before being formally charged in Irizari's murder. The DA's office
also released bodycam footage of the deadly shooting, showing the
crucial moments leading up to and after shots were fired
back on August fourteenth in Kensington.

Irizari's family viewed the videos in their entirety before they
were released to the public today, and due to their

graphic nature, NBC ten is choosing not to air video
showing in Azari after those shots were fired. We have
team coverage following the very latest developments. We begin with
NBC ten's friends Swag Live at the DA's office.

Francis Well, Jackie Johnny. As you mentioned, Officer Mark Dahle
turned himself in this morning, and then DA Krasner announced
the charges, released the body camera footage, and shortly after that,
Officer Dile was arraigned in court where he heard the
charges he is now facing, the most serious one being
first agree.

Murder, murder, voluntary manslaughter, aggravated assault, simple assault, reckless and
dangering of another person, and official oppression.

A long list of charges for suspended Officer Mark Dile that.

these charges.

DA Larry Krasner releasing a crucial piece of evidence today
in the criminal investigation, the footage from the two officers'
body cameras. He wouldn't answer many of our questions or
specifics about the footage or the charges.

These videos speak for themselves, the law and the jury
instructions in Pennsylvania. The definitions of these offenses are supported
by this and other evidence, and that is why we
have charged ex officer dial with these charges.

Officer Diles attorney said this morning when he turned himself
in quote, we intend to vigorously defend him against the charges.
Despite what has been portrayed to the media, the facts
will unmistakably show that Officer Mark Dile was legally justified
in discharging his weapon while fearing for his life. At
that time, they didn't know the specific charges and had

no comment. After Dial's arraignment, the police union adding that
Dial has their full support end quote. We ask the
public to reserve judgment until all the evidence is presented
during trial. Like any other individual facing allegations, Officer Dial
is presumed innocent and looks forward to helping his attorneys
prepare a vigorous defense against these serious criminal charges. The

Dial was arraigned earlier today, just hours after he turned
himself in. Bail was set for him at five hundred
thousand dollars, which is highly unusual for someone facing first
degree murder.

The former Philadelphia officer who's also facing first agree murder
for shooting a twelve year old boy last year, did

on that new body camera video.

Ryan, Yeah, Jackie. The public has waited weeks to see
Mark Dill's body cam footage from his best of the
day of that shooting. In Today, District Attorney Larry Krassner
released that footage with the consent of Irrazari's family today,
who is also calling for no violent response to the video.

For the first time, the public is getting to see
former Philadelphia police officer Mark Dial's body worn camera from
the day he shot and killed Eddie Irazari's Corey Jones
is a retired police sergeant with experience has both a
use of force and firearms instructor. He's not affiliated with
the case, but watch it with us and gave his
expert opinion about what a scene in the footage. Do

Let's start with the officers initial commands to Irazari. In
the roughly five seconds it takes from when they exit
their cruiser to win Dial fires into Irazari's car, one
officer was saying, I will exple it.

There is question as to whether one of the officers
shouted that Irozari had a weapon. Did you hear either
officer state what type of weapon or that there was
a weapon?

I did not hear exactly what the officer said.

No, take another listen, assure you, Jones says. An officer
who use deadly force if they reasonably believe they are
an immediate fear of death or serious bodily injury to
themselves or a third party. Did you at any point
see either officer in immediate danger?

There is nothing from my vantage point watching from the
one officer's body worn camera that showed a knife, a weapon,
or a deadly course threat that would have put anybody
that I could see on camera and immediate fear of
death or serious bodily of.

The portion of the footage showing Dial in the other
officer removing I Rozari from his car is too graphic
to show. But this is footage of Dial driving a
severely injured Irasari in his back seat during the roughly
two minute drive to Temple Hospital. Once inside the hospital,
Dial a scene walking around and taking a few seconds

to wash his hands. On two occasions, it appears he
dissuades other officers from approaching him.

partner was also released today. The audio does not start
until after the shooting, so we can't hear from his
microphone what he said as he approached the car, but
we do hear what he told super advisors about how

story on Action News is that surveillance video that shed's
new light of the moments leading up to last Monday's
deadly shooting on Willard Street. Hirazari's family attorney says it
raises even more questions and an already controversial investigation.

Actually, news reporter Maggie Ken was there as that video
was released. Today, She's live and Place Headquarters now with
more on what that video show is Maggie.

Well, Brian and Sarah. As you said, this video is
very graphic, but it was important for the Irazari family
to release it to the public. They say what it
shows is a vindication of what they've been saying all
along that Eddie Irosari was innocent in this case. He
did not deserve to be shot. All of this ahead
of them planning the funeral on Thursday.

Shaka Johnson, the lawyer for Eddie Irosari's family, released this
ring video of his final moments as officer Mark Diele
opens fire after a traffic stop. In a news conference today,
the Irozari family says eight days have gone by and

now they're learning what really happened on the one hundred
block of East Willard Street.

This officer really took someone every special to us, and
I just wanted to pay the way you did.

Initially, police set Irozari got out of the car and
lunged at officers with a knife before Officer dial opened fire.
The video shows his car door and window was closed.

One day after the shooting, after watching body warn camera footage,
Commissioner Danielle Outlaw said Irozari was in his car when
he was killed and that two knives were recovered inside.
Johnson argues the damage to his client's loved ones reputation
is done.

Now the Digit Attorney's office has that body worn camera footage.
Shaka Johnson says that his clients will offered to see
the footage on last Friday, but then that office was

They say they are keeping that body worn camera footage
under wraps until their investigation is complete. There's also that

internal affairs investigation going on to see if procedure was
broken in this case. A lot to follow here, this

are the same spots. So we know that the video
they used for the initial part of the news story.
It's the same video that they showed their subject matter expert.
What I was doing was I was watching Corey Jones.
The way he answered it is the way that I
would answer on the stand. And and it wasn't that

released that footage with the consent of Irrazari's family today,
who is also calling for no violent response to the video.

the day he shot and killed Eddie Irazari's Corey Jones

shouted that Irozari had a weapon. Did you hear either
officer state what type of weapon or that there was
a weapon?

No, take another listen, assure you, Jones says. An officer
who use deadly force if they reasonably believe they are
an immediate fear of death or serious bodily injury to
themselves or a third party. Did you at any point
see either officer in immediate danger?

There is nothing from my vantage point watching from the
one officer's body worn camera that showed a knife, a weapon,
or a deadly course threat that would have put anybody
that I could see on camera and immediate fear of

officer removing I Rozari from his car is too graphic
to show. But this is footage of Dial driving a
severely injured Irasari in his back seat during the roughly
two minute drive to Temple Hospital. Once inside the hospital,
Dial a scene walking around and taking a few seconds

to wash his hands. On two occasions, it appears he
dissuades other officers from approaching him.

depending on who you spoke to, either was overlooked or
the police department attempted to obtain it and they didn't

business of higher authorities, so you know, maybe he was

There is no way where that video was situated what
you just saw that it would not have been collected
as evidence that day, that minute, that hour, ye would
have been And if someone would have said since they

I would have got a search for and I would
have took the whole system everything, because that's what happens
when people are uncooperative when you need thee Why that wasn't.

it and it was evidently used in this trial with
no chain of custody, no testimony about was.

whatever the case, maybe after you perused the car and
maybe saw whatever, but you're not backing up. You're not

was there was shot, you went there to try to

You know, one of the favorite news stations for that area.
The beeping out, I mean they you the first video though,
I mean we could go back. I know we can't
go back and cut the videos up, but there were
there were at least three beeps in that video. And
then the same the same video that they're showing to

Corey Jones or subject matter expert on Deadly Force, there
are the same spots. So we know that the video
they used for the initial part of the news story.
It's the same video that they showed their subject matter expert.
What I was doing was I was watching Corey Jones.
The way he answered it is the way that I
would answer on the stand. And and it wasn't that

his his his answers were incorrect.

It was the fact that they're being placed in such
a way.

That that it takes it takes any type of doubt
out for where he stands on it. And I don't
believe that's where he stands. I believe that he was
probably a paid subject with or expert and he's just
answering like he would.

On on on on the stand. It was either negative.
It was either negative or positive.

It was the fact that the way that they were
telling the story, it has that impact.

Right. Plus uh, he wasn't shown at the video that
the actual video, No, he was shown the news video.

And then one of the last thing that I would
say is is that leading up to that, you you
heard the one officer say that, and I can't please
telp me with the wording there's something going inside the
car that we can't see. He said that he's he
was acting irrational or there was you know, there was
activity going on the.

Do you know the word the wording he use from
the the.

I think what's part So when they're they're talking about
when he's explaining to the the white shirt guy's a
lieutenant probably and uh, he's explaining to his lieutenant what's
going on. He said that we we pulled him over
and and then he just started acting crazy or something
like that.

Yeah, so that's a very important thing to see.

So you're playing the body cam video, you can't see
any of that.
Speaker 11 (28:35):
That's what the officers seeing.
Speaker 16 (28:36):
There's all this activity going on inside the car, and
due to the tent and the reflection, that's pretty important.
Speaker 12 (28:45):
And at one point something second reaction every time that
you have.
Speaker 3 (28:51):
Yeah, that's why Corey needs to.
Speaker 12 (28:53):
Uh, he's going to play by the news people and
the new people was the one with the big checkbook.
Speaker 3 (29:01):
Then he's answering exactly the way that he needs.
Speaker 1 (29:03):
To answer for his for his benefit of having seen
the real that hasn't been manipulated and by evidence by
Krasner presenting that video, presumably it was manipulated by the
District Attorney's office.
Speaker 12 (29:23):
Well, at least progressive district attorneys talk about, you know,
fairness and everything. You have a bias towards law enforcement.
It was clearly overcharged. Now, as I stated in my letter,
you can you can try to bring you you're the
top cop. You can, I mean, you're the top prosecutor.
You can bring a case, you know, if you believe

there's probable cause. But can you prove the case? You know,
it's not what you believe is what you can prove.
And if you don't alter or doctor that evidence, do
you even get to that point if you don't take
out all them guns and bleep out all the guns
and all the other stuff.
Speaker 3 (30:02):
You know, because he said, among other evidence, what is
the other evidence? Larry? You know, what is it?
Speaker 12 (30:09):
So because what we saw there, we saw officers approach down.
Maybe not the greatest tactic in the world for the
driver to pull up alongside of that car and reduce
his reaction time. But I'm not going to Monday morning
quarterback on that. But who knows that too. If you
want to talk about totality of the circumstances.
Speaker 3 (30:28):
You know that reduces your time, your.
Speaker 12 (30:30):
Reaction time and Dall's reaction time because That's why you
believed you saw the gun so quickly, and that's why
Dal had to rush over there and try to, you know,
get the situation calm also.
Speaker 3 (30:44):
But it was you already were retreating and yelling he
got a gun.
Speaker 12 (30:49):
Meanwhile, that shiny object is coming up with the curved handle,
and I don't have time in one point something seconds,
you know, which is since he always had to use
criminalists and all these type of experts. Well, let's look
at the experts and tell Larry how much time you
actually have to do something like.

This, right, So you know, I mean, you know, I
don't know whether or now. You've seen, uh, the doctored
video from the news, You've seen the doctored video from
Shaka Johnson, you've heard you've seen a security expert look

at look at a doctor doctored video, and you've seen
the real video that says gone anyway.

So no, john Here's another big point that I neglected
to mention. You heard them say that, you know, the
reason Shaka had that that that's availlance video was to
show that the police department lied about it. Was there's
actions that he got out the car and lunched at
the officers.

With a knife, which obviously never happened, but.
Speaker 12 (32:08):
There was there was a big investigation that was supposed
to happen relating to how that misinformation from that scene
got out there. Well, we're two years in that information
and that investigation has went nowhere. You know why, because
all this stuff was staged. This was a big conspiracy
to extract moneies from the citizens of the city, the

tax pans citizens. Because Shaka Johnson said in the news
foot this we were intentionally missed. The public was intentionally misled. Well,
if you intentionally, if you got criminal intent and it's
related to a crime because you charged down so it
was a crime, and someone intentionally misled you or participated
and attempted to corrupt that crime, then internally and criminally

something should have been done. Why hasn't it been Because
all this stuff and we know how Krazer loved to
charge ops, why has he charged the cop who intentionally
misled the public or why was that? Where's the investigation
of why the public was intentionally misled? Because these people
are criminals and they all work in hand in hand.
Because if Crash, he just locked up a homicide guy

for perjury with the witness was the convicted murderer James
burs So if people are lying, we know, Crash don't
have a lot of problem with locking them up.

Where's the investigation into who misled the public? Larry and Shaka?

was found guilty again of involuntary manslaughter.

Now we know the umpire, which is the judge this matter.
All he can deal with is the evidence that the
defense and the prosecution puts in front of him.

I know, Judge, I've testified in front of Judge Bronston.
I think he's a good judge and I'm hoping that
he sees students nonsense, which he's also an intelligent person,
so let's hope that he.

I know he knows the law as far as sub
section five a week and we'll and we'll see.

And uh, Jake, you were kind enough to apprise the
judge via letter.

Yes, the letterature just had on the screen was something
that I didn't know because I didn't attend. Now Rob
Cipriano attended the trial. I did, so I didn't want
to get beyond my skis, so I figured what we
all witness just now. If this was placed in front
of Judge Bronson and he didn't know about it, he should.

Right absolutely. I mean, you've got a situation where you've
got video of the event that apparently wasn't shown to
the jury or shown to the judge. So, Judge Bronson,
you know it would be a im sure it would

be good to see if you read Jake's letter detailing
what you didn't at your disposal before.

Well, the intentionally tamped there's one thing for NBC ten
or Channel six to do what they did there.

You know, if you want to call.

Them a news outlet at this point, you know they
in form an apartment the way they see fit with
Corey and everyone else. But it's another thing where you
intentionally tamper with evidence in a criminal trial in order
to convict the law enforcement officer who you have disdain for. Right,
that's the whole different. That's not every intend doing it.

That's not Shaka Johnson doing it, because Shaka Johnson's not
in this case. Now, if Shaka Johnson's stuff goes to
a trial and he decides to mislead the court, then
wearing a whole nother ball of wax.

producer has been kind of enough to highlight number five
in the Philadelphia Police Department directive body worn cameras to
reserve visual and audio information for use in current and

future investigations.

Until if you go down a little bit to the policy,
I want to just point something else out there, all
r right there, you see their body war cameras was activity.
That's the policy whenever initiating any vehicle or foot pursuit.
They were with this guy for a while and you

saw their body war cameras activity. How is it that
is convenient that the person who was yelling there was
a gun audio is not working until after the shooting,
until after that because you didn't want to because you
clearly heard it and then you clearly deleted it.

Well, the bottom line is, you know, a reasonable person
would tend not to believe Zero's installed. District Attorney Larry
Kreisner or the mainstream media that reported on this case.

had twelve jurors, you know, unfortnately.

They didn't have benefit of this eleven seconds of video.

but I think you should, uh, you know, see this

the district Attorney Krasner and the mainstream media whatever they
say with a grain of salt.

his wife and in this family. You know, it's all

got to look at this, look at this letter and understand.

So you know, uh, Officer dial is supposed to be
sentenced on Thursday, and we'll update you as that goes on.

information was presented and decision was made with the lack
