a half, I have been sharingacross various platforms and justice that's been taking
place within the TDCJ, not justTDCJ, but the entire Texas Department of
Criminal Justice, the judicial system period, and it is time for it to
be addressed. Today. I haveh mister Roberto Dela Cruz. He's gonna

Hello, yeah, Well how areyou m hm? Yourself? I'm
great. I'm here today to allowyou to be able to share your story,
an opportunity to with you, yourdaughter, have opportunities with for Neill

and just hearing your story. Ifeel like it needs to be shared and
other people need to hear what isgoing on. Twenty five years to be
incarcerated what you do. It's waytoo long for the government the judicial systems

continually just deny you and things thatthey want like they are the reasons that
a lot of things take place becauseof their ruption. And then if you
have been following the platform, youknow that we have been sharing stories of
(04:55):
those that are wrong and o incarceratedwithin the state of Texas. And this
has been happening for far too long. We're talking about three to four decades.
We're not talking about three to fouryears. We're talking about decades,
and we're talking about three to fourdecades. We're not talking about just a

handful of people. We're talking abouthundreds of people that are wrongfully and overly
incarcerated. I personally have talked tosixty eight wrongfully and overly incarcerated individuals inside
of TDCJ, and it's time thatwe hold these people accountable that are placing
(05:36):
these people in prison wrongfully. Theyare falsile, they're falsifying documents, they're
falsifying statements. I mean, theyare doing all kind of stuff. And
if I didn't hear and see thismyself, if I was just somebody was
just telling me this, y'all,I wouldn't believe this. Like I just

couldn't believe it. When I startedhearing these stores, it took me back.
And for those that are in thestate of Texas to be sitting and
doing nothing and not speaking out.If you have a family member that is
incarcerated and been incarcerated for ten,fifteen, twenty years, you should be

speaking out. You should be standingup, You should be on somebody's doorstep,
you should be saying something. Becausethis has been going on for far
too long. And I am puttingthe governor notice because he is part of
the problem and it's a lot.I'm gonna move out the way, and

I'm gonna allow mister mister Cruise dela Cruz to share his story. I'm
gonna allow his daughter as well insidehelp him. So y'all, yeah,
yeah, yeah, it's your opportunityto share what y'all want to share.

ninety right. Suppose I'm working todaywhen somebody kills there to they do what
he killed? They do? Ishis brother in law, right, because
at least why he got a problemfrom But he s right, he called

the brother and the brother. Supposehe come in to his brother in law,
he n his sister and he's don'ttake it to his royal round to
buy bills at the store. Supposehe takes it to the forest, Barkley,
he takes it to the he's okayand and uh go and he taken

that he's gone gone. When hegot back two years he never see then
if he wants to take the government, but he didn't. What what happened

mister bay and he said something allright here, you know, he said,
okay, did you give me?Can do him? Because he never

when he take it, and he'sgonna mind, he's never coming back.
So then the man he going tobrann but he uses to kill his brother

along. So there the detectives.He given the roar and row, you
know, horsa and then then heput his informan and he said you needed

mister lacrouse he kill that man.I'm working, But MYSTI, well,
can I can I kind of jumpin and like explain because he's kind of
just talking about, you know,like like what happened. But I guess

if I can jump in and kindof just talk to you all about how
you know, everything started and whathappened as far as you know where he's
at now, can I do thatmuch time? Is that founswer? Your

He said, okay, so mydad had Okay. So my dad
has been in prison for twenty sixyears now. And my dad was accused
of killing mister Jorge Pinion in nineteenninety eight. And this man that was
murdered, he he was taken outto a secluded area that not a lot

of people knew in Baytown. Butwhen my dad was questioned about this murder,
it was in two thousand, sothey kind of used like his I
guess present life for his past andwhat he was talking about with the informants
to the Beyton Police department. Wehad two corrupt police officers, Renee Najosa
(11:20):
and Raoul Budd who picked up twoinformants from Baytown that were crackheads at the
time, Marcus Taurus and Juan DelaGarza. Juan Dela Garza being my dad's
son in law. And when thesepolice officers picked up these guys, they
picked them up and fabricated a casesaying that my dad. They were going
(11:43):
to say that my dad murdered thisguy at a store called Porus. And
after they murdered him, the storywas that Meg had fainted. Meg being
Juandala Garza and Marcus put the bodyin the vehicle and they went and dumped
it the secluded area that I'm tellingyou about that not a lot of people
(12:03):
know about that area. So thestory was my dad shot him once,
Marcus threw him in the car,and they went and dumped his body.
According to the Baytown Police Department,their own medical examiner has now said that
whenever that man was murdered, wherethey found him, that's where they killed
(12:26):
him. So that was their firstyou know, inconsistency in their story.
And another thing which is big,it's huge, is that this man had
two gun shot wounds. He wasshot with a three fifty seven magnum.
He got shot in the face andwhen he went down that actually shot him
in the head again. So accordingto the Beyton Police Department, my dad
(12:50):
shot him once. That was nottrue. The man had two gunshot wounds.
And when he talks about the brotherin law, this is what happened.
So the widow of mister Jorge Penahad a brother and that brother was
the last person to see this manalive. That brother took him to the
(13:11):
store to go by beer, andno one ever saw mister Jorgey Pena again.
When we look at all the transcripts, because we've looked at him over
and over again, we see wherethe Beytown police is trying to interview this
guy about where he was, whathe was doing, what happened, and
they wanted to give him a liedetector test, but at that point it

seemed like the sister would kind ofthrow him off a little bit, being
the widow. You know, hey, this happened today. You know,
there were some guys with guns atmy job, so they never got the
opportunity to give this guy that liedetector test. And this guy left Mexico.
He was from Mexico. He wasjust here visiting her. This guy
committed suicide two years later with athree point fifty seven magnum you know,

and they have that gun Harris County. We asked that gun to be brought
to Harris County to get it testedso we could try and prove that it
was the same gun that they usedto kill mister Jorge pinyon nineteen ninety eight.
And when they tested it, HarrisCounty said it could be the gun,
but they weren't going to say itwas, you know. So we

have always felt that he's the onethat killed his brother in law, But
no one wants to help us.Like we've had attorneys, We've had people
help us, like, but noone. I don't know if the police,
I mean, the attorney sold outto the police. What. But
it's like, we know my dad'sinnocent, we know he didn't kill this
guy. We're just not getting thehelp that we need from anyone. You

know, there's nothing that proves thatmy dad killed mister Horgey Pania. He
didn't even know him. It's justthe Beton Police department that fabricated this case.
And so whenever trial started, mybrother in law wanted to say that
he was forced because, according toto him, he was forced by the
Beyton Police Department to sign this statement. They were scaring him with my sister,

telling him that they were going todeport my sister. She doesn't have
papers, they were gonna, youknow, her baby was gonna be born
in Mexico. So he was forcedto sign that. If not, my
sister was going to be deported accordingto the police, you know, and
the district attorney did not want touse him at that point. They threw
him out. They did not wantanything to do with him. After he

wanted to, you know, tellthem what really happened, and Marcus was
the only one that testified against mydad. You know, so my dad
is in prison for something that hedidn't do. It's been twenty six years,
and we really don't know what elseto do, because we've even had
a judge look at his appeals,and when we were trying to send writs
(15:46):
and things like that, there wasa judge that actually recommended that he get
a new trial, and they stilldidn't listen to him either. So we
don't know what to do anymore.You know. So you said it was
a judge that recommended a new trial. Yes, there was a judge that
was who was recommending the new trialtoo. He recommended it to the Court
(16:12):
of Appeals. Yeah he was.Who was he recommended it to If he's
the judge and he saw this,who was he was recommending it to the
Uh, Yeah, to the court. Even after my dad's trial. The
judge that was there at the timehandling the trial, his own words were,
(16:37):
I cannot believe they y'all found thisman guilty based on the testimony of
this witness. Because the guy thatwas up there, this crackhead Marcus Turres.
Every other answer was like, Idon't know, I don't remember,
I don't know. You know,it was just the trial. According to
our attorney, the the jury saidmy dad looked mean. That's why they

found him guilty because other than that, there was no evidence linking this man
to that murder. My dad wasat work the night that this murder occurred,
so was an alibi ever produced.My dad said that he gave that
to his quarter pointed attorney, andthat attorney never presented that evidence to the
(17:27):
court. He asked us for money. We didn't have money. My dad
doesn't have papers. You know,he's a Mexican, so they just,
you know, they they it's anotherillegal Mexican man that they have found,
just put in prison for something thathe didn't know. And it is just
(17:48):
all a part of this big schemethat they have in the state of Texas
where they used these quarter pointed attorneys. They used these quarter point of attorneys
and they get these guys. Thisis how they get them in the prison
system. And once they get themin the prison system because half of the
time these lawyers they don't know whatthey're doing. I've heard so many times

where they've given new lawyers fresh outof freaking law school capital murder cases.
How they're not supposed to have capitalmurder cases. And then they look at
the amount of individuals in prison withcapital murder cases. It is so sad.
It is sad. And then thesepeople just keep kicking the can down

the road and doing nothing cottage likeI don't I don't get it. And
it's like they have the evidence.They have the evidence, like even the
jury. Because this man, wheneverhe was found murdered, he had his
hand in his pocket. Like ifsomebody dragged this man, his hand would
not be in his pocket where helanded. That's where he died with his

hand in his pocket. If thisinformant lifted this man through him and the
car, his hand wouldn't be inhis pocket like they they saw that,
but they chose to ignore it andstill give my dad ninety nine years.
They offered him twenty five years.The detective was this medical meminer who did

this report from it was was it? Yes? From the department? Their
medical examiner. Their medical examiner contradictedtheir story. So in other words,
they didn't want they was covering,but they didn't want to call their medical

examiner liar, So they was doingeverything that they could to to to not
make them look like a liar,so they would go to that extent to
cover it up. That's the youtalk about. You you talk about Cornel
Drummer, Who's who's over there incarceratedwith your dad, same same thing.

They falsified documents, They the medicalexaminer live and this man had been a
part of a scheme for years,been putting people in prison for years.
They call it the pay for playplay for whatever it's called. Well they've

been they man, It's it's crazybecause these people the court opponted lawyers,
becomes assistant district attorneys, then theybecome district attorneys, and then they get
on the Court of Appeals and thenthese same people that they allowed to get

behind prison walls. Now can't rnyou out. It's just so much,
it's it is so sad. Andthen you talk about all of the stuff
that's been going on with the dA, like, I just don't get

it. You you got something justover there on your dad's unit alone.
There's so many people that have documentationswhere the same thing the court said to
your dad. There's people over therethat the court said should be free,
but yet these people are still holdingthem. And then they want to hold
the technicalities, the way something iswritten, the way something is said.

It's just being crazy ittself. Wheny'all people are the ones that did wrong,
y'all are the ones that was heldevident, y'all are the ones that
did not used evidence that was presented, because if you use the evidence that
was presented, he wouldn't even bethere. There's so many people that's like
up and take. If they hadbeen in another state, man, these

people would have been whole with counselprobation or whatever. They would not be
doing the time that they're doing inTexas, and it's bad. Like today,
I'm about listening today, mss Irene. What is it that you want
them to know about your dad's caseand what is it that you want them

to be able to do. Howcan somebody help y'all on today? I
want someone to just guide us,let us know what we can do.
You know, we've tried reaching outwith how attorneys, We've tried to text
US Department, the Innocence Network,and no one's listening to us. So
meanwhile, my dad's just there likeWe don't know what to do anymore.
The evidence is there, like Ihave his case in a USB. If

I need to send it to someone, if I need to share it to
someone, let me know, becauseat this point, we don't know what
we're gonna do. You know,he's in there and he's just getting old
by the day. My dad's seventyyears old. He's been there twenty six
years, and no one's listening tous, So we don't know what to
do anymore. You know. It'slike any little hope that we get it

gets shut down, you know,like no one's listening. The Court of
Appeals, no one, you know, and they have all this stuff in
front of them, you know,showing that my dad is innocent, and
no one you know, is doinganything for us. So I don't know,
I don't know. I'm pleading thatsomeone please help us, like guide

us, let us know if you'vebeen in that situation, someone with power,
you know, because it's all justa big corruption, Like you know,
this is what they do to alot of people, and you know,
sadly some people don't have anyone tospeak up, so this is you
know, we appreciate you doing thisfor us. Too, because we don't

know what to do anymore. Weneed help from someone, you know,
So what are your local government?What is the local government saying? What?
What? What? What is thenews station doing? But have the
news station even covered the store getany type of investigation their sales? We

had a story done, We didhave a story done by the news.
We had Quanta lex that came outand supported us, but no one is
listening to us. So we havehad you know, uh, news stories
done with my dad and you know, we've talked about everything and and you
know, we've gotten nowhere, nowheremissus Thomas taken. Do you say do

like my dad. My brother hasnever had my dad in my life.
And they don't realize everything that they'vedone to us, you know,
all the pain and all the earththat we've gone through. You know,
you want to say something, Robert, I mean, basically, I mean,

I just want my dad to getout. You know. It's it's
pretty tough because we can't do nothingfor him because the system's so messed up,
you know, like we don't tryto do everything like it's just the
law. It's not fair. Youknow. There has to be somebody that's
fair in the law, you know, to help my father out, you

know, because I mean, andI'm not saying he's the only one in
there like that. I'm pretty surethere's a lot of people that are locked
up like my father, you know, that need help. But you know,
they need to do something about thatsystem because it's not fair that h

I mean, that are locked upfor no reason. I mean it's yeah,
it's like it's crazy to believe,but it's you know, like I
just I just want my dad toI just wish somebody would help my father
out because he's just been in jailfor so long and you know, for

something he didn't do. Like,man, that's that's that's tough, you
know, like that's that's tough onall of us. You know, we
we all have kids, he has, he has a bunch of grandkids.
I don't know, it's just it'sjust tough. Wow. Wow. Well,

I definitely I'm going to be sharingthis out and I'm gonna be like
I write letters constantly back and forthtrying to get people. So I'm definitely
gonna be sharing this story on theblog, sharing it out so people can
at least hear about it and maybeit will touch somebody's heart, because it's
sad that, you know, theyare putting people behind prison walls off of

what somebody is saying and not evidence. Because they had reviewed the evidence and
went by the evidence. This manwill not be in prison, will not
be in prison, but they wentby some somebody else's words, and that's
not right. In the state oftechnically, they have been ruining people live

for decades and it's sad what theygot going on now. It's so much
just attorney and all these end agentshave they have been falsifying documents and doing
all kinds of stuff it's coming tolife. But how many more people are

They're going to have to sacrifice becausepeople are dying behind these prison walls and
you got people losing their lives thathe shouldn't even be a prison and then
what how they're doing this stuff is. It's sad. So I'm definitely gonna
be sharing this out and hopefully somebodywill reach out and be in touch and

hopefully have a heart. No,I just I'm in a conference car Well,
you appreciation doing this for my father. I mean, I know he's
trying to find any way he canget help, you know, like he's
just we really appreciate everything you're tryingto do for my father, and I

hope somebody really listens. We justyeah, we just need somebody. I'm
going to be made. What dowe make of my way to Texas?
And what I've been telling these familiesyou got you got family members that's been
incarcerated fifteen, twenty, twenty five, thirty years. It's time for these

people to come home. It's timefor them to come home. And then
you look at the amount of timethat they've been incarcerated and how old these
people are, like you got togive them a chance. They that Texas
don't believe in rehabilitation because they're definitelynot doing anything to try to help these
people come home, because if theywas, they would have them on a
fast track to be coming home,and not what they're doing. You know,

every day I get a phone callfrom somebody about something that's going on
in that prison system and should notbe going there every day, and there's
so many but yeah, like there'stimes that we have to call because of
everything that's going on in that prison. My dad's been you know, a
locked in a little room where hecould take four steps to the front,

four steps to the back, becausethey don't take them out because they're always
short of staff. There's never enoughstaff there to you know, take them
out, to take them to takea shower, to do what they have
to. I mean, they're literallywaiting for them to just kill themselves and
then they lie about what happened,and you know, it's just everything is
just a big cover up, andit's just you know, it needs to

change, like this is not right, you know, everything that happens to
these prisoners, and there's so manythat are suffering like my dad, and
it's not fair. You know,someone needs to stand up for them.
They're human, you know. Wellagain, I am going to be making
my way to Texas and I definitelywould like to meet with you guys.

It's time for us to get backto going out and standing in front of
these people doors, knocking on thesepeople doors and calling for action because something
has to be done, because youknow, and and yeah, go ahead.
I'm sorry. No, it's akevi of saying, I don't know
if we can go to the BeetonPolice Department and say, hey, you

know, like, you know,you have two dirty cops that have my
dad in prison, like, youknow, help us, you know,
but you know a lot of themaren't gonna admit that they have dirty cops.
So it's like it's hard. Youknow, Well, we gonna we
can protest, and we can presentthis stuff and we can get it out
there in front of the people andand keep it out there in front of

the people because one thing about meis I'm not gonna stop and and TDCJ
they know that right now, Icurrently have I've been complaining about the The
other day last week there was anincident where a G four killed a G
two. Do you got inmates.And this was in Connelly. You got

inmates over there overdosing on this Ktwo. They overdosing and they moving the
bodies. These these these guys movedthe body and then they went back and
they were still there. And thenthe officers saw it on video and did
(33:22):
nothing about it. They know,I don't keep I report everything. If
they if somebody called me and tellme something that is going on in that
prison, I'm reporting it to everybodyin k Nobody. They said that they
don't know what's going on. Justlike the food that they sent over to
McConnelly. They sent truck loads offoods from the San Antonio Food Bank officer

taking it home. They were takingit home and then they were causing friction
in the kitchen. They were givingthem stuff and letting them have stuff,
and then they were selling it tothe other inmates. Nothing been free for
them, something they provided or thatwas donated by citizens, so that these

so that they could have something,because they've been teating them, craft them
feeding them maggots. And then theywant to tell me that they were weak
worms. I don't care what theywere. They shouldn't have been in their
pood. You gonna just for weakworms and not magics, school casts.

What kind of larck they was?They weren't supposed to be in their food.
And that's what I'm trying to getthem to understand. You're gonna treat
them like humans, because that's whatthey are, what they've done, and
some of them have done nothing,and you treat them. But I'm not
just saying you're gonna share this outand I will be just we need to

get together and a lot of thesefamilies, if if you know other individuals
and have family members that's incarcerated,y'all, we need to get together and
we need to go standing at thatcapitol. We need to go down there
and we need to protest. Weneed to get signs with our loved ones
pictures on it, and we needto go down there and let these people
know that we mean business. We'renot playing with them because they've been kicking

the can down the road and doingwhat they want to do for decades and
it's time out. It's time out. You can count us in. We're
here to help or whatever we haveto do because it's time like. It
makes no sense, it makes nosense that that's not you know, and

and it's like and it's like thatyea, yeah, we're still alive.
We were over here talking about whatwe're trying to do. We're gonna try
to do some getting some rallies andsome marches together because this this got the
stop this this, this, thishas to stop. No. I've been
working back and forth with the Stateof Texas now for about a year and

a half, and I've come acrossabout sixty eight individuals that have similar cases
to your dad. They documents havebeen falsified. Judges have said that these
people should be locked up or thesepeople should be free. Yeah, right
now, right over there next doorto your dad that they have said that

this man is supposed to be free, he shouldn't be locked up. They've
granted him a release and he's stilllocked up. This is what they're doing.
This is what they're doing. Butwe talking about we're exposing a lot
of this stuff. I've been talkingabout it. I'm not letting up.
I talk about this stuff in mymagazine. I shared you see Free Texas

campaign behind me. This is whatI do. I'm not gonna be moved.
I am the change that I desireto see in this world. And
I am not gonna stop until Isee change because this has been going on
far too long, far too long. And yes, this was dropped in
my laugh. I don't know howI got the state of Texas. I

live in South Carolina, live allthe way on the east coast. I
don't know how I got connected withthe state of Texas. But now this
is I'm connected to it, andI can't let it go because this is
sad and the and and those thatlive in the state of Texas. It's
time to stand up. It's timeto stand up. It's time to stand
up against your government because he's theone that is allowing all of this to

told me he not he's not lookinginto different stuff because it just ain't enough
of them forget what it ain't enough. If it ain't enough, then you
need to pass it on to somebodyelse over you and allow them to look

I really want people to understand whatreally is going on in the state

been locked up twenty six years.It's something that he did not do,

the big problem lies and it lieswith these people that have control with your
governors. Because if you look atthe amount of money that this man gets
outste this man gets fifty five thousanddollars year, and that document. It's

He gets five thousand, the Lieutenantgovernor gets money. Everybody has so many
of them that's getting money from thebusinesses. To me, I feel like
that, right, there's a conflictthe interest. A lot of those people

on the p road boards are gettingmoney and I feel like it's a conflict
the interest and something needs to bedone about it. Something definitely needs to
be done about it. And we'regonna keep sharing it out. We're gonna
keep talking about it, so stoptalking about it. They got the right
one involved. I've been on thistrail go about a year and a half
now, and I'm telling you theygot the right one and they know me

by name, and I'm going theexecutive direct us and the reasons they know
me because I'm not gonna let goand if people let me know what's going
on, I'm gonna talk about it. And now that I know you,
okay, I know what's going on, it will completely stay before me and
