Domniemanie, o którym mowa w art. 8 ust. 2 prawa autorskiego stanowi, iż twórcą jest osoba, której nazwisko w tym charakterze uwidoczniono na egzemplarzach utworu. Podkreślam utworu, a nie projektu, dokumentacji etc.
Chodzi o dzieło, które spełnia cechy utworu w rozumieniu przepisów prawa autorskiego.
Kim dokładnie jest twórca?
Aby mówić o domniemaniu bycia twórcą utworu musimy mieć do czynienia łącznie z następującymi elementami:
- egzemplarzem utworu w rozumieniu właściwych przepisów prawa;
- wskazaniem nazwiska osoby fizycznej;
- uwidocznieniem nazwiska w charakterze autora
