Speaker 1 (00:06):
Welcome to all who have served, are serving, and will

Podcast with your host, doctor and Navy veteran k l Rich,
we pray that every battle in your spiritual, personal and
physical life is one as we follow Christ, who is
our commanding officer in this field called life. Whether you
are here for spiritual encouragement, information on veteran benefits, PTSD,
(00:30):
suicide prevention, or want to know the latest military news,
we are here to serve you. Now Here is your host,
doctor k l Rich.
Speaker 2 (00:40):
Hi, and thanks for tuning in today. I am glad
that you have decided to join me today on this
particular podcast. My name is doctor ko Rich and I
am your Navy veteran. Thank you for tuning in on
this November the fourteen, twenty two, four Thursday. It is
(01:02):
raining here in Georgia. I pray that you wherever you are,
that even if it is raining, there is sun in
your life and I'm talking about the Son of God. Amen. Again,
thanks for tuning in today and we are here as
always to help you if you are a veteran or
(01:28):
if you are active duty Navy, Air Force, Marines, Army,
National Coast Guard. I know I'm leaving not one space
force with National Guard and the Coast Guard. Now what
I say National Coast Guard, National Guard and the Coast Guard.
(01:51):
But anyway, whatever branch you are serving in, if you
are a first responder, if you are a paramedic, a firefighter,
if you are a police officer, we want to just
thank you, thank you for your service. You are not
alone and there are many of us out here that
(02:12):
either have warned the uniform or are warning uniform, and
so we want to thank you. We also want to
thank the families of those that are serving and those
that have served, because as you are serving, your family
is serving too. As you have served, your family had
to serve too. So we want to just thank all
(02:33):
of you. And one of the things that we honor
God with is through our service to him, and He
requires that we have a prayer life, which is our
best weapon against the enemy. He did not leave us defenseless,
(02:58):
and we know that the enemy is coming up against
so many. So many veterans are going through various things.
Rather it's homelessness, rather it's mental illness. Rather it's trying
to transition from active do the military life into the
civilian world, and there's a lot of things you may
(03:19):
be fighting for benefits which we're gonna talk about today.
But whatever it is that you may be facing, if
you're in the military right now and you're just finding
it just hard to deal with various things. Cause oftentimes
soldiers they are uh turned to alcohol, some have even
turned to drugs or whatever. And so we want to
(03:42):
just pray that God would help you through whatever situation
that you may be facing today. Dear helping Father God,
we just thank you God for allowing us to come
before your presence this morning. Lord. We thank you Lord
for being a good God. We thank you for commanding
our lives. We thank you for giving us order in
(04:04):
our lives. Lord. We ask you, Lord to forgive us
for all our sins. We ask that you would cleanse
us from all unrighteousness. Lord, Lord, I pray for every
veteran that's that's tuning in right now, and those who
may not have never heard my name. Lord, I pray
that you would be with them, guide them, Lord, and
deliver them for whatever issues Lord that they may be
(04:24):
facing right now. In the name of Jesus' Lord, where
there is loneliness, we ask that you will fill that
void where there is struggles with mental illness. Lord, we
ask that you would give them peace that's surpassive, all
understanding where there may be just whatever issue they face
in Lord, with family or just relationships with whatever. Lord,
(04:48):
we ask that you would give them guidance right now
in the name of Jesus. Lord, Lord, we pray right
now for those that are serving on active duty. Lord,
we ask Lord that you we would be with them, Lord,
and that you will protect them, have a hedge of
protection around them. Lord, in the name of Jesus. Lord,
we pray with their family. Pray for their families right now, Lord,
(05:11):
that as they may be separated from their loved ones, Lord,
that you would be with them and let them know
that they are not alone. Lord. We pray Lord that
you will help those who are not safe right now,
that they will come to the acknowledgment of who you are. Lord.
We just thank you for being our God. We thank
you for being our counselor. We thank you for being
(05:32):
our deliverer. We thank you for being our savior. We
pray all these things and your son's name, Jesus is
she a hummashik, Thank God. Amen. Amen, Amen, and we
again we just want to thank you for tuning, thank
you for tuning in today, and we pray that you
(05:54):
would be blessed by this particular podcast and those that
are going to be coming up in the future. All right,
all right, all right, so today today we're going to
(06:14):
go to the Book of Luke, the Book of Luke,
and I chose the Book of Luke chapter eighteen, dealing
with the unjust judge because many veterans right now are
trying to fight for benefits. They're trying to get their
disability benefits, and it can be a strenuous process. And
(06:36):
so it reminded me of the parable of the unjust
judge and the widow. And many of you may be
trying to fight for benefice and you may have been
denied and had to go through appeals and all that.
We're going to go into that in just the moment,
but I want to go to Luke chapter eighteen. Luke
(06:58):
chapter eighteen, and Jesus gave this parable for us to
be reminded of how we are to be when it
comes to God. Now we know that God is fair,
God is just, God is gracious, God is merciful, but
Jesus wanted us to be persistent in our prayers to God.
(07:22):
It is not that God is again that he's not
fair and just in everything, but he wants to see
that we are diligent in seeking him and also in
serving him. And so in Looke ch Outter eighteen verse
starting that verse one, it says, then Jesus told his
(07:42):
disciples a parable to show them that they are to
always pray and not give up. He said, a certain town,
in a certain town, there was a judge who neither
feared God nor cared what people thought. And there was
a widow in that town who kept coming to him
with the plea, grant me justice against my adversary. For
(08:06):
some time he refused, but finally he said to himself,
even though I don't fear God, oh care what people think. Yet,
because this widow keeps bothering me, I will see that
she gets justice so that she won't eventually come back
and attack me. And the Lord said, listen to what
(08:28):
the unjust judge says. And will not God bring about
justice for his chosen ones who cry out to him
day and night? Will he keep putting them off? I
tell you, he will see that they get justice and quickly. However,
when the Son of Man comes, will he find faith
(08:50):
on the earth. And Jesus gave this parabowl of this woman,
this widow who it doesn't say what happened to her.
Jesus didn't go into details, but this was a parable
to help people understand about the Kingdom of God. And
so whenever it took place in this widow's life, she
(09:10):
needed someone who was gonna set things straight. She couldn't
do it herself, but she went to the one who
she knew would be able to grant her request. Oftentimes
we may go to this person that person. We're running
around in a circle or running through this maize and
(09:31):
trying to find it out, when all we have to
do is go to God, who has all the answers.
I know that I've learned throughout my lifetime that it
is best to go to God before I go to
anyone else. And this is not to say that God
does not use people to give answers, to grant answers,
(09:51):
or to grant the request that we have asked. He
absolutely does whenever he sees fit for that. But the
first thing what he should always do is go to God.
Regardless of what situation we face, whatever trial that comes
our way, just getting God's guidance. We don't want to
(10:12):
put God last on the list. We want to make
sure that He is our first go to. That means
that whatever situation that I am facing, I go to
God first. Whatever illness I may be dealing with, I
pray to God first. Whatever financial situation I'm in, I
(10:33):
go to God first. Whatever relationship situations that I may
be facing, challenges I may be facing, I go to
God first. Whatever it is that you're facing in life,
you might say, well, I'm a veteran in I'm dealing
with all these issues. Go to God first. I'm in
(10:53):
active duty and I really don't feel like I have
anyone to talk to. Go to God first. Whatever it is,
you can always go to the Lord, because he is fair,
he is just, he is loving, he is gracious, he
is merciful. And so this widow, she kept going to
(11:15):
the judge, and you can you can possibly gather that
this judge was possibly becoming annoyed at the fact that
he had to see this widow over and over and
over and over again, and so he got tired, like
if I don't give this woman what she wants. She's
gonna keep annoying me. She's gonna she's gonna keep getting
(11:36):
on my last nerve. And so I don't want her
to continue pestering me about the same thing over and
over and over again. With God, he doesn't get tired
when it comes to us. He wants us to come
to him. The Book of James says to go to
God with all kinds of petitions. So you can present
any kind of petition before the Lord. Now the thing
(12:00):
is is that it should the Lord granted. It has
to go in accordance with his will, and he will
not do anything that goes against who he is. But
we are to always ask, if it's in his will,
let thy will be done. And so this judge decided
that he was gonna grant the widow her request, and
(12:24):
she got the justice that she that she needed. Jesus,
he let us know that God is the same way.
God will, He listens to us, He hears us, he
answers us, He sees that we get justice. Whatever situation
(12:47):
you're facing, that's your request to go to God. That's
your time to go to God and ask Lord, deliver
me help me. I need you. I can't do this
on my own, and that requires that when we go
to God, that we have a measure of faith. Jesus said, however,
when the son of Man comes, will he find faith
(13:09):
on the earth. The Bible lets us know that without
God and without faith, I'm sorry, without faith, it is
impossible to please the Lord. That means when I go
to God, I have to have faith to say that
I'm going to you. I'm coming to you, Lord, and
(13:30):
I need you to do this. I have to have
faith to know and believe that He will do it
in accordance with his will. The Bible says that we
have faith just the size of a mustard seed, that
it will move mountains. And with a mustard seed, for
those who know that when you plant a garden, that
(13:50):
mustard seed starts are very very tiny, but then it
blossoms into these beautiful big leaves. And that's the type
of faith that God wants us to have, where it
starts off small, but then as we continue to believe
in developing our relationship with God, then it grows and
grows and grows, and then we know that there is
(14:14):
nothing impossible for God to do except fail, because each
time God does a miracle in our lives that should
increase our faith. And the more that God moves in
our lives, the more that our faith should be able
to increase. And so therefore I know that because of
what I've seen God do in the past, I know
(14:37):
what He is able to do in the present and
the future. When we go to God, it's not that
he doesn't know what we're gonna ask, but is our
measure of faith in humbling ourselves to go to Him
and present our request to him, and He listens and
(14:58):
he hears and he answers. All right, We're going to
take a quick break and we'll be back in just
a moment. If my mama on that day.
Speaker 3 (15:14):
My mama on that day, he is see from Tampa Bay.
He need to see from Tampa Bae, Mama, Mama, don't

(15:58):
too short Fly signaled ham to shortlast signal Lam. Next
song was the Collision Lawn. This song was the colicious
A lawn for the mama. Don't you wait for the mama,
(16:20):
don't wait. Get to thy locker in a hurry. Get
to that locker, hurry, taking on water, going down fast,
taking on water, doing dump fast, pety day by fem, last.
Speaker 2 (16:42):
Puty day by female.
Speaker 3 (16:45):

Speaker 3 (16:53):
So I opened that locker with my belt, that lock
with my mama. Please don't cry, mama, mama, please don't cry.
Speaker 2 (17:10):
Your son is gone.
Speaker 3 (17:12):
I tell you so, it's gone.
Speaker 4 (17:16):
I tell you.
Speaker 3 (17:17):
With the heavy last stand one, the row, with the.
Speaker 2 (17:22):
Heavy stand one, the troll.
Speaker 3 (17:26):
He stayed aboard the Black Thorns home. He stayed the
Black Ashole.
Speaker 4 (17:34):
He gave his life to save this school. He gave
his life to save this school. Or it's sacrificed to it.
Speaker 3 (17:44):
Thank you, or he's sacrifice, thank you.
Speaker 2 (17:50):
And that is your son is gone. The Military Cadence
by Jeremy Michael Fleming and you can find his cadences
on YouTube and Spotify. All right, so today we're gonna
be talking about and giving you information regarding filing v
(18:13):
A disability claims. Filing VA disability claims now One of
the things that you often don't hear when you're in
the military is to go to the doc for anything
that you are having issues with a lot of times
(18:34):
you feel like you have to suck it up and
then you don't go to the medical care in order
to get whatever issue you're having fixed. The thing is,
that's a mistake. That's a mistake in any veteran that
has filed for disability claims will tell you, will oftentimes
(18:57):
tell you that you need to go for whatever issues
you're having while you're on active duty, because if you
don't have it in your medical file, it'll be more challenging,
not impossible, but more challenging to claim those issues if
you have no record of it at all. So it
(19:20):
is so important if you are in the military, active duty,
if you are dealing with any type of issue, anything
that happens, make sure it's documented. You might think it's
minor now, and it may be the difference later once
you get out. For is what benefits that you are
(19:41):
able to receive for your disability compensation should you get approved.
So I want to go over how to file a
VA disability claim rather it's a new claim or a
claim to get an increase for disability compensation. So before
(20:04):
you get started, you you really need to know if
you're eligible to get to file a disability claim. If
you're eligible for anyone can file, but if you're eligible
for it, so be. A disability compensation provides a tax
(20:24):
free monthly payment. So if you have a service connected condition,
you may be eligible for compensation. A service connected condition
means an illness or injury that was caused or was aggravated,
meaning that it got worse due to your active duty
(20:46):
military service.
Speaker 3 (20:48):
UH.
Speaker 2 (20:49):
One thing that has taken place within the last few
years is the Pack Act and the PACKDACK Expands Benefits
Benefit Act says to veterans exposed exposed to burn pits
and other toxic substances. So this is a new law
that expands access to VA healthcare and benefits for those
(21:13):
veterans exposed to burn pits and toxic substances. And this
is something that if you were, for example, if you
were in the Vietnam War for a long time, there
was the VA did not admit that the agent orange
(21:34):
was possibly causing veterans to get cancer and other things. Well,
now there are certain illnesses that if you were in
certain areas, and I think we talked about this before,
but if you were in certain areas that are certain
you served during certain years that you are is presumptive day.
(21:58):
If you have a certain condition, is presumptive that it
was due to your time in service. So in order
to find out if you are eligible for VA disability
benefits or compensation, you need to meet two things. You
must have a current illness or injury known as a
(22:20):
condition that affects your mind or body. So you must
have a current diagnosis. You can't just say, oh, I
had this ten years ago, but then you don't have
it now, Okay, so you have. You must have a
current illness or injury. The second thing is you had
to have served on active duty, active duty for training,
(22:42):
or inactive duty training. So again you must have a
current diagnosis a caring injury or illness, and you must
have served on active duty at some point or inactive
duty training. And then at least one of these must
be true. T you got sick or injured while serving
(23:03):
in the military and can link this condition to your
illness or injury called an in service disability claim, or
you had an illness or injury before you joined the
military and serving made it worse, called a pre service
disability claim, or you have a disability related to your
(23:24):
active duty service that didn't appear until after you ended
your service, called a post service disability claim. Now let
me break those down for you. If you get injured
while you're in the military, this is called an in
service disability claim. So anything that happens while you're in
(23:45):
the military, including car accidents or anything of that nature.
So you can be in a vehicle, you may not
even be in uniform at that point for us, doing
the hours that you normally would work, but because you
are up on a with the military, then you're considered
government property. With that being said, you can have an accident.
(24:08):
You can get hurt in that accident, your neck or
something like that. That still considered an in service injury
because it took place while you were serving on active duty.
Another thing, you may have had a pre existing condition. Okay,
(24:29):
so the military. This means that the military knew that
you had a certain condition before you entered the military.
They did a waiver to allow you to enter anyway. Okay,
that particular injury, God made it, it was made worse
by your service. So you also can claim a disability
(24:51):
claim even though they may say, oh, well, this was preexisting,
but because they allowed you and possibly did a waiver
for for you to enter the military knowing that you
had that condition, then if it's aggravated while you ind
then that is that it is a cause that you
may have for filing a disability claim. Let no one
(25:16):
tell you that, oh, because it was pre existing, that
you can't claim anything if it was aggravated. And now
it's a difference if you committed fraud and you didn't
tell them that you had something, and you knew you
had it before you entered. But if they knew that
you had this condition before you entered, and you told
them about it and you had to document it and
(25:37):
oftentimes they have to do a waiver, they say, Okay,
we're gonna accept this person even though we know they
have this particular situation going on, and if it was
made worse while you're in the military, then guess what.
You may have a claim you have a disability related
to your active duty service that didn't appear until after
you ended your service. Now, there's some things that may
(26:01):
take place with this. For example, oftentimes when you get
out the military. They normally say within a year after separation.
If something takes place, then they will consider it an
in service event. But sometimes things doesn't they They things
don't happen until you actually leave the military, all right.
(26:25):
So that can be any type of thing that could
be a mental health issue or whatever the situation. Then
you know that it's from your service, all right, So
that is another eligibility, or it may you may be
eligible to receive some type of compensation. But again you
(26:46):
want to make sure that if you can have it
documented while you're in or or or at least where
it's closely where you just got out, then that's the
best route to take. Now, there are some presumptive illnesses
again we talked about this just briefly, that may have
(27:09):
been casts due to you being in service or serving
during certain periods. And therefore, for example, if you were
serving in certain areas and you have high pertension. Now
most veterans know that it is hard to get a
rating for high pertension. But even if you're zero percent connected,
(27:32):
if they service connect you for zero percent, that's still
saying that your service connected no zero percent. You would
not get paid for it. But you will be considered
service connected. So that is important because if something happens
to you, your loved ones could possibly still receive benefits
if you were to pass away due to anything that
(27:55):
the VA has deemed as being service connected. So the
pack Act also covers certain presumptive presumptive I'm signing presumptive conditions.
And this is something that you may want to talk
to a VA service officer about. If you have received
(28:18):
an other than honorable bad conduct or dishonorable discharge, you
will need to find out if you qualify. We're not
gonna go into all of that right now, but you
can go to VA dot gov forward slash Disability, forward
slash Eligibility and due to research to find out, or
(28:40):
you can go to a Veteran Service officer. Now, let
me just say this to the veterans. If you are
going to file for a VA disability claim and you're
thinking about going to a Veteran service officer or otherwise
known as a vso, for sure, please do your research.
(29:03):
Not all vsos, or let me be kind worth their salt. Okay.
So with that being said, you have to do your research.
It's just with anything in life, okay, it's best to
get three estimates if you're getting the house project done,
(29:24):
or it's best to you if you're wanting to get
a vehicle, you're gonna test drive some things. Do your research.
Ask other veterans if you know any how they had success.
Was this person helpful? Because you have some people that
go over and beyond. I've had them. They go over
(29:45):
and beyond and tell you what to do, how to do,
and all that and awesome. And then you have some
that's just therefore a check and they can care less
because they're gonna get paid rather you get approved, or
rather you don't. So make sure you do your due
diligence and doing your research to find out if that
(30:07):
particular veteran service officer is the best one for you,
because it does it does matter. And let me just
say this, you have to be your own best advocate
if you go to get If you follow acclaim and
(30:27):
it gets denied, don't just stop. Just like we talked
about the unjust judge and the persistent widow, keep going,
keep appealing. If you think you got a case, keep
uppilling that because one thing that you need to know
is you have a year after a decision is made
to do an appeal. Now, there's different types of appeals
(30:50):
and we're going to go into that in an upcoming podcast,
and you have to decide which one is best for you.
The longest one is the Veteran Board of Appeals and
that can case that can take they can take forever.
With that one. You have an hr R, which is
a higher level review. You have. It's one more and
(31:10):
I don't have it in front of me right now,
but anyway, you can file supplemental claims. But you need
to make sure that you stay within the dates of
doing the appeal and don't give up because as long
as you have as long as you keep appealing, then
that resets that date for that particularly year. And it
(31:33):
can be important also because you will be back paid
and compensated should you win. They have to back pay
you from the initial time that you either put in
an intent to fiul. And what's an intent.
Speaker 3 (31:51):
To file.
Speaker 2 (31:53):
An intent to file is you contact the VA, you
let them know that you're about to put in you're
about to do a VA disability claim from that date.
The VA will oftentimes backpay you to that particular date,
from the date that you put in for an intent
(32:15):
to file. That means I am planning, I'm gathering my evidence.
I don't have everything just yet, but you're letting them know.
And you have a year I believe a year from
the intent to file to actually put in your claim
so that you can be back paid should your case
(32:36):
be approved. So those intental files are very important. And
if you say, well, how do I do an INTENTI file?
You can either go mom to VA dot gov or
you can call one eight hundred eight to seven one thousand.
Put this number in your phone if you have a
cell phone or in your memory bank one eight hundred
(32:59):
eight two seven one thousand. That is the national hotline
for the VA, and they can direct you as to
where to go. Now, remember this, they they they're they're
very helpful, but then they cannot counsel you as to
what you need to do. They can tell you, okay, well,
(33:21):
if you tell them I'm planning on doing X, Y
and Z, then they can give you the They can
email you or mail out the forms to you so
that you can take up the process to do whatever
it is that you're trying to do. However, they are
only limited with what they can the information that they
can give you. They cannot counsel you, but they can say, Okay,
(33:45):
if you plan on doing X, Y and Z, then
this is the form you need or that is the
form you need, so be mindful of that, all right.
I pray that this information has been helpful to you
and that you will know that as a veteran, you
(34:07):
are important to God. If you are active duty, you
are important to God. And we thank you for your
service because as you serve others, then you must be
reminded and should be reminded that you are also doing
(34:30):
so unto the Lord. Until next time, I am your host,
doctor and Navy veteran k l. Rich. God bless.
Speaker 1 (34:43):
Thanks for tuning in to Veterans in Christ. We pray
that you found today's podcast informative and we look forward
to being with you again during the next podcast. May
the Lord blessed and keep you going out and coming in.
