and then they laid
hands on him and. Attacked him carmelo actually backed out
of the canopy and tried to. Get away they pulled

then that's when the alleged polkaine splashing or whatever the case, may.
Be happened and then he back back, out again looked to,
his right couldn't go, that way he looked the lesson
took off and that he. Went down, he failed and
then he got back up and took off a year
and they. Gave chased so those are the communities that happened.

That day so that nice itself is not illegal to
have in the State of texas because the blade was
under five four and five inches and so that far
as far as them saying that he had and the,
legal weapons no he, did not and to state that
he was carried it unlawfully that Day on april The

corminal anthony, graduate from that he was pusy at, The
Time frisco at which is the school district that's overall,
that moment and ALSO the uil which governs all athletics
In the states In the sexas all did an investigation
on this very big one that is said that Day

criminal anthony didn't have not one violation from. Either INSTITUTION
and i can. SEE why i know That Because Carmelo
carmelo anthony was in jail for. Eleven days the, day
after maybe the, day after on the third or, the
fourth the U i l at first go id they

on i'm sorry eight for the second to be Held

trespassing i've had people say that that it was a

there were four people that. Walked Up and i've heard
that clip over and over and Over of austin saying
that it was him, his brother and he said, two kids,
Two Kids and i'm trying to figure out why is
he calling them? Two Kids but i've heard that one

and it's like to me that that sounds like four
versus one and not one. On one i've never seen,
the VIDEO so i don't exactly know what. Took Place
so i'm just going on the accounts of INDIVIDUALS that
i believe are telling. The truth because every every Person
that i've heard tell this story that that went and

saw the video that Is, for camelo they say the
same thing that, you're saying that there were four people
that approached, that tent well, that canopy approached, that canopy
and they did not, sit down. YOU know i hear
people saying that they were sitting down and they were,
looking up and all types of different stories that are,

being spread but the one that really blows my mind
is that they're trying to say that this baby was
trespassing and they loved to bring up. The poker they
loved to bring up, the poker but do not answer the.
First question we didn't go into details about the actual

occurrence of what individuals have said happened under, that tent
because if you Listen to, austin's story he said that
his brother asked him to leave the tent and then
he grabbed His bad so a lot of things happened
before the poken. Even happened but everybody's so quick to

because nobody just. Poked somebody so can you kind of
elaborate on some of those things that you saw that

itself You can carmelo was already sitting there for, several
minutes he and probably about another six or seven people
and there with other people walking back. And forth at,

no time that's neither one of the twins nor the
other two guys that were with him. Were, sitting however
there were other KIDS that i would stay from looking
at the video. Were INVOLVED and i say that because
there was a young person in a. Yellow ponto you
could see them walking up right before those four individuals

come and they kind of sit down and kind of
look back To where, carmelo was and you know how
someone is when they their part is some but. They're
nervous they kept looking back and looking around and watching
those four division. Woke up there's also a video As
a snapchat signific a. Four seconds most of these people

that do their Lives, when kichak they have a skillfolio
and It shows carmelo sitting from behind that original you
know it's four they could Gone from snapchat and it's
from a, young PERSON so i won't say, their name
but they recorded it instead to a few minutes before
or two minutes before. The incident you can see on

the video that person coming from the, left side coming
back into the canopy and sitting down before the four individuals.
Walked up so, to me this was a pre planned
moment based On Whatever, Hunter Metcalf, austin metcalf and the
other kids that, were involved which one of the young

men that that was that gave a statement on the
police support actually stated themselves on. MANY occasions i guess
that people are other folks talking, about it that he
was there and he was start at the moment this
young man Ran Against carmelo anthony probably a few weeks,
before that prior, to That and carmelo, you know beingmadually

AND so i think this is the young person that
kept going up the down when the Force Arounded carmel
alan and so when they, walked up they came with.
A mission they did not, Walk slowly they were, not
running but they were walking with a fast pace and
they walked up to. That state they never, sat down
and you could see them at, that point one of

them walking up and down like it was like he
was going To touch carmelo and. Come back you could
see the one that's probably the second from, the RIGHT
which i would assume that would be awesome based on
how everything, went down that one. Leaning FORWARD so i

aants and needed everything to get out and if you
look at the original, looking photo you can see the

chin and he's actually met being a part or a

him in all kinds of, different things and they assaulted the,
young man and just by the Grace, of god he.
Got away but what people have to understand as well
is that these young men not only as, thoughted him
but when he got away after, the folking the scraping

them chased. After him so if their story, is saying
if they wanted him to move from the tenth Or,
the kennedy then they accomplished that twice because he backed
up trying to get out when they originally. Attacked him
they pulled him back by his great hoodies and they

began to put him in the head lock and began
to assault. Him more and that's where the lives poking or.
Whatever happened at that point time he got away again and.
Ran away they Can't chase austin was still a, positive

in a moment to where he was like having a

would have went to the coach and said that he

those are things that meet the statue to charge you

SAYING yeah, I did that's what. It is he was
kind of a. Planned moment but if you look at
the totality of, the situation They had carmelo from the
time an, incident happened they hadn't booked, in jail probably within.

Thirty minutes it was under first of three murder remember,
if well if you, don't know but if anyone saw
the video or know about, the video and just listen
to the reports that they talk, about it or Even

a live and all of the things that, he said

his last that this young man got to the hospital
and then they walked on them still at. The, hospital
remember and they said that he Died, IN austin I mean,
hunter's arms if they's what, they're Saying. Because austin hunter
never went Back to austin at the, actual scene so
the coach was, holding them so he never even got to,
that point so he did not have no blood on

them at the seen and all, the stuff because if
he was Not holding austin at, That moment so if
the ice school, MAYBE did i. DON'T know i guess
that's what the parents was. Talking about but that's a.
Whole hour it's changed that he that.

he he unlived in, his arms his his his twin
unlived in. His arm if we listened To what. Hunter
said but in, that case and if that was, the
case then the corner should have left with the body

they allowed him to, go home which he went to,
the hospital came home a few hours later and had

him and his mom talked about what happened at the

and even the principal actor because as from what the
police auster said and the, Police support carmelo, told him
he was defending himself and you shouldn't have put his hands.

station you're supposed to grab evidence from everybody at the.
